Mahoney and Chairman pro tern Ron Isles, Director Irv Pickier was appointed __________________________________ The Joint Chairman reported on the -August 28th meeting with the Environmental Protection Agency (EPA) Region 9 officials in San Francisco to present the Districts’“2020 VISION” Action Plan for Wastewater Management and officially file the application for renewal of the Districts’NPDES Ocean Discharge Permit,as authorized and directed by the Boards on July 19,1989. The Joint Chairman observed that it was a very positive meeting.Staff will remain at EPA’s disposal for any and all questions or concerns which they may have during the process of reviewing the Districts’application. S Mr.Hoesterey then reported on the California Association of Sanitation Agencies’ (CASA)Annual Work Conference in San Diego In August which he attended along with Directors John Cox,Richard Edgar,Bob Hanson,Richard Polls and Jim Wahner,the General Manager,Wayne Sylvester,and General Counsel,Tom Woodruff.The Joint Chairman comented on several of the topics discussed at the conference. Chairman Hoesterey also advised that the Districts were a winner in the Annual CASA Safety Contest for their innovative safety program. The Joint Wednesday, attend and Chairman then called a meeting of the Executive Comittee for September 27th,at 5:30 p.m.,and invited Director Wayne Wedin to participate in the discussions. ALL DISTRICTS The Joint Chairman announced that he had Board Cormiittee Appointments completed the Board Co,ni~ittee assignments and that a revised listing of the members of the various Cormiittees would be mailed to the Directors in a few days. ALL DISTRICTS The General Manager coaTnented on the Report of the General Manager meeting with EPA Region 9 officials in San Francisco on August 28th,and called the Directors’attention to the briefing booklet included in their meeting folders which had been used at the meeting.Also included for the Directors’ information was the newly-printed surrinary brochure on the “2020 VISION”Action STAFF MEMBERS PRESENT: OTHERS PRESENT: Chairman pro tern of District No.2. S —3— 09/13/89 Plan.Mr.Sylvester noted that the Districts had submitted a five—volume application for renewal of the NPDES Permit.The application included a suggested schedule in order for EPA to issue the new permit in February 1990, when the current permit expires.EPA has indicated that they will be unable to meet the suggested schedule,but added that they would administratively extend the Districts’current permit until they had reached a decision regarding the renewal. Mr.Sylvester then expressed appreciation to Don Fox,the Districts’Safety Consultant,and Ray Young,Safety Coordinator,for their contributions and efforts in connection with the safety award presented to the Districts by the California Association of Sanitation Agencies (CASA). The General Manager reported on a meeting in Washington,D.C.with new EPA Administrator,William Reilly,on August 14th which he attended along with other members of the Board of Directors of the Association of Metropolitan Sewerage Agencies (AMSA).It was Administrator Reilly’s first meeting with the wastewater management coninunity.EPA was urged to follow a scientifically supportable, pragmatic course in setting their regulations.Mr.Sylvester briefly reviewed the five key subjects focused on at the meeting,which Included sludge management regulations,emerging effluent toxicity testing regulations,national coastal marine policy,the combined sewer overflow issue,and formation of a policy board with broad representation from POTW’S,regulatory agencies and groups with environmental,academic and scientific interests to address policy issues as they emerge. ALL DISTRICTS Report of the General Counsel ______________________________________ The General Counsel reported on the _____________________________________ ordinances to be introduced later in the meeting increasing connection charges in each District.He noted that a paragraph was inadvertently omitted from District 13’s Ordinance relative to the existing provision providing that local governmental agencies pay established connection fees.The General Counsel noted that the ordinances are uniform for each District with the exception of that provision in District 13’s ordinance. Mr.Woodruff then briefly reviewed the status of the Beatrice/Hunt—Wesson litigation filed following their appeal to the Board relative to Industrial Waste Permit No.3—1-143. DISTRICT 1 Authorizing General Counsel to file legal actions against Universal Circuits,Inc.No.1 for non—compliance with conditions of Industrial Waste Discharge Permit No.1-1—346 The General Counsel reported on a major violation of District No.l’s industrial waste discharge ordinance by Universal Circuits,Inc.No.1.He Indicated that the firm has been dumping Illegal concentrations of regulated wastes into the sewer in excess of discharge permit limitations imposed by the District. Mr.Woodruff further advised that the District has the option of filing a criminal action in conjunction with the District Attorney or filing for civil penalties.He recomended that the District file suit against Universal Circuits for civil penalties for violating the conditions set forth In their discharge pemit. Also discussed were reasons the Board previously chose to make connection fees applicable to local governmental agencies.In 1988 the Board included a provision In the District 13 ordinance to assess local government agencies for connection fees in order to assure that the cost of providing sewage service to large governmental Installations would be borne by those requiring sewage system capacity and not the residents and businesses of District 13. Federal and State installations pay connection fees In all Districts. Directors discussed the possibility of exempting a particular type of government facility and/or assessing connection fees only to facilities exceeding a certain size.The General Counsel pointed out that the connection fees must be equitable and that there must be justification for different rates or applications.
