OGSD-27 AN ORDINANCE OF THE BOARD OF DIRECTORS OF ORANGE COUNTY SANITATION DISTRICT ESTABLISHING SPECIFIED REVENUE AREAS WITHIN THE DISTRICT, AND REPEALING ORDINANCE NO. OGSD-02 WHEREAS, the Board of Directors of the Orange County Sanitation District ("District") has previously adopted Ordinance No. OCSD-02, establishing nine (9) separate geographical revenue areas based on former County Sanitation Districts Nos. 1, 2, 3, 5, 6, 7, 11, 13 and 14 of Orange County, California (the Predecessor Districts. This Ordinance is presently in full force and effect; and, WHEREAS, each of the nine individual Predecessor Districts, pursuant to applicable provisions of state law, previously established various fees and charges applicable to the users of the District's wastewater collection, treatment, a,rc disposal facilities system, and to certain properties within its respective 'urisc.ctional boundaries. Said fees included sewer service user fees, connection charges, annexation fees, industrial source control permit fees and use charges, source con:rcl fees, adm'.nistrative fees, non-compliance sampling fees, and m scehaneous charges. The various fees and charges within the respective jurisdictional boundaries of the nine individual Predecessor Districts, were established pursuant to the respective Ordinances of the individual Predecessor Districts, with the exception that certain of the fees and charges applicable to the properties within the jurisdictional boundaries of Predecessor District No. 14 were estab ished by agreement between Predecessor District 14 and the Irvine Ranch VJa:er District; and, WHEREAS, for purposes of improved efficiency and effectiveness of the District's operations, it is the intent, by the adoption of this Ordinance, to repeal and replace the existing Ordinance to allow for the consolidation of these nine (9) separate revenue areas into two (2) separate revenue areas and to apply fees and charges accordingly; and, WHEREAS, on April 26, 2000, the Board approved consolidation of Revenue Area Nos. 1, 2, 3, 5, 6, 11 and 13 into one consolidated revenue area because of the variance in rates, the ability to pay, the regional focus and mission of the District, and the adoption of one user fee rate; and, WHEREAS, on November 20, 2002, the Board approved consolidation of Revenue Area No. 7 into the consolidated revenue area previously established on April 26, 2000; and, WHEREAS, Revenue Area No. 14 continues to be fully funded through existing contracts with the Irvine Ranch Water District and it is necessary to O tt 27 p II I I II 10IIM5071I ° II III III continue to maintain a separate accounting record to ensure proper charges and fees; and, WHEREAS, that the adoption of this Ordinance is statutorily exempt under the California Environmental Quality Act from further environmental assessment pursuant to the provisions of California Public Resources Code Section 21080(b)(8), and 14 California Code of Regulations Section 15273(a). NOW, THEREFORE, the Board of Directors of Orange County Sanitation District does hereby ORDAIN: Section 1: That two separate revenue areas are hereby established within the District to be known as 'Revenue Area No. 14" and "Consolidated Revenue Area". Consolidated Revenue Area is a consolidation of former Revenue Area Nos. 1, 2, 3, 5, 6, 7, 11, and 13. Section 2: Revenue Area No. 14 shall continue to be fully funded through contracts with Irvine Ranch Water District. Section 3. Effective Date. That the provisions of this Ordinance shall become effective thirty (30) days after adoption. Section 4. Repeal. Ordinance No. OCSD-02 is hereby repealed. Section 5: The Secretary of the Board shall certify to the adoption of this Ordinance and shall cause a summary to be published in a newspaper of general circulation as required by law.
