A regular meeting of the Boards of Directors of County Sanitation Districts Nos.
1, 2, 3, 5, 6, 7 and 11 of Orange County, California was held at 7:30 p.m. , in the
Districts, Administrative Offices. Following the Pledge of Allegiance and invocation,
the roll was called and the Secretary reported a quorum present for Districts Nos. 1,
2, 3, 5, 6, 7 and 11 as follows:

ALL DISTRICTS This being the annual meeting fixed by the
Annual election of Boards for election of the Chairman of the
Joint Chairman Joint Administrative Organization, the
Secretary stated that Director Donald
Saltarelli had been nominated at the regular meeting of the Joint Boards on
June 14, 1978, in accordance with established procedures.
It was then moved, seconded and duly carried: That a unanimous vote be cast
for Director Donald Saltarelli as Chairman of the Joint Administrative
Organization.
ALL DISTRICTS This being the annual meeting fixed by the
Annual election of Boards for election of the Vice Chairman of
Vice Joint Chairman the Joint Administrative Organization, the
Secretary stated that Director Donald Fox
had been nominated at the regular meeting of the Joint Boards on June 14,
1978, in accordance with established procedures.

ALL DISTRICTS Chairman Saltarelli commented briefly on
Report of the the hearing scheduled July 19, 1978,
Joint Chairman regarding the proposed flat rate special
assessment for sewer service charges to
fund 1978-79 operating and capital budgetary requirements.
He also reported on a release from Senator Cranston's office urging EPA to
adopt responsible regulations relative to waiver of secondary treatment
requirements for ocean dischargers in accordance with Congressional intent.
Joint Chairman Saltarelli then called a joint meeting of the Fiscal Policy
Committee and the Executive Committee for August 2, 1978, at 5:30 p.m. and
invited Directors Perry and Nyborg to attend and participate in the discussions.

a used loader is an alternative to securing a new piece of equipment which
would •cost about $212,000.

on the basis of previous legal and judicial opinions that the Sanita.t.-i.on
Districts ' levy is a "special. assessment" and, therefore, not subject to
Jarvis-Gann; and the alternative method of establishing a flat rate special.
assessment for server service and iminediate availability against each parcel
of property to be collected on the tax roll (Alternative II) in the event an
unfavorable legal ruling is received oil Alternative III. The Boards previously
established July 19, 1978, as the date. of hearing re implementation of
Alternative II, if necessary, and notices thereof were mailed on July 6th
to all property owners of rec;c-rd.
Mr. Woodruff advised that continued use of Alternative III was subject to a
favorable legal opinion from the County Counsel. An opinion has not yet •
been rendered. Eowever, the General Counsel stated, in his discussions
with County Counsel 's office relative to the forthcoming ruling, although
it appears as if the County Counsel will rule that the Districts' levy is,
in fact, a "special assessment", the State Legislature's action implementing
Jarvis-Gann placed the amendments into the Rc-%:enue and Taxation Code which
will, in effect, subject said Levy to the Jarvis-Gann (Proposition 13)
limitations. He further observed that in the event such a ruling is handed
down, the Districts would, in hi_s opinion, be eligible for their pro rata
share of the maximum to ta_x levy under Proposition 13. An opinion which
will enable the Directors to determine the. appropriate means of funding
1978-79 budgetary requirements is expected in time for the July 19th hearing.
The Boards and staff then entered into a general discussion of the proposed
flat rate assessment alterna-tive; . Although the annual cost for the average,
homeowner would be reduced under the flat rate method, those properties
with a relatively low valuation would experience an increase over what had
been paid in the past year. Further, as was pointed out when the available
alternative funding methods were originally considered, there are certain
inequities in the proposed flat rate assessment, particularly with respect..
to multiple dwelling parcels and some cotmrc.;rcial px•opert.ies. However,
because of the time cont:raints imposed by the County in order to place the
flat rate charge on the tax bill and the limited information available
from the County Assessor's files on these types of properties, there is
insufficient ti.nu; to develop a fully equitable system for 1978-79. This

problem would exist for one year only and would be corrected in subsequent
years. The General Counsel also ruled that based upon the expected legal
opinion from the County Counsels office, any proposed alternative variable
rate system based upon the valuation of the property would be illegal
outside of the allowable 1% county tax. Industrial and large commercial
dischargers presently pay a charge based upon their actual use pursuant
to the Districts' uniform industrial waste ordinance.
The proposed flat rate assessment amounts were originally calculated to
fund $17.2 million in capital and operating requirements. However, if
the Districts proceed with the flat rate and receive a pro rata share of
the 1% maximum tax levy of approximately $7 million, the proposed flat
rates could be reduced approximately 40% by the Boards. The staff also
reported that a recommendation would be submitted to revise the proposed
flat rate system at the hearing on July 19th to provide for a reduced rate
or full refund for properties that are not connected to the sewer or are
unsewerable.

counsel to assist the District's in opposing said appeals.

payable in seven equal annual installments commencing one year following
annexation with interest at 6% per annum; and defferal of acreage fees on
1,823 acres of open space until service is required for said acreage at
which time annexation acreage fees would be due and payable at the fee in
effect at the time service is provided. Mr. Colgan requested that the
Boards act as soon as possible.
The General Counsel and staff reported that the proponents had submitted
an agreement outlining the proposed terms and conditions of the annexation
and expressed several concerns regarding the draft agreement. Because
information submitted to date regarding the proposed annexation is limited,
it was recommended that the staff be directed to prepare a report for
consideration by the Board at a future meeting and that the developer be
required to deposit. $2,000 to cover the cost of preparing said report. The
General Manager cautioned the Board that the impact of annexing large areas
presently outside the District on the Joint Districts application for waiver d
of secondary treatment -requirements was unknown at this time, pending
Environmental Protection Agency clarification of the issue which must be
addressed pursuant to recent legislation enabling said waivers. I-ie suggested
that any Board action or declaration of intent regarding the annexation be
subject to the regulations and/or conditions of the waiver.

The Board then entered into a general discussion regarding the proposed
annexation and observed that although the urgency expressed by the annexa-
tion proponent was understood, other pressing matters of District business
would preclude initiation of formal annexation proceedings pending a full
report and satisfaction of stipulated conditions.
It was then moved, seconded and duly carried:
That proposed Annexation No. 35 - Bryant Ranch Annexation to County
Sanitation District No. 2, be, and is hereby, tentatively approved in
concept subject to the following conditions: -
a. Preparation of a favorable staff report regarding said
proposed annexation, for consideration by the Board
b. Deposit in the amount of $2,000 for preparation of said 71
