4 On motion of Director Greeley,duly seconded and carried,the follow-
5 ing Resolution was adopted:
8 RESOLVED,THAT WHEREAS,in accordance with the provisions of an Act
7 of the Legislature of the State of California,known and designated as the
8 “County Sanitation District Act”,now Chapter 3,Fart 3,Division V of the~
9 Health and Safety Code of the State of California,the Board of Directors
10 of County Sanitation District No.5 of Orange County,State of California,
11 did by re)solution,duly adopted at its meeting of December 8th,1914.8,
12 appoint 1~Iinton W.Bacon as Sanitation Engineer of said County Sanitation
13~District~No.5,and did employ him as Sanitation Engineer to make a survey~
of the problems of the District concerning sanitation,and especially with~
15 reference to the matter of sewage collection,treatment and disposal,of
16 said district,ii~accordance with the provisions of said act,and further,~
17 did by resolution,duly adopted at its meeting of December 8th,1914.8,
18 direct said Sanitation Engineer,Vinton W.Bacon,to prepare and file with
19 the Board of Directors of the said District,a report setting forth:
20 First A general description of the existing facilities for sewage
21
collection,treatment and disposal.
22 Second A general description of the work proposed to be done to
23
carry out the objects of the district.
24
Third A general plan and general specifications of the work.
25
Fourth:A general description of the property proposed to be acquire
or damaged in carrying out the work.
27
Fifth A map showing the boundaries of the district and in general
28
the location of the work proposed to be done,property taken or damaged,
•29 and any other information useful to an understanding of the proposed work.,
30
Sixth An estimate of the cost of the proposed work,and
31
WHEREAS,in pursuance of his said employment and the said directions

1 and orders of the said Board of Directors of the said district,the said
2 Vinton W0 Bacon did make,and on the 22nd day of December,19)48,did file

~with the said Board of Directors his report entitled:“Engineer’s Report,
~‘County Sanitation District No0 5 of Orange County,California,December
~22nd,19)48”,and
6 WHEREAS,such report did show each of the matters required in said
‘~resolution to be contained therein,and the said Board of Directors of the
8 said District,after a careful consideration of the said report,did,by a
resolution duly adopted at its meeting of January 12,19)49,find and

determine that said report so filed complied with the provisions and re
11 quirements of Article )4 of the said County Sanitation District Act,and
12
was satisfactory to said Board,and did,by resolution,fix the time and
13
p1ac~for hearing objections to said report,and to the doing of the work
therein referred to,or to any part thereof;such time and place being at
15
10:00 o’clock !~.M.,on I~onday,January 2)4,19)49,in the office of the
16~County Sanitation Districts,Room 205,Orange County Court House,Santa
17
P~na,California,and such resolution did further direct that notice of
18
said hearing should be given by publishing the same once a day for five
19
~consecutive days in the Newport-Balboa News Times,a daily newspaper,
20
having a general circulation in the District;and
21
UHEREAS,at the said time and place,the Board did hear all objec
22
t~ons made to the said report,and to the doing of the work therein
23
referred to,and any part thereof,and did continue the matter for further
24
hearing ~o January 26th,19)49,at 8:00 o’clock P.M.,in the office of the
25
County Sanitation Districts,Room 205,Orange County Court House,Santa
26
‘ia,California,at which time said matter was called for further hearing
27
and the said Board of Directors did approve said report and adopt the
28
same,and
.29 UHEFEAS,under the provisions of Article 5 of said Act it is made the
30
duty of this Board of Directors of County Sanitation District No.~,after
31
the approval and adoption of said report,to proceed to submit to the
voters of the District tho proposition of incurring a bonded indebtedness

1 to obtain funds with which to acquire the property and do the rfork set
2 forth in the said report,such bonded indebtodness being in the amount and
3 for the purposes stated in said rsport.
4 NOVJ,THEREFORE,IT IS 1~EREDY FOUND,DETERMINED,RESOLVED AND ORDERED
5 by this ~oard of Directors of County Sanitation District No.~of Orange
6 County.
7 First That a special election be,and the same is hereby called
8 and ordered to be held in Co~inty Sanitation District No.~of Orange Count~
9 on the 28th day of February,19)4.9,for the object and purpose of submittin~
10 to the qualified electors of said District the proposition of incurring a
11 bonded debt in the amount of SEVEN HUNDRED NINETY-SIX THOUSAND DOLLARS
12 (~)796,OOO.OO),for the purposes stated in the said report of the Sanita
13 I
tion Engineer,Vinton V~.Bacon,approved and adopted by this Board,the
14 26th day of January,l9~9,and hereinafter stated.
15 Second That the general objects and purposes for which it is pro—
16 posed to incur said indebtedness are the following,to—wit:
17 (a)the acquisition and construction by said District No.~,to-
18 gethor wIth other sanitation districts of said county,of (1)a sewage
19 treat~ient plant to he located near the mouth of the Santa Ana Rivor,and
20 (2)an ocean outfall from said sewage treatment plant to and into the
21 Pacific Ocean;
22 (b)the acquisition by said District No.~,together with other
23 sanItation districts of said county,of sewage disposal facilities owned
24
on January 26,19)4.9,by the cities of Anaheim,Fullerton,Orange,and
25 Santa Ana and the Buena Park,Garden Grove,La Habra,and Placentia Sani
tary Districts,as follows:(1)the existing sewage treatment plant locate
27
near the intersection of Ellis Avenue and Verano Street,(2)the existing
28
booster pumping plant located near the intersection of the Santa Ana River~
•29 and U.S.Highway 101 Alternate,and (3)the existing ocean outfall from
30
said booster pumping plant to and into the Pacific Ocean;
31 (c)the acquisition by said District No,~of a portion of a main

trunk sewer owned on January 26,l9L1~.9,by the City of Newport.Beach,and
1 the acquisition by said District No.5,together with County Sanitation
2 District No.6 of said county,of the remaining portions of said main
trunk sewer owned by the City of’Newport Beach for the joint use of said
4 Districts Nos.5 and 6;and
5 (d)the acquisition and construction by said District No.5 of an
6 additional main trunk sewer for said district,and the acquisition and con
7 truction by said District No,5,together with said District No.6,of
8 additional main trunk sewers for the joint use by said Districts Nos.5
g and6;
10 all in accordance with the report of Vinton W.Bacon,Sanitation Engineer
i~of said District No.5,filed with the Board of’Directors of said districtf
-12 on December 22,19).i.8,approved and adopted by said Board on January 26,
13 19L1.9,and on file in the office of the Secretary of said Board,reference
14~to which report is hereby made for further particulars,and in accordance
15 with the provisions of the County Sanitation District Act.
16 Third That the amount of the principal of the bonds proposed to be
17 issued by said Sanitation District No.5 to obtain funds with which to
18 acquire the property and do the work set forth in said report is SEVEN
19 HUNDRED NINETY-SIX THOUSAND DOLLARS (~796,OOO.0O);and that part of the
20 principal of the bonded indebtedness to be paid each year is as follows:
21 for the first thirty-six (36)years after date of the bonds TWENTY THOUSAN
22 DOLLARS (4~2O,OOO.OO)principal shall be paid annually,~for the next
23 two (2)years TWENTY-FIVE THOUSAND DOLLARS (~25,OOO.OO)principal shall be

24 paid annually,~and that the maximum rate of interest to be paid on such
25 indebtedness shall be not in excess of six percent (6~)per annum,payable
26 annually for the first year and thereafter semi-annually;that if at such
27 election two—thirds of the votes cast are in favor of incurring such
28 bonded indebtedness,then bonds of said district in the said amount of
•29 SEVEN HUNDRED NINETY-SIX THOUSAND DOLLARS ($796,000.00)shall be issued an~i
30 sold as in the said County Sanitation District Act provided.
31 Fourth That seven (7)consolidated election precincts are hereby
established for the purpose of conducting said election within said Sani
tation District,which said consolidated election precin~ts ~hall include
the following Orange County election precincts,as they existed on
January 1,1914.9,and the following polling places located within the
respective consolidated precincts and the following officers for said

election,each of whom is a qualified registered elector of the said dis~’

trict and of his respective consolidated precinct,are hereby designated,

established,and named for each of said precincts as follows,to-wit:

1 Seventh That the returns of said Election shall be canvassed by the
2 Board of Directors of said District at the office of the County Sanitation
3 Districts,Room 20~,Orange County Court House,Santa Ana,California,at
4 the hour of 2:30 o’clock P.M.,on the 7th day of March,1914.9.If two—

~thirds of the votes cast at said election are in favor of incurring the
6 bonded indebtedness as proposed,the proposition shall be deemed to have
7 carried.
8 Eighth That said election shall be in all other respects conducted
9 as far as practicable in accordance with the general election laws of this
10 state,so far as the same may be applicable.
11 Ninth That the Secretary of the Board of Directors shall cause thi~
12 ~resolution to be published once a week for three (3)consecutive weeks
13 ~prior to the date of said election in the Newport-Balboa Press,a weekly
14 ‘newspaper,having a general circulation in the District and hereby
15 designated for such publication.No other notice of said Election need be
16 given.
17 Tenth The Chairman and Secretary of this Board of Directors are
18 hereby authorized and directed to sign a certificate of adoption of the
19 said resolution tO be published herewith.
