HomeMy WebLinkAboutOrdinance No. 1409 ORDINANCE NO. 1409 AN URGENCY ORDINANCE OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 14 OF ORANGE COUNTY, CALIFORNIA, REPEALING ORDINANCE NOS. 1407 AND 1408 RELATING TO THE ESTABLISHMENT OF EXCESS CAPACITY CHARGES WHEREAS, the Board of Directors of County Sanitation District No. 14 of Orange County, California ("District"), has heretofore adopted Ordinance No. 1403, An Ordinance Establishing Wastewater Discharge Regulations for Use of District Sewerage Facilities; and WHEREAS, on June 28, 1995, the Board of Directors of County Sanitation District No. 14 of Orange County, California adopted Ordinance No. 1407, which amended Section 309 of Ordinance No. 1403 relating to the establishment of excess capacity charges; and WHEREAS, on August 23, 1995, the Board of Directors of County Sanitation District No. 14 of Orange County, California adopted Ordinance No. 1408, as an Urgency Ordinance, adding Section 309.5 to Ordinance No. 1403, to provide for deferred payment schedules of excess capacity charges; and WHEREAS, the Board of Directors has received a comprehensive staff report concerning the application of Ordinance Nos. 1407 and 1408, together with a similar staff report regarding the similar Ordinances of other Districts; and WHEREAS, the Board of Directors finds that because all connection fees are levied and collected by the Irvine Ranch Water District and not District No. 14, Ordinance Nos. 1407 and 1408 have no further purpose and should be repealed. 1 NOW, THEREFORE, the Board of Directors of County Sanitation District No. 14 of Orange County, California, Does hereby ORDAIN as follows: Section 1: Ordinance No. 1407 is hereby repealed. Section 2: Ordinance No. 1408 is hereby repealed. Section 3: This Ordinance is enacted as an Urgency Ordinance in order to allow for the processing of pending permit applications in accordance with the provisions of the District's Ordinances in effect prior to the enactment of Ordinance No. 1407, and to promote the public welfare by allowing businesses to make connection without incurring excess capacity charges that could be greater than a final recommendation made upon completion of a comprehensive study. Section 4: The Secretary of the Board shall certify to the adoption of this Ordinance and shall cause a summary of the same to be published in a newspaper of general circulation in the District as required by law.
