ALL DISTRICTS Chairman Winn reported briefly on his ' Report of Joint attendance at the recent concurrent Chairman legislative meetings of the Water Pollu- tion Control Federation (WPCF) and the Association of Metropolitan Sewerage Agencies (AMSA) in Washington D.C. The proposed amendments to the Federal Water Pollution Control Act are essentially being blocked by Senator Muskie and his senior staff member Leon Billings. The message from the Senate is "money (funding appropria- tions) now and changes in the Act later." The AMSA group had the opportunity to meet with Barbara Blum, the new Environmental Protection Agency Assistant Administrator, who appears to be receptive to input from locally elected officials. Following an announcement of the California Association of Sanitation Agencies Executive Committee meeting in San Diego in mid-May, the Joint Chairman called an Executive Committee meeting for April 27, 1977, at 5:30 p.m. and invited Directors Shenkman'and Svalstad to attend and participate. ALL DISTRICTS The General Manager reported that Report of the representatives of the Environmental General Manager Protection Agency (EPA) had visited the Districts' facilities during the past few days with a delegation of Russian officials and commented briefly on their visit. Mr. Harper reported further on the AMSA meeting with Barbara Blum, Assistant EPA Administrator. The new administration appears concerned about cost effectiveness in their programs and AMSA took the opportunity to reiterate their proposed amendments to PL.92-500 as cost saving proposals. The Association also emphatically urged EPA to adopt a national sludge policy. Number of voters in the territory has been determined to be 27. gg , Y C I fI > � -8- F I i 4/13/77 In the event annexation fails, the Board of Directors on April 14, 1976, declared their intent to levy a sewer service charge in the amount of $10 per residential unit per month. On April 14, 1976, the Board of Directors took the following actions: Adopted Resolution No. 76-71-2, declaring a special exception for Tract No. 7350 and waived District connec- tion fees therefor; Adopted Resolution No. 76-72-2, authorizing initiation of proceedings to annex the territory and setting fees therefor at one-half the established amount, pursuant to the declaration of a special exception for said annexation; Declared intent to levy a sewer service charge in the amount of $10 per unit per month if annexation is not completed. On August 11, 1976, the Local Agency Formation Commission adopted Resolution No. 76-117, declaring its findings regarding the proposed annexation, approving said annexation, and directing County Sanitation District No. 2 to proceed with the annexation. On. February 9, 1977, the Board of Directors adopted Resolution No. 77-31-2, fixing April 13, 1977, at 7:30 p.m. as the date and time of hearing on proposed Annexation No. 13 - Tract No. 7350, and establishing procedures for filing of written protests. Notice of the hearing has been posted in the Districts' office. On March 9, documents were mailed to owners of record within the territory proposed to be annexed, affected cities and special districts, District No. 2 Directors, and other interested parties, containing the following information: A letter of explanation A brochure explaining the District's function An Official Notice of the Public Hearing Maps indicating the area to be annexed and Copy of the resolution fixing the hearing Legal notice of the hearing was published in the Santa Ana Register on March 16 and 23, 1977. To date no written protests have been filed with the Secretary." The firm has considerable expertise in coastal environmental ' ` matters. ! { -10- YI' ! 4/13/77 After a brief discussion it was moved, seconded, and-,duly carried: That the firm of Ball, Hunt, Hart, Brown and Baerwitz be engaged as special consultant relative to defense of Appeals from Permit Decision and Vested Right Decision of Regional Coastal Commission in Connection with permit for construction of the Back Bay Trunk Sewer, on a per diem fee basis, for a maximum fee .not to exceed $10,000.00. The District Chairman stated for the record that the fee amounted to approximately one-third of the additional annual energy costs that would be incurred if the alternative to the facility approved by the permit is required. Pipe and pipe re Contract .5-20A Foundry Company, the pipe supplier for Contract 5-20A, agreed to extend the contract until April 15, 1977, pending outcome of the Districts' application for a Coastal Commission permit to construct the Back Bay Drive Trunk Sewer. If the contract is cancelled by the District a 15% penalty would be imposed. It was the staff's recommendation that, prior to the April 15 deadline, the pipe be ordered delivered to Plant No. 1 for storage, pending outcome of, the coastal permit appeal. In the event the permit to construct is subsequently denied, the District could sell the pipe on the open market.
