ORDINANCE NO. 627
AN URGENCY ORDINANCE OF THE BOARD OF DIRECTORS
OF COUNTY SANITATION DISTRICT NO. 6 OF ORANGE
COUNTY, CALIFORNIA, REPEALING ORDINANCE NOS. 625
AND 626 AND AMENDING ORDINANCE NO. 620
ESTABLISHING WASTEWATER DISCHARGE REGULATIONS
FOR USE OF DISTRICT SEWERAGE FACILITIES
WHEREAS, the Board of Directors of County Sanitation District No. 6 of Orange County,
California ("District"), has heretofore adopted Ordinance No. 620. An Ordinance Establishing
Wastewater Discharge Regulations for Use of District Sewerage Facilities; and
WHEREAS, on May 24, 1995, the Board of Directors of County Sanitation District No. 6
of Orange County, California adopted Ordinance No. 625, which amended Section 309 of
Ordinance No. 620 relating to the establishment of excess capacity charges; and
WHEREAS, on August 23, 1995, the Board of Directors of County Sanitation District No.
6 of Orange County, California adopted Ordinance No. 626, as an Urgency Ordinance, adding
Section 309.5 to Ordinance No. 620, to provide for deferred payment schedules of excess
capacity charges; and
WHEREAS, the Board of Directors has received a comprehensive staff report
concerning the application of Ordinance Nos. 625 and 626, together with a recommendation to
solicit proposals to undertake a comprehensive study of fees; and
WHEREAS, the Board of Directors finds that pending the results of the comprehensive
rate study, the excess capacity charges, as established by Ordinance No. 620, should be in
effect in lieu of the formula method of establishing charges as contained in Ordinance No. 625.
NOW, THEREFORE, the Board of Directors of County Sanitation District No. 6 of
Orange County, California,
Does hereby ORDAIN as follows:

Section 1: Ordinance No. 625 is hereby repealed.
Section 2: Ordinance No. 626 is hereby repealed.
Section 3: Section 309 of Ordinance No. 620 is hereby re-enacted to read:
"Section 309. Excess Capacity Chame. New developments or existing
developments that expand operations that require substantial sewerage facilities
capacity, will be subject to an excess capacity facilities charge in an amount and
method to be determined by the Board of Directors on a case-by-case basis,
taking into consideration the quantity of Flow and the strength of the wastewater
discharge."
Section 4: This Ordinance is enacted as an Urgency Ordinance in order to allow for
the processing of pending permit applications in accordance with the provisions of the District's
Ordinances in effect prior to the enactment of Ordinance No. 625, and to promote the public
welfare by allowing businesses to make connection without incurring excess capacity charges
that could be greater than a final recommendation made upon completion of a comprehensive
study.
Section 5: The Secretary of the Board shall certify to the adoption of this Ordinance
and shall cause a summary of the same to be published in a newspaper of general circulation in
the District as required by law.
