OGSD-19 AN ORDINANCE OF THE BOARD OF DIRECTORS OF ORANGE COUNTY SANITATION DISTRICT AMENDING TABLE H OF ORDINANCE NO. 00SD-18 RE WASTEHAULER CHARGES FOR USE The Board of Directors of Orange County Sanitation District does hereby find: A. -�eBoardof Directors has previously established, by duly adopted Ordinance %c OCSD-18. ?ableH, charges for use by Wastehaulers, as autorized by Sections 306.3 and 306.7 of the Districts Wastewater Discharge Reculatlors, adopted by Ordnance No. OCSD-01, as amended. B. Tha' tFe inter: of Ordinance No. OCSD-18, Table H, was to continue in effec` -he rases established by Ordinance No. OCSD-06. C. By inadvertent error,the rate of charges for out-of-County ,.'astehaulers was incorrectly stated in Table H, notwithstanding written and verbal reports to the Board of Directors to continue the same rates as set forth in Ordinance No. OCSD-06. D. That the charges for use adopted by this Ordinance, revise the rates rcr';Nastehaule-s ror waste originating outside of Orange County,to comply with the intent of the 3oard of Directors when adopting Ordinance No. OCSD-18. E. That the adoption of this Ordinance is statutorily exempt under the Califo-nia Env'.ronrnental Quality Act from further environmental assessment, pursuant to the provslons of California Public Resources Code Section 21080(b)(8j. and tFe California Code of Regulations Section 15273(a). \C`V --1EREFORE, the Board of Directors of Orange County Sanitation Dls'r:ct, does Fe-eby ORDAIN: Section 1: Table H of Ordinance No. OCSD-18 is hereby amended, as 'o 1.o'%s. aria®m 1 otvo9w65277bszn "TABLE H WASTEHAULER CHARGES FOR USE Wastehauler Fees Charges Charge for Use —Waste originating $0.035/gallon of within Orange County truck capacity Charge for Use—Waste originating $0.11/gallon of outside Orange County truck capacity" Section 2: This Ordinance is enacted as an Urgency Ordinance, to allow for the continued processing of charges for use, in order to fulfill the on- going obligations of the District in accordance with the provisions of the District's Ordinances currently in effect. Section 3: This Ordinance shall take effect immediately upon adoption. Section 4: The Secretary of the Board shall certify to the adoption of this Ordinance and shall cause a summary to be published in a newspaper of general circulation, as required by law. PASSED AND ADOPTED by the affirmative vote of greater than two- thirds of the Board of Directors of the Orange County Sanitation District at a meeting held September 25, 2002.
