ALL DISTRICTS Joint Chairman Saltarelli reported that Report of Joint - Pentech/Houdaille had appealed the Boards' c: Chairman recent decision to award the contract for Divisional - Oxygen Storage and Generation Facilities and Division 2 - Dissolution Facilities for 75 MGD Improved r Treatment' at Plant No. 2, Job No. P2-23-2, to Catalytic, Inc. the second low x bidder and reject the bid of Pentech/Houdaille. The Environmental Protection Agency will receive written comments relative to the appeal until October 18, 1977, and render an opinion shortly thereafter. c a i f he Executive omm' r Chairman Saltarelli then called meeting o tCommittee fo Wednesday, October 26, 1977, at 5:30 P.M., and invited Directors Cooper and Culver to attend and participate in the discussion: ALL DISTRICTS The General Manager reported that congres- Re ort of General sional conferees were attempting to resolve P mP g Manager the respective versions of the House and . Senate bills to amend the Federal Water Pollution Control Act (PL 92-500) . The key issues under discussion are secondary treatment requirements for ocean dischargers and allowance of ad . . f valorem taxes for use charges. AMSA is monitoring the committee deliberations and keeping our staff apprised of the progress. t Mr. Harper also reported on his attendance at the recent concurrent meeting of the Water Pollution Control Federation and the Association of Metropolitan Sewerage Agencies held in Philadelphia. Three technical papers were presented by the Districts' staff at the conference which had a record-breaking registration. The annual conference will be held in Anaheim next year. ALL DISTRICTS The General Counsel reported on recent Report of General problems which the Districts have encountered Counsel relative to relocation of District facilities t in the public right-of-way due to the con- € struction of other public works improvements in the area. The issue is basically a matter of both legal and contractual responsibility for payment a of the cost of relocation of utilities in public streets required during the construction of other public works. The problem has most recently arisen in District No. 7; however, Mr. Woodruff stated that he wished to bring the matter to the attention of the Joint Boards inasmuch as other Districts could Y possibly be affected in the future. He advised the Boards that there is a F difference in legal opinions between the General Counsel and the County Counsel with regard to the present controversy in District No. 7 and stated -' that the District 7 Board of Directors would be requested to take a position on the matter. a P . The Act, which will bring the unemployment compensa- tion insurance into effect for all public employees, will result' in consid- r erable expense to governmental agencies. Mr. Woodruff recommended that the Boards authorize participation. in the.,legal action in order to gain the advantage of protective orders which. will most certainly be issued by the courts. He advised the Boards that the Districts could participate at no cost due to the fact that the county and cities encompassed by the Districts are also participating, and, therefore, no fees would be assessed to the Sanitation Districts. Certified copy of this resolution is attached hereto and madea part of these minutes. -7- 10/12/77 ALL DISTRICTS The Chief Engineer reported on the JPL-ACTS Report on JPL-ACTS Pilot Unit testing and evaluation results Process and presented a slide presentation on the process. The final report- is under prepara- tion and will be filed with the Environmental Protection Agency and, the State Water Resources Control Board. He reported that the process has proved to be effective with the exception of. B.O.D. removal, and appears extremely success- ful in removing heavy metals from the waste stream. and .reducing the volume of . residual sludge. ALI. DISTRICT 7 Moved, seconded, and duly carried: Authorizing staff to install. replacement pumps That the staff be authorized to install at MacArthur Pump Station replacement pumps at MacArthur Pump Station with District personnel on a force account basis for an amount not to exceed $9,200.00. i -10- 10/12/77 DISTRICT 7 The General Counsel reported on recent Policy re cost of discussions with representativesof the relocation of facilities Orange County Environmental Management in connection with other Agency (EMA) pertaining to both legal and public works improvements contractual responsibility for payment of the cost of relocation of utilities required during the course of County road and drainage project construction. He noted the disagreement in legal opinions between his office and the County Counsel pertaining to the obligation of the Sanitation Districts in the event a sewer line is required to be relocated and also pointed out that with respect to a particular project that is currently under way (Hewes Street Reconstruction) , that the District and EMA had agreed on four of five items of responsibility for cost. Our staff recommended that the District not be responsible for the payment of charges to relocate sewer lines that are currently being maintained by the Seventh or Seventieth Sewer Maintenance District. After discussions, the Directors upon motion duly made and seconded, unanimously adopted the following policy: That the District will be responsible for the cost of relocation of any of its sewer lines and appurtenances when it is required to do so pursuant to the provisions of a permit previously issued by the County of Orange or any City. In all other instances, the District will not absorb the cost of -relocating its lines if they have been installed previous -to the facilities that are being changed by the County or City. This policy will apply to those lines that are installed and owned by either the District or the Seventh (7th) or Seventieth (70th) Sewer Maintenance District. DISTRICT S The staff reported that on September 21, Authorizing filing of 1977, the State Coastal Commission heard an application with Coastal appeal of the Regional Coastal Commission's Commission re new facili- permit approval for construction of the ties in Jamboree Road Brack Bay Drive Trunk Sewer and voted to sustain the appeal and deny issuance of the permit to the District for installation of said sewer. . The denial was based on the fact that the District had a viable alternative for conveyance of sewage from drainage area. Since the existing pump station is not capable of serving the area, the staff requested authority to file for a. permit from the Regional Coastal Commission for installation of a new pump station, or modification of the existing station, and a new gravity sewer. in Jamboree Road.
