HomeMy WebLinkAboutOrdinance No. 1 - District No. 12 �' eJ �a 1 ORDINANCE NO. 2 AN ORDINANCE OF THE BOARD OF SUPERVISORS O THTH 3 COUNTY, CALIFORNIA, AS AND CONSTITUTING DISTRICT BOARD OF COUNTY SANITATION DISTRICT(NO. 12 4 OF ORANGE COUNTY. 5 6 The Board of Supervisors of the County of Orange, as and 7 constituting theDistrict Board of County Sanitation District No. 12 8 of Orange County, does ordain as follows : — g 10 SECTION 1. Definitions . 11 (a) The word 'District" as used herein shall mean County 12 Sanitation District No . 12 of Orange County. 13 (b) Sewerage System: Those pipe lines and appurtenances 14 constructed, maintained and operated by the District primarily for 15 the collection of sewage. 16 (c) A residential unit is defined to be any single family 17 dwelling and may constitute a separate building or may constitute 18 a portion of a building. 19 (d) A commercial unit is defined to be any business estab- 20 lishment, commercial house, industrial building, country club, or 21 other type of business establishment, whether such establishment 22 constitutes a separate building or constitutes a portion of a 23 building. 24 25 SECTION 2. Every residential unit served by a connection 26 with the sewerage system of the District whereby sewage is disposed 27 of by the District either through the facilities of the District 28 or otherwise, shall pay a sewer service charge of Two Dollars 29 ($2.00) per month, or portion of a month exceeding fifteen days . 30 31 O SECTION 3. Every gomercial unit served by a connection 32 with the sewerage system of the District whereby sewage is disposed 1. 1 of by District either through the facilities of the District or 2 otherwise, shall pay a sewer service charge of Ten Dollars ($10.00) 3 per month , or portion of a month exceeding fi teen days . 4 5 SECTION 4. Sewer service charges may be collected separ- 6 ately or may be collected with the rates or charges of any other 7 publicly or privately owned public utility. 8 9 SECTION 5 . Sewer service charges may be collected monthly 10 or bi-monthly at the discretion of the District management. 11 12 SECTION 6. All sewer service charges are due and payable 13 upon the tenth day of the month. If a bill is not paid by that 14 date, a delinquent service charge shall be assessed in the amount 15 of One Dollar ($1.00) per day, with the total assessmentnot to 16 exceed Fifteen Dollars ($15 .00) . 17 18 SECTION 7 . In the event that any sewerage charge provided 19 herein is not paid when the same becomes due, the District may, in 20 addition to any other remedies it has , cut off any of the said 21 services and facilities referred to in this Ordinance and shall 82 not resume the same until all delinquent charges, together with 23 any charges necessitated by resumption of such services and facil- 24 ities , have been fully paid. Failure to receive a bill for the 25 sewer services does not relieve the consumer of liability. When ` 26 sewerage service has been discontinued for failure of payment of a 27 sewerage charge, the consumer shall pay a service charge of 28 Fifteen Dollars ($15 .00) for the reinstatement of sewerage service 29 to him; provided, however, that such charge shall not apply to 30 reinstatement of sewerage service where the owner of the property 31 has paid the delinquent charge and a different consumer is occupying 32 the property than the person who permitted the charge to become 2. I delinquent. 2 3 SECTION 8. Any amount due for sewerage charges under this 4 Ordinance shall be deemed a debt to the District, and any persons, 5 firms or corporations failing, neglecting or refusing to pay said 6 indebtedness shall be liable to an action in the name of said 7 District in any court of competent jurisdiction for the amount 6 thereof. 9 10 SECTION 9. Revenues derived from sewerage charges under ll the provisions of' this Ordinance shall be used only for the acquis- 12 ition, construction, reconstruction, maintenance and operation of 13 sanitation or sewerage facilities , to repay principal and interest 14 on bonds for the construction or reconstruction of such sanitation 15 or sewerage facilities, and to repay federal or state Loans or 16 advances made to the District for construction or reconstruction 17 of sanitation or sewerage facilities ; provided, however, that such 18 revenue shall not be used for the acquisition or construction of 19 new local street sewers or laterals as distinguished from main 20 trunk, interceptor and outfall sewers . 21 22 SECTION 10. The Board of Directors may, from time to time, 23 in its discretion and by resolution, fix, alter, change, amend or 24 revise the charges and rates for facilities and services in 25 connection with the sewerage system as herein or.hereafter estab- 26 lished and fixed. 27 28 SECTION 11. If any section, subsection, sentence, clause - 29 or phrase of this Ordinance is for any reason held to be uncon- 30 stitutional, the Board of the District hereby declares that it 31 would have passed this Ordinance irrespective of the .fact that any 32 one or more sections, subsections , sentences,clauses or phrases 3. I thereof be declared unconstitutional. 2 3 SECTION 12. This Ordinance shall take effect thirty (30) 4 days after its passagein the manner and form required by law, and 5 the charges authorized in this Ordinance shall be computed and 6 charged from the first day of May, 1964. 7 8 SECTION 13. Prior to the expiration of fifteen (15) days 9 after the passage hereof, this Ordinance, together with the names 10 of the members of the Board of Supervisors, constituting and acting 11 as the District Board of County Sanitation District No. 12 of Orange 12 County, voting for and against the same, shall be published once 13 in the SANTA ANA REGISTER, a newspaper printed and published in 14 the County of Orange, State of California. 15 16 WILLIAM J.
