HomeMy WebLinkAboutResolution 1960 - 0813• • RESOLUTION NO. 813-2 RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DI.STRICT NO. 2 OF OP.ANGE COUNTY, CALIFOIU:IA, /:MENDING AND MODIFYING ENGINEER'S REPORT DATED MARCH 1958 AND ADOPTED APRIL 9, 1958. The Board of Directors of County Sanitation District No. 2 of Orange County, California, does hereby resolve as follows: Section 1. That the Engineer's Report for County Sanitation District No. 2 of Orange County, California, dated March 1950, adopted April 9, 1958, and prepared by J. R. Lester Boyle and Sidney L. Lowry, is hereby amended and modified by adding page lG to said report to read as follows: ;i That the construction of new facilities jointly by County Sanitation Districts Nos. 2 and 3 (Miller-Holder Trunk and Magnolia Relief Sewer) shall actually be con- structed by County Sanitation District No. 3, and upon the completion thereof, District No. 2 shall pay its pro- portionate share of the actual costs thereof. That all funds from the sale of bonds by District No. 2, together with all funds received from the investment of such funds, not required for the construction of new sewer- age facilities to be owned solely by District No. 2 and the acquisition of existing sewerage facilities shall be applied to repay District No. 3 on the joint construction costs of the Miller-Holder Trunk and the Magnolia Relief Sewer. That any unpaid amounts due and owing by District No. 2 to District No. 3 thereafter shall bear interest at the rate of four percent per annum and shall be paid in ten equal annual installments on or before the 30th day of June in each year commencing with the year 1961. District No. 2 may at its option pay the whole thereof sooner and at any time. That District No. 2 shall budget and thereafter levy sufficient ad valorum taxes to make the payments required as hereinabove provided for." -1- • • STATE OF CALIFORNIA) COUNTY OF ORANGE ) SS I, FRED A. AMENDING AND MODIFYING ENGINEZR'S REPOK.T DA'.LEn MARCH 1958 AND ADOPTED APRIL 9, 1958.
