SECTION II:That the District’s Attorney is hereby directed to prepare a contract for said Healy-Tlbbitte Construction Company with bond for faithful performance to accompany same,which bond shall be in the sum of not less than $2,OL~7,8OO for faithful performance of the contract and a second bond in the sum of not less than $1,023,900 to guarantee payment of all claims for labor -3- and material furnished;that said contract shall provide that the work be completed within three hundred sixty (360)calendar days from the date of the contract;said contract shall also provide that progress pa~,ments will be made for work completed as of the first day of each rionth in the manner in which other bills of the District are paid. SECTION III~That the contract be awarded on the basis of the construction of the Ocean Outfall Sewer to Station 70 ~00 as shown on the plans and specifications therofor adopted by Resolution No. of the Board of Directors of said District No.1 with a provision in the Contract to ~itomatically eliminate from said Contract for Proposal No.1,First idtemate,item nec.~,6,9, 10,i5,16,22 and 23,thereby reducing the length of the Ocean Outfall Sewer (Marine Section)from a total length of 7000 ‘feet to a length of 6000 feet at the end of sixty (60)days from the date of the Contract if said County Sanitation Districts Nos. 2,3,~,6,7 and 11 acting through said County Sanitation District No.1 does not reaffirm the provisions of the Contract providing for the Ocean Outfall (Narine Seotion)be constructed to a total length of 7000 feet. SECTION IV:That the Chairman of the Board of Directors is hereby directed to enter into said contract with Healy—Tibbitts Construction Company in behalf of County Sanitation District No.1 of Orange County,California,acting for itself and as Contracting ~gent for said County Sanitation Districts Nos.2,3,~,6,7 and 11 of Orange County,California. SECTION V:That all other bids for the construction of the Ocean Outfall Sewer (Marine Seotton)be and the same are hereby rejected and the Secretary of the Board is hereby directed to re turn cashierts checks,certified checks or bidder!s bonds to the unsuccessful bidders. SECTION VI:That payment for the ~rk to be done under the provisions of the hereinabove authorized Contract chargeable to said County Sanitation District No.1,be made from the Construc tion i~nd of said County Sanitation District No.1 in the manner heretofore agreed by and between said County $anitation Districts 1,2,3,S,6,7 and :i.1. —14...
