HomeMy WebLinkAboutResolution 1958 - 0515RESOLUTION NO.515-11 RESQLTJTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.11 OF ORANGE COUNTY CALIFORNIA,CALLING A SPECIAL ELEC TION To BE HELD IN SAID DISTRICT ON JULY 22, 1958,FOR THE PURPOSE OF SUBMITTING TO THE OIJALIFIED ELECTORS CF SAID DISTRICT A PROPOSI TION OF INCURRING I BONDED INDEBTEDNESS IN THE PRINCIPAL AMOUNT OF $1,515,000 FOR THE PTJRPOSF CF ACCTJIRING AND CONSTRUCTING ADDI TIONAL SE~rFRIGE FACILITIES FOR SAID DISTRICT. The Board of Directors of County Sanitation District No.11 of Orange County,California,resolves as follows: ~.THEREAS,pursuant to the County Sanitation District Act (Chapter 3,Part 3,Division 5 of the Health and Safety Code of the State of California)and Section 4795 thereof,this Board of Directors has heretofore determined,by resolution passed by a vote of four—fifths of all its members,that the public interest and necessity of County Sanitation District No.11 of Orange Oounty demand the issuance of additional bonds of said district for carrying out the objects of the district;and ~THEREAS,this Board did,by resolution,direct Lowry— Overmyer and Associates,Inc.,as sanitation engineers for said district,to prepare a report pursuant to Section 4748 of said law,and said report was duly filed and set for hearing,and notice of said hearing was duly given,and said hearing was duly held and at the conclusion thereof this Board approved and adopted said report as made; NOW,THEREFORE,the Board of Directors of County Sani tation District No.11 of Orange County does hereby RESOLVE, DETERMINE AND ORDER,as follows: Section 1.That a special election is hereby called and ordered to be held in County Sanitation District No.11 of Orange County on July 22,1958,for the purpose of sub mitting to the qualified electors of said district the pro position of incurring a bonded indebtedness of said district in the principal amount of $1,515,000 to obtain funds with —1—• which to acquire the property and do the work set forth in the report of Lowry—Overmyer and Associates,Inc.approved and adopted by this Board on Ipril 28,1958,and hereinafter stated. Section 2.That the general objects and purposes for which it is proposed to incur said bonded indebtedness are as follows: (1)The construction of the folloiing trunk sewers, pumping stations and seJerage facilities appurtenant thereto: (a)Main outfall pumping station at Newland Street and Hamilton ~4venue and force main connecting with County Sanitation District Plant No.2; (b)Newland—Delaware gravity trunk sewer; (c)Pumping station (at Golden ~Jest Street and Sister 1-venue)e~id force main connecting ~ith Newiand telaware gravity trunk sewer; (d)Golden West trunk sewer; (e)Slater—Springdale trunk sewer; (1)Smeltzer-Folsa (~hica trunk sewer and pumping station; (g)~tlenta interceotor trunk sewer; (2)The acquisition of all easements,pipe,machinery, equipment,appurtenances and other property necessary for any of the foregoing; ~4ll the foregoing in accordance ~ith a report of Lowry flvermyer and 1~ssociates,Inc.approved and adopted by the Board of Directors of said County Sanitation District No.11 on Ppril 28,1958 and on file in the office of the Secretary of said Board,reference to which report is hereby made for further particulars,and in accordance with the provisions of the County Sanitation District ~ct;all for the purpose of providing additional trunk sewerage facilities in the district to meet the sewage and industrial waste disposal requirements thereof. -2- Section 3.That the amount of the principal of the bonds proposed to be issued by said district for said objects end purposes is $1,515,000;that the number of years not to exceed which the whole of said bonds are to run is forty (~0)years,but said bonds may be made to mature within a lesser number of years;that the maximum rate of interest to be paid on such indebtedness shall be not to exceed six per cent (6%)per annum,payable annually the first year and semiannually thereafter,the actual rate or rates to be determined at the time of the sale or sales thereof;that if at such election two—thirds of the votes cast are in favor of incurring said bonded indebtedness,then bonds of the district not exceeding the amount stated herein shall be issued and sold as provided in said j~ct. Section LJ~~That for the purpose of holding said elec tion,there are hereby established five (5)consolidated voting precincts designated as hereinafter stated.That each such consolidated voting precinct shall consist of the here inafter designated regular election precincts (or the portion thereof within said district)established for the holding of state and county elections as such regular election precincts have been established by the ~3oard of Supervisors of Orange County and exist on the date of adoption of this resolution. That the polling places for the respective consolidated pre cincts shall be the places hereinafter designated,and the persons hereinafter named,being competent and qualified electors and residents of said district and of their respec tive consolidated voting precincts,are hereby appointed officers of election for their respective consolidated voting precincts and they shall hold said election and make return thereof in the manner provided by law. On absent voter’s ballots mark a cross (+)with pen or pencil. —5-- BOND PRCPCSITION:Shall County Sanitation District No 11 of Orange County,California,incur: a bonded indebtedness in the principal amount of $1,515,000 for the purpose of providing additional trunk sewerage facilities in the district to meet the sewage and industrial waste disposal require-: ments thereof by means of the following:(1)The construction of the following trunk sewers,pumping: stations and sewerage facilities appurtenant there-: to:(a)Main outfall pumping station at Newland Street and Hamilton I~venue end force main connect ing with County Sanitation District Plant No.2; (b)Newland—Delawere gravity trunk sewer;(c)Pump—: ing station (at Golden West Street and Slater Ivenue)and force main connecting with Newland— Delaware gravity trunk sewer;Cd)Golden West trunk: sewer;(e)Slater—Springdale trunk sewer; (f)Smeltzer-Bolsa Chica trunk sewer arid pumping station;(g)Atlanta interceptor trunk sewer; (2)The acquisition of all easements,pipe,tnachin-: ery,equipment,appurtenances and other property necessary for any of the foregoing;all of the foregoing in accordance with a report of Lowry Overtnyer and ~ssociates,Inc.approved and adopted by the Board of Directors of said County Sanita tion District No.11 on pril 28,1958 and on file in the office of the Secretary of said Board, reference to which report is hereby made for further particulars,and in accordance with the provisions of the County Sanitation tistrict Lct? Section 8.That,except as herein set forth,said elec tion shall be held and conducted as far as practicable in accordance with the general election laws of the State of California as far as the same may be applicable. Section 9.That only registered voters residing within said district are eligible to vote at the bond election. Section 10.That the Secretary of this Board shall cause this resolution to be published once a week for three succes sive weeks in the Huntington Beach News,a newspaper having a general circulation in said district.That no other notice of said election need be given. Section 11.That the Secretary of this Board is hereby authorized and directed to sign a certificate of the adoption of this resolution to be published herewith. The foregoing Resolution No.515-11 was passed and adopted by the Board of Directors of County Sanitation District No.11 of Orange County,California,at a regular tneeting thereof held on the 14th day of May 1958.
