The Chairman called the meeting to order at 4:00 p.m.The roll was called and the Secretary pro tern reported a quorum present. DIRECTORS PRESENT:Jacqueline Heather (Chairman),John C. Status review and discussion The Chief Engineer reviewed the history of of history of alternate existing and proposed alternate facilities facilities to serve the for sewering the Jamboree Road -Big Canyon Jamboree Road -Big Canyon drainage area.In 1959 the Jamboree Pump drainage area Station was built to serve the area on an interim basis.The pump station is now at capacity and cannot be expanded.The Master Plan reports of 1964 and 1969 recommended deactivation of the temporary pump station and construction of a gravity sewer system along the east side of the Back Bay.Following completion of necessary environmental reports and hearings,application for a construction permit was filed with the California Coastal Zone Conservation Commission in June,1976.In order to meet the time constraints imposed for construction of the gravity line (from September 1st to November 1st),the Board authorized procurement of the necessary pipe (which remains in District inventory)prior to award of a construction contract.The regional Coastal Commission approved the District’s application but,upon appeal by environmentalists,it was sub sequently denied at the State level in September,1977,on the contention that - 5/20/80 District #5 0-~ it impacted endangered species and that there was an alternate method;namely, construction of a new pumping station. In 1978,the Board authorized preparation of a Project Report and an Environ mental Impact Report to evaluate alternative methods of serving the area: Alternate I.Gravity System Along the Back Bay Drive Although from an engineering and cost (~750,000 utilizing District-owned pipe)standpoint this alternative is the best and most reliable system to accommodate the sewage flows,because of the environmental concerns regarding the Back Bay and the previous action of the California Coastal Commission in denying the permit,this alternative was not considered viable for implementation by the study. Alternate II.Improved Pump Station and Force Main At $1,000,000,this alternative is comparable in cost to the Back Bay gravity sewer and estimated to be approximately one-half of the gravity tunnel sewer in Jamboree Road,but the annual maintenance and energy costs,estimated to be over $40,000 per year,would far exceed the cost of the gravity tunnel system over the life of the facility.It does not provide the reliability of service unless standby generation is installed to avoid overflows in the Big Canyon area and subsequently to the Back Bay. Alternate III.Gravity Tunnel System in Jamboree Road This alternative,although the most expensive in initial capital investment ($2,500,000),was considered less costly than Alternate II (Improved Pump Station and Force Main). Because the existing system is operating at capacity the Board of Directors, on January 15,1980,adopted Urgency Ordinance No.510,that accomplished three basic objectives:(1)divided the District into three separate drainage zones for purposes of development and regulation of sewerage facility use;(2)estab lished a schedule of connection fees for said zones;and (3)imposed a temporary suspension on the issuance of sewer connection permits for the zone tributary to the Big Canyon Drainage area (Zone 2)until additional sewer service for said area is determined to be available.The ordinance also provides for exceptions to the temporary suspension of connections under certain conditions. Zone 2 is the Jamboree Road -Big Canyon drainage area for which the connection fee has been established in an amount sufficient to repay the cost to be advanced by developers for constructing a facility to serve the area.Zone 3 is the down-coast area now outside the City limits of Newport Beach,which has no development at the present time.Zone 1 is the balance of the District which is presently developed. In February,1980,Directors ordered preparation of a Supplement to the Environmental Impact Report,which •is before the Board for review at this time,to reflect any changes in conditions due to the time lapse since com pletion of the Project Report and EIR. —2— ~5/20/80 tristrict #5 -e I The Board then entered into a discussion of the alternatives during which the Supplement to the EIR and a time schedule for construction of a new facility were reviewed.Also considered was possible employment of a firm that special izes in preparing and processing of EIR and Coastal Commission documents to assist the staff in submitting and obtaining a favorab~e ruling from the Commission on the desired alternative.It was the consensus of the Directors that~•~~the high cost of energy and other changed conditions made the Back Bay gravity sewer alternative the best and most feasible project. It was then moved,seconded and duly carried: That the staff be directed to further evaluate the environmental documentation necessary to proceed toward construction of the Back Bay gravity sewer and possible consultant’s services that may be required in this regard and report back to the Board at the regular meeting on June 11,1980. Discussion re financing of The General Counsel reviewed the two agree- facilities to serve the ments in force to provide funds to build Jamboree Road -Big Canyon the required facilities to serve the Jamboree drainage area Road -Big Canyon area.The first agreement was entered into with The Irvine Company in May,1976,and was originally designed to provide funds for the Back Bay Drive Sewer facility.It provided for an advance of $600,000 to the District.The second agreement,with the Daon Corporation,was executed in January,1980,to advance the $400,000 balance of the $1,000,000 needed by the District.He advised that the Irvine Company agreement is currently being renegotiated in order to reflect changed conditions. Receive and file application Dennis O’Neil,attorney representing Daon from Daon Corporation for Corporation,presented a request for an exception to Ordinance No.510 exception to Ordinance No.510 to allow construction of a SO-unit condominium project located at Jamboree Road and Ford Road.He proposed that the project, which would gravity flow into existing District No.5 facilities,receive interim sewer service by connecting to said facilities.After a brief discussion of the issues with regard to the request,it was moved,seconded and duly carried: That the letter from Daon Corporation dated May 20,1980,-making application for exception to Ordinance No.510 to provide interim sewer service for a 50-unit condominium project located at Jamboree Road and Ford Road be,and is hereby,received,ordered filed and referred to staff for study and report back at the June 11,1980,Joint Board meeting. —3— 5/20/80 District No.5 Adjournment Moved,seconded and duly carried: That this meeting of the Board of Directors of County Sanitation District No.5 be adjourned.The Chairman then declared the meeting so adjourned at 4:50 p.m.,May 20,1980.
