MINUTES OF ADJOURNED REGULAR MEETING
December 11,1975 —5:00 p.m

Fountain Valley,California
Pursuant to adjournment of the regular meeting held December 10,1975,
the Boards of Directors of County Sanitation District No.5 of Orange County,
California,met in an adjourned regular meeting at the above hour and date,
at the Newport Beach City Hall.
The Chairman called the meeting to order at 5:00 p.m.Following the
Pledge of Allegiance and invocation,the roll was called,and the Secretary
reported a quorum present.
ROLL CALL
DIRECTORS PRESENT:Don Mclnnis (Chairman),Thomas Riley,
and Howard Rogers
DIRECTORS ABSENT:None
STAFF MEMBERS PRESENT:Fred A.Harper,General Manager,
J.Wayne Sylvester,Secretary,and
Ray Lewis
OTHERS PRESENT:Thomas L.Woodruff,General Counsel,
Don Simpson,and Gordon Jones
Directing staff to proceed Following a brief report on the District’s
with measures to increase long-range master plan construction
connection fees program,the staff reviewed the District’s
projected five-year cash flow in detail.
Increased capital and operational costs resulting from requirements of the
Federal Water Pollution Control Act,and the impact of inflationary trends
coupled with certain financing restrictions,will require permanent changes
in the District’s revenue measures to provide necessary funds to meet the
increasing costs of the District.The staff outlined restrictions on the
tax rate and possible relief based upon State and Federal mandate provisions
of the law,and pending amendments to the Federal Water Pollution Control
Act regarding the use of ad valorem taxes for financing maintenance and
operation costs and capital recovery.Also discussed were sources of
revenue other than taxes,such as connection fees,loans in aid of con
struction,general obligation bonds,and user charges.
It was then moved,seconded,and duly carried:
That the staff be directed to proceed with necessary measures to increase
the connection fee provisions of District’s ordinances for family dwelling
units from $175 to $250 and from $90 per thousand square feet to $130 per
thousand square feet for other than family dwelling connections.

Declaring intent to enter into
agreement with Irvine Company
re construction and acquisition
of Back Bay Drive Trunk Sewer
(East Side)
Following a report by Chairman Mclnnis
regarding discussions with the Irvine
Company in connection with construction
of the Back Bay Drive Trunk Sewer (East
Side),it was moved,seconded and duly
carried:
That the Board of Directors declare its intent to enter into an agree
ment with The Irvine Company for construction and acquisition of the
Back Bay Trunk Drive T±unk Sewer (East Side)in the amount of $600,000
for a term of six years with interest at 4½%on the unpaid balance.
Gordon Jones,representing The Irvine Company,indicated their firm’s
concurrence with the terms and conditions of said loan.
Waiving NIWA audit Moved,seconded,and duly carried:
for 1974-75
That the letter from Alexander Bowie’s
office dated December 1,1975,regarding waiver of 1974-75 audit for
Newport-Irvine Waste-Management Planning Agency (NIWA)be received and
ordered filed;and,
FURTHER MOVED:That the Board of Directors of County Sanitation District
No..5 hereby waives audit of the Newport-Irvine Waste-Management Planning
Agency (NIWA)for the 1974-75 fiscal year.

That the Board of Directors adopt
Resolution No.75-170-5,approving the First Amended Joint.Exercise of
Powers Agreement Creating Newport-Irvine Waste-Management Planning
Agency (NIWA).Certified copy of this resolution is attached hereto
and made a part Of these minutes.
