HomeMy WebLinkAboutResolution 1959 - 0602RESOLUTION NO.602-7 RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.7 OF ORANGE COUNTY,CALIFORNIA,CALLING A SPECIAL ELEC TION TO BE HELD IN SPID DISTRICT ON MARCH 10,1959,FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF SAID DISTRICT A PROPOSITION OF INCURRING A BONDED INDEBTED NESS IN THE PRINCIPAL AMOUNT OF $2,230,000 FOR THE PURPOSE OF ACQUIRING AND COi~rRUCT ING ADDITIONAL SEWERAGE FPCILITIES FOR SAID DISTRICT. The Board of Directors of County Sanitation District No.7 of Orange County,California,resolves as follows: WHEREAS,pursuant to the County Sanitation District Act (Chapter 3,Part 3,DivIsion 5 of the Health and Safety Code of the State of California)and Section 14795 thereof,this Board of Directors has heretofore determined,by resolution passed by a vote of four-fifths of all its members,that the public interest and necessity of County Sanitation District No.7 of Orange County demand the issuance of additional bonds of said district for carry ing out the objects of the district;and, WHEREAS,this Board did,by resolution,direct J.R.Lester Boyle and Sidney L.Lowry,as sanitation engineers for said district, to prepare a report pursuant to Section 14748 of said law,and said report was duly filed and set for hearing,and notice of said hear ing was duly given,and said hearing was duly held and at the con clusion thereof this Board approved and adopted said report as made; NOW,THEREFORE,the Board of Directors of County Sanitation District No.7 of Orange County does hereby RESOLVE,DETERMINE AND ORDER,as follows: Section 1.That a special election is hereby called and ordered.tobe held in County Sanitation District No.7 of Orange County on March 10,1959,for the purpose of submitting to the qualified electors of said district the proposition of incurring a bonded indebtedness of said district in the principal amount of $2,230,00 to obtain funds with which to acquire the property and do -1- the work set forth in the report of J.R.Lester Boyle and Sidney L.Lowry approved and adopted by this Board on January 23,1959,and hereinafter stated. Section 2.That the general objects for which it is proposed to incur said bonded indebtedness are as follows: (1)The construction of the following trunk sewers and sewer age facilities appurtenant thereto: (a)Gisler-Red Hill Trunk Sewer and appurtenances from County Sanitation District Treatment Plant No.1 along Gisler Avenue extended easterly to Red Hill Avenue and northeasterly along Red Hill Avenue to Mitchell Avenue. (b)Lemon Heights Trunk Sewer and appurtenances from Red Hill Avenue at Mitchell Avenue northeasterly along Red Hill Avenue to Skyline Drive,thence northwesterly to Arroyo Avenue, and thence northeasterly along Arroyo Avenue to Foothill Boulevard. (c)North Trunk Sewer and appurtenances from Mitchell Avenue at Red Hill Avenue running northwesterly along Mitchell Avenue to Newport Boulevard,thence northeasterly along Newport Boulevard to “D”Street,thence northerly along “DT’Street to an easement approximately 358 feet southerly of the centerline of Main Street,thence easterly to the southerly extension of Prospect Avenue,thence northerly along said southerly ex tension and along Prospect Avenue to 17th Street,thence westerly along 17th Street to Yorba Street,thence northerly along Yorba Street to Fairhaven Avenue,thence easterly along Fairhaven Avenue to the easterly intersection of Prospect Avenue and Fairhaven Avenue,thence northerly along Prospect Avenue to Chapman Avenue,thence easterly along Chapman Avenue to Santiago Avenue,thence northerly along Santiago Avenue for a distance of approxImately 1320 feet. (a)West Trunk Sewer from the Gisler-Red Hill Trunk Sewer on Red Hill Avenue at and adjacent to the intersection of the Atchison,Topeka and Santa Fe Railroad right of way and Red Hill -2- Avenue and running northwesterly along an easement parallel with and approximately 390 feet southerly of said Railroad right of way to Newport Avenue,thence northeasterly along Newport Avenue to Tustin Avenue,thence northerly along Tustin Avenue to McFadden Street,thence westerly along McFadden Street to Williams Street,thence northerly along Williams Street to Main Street,thence easterly along Main Street to an easement the centerline of which is the southerly extension of the west line of Lot E of the Stafford and Tustiri Tract as shown oh map thereof recorded in Book 1,pages 15 and 16 of Miscellaneous Record Maps in the office of the Recorder of Los Angeles County,California,thence northerly along said easement to First Street. (e)MacArthur Trunk Sewer extending from the Gisler-Red Hill Trunk Sewer where it intersects said trunk sewer and running thence southerly along MacArthur Boulevard to the intersection of MacArthur Boulevard and Acacla Street. (2)The acquisition of that certain trunk sewer and appur tenances on Harbor Boulevard running north from Huntzinger Avenue approximately 2000 feet to the main trunk sewer of County Sanitation District No.1 of’Orange County,California. (3)The acquisition of’all easements,,pipe,machinery,equip ment,appurtenances and other property necessary for any of the foregoing; (14)The payment of all selling expenses,including legal opinions,incident to the sale of said bonds proposed to be issued; All the foregoing in accordance with a report of J.R.Lester Boyle and Sidney L.Lowry approved and adopted by the Board of Directors of said County Sanitation District No.7 on January 23, 1959 and on file In the office of the Secretary of said Board, reference to which report Is hereby made for further particulars,and in accordance with the provisions of the County Sanitation District Act;all for the purpose of providing additional trunk sewerage facilities in the district to meet the sewage and industrial waste -3- disposal requirements thereof. Section 3.That the amount of the principal of the bonds proposed to be issued by said district for said objects and purposes is $2,230,000;that the number of years not to exceed which the whole of said bonds are to run Is forty (140)years,but said bonds may be made to mature within a lesser number of years;that the maximum rate of interest to be paid on such Indebtedness shall be not to exceed six percent (6~)per annum,payable annually the first year and semiannually thereafter,the actual rate or rates to be de termined at the time of the sale or sales thereof;that if at such election two-thirds of the votes cast are in favor of Incurring said bonded indebtedness,then bonds of the district not exceeding the amount stated herein shall be issued and sold as provided in said Act. Section )4•That for the purpose of holding said election,there are hereby established eight (8)consolidated voting precincts designated as hereinafter stated.That each such consolidated voting precinct shall consist of the hereinafter designated regular election precincts (or the portion thereof within said district)established for the holding of state and county elections as such regular election precincts have been established by the Board of Supervisors of Orange County and exist on the date of adoption of this resolution. That the polling places for the respective consolidated precincts shall be the places hereinafter designated,and the persons herein after named,being competent and qualified electors and residents of said district and of their respective consolidated voting precincts, are hereby appointed officers of election for their respective consolidated voting precincts and they shall hold said election and make return thereof in the manner provided by law. -4- SANITATION DISTRICT NO.7 CONSOLIDATED VOTING PRECINCT NO.1 consisting of regular election precincts (or portion thereof within said district)designated El Modena 2,Orange Park Acres,Santiago and Villa Park. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp,tear,or deface this ballot, return it to the inspector of election and obtain another. On absent voter’s ballots mark a cross (+)with pen or pencil. -7- BOND PROPOSITION:Shall County Sanitation District No.7 of Orange County,California,incur a bonded indebtedness of $2,230,000 for the purpose of providing trunk sewerage facilities in the district to meet the sewage and industrial waste disposal requirements thereof by means of the following:(1)The construction of the following trunk sewers and appurtenances thereto: ~ES (a)Gisler-Red Hill Trunk Sewer from County Sanitation District Treatment Plant No.1 along Gisler Avenue extend ed easterly to Red Hill Avenue and northeasterly along Red Hill Avenue to Mitchell Avenue;(b)Lemon Heights Trunk Sewer connecting with Gisler-Red Hill Trunk Sewer; (c)North Trunk Sewer connecting with Gisler-Red Hill Trunk Sewer;(d)West Trunk Sewer connecting with Gisler Red Hill Trunk Sewer;Ce)MacArthur Trunk Sewer connect ing with the Gisler-Red Hill Trunk Sewer;(2)The acquisition of approximately 2000 feet of trunk sewer on Harbor Boulevard running north from Huntzinger Avenue; (3)The acquisition of all easements,pipe,machinery, equipment,appurtenances and other property necessary fo~ any of the foregoIng;(4)The payment of expenses incident to the sale of the bonds to be Issued;all of NO the foregoing In accordance with a report of J.R. Lester Boyle and Sidney L.Lowry,Consulting Engineers, approved and adopted by the Board of Directors of said County Sanitation District No.7 on January 23,1959 and on file in the office of the Secretary of said Board, reference to which report is hereby made for further particulars,and in accordance with the provisions of the County Sanitation District Act? -8- Section 7.A cross (÷)placed in the voting square after the word “YES”in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition.A cross (+)placed in the voting square after the word “NO”in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section 8.That,except as herein set forth,said election shall be held and conducted as far as practicable in accordance with the general election laws of the State of California as far as the same may be applicable. Section 9.That only registered voters residing within said district are eligible to vote at the bond election. Section 10.That the Secretary of this Board shall cause this resolution to be published once a week for three successive weeks in the Tustin News,a newspaper having a general circulation in said district.That no other notice of said election need be given. Section 11.That the Secretary of this Board is hereby authorized and directed to sign a certificate of the adoption of this resolution to be published herewith.
