DISTRICT 11 Moved,seconded and duly carried: Approval of Minutes That the minutes of the regular meeting held January 10,1979,be,and are hereby,approved,as mailed. ______________ The Joint Chairman announced that Mike ______________ Dillon,Executive Director of the _____________ California Association of Sanitation Agencies (CASA),had advised the staff that it appears that legislation will be adopted to allow the Districts to receive their pro rata share of the 1%ad valorem tax in 1979-80,and that the provision of SB 154 adopted last year to the effect that special districts will no longer receive ad valorem tax will not be implemented by the State Legislature this year. Chairman Saltarelli reported that CASA held a mid-year work conference in Indian Wells,January 19th ~20th,and that the Districts were represented by Directors Hutchison and Smith,former Joint Chairman Don Winn,the General Manager and the General Counsel.He then recognized Director Smith, who commented briefly on the conference sessions. The Joint Chairman then called a meeting of the Executive Committee for Wednesday,February 28,1979,at 5:30 p.m.and invited Directors Velasquez and Williams to attend and.participate in the discussions. ALL DISTRICTS Report of the General Manager ALL DISTRICTS The General Manager then referred Removing consideration of Directors to a letter from Pascal award of Job No.J-3-1 from ~Ludwig,Inc.,the apparent low consent calendar and referring bidder on Installation of Gas contractor~s request for re Engines with Gear Drives at Rothrock lief from award to the General Outfall Booster Station,Job No.J-3-l, Counsel requesting that they be relieved from ALL DISTRICTS Report of the Joint Chairman -j The General Manager reported that the Environmental Protection Agency has indicated that they still intend to publish secondary treatment waiver regu lations by mid-March.The Agency has further stated at a recent meeting in Washington,D.C.that the proposed regulations will be reasonable. -4- 2/14/79 award of the contract for said job due to an alleged ommision in their bid of the price for Falk Drive Couplings and Waukesha Drive Shafts. Mi’.Harper recommended that the item be removed from the consent calendar and the matter referred to the General Counsel for review and recommendation. ALL DISTRICTS Committee Chairman Smith reported on the Report on Special Committee activities of the Special Committee to to Study Reorganization of Study Reorganization of the Districts. the Districts The Committee has developed a draft agree ment to consolidate the seven Sanitation Districts into one Districtand Chairman Smith announced that the General Counsel and Director of Finance would review the agreement and financial considerations.He recommended that following the briefing each District Board consider meeting within the next forty-five days to review the pros and cons of consolidation to determine if they wish to have the Committee proceed with a final consolidation agreement. The General Counsel and Director of Finance then reviewed the draft agreement and financial considerations relative to consolidation,following which the Boards entered into a general discussion regarding the proposal.In response to a question as to why consolidation was being considered,the General Counsel reported that the issue had been considered by the Joint Boards on two previous occasions and that the Grand Jury requested that the Boards once again con sider the matter in light of Proposition 13. Following further discussion and consideration of procedures for consolidation and the potential benefits and estimated preliminary annual savings,the staff was directed to prepare additional cost information and resubmit the initial report outlining the pros and cons of consolidation for review by Directors prior to the adjourned meetings of the individual Boards to consider the proposal. _________________________ That the bid tabulation and recommendation ________________________ for awarding purchase of Polyelectrolyte ________________________ Chemical Flocculent,Specification No. P-033 (Rebid),be,and is hereby,received and ordered filed;and that said purchase be,and is hereby,awarded to American Cyanamid for the unit price of $1.46 per pound,for a maximum amount not to exceed $87,089.54,plus applicable taxes. DISTRICT 2 The General Counsel reviewed his memoran— •Denying request of Breal,Inc dum outlining possible alternative ordinance for waiver of connection fees amendments in the event the Boards wished to and tabling further considera consider establishing provisions for waiver •tion of waiver alternatives or deferral of connection fees for govern mental agencies or non-profit organizations. He reminded Directors that the list was not all-inclusive and that any provision for waiver or deferral of fees would require an amendment to the existing ordinance. It was then moved and seconded that the request of Breal,Inc.for waiver of connection fees for their non—profit,low-cost,senior citizenshousing project,be denied. The BOard then entered into a lengthy discussion regarding the propriety of waiving or deferring connection fees for governmental agencies or non-profit organizations in general,specifically the request of the Breal,Inc.,and the alternatives presented in the General Counsel’s memorandum re waiver of fees,following which Director Cooper requested that a letter dated February 13,1979,from the City of Brea,filed this date with the Chairman,be read. The Chair then directed that the letter be received and filed as a part of the record. After further discussion concerning the Board’s posture on similar requests for waiver of fees in the past and the possible precedent-setting impact of granting such requests,Director Cooper,representing the City of Brea, withdrew on behalf of Breal,Inc.,the request fOr waiver of District’s connection-fees for the non-profit,low-cost,senior citizens housing project. A substitute motion to accept the withdrawal by the City of Brea on behalf of Breal,Inc.,of the request for waiver of Dlstrictts connection fees was then moved,seconded and duly carried: It was then moved that Breal,Inc.be granted a deferral of payment of con nection fees for the non-profit,low-cost,senior citizens housing project for a period of ten years.The motion died for lack of second. It was then moved,seconded and duly carried: That further consideration of any alternative for waiver and/or deferment of District’s connection fees be tabled.
