ALL DISTRICTS Following an. introduction of new Directors Report of the Joint Chairman Saltarelli called an Joint Chairman Executive Committee meeting for Wednesday, April 2S, 1979, at 5:30 p.m. , and invited Directors Bailey and Culver to attend and participate in the discussions. He reported that the Committee will be considering the staff recommendations on April 25th relative to the remaining steps to complete the Environmental Protection Agency's (EPA) Draft Environmental Impact Statement (EIS) to add r the needed capacity to the treatment plants. The staff and Districts' EIS consultant will be meeting with San Francisco EPA personnel on Wednesday, April 18th, to review the matter. ALL DISTRICTS The General Manager reported that hearings Report of the are presently under way in Washington, D.C. General. Manager regarding appropriations for construction of sewage treatment works under the grant program. Current recommendations range from zero to $3.8 billion, which is considerably less than the $5 -billion annual allocation approved by Congress in 1977. Any reduction in the funding level may significantly influence EPA's deliberations on the secondary treatment waiver issue. Mr. Harper advised Directors that the Executive .Officer of the California Regional Water Quality Control Board (RWQCB) has informed him,that a hearing will be held on April 27th to consider the Executive Officer's recommendation to issue a cease and desist order because of the Districts' failure to meet the solids disposal requirements. He reported that the violations are tem- porary in nature brought about by the recent inclement weather and the revocation of the Districts' sludge contractor's processing site lease at the urging of the RWQCB. The sewage sludge management facility presently being constructed at the Coyote Canyon Landfill should resolve the problem. He also noted that the $2.3 million LA/OMA study on sludge disposal alternatives is recommending the method to be utilized by the Districts at Coyote Canyon as the best solution for the next 10 to 15-year period. The General Manager then commented briefly on supplemental agenda items for ratifying attendance of the General Counsel at the Association of Metropolitan Sewerage Agencies' Attorney's Seminar. on Enforcement in St. Louis, Missouri; final approval of proposed Annexation No�. 84 - Chou Annexation to County Sanitation District No. 7; recommendations regarding the agreement with the City of Orange for collection of sewage connection charges in District No. 7; and proposed actions establishing user fees and annexation charges for property at 1701 Sirrine Drive, Santa Ana, which is presently outside the boundaries of District No. 7. ALL DISTRICTS The General Counsel reported briefly on his Report of the attendance at the Association of Metropolitan General Counsel Sewerage Agencies' Attorney's Seminar on Enforcement held in St. Louis, Missouri. Mr. Woodruff noted that it was the first such meeting of attorneys from the major sewerage agencies throughout the nation and proved to be very productive. ALL DISTRICTS The Chair recognized Mr. Bill Butler, of Approving Draft Financial Peat, Marwick, !•fitchell and Co. , Districts' Plan .and P.evenue Program, Revenue Program Consultant, who reviewed in principle the Draft Financial Plan and Revenue Program prepared by the consultant to comply with Federal and State regulations relative to construction grant regulations. The regulations require that users of the Districts' sewage system be classified -9- -r 4/11/79 into residential/small non-residential, industrial/large commercial or institutional/tax exempt groups. The Revenue Program proposes that maintenance and operation costs for residential/small non-residential group be funded through the Districts' share of the to ad valorem property tax levy to satisfy user charge require- ments. However, at such time as the tax levy is insufficient to cover operation and maintenance of Districts' facilities, or cut off entirely by legislative fiat, an alternative funding method will have to be implemented for this group of users. The possible alternative methods are: 1) Hearing and separate levy of special assessment on the property tax bill 2) Separate charge collected on water purveyors utility bill 3) Direct billing by Districts 4) Election to authorize separate ad valorem tax levy The industrial/large commercial group will be charged on the basis of actual use and receive credit for ad valorem taxes paid in essentially the same manner followed since adoption of the uniform industrial waste ordinance in 1970. This group of users will also be subject to the industrial cost recovery provision of the Federal Water Pollution Control Act which requires recovery of the Federal share of the cost of capacity of grant-funded facilities con- structed for industrial users. There is presently a moratorium on this pro- vision of the Act, thus, it will not be implemented until Congress makes a further determination on its desirability. The institutional/tax exempt group will be billed separately by the Districts based on actual use. This class has been interpreted to exempt local govern- mental. agencies from user charges and, therefore, it appears the dischargers within this group will be limited to State and Federal properties. The consultant briefly reviewed other major items which must be considered by the Boards in connection with the Financial Plan and Revenue Program, including capital funding policies, notification requirements regarding residential/small non-residential users, the ordinance amendments necessary to implement the revenue program and other provisions required by the Act, and the issue of consolidation of the Districts.
