An Ordinance Providing for the Levy and Collection of Fees and Charges for the Maintenance andOperation Costs of the District. The Board of Directors of County Sanitation District No. 7 of Orange County, California, does ordain as follows: WHEREAS, certain areas within the territory of the District are discharging sewage and industrial wastes through the sewerage facilities of other County Sanitation Districts in Orange County into the ,Jointly owned Treatment and Disposal Works of the District, and WHEREAS, the treatment disposal charges have heretofore been paid from a general tax levy on all of the real property in the District, and WHEREAS, there is no system of trunk sewers in the District which will serve all portions of the territory in the District which would enable each property owner reasonable access to trunk sewer facilities: NOW, THEREFORE, the Board of Directors of County Sanitation District No. 7 of Orange County, California, acting in the best public interests, does ordain as follows: ARTICLE 1. Each owner of real property in the District, whose real property or any portion thereof is connected to and is discharging any sewage or industrial wastes into a sanitary sewer or similar facility which ultimately discharges sewage and industrial wastes into the ,Jointly owned treatment and disposal works of the District, shall be charged and be required to pay a fee for the purpose of defraying the costs of operation and maintenance of the sewerage facilities of the District. ARTICLE. 2. The fees to be charged to each property owner shall be -1- • determined in accordance with the following schedule: (a) For each single-family dwelling unit, the sum of $2.00 a month. ' (b) For each commercial, manufacturing, or industrial use and all uses other than private residential for which the monthly water consumption as shown by water meter reading is more than 5,000 cubic feet, the sum of $4.50 for each 3.2,500 cubic feet or any portion thereof consumed or used per month on said property as shown by water meter readings. In this connection, apartments and hotels shall be considered commercial establishments unless the tenants are metered individually and pay their own water consumption charges, in which event the apartment unit shall be considered a private dwelling. In the event a commercial, manufacturing or industrial use consumes lees than 5,000 cubic feet of water per month, the fee shall be $2.o0 per month. (c ) The fees and charges hereinabove provided for shall be billed bi-monthly to the real property owners subject to said fees and charges as hereinabove provided. (d) The General Manager of the District is authorized and directed to levy and collect said fees and charges, commencing and effective on the date of September 1, 1960. (a) All fee charges so levied shall be due and payable at the close of each billing period, and shall become delinquent if not paid within thirty (30) days thereafter. All delinquent fees and charges shall bear interest at the rate of six percent (6%) per annum from the due date. (f ) The provisions of this Ordinance may be enforced by civil action at. law. (g) The General Manager of the District is authorized and directed to collect all of said charges and fees and is hereby em- powered to bring actions at law to collect delinquent accounts. Any delinquent account of less than One Hundred and Fifty Dollars ($150.00) may be the subject of ,a small claims action on behalf of the District, and any such action may be brought by any officer or agent of the District upon the direction of the General Manager. -2- ARTICLE 3. VALIDITY If any article, section, subsection, sentence, clause or ' phrase of this Ordinance, or the application of any thereof to any person, entity, public corporation or circumstance be held to be invalid for any reason, such invalidity shall not affect the validity of any other provision or application of any of the remaining pro- visions or portions of this Ordinance; and to this end the Board of Directors of County Sanitation District No. 7 of Orange County, , California hereby declares that it would have adopted this Ordinance and each and every article, section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one or more other articles, sections, subsections, sentences, clauses or phrases, or the application of any thereof to any person, entity, public corp- oration or circumstance be declared invalid. ARTICLE 4. EFFECTIVE DATE The Chairman of the Board of Directors of County Sanitation District No. 7 of Orange County, California shall sign this Ordinance and the Secretary of the District shall attest thereto and certify to the passage of this Ordinance, and shall cause the same to be published once in The Tustin News, a weekly newspaper of general circulation, printed, published and circulated in County Sanitation District No. 7 of Orange County, California, within fifteen (15 ) days after the date of the passage of this Ordinance by said Board of Directors, and said Ordinance shall take effect September 1, 1960.
