Joint Chairman Saltarelli recognized Directors

Association of Sanitation Agencies in Monterey.
Chairman Saltarelli then called a meeting of the Executive Committee for
Wednesday,September 28th,at 5:30 p.m.,and invited Directors Clark and
Culver to attend and participate in the discussions.

ALL DISTRICTS The General Manager reported on his attendance
Report of General at the recent Association of Metropolitan
Manager Sewerage Agencies Conference in Hartford,
Connecticut.While at the conference,he
had the opportunity to have some meaningful discussions with Douglas Costal,
the new administrator of the Environmental Protection Agency (EPA).Mr.Harper
observed that under Mr.Costal,he felt there would he some positive changes
in EPA’s posture with regard to water pollution control matters.
Mr.Harper also reported on the status of the House and Senate bills to amend
PL 92-500,including the provisions for modifying secondary treatment require
ments for ocean dischargers and allowance for ad valorem tax for residential
users.He has been asked to appear before the House committee next week to
testify on the proposed amendments.
The General Manager noted that some Directors had been experiencing difficulty
receiving their agenda packages through the mail and announced that the
matter would be discussed with the Executive Committee at their next meeting
to determine if a change inthe mailing procedures might be desirable.

Facilities for 75 MGD Improved Treatment at Plant No.2,Job No.P2-23-2,to
Catalytic,Inc.,the second low bidder,and rejecting the low bid of Pentech
Division,1-loudaille Industries,Inc.,as nonresponsive.
Immediately after the bid opening on July 26th the low bid of Pentech/
Floudaille was analyzed by the Districts’engineers and determined to be non-
responsive in that their proposal did not comply with the plans and specifi
cations as prepared by the Districts and approved by the State Water Resources
Control Board and the-Environmental Protection Agency.Pentech/lloudaille has
proposed an entirely different system.Mr.Woodruff stated that,in his
opinion,their bid has major defects,both formal and technical.He advised
the Boards that because of federal funds involved in the project,any protest
would be subject to federal regulations and procedures and recommended that
Directors delay the proposed award of the contract and fix a time and place
to hear and consider the protest of Pentech/Houdaille.
Following a further review by the General Counsel with regard to the
protest and the procedures to be followed in hearing said protest,it was
moved,seconded,and duly carried:
That Thursday,September 22,1977,at 5:30 p.m.,in the Districts’adminis
trative office,be fixed as the time and place to hear the protest of Pentech
Division Houdaille Industries,Inc.regarding the proposed award of Division 1 -
Oxygen Generation and Storage Facilities and Division 2 -Oxygen Dissolution
Facilities for 75 MGD Improved Treatment at Plant No.2,Job No.P2-23-2,to
Catalytic,Inc.,the second low bidder,in the amount of $8,273,000.00;and,

The Board then entered into a brief discussion concerning available alternative

consider their position regarding payment of the debt.
