ALL DISTRICTS The Joint Chairman reported that members Report of the of the Executive Committee would be Joint Chairman meeting on November 25 with representatives of the Regional Environmental Protection Agency (EPA)and the State Water Resources Control Board (SWRCB)to review the current status,of the preparation of the Districts Facilities Plan and Environmental Impact Statement for improved treatment at which time some alternate plans presented by the staff will be explored.The Committee’s major concern is that $62.5 million in grant funds which are earmarked for our Districts for advanced treatment are not lost because of delays which could result from our efforts to prove out the JPL-ACTS system. The Joint Chairman then called an Executive Committee meeting for Tuesday,November 25,1975,at 10:30 a.m.to meet with EPA and SWRCB officials. 3- 11/12/75 The General Counsel reported briefly on the pending Orange Park Acres area concurrent annexation and bond authori zation matter in District No.7;and on negotiations with the City of Los Alaniitos regarding costs incurred by the City for engineering reviews and inspection in connection with construction of Contract No.3-21-1 in District No.3. ALL DISTRICTS In connection with consideration of a Discussion regarding proposal for engineering services on a procedures for en~in~j~~s project at Treatment Plant No.2,the for prcf~zicn~.l ~‘ice~-Board entered into a discussion regarding procedures for soliciting proposals for professional services such as engineering and architectural work. Following a brief staff report on the matter and further discussion by the Directors,the General Manager advised the Directors that the staff would report back to the Boards on the matter at a meeting in the near future. Director Svalstad requested that his objection to the percent of the engineering fee be made a matter of record. County Judicial District. hereto and made a part of .-..---.--~-.—---.—--~-----,‘—...-~—--.-.-—.---—--.-.——---.5, ALL DISTRICTS The General Manager reported that a Rejecting all bids for Sale letter dated November 11,1975,had of Digested Sewage Sludge been received from Golden West Fertilizer Specification No.5-016 Company regarding their misinterpretation of the bid documents for Sale of Digested Sewage Sludge,Specification No.S-016.In view of the questions raised by Golden West Fertilizer Company,Mr.Harper recommended that all bids be rejected and that the sale be rebid following clarification of the bid documents for the items in question. It was then moved,seconded,and duly carried:That all bids received on Sale of Digested Sewage Sludge,Specification No.S-0l6,be rejected; and, FURTHER MOVED:That the staff be authorized to advertise for rabid for Sale of Digested Sewage Sludge,Specification No.S-016. ALL DISTRICTS The General Manager reported on meetings Discussion regarding to date between the Environmental “208”planning Protection Agency (EPA),the State Water Resources Cont±ol Board (SWRCB),the major sewerage agencies in Southern California,and the Southern California Association of Goverrutents (SCAG),regarding designation of a “Section 208” areawide planning agency for the Southern California area pursuant to provisions of the 1972 Amendments to the Federal Water Pollution Control Act.Mr.Harper then reviewed a memorandum outlining four alternatives under consideration as follows:- •(1)That the Southern California Association of Governments (SCAG)be designated as the planning agency •(2).A Joint Powers arrangement involving the City of Los Angeles,Los Angeles County Sanitation Districts,Orange County Sanitation Districts,the Counties of Los Angeles, Orange,Riverside,San Bernardino,and possibly Ventura, the Metropolitan Water District,.Santa Ana Watershed Project Authority,etc.,with each entity accepting the responsibility of doing the planning within -their expertise (3)Four separate planning agencies involving a Joint Powers arrangement in each of the counties,bringiitg the~ disciplines together (4)A proposal currently being explored by the State Water Resources Control Board with EPA for the designation of SCAG,which would assembly existing land-use plans and obtain from utility agencies the best service plans to satisfy existing land-use plans.SCAG would prepare an Environmental Impact Statement based on existing plans and determine the costs necessary to meet environmental -i -7- 11/12/75 -~ standards.For each alternate land-use plan to meet EPA and State environmental standards,SCAG would prepare the alternate land-use plans and the utility agencies would provide SCAG with.the utility plans to serve the alternate land-use plan areas.SCAC would then develop a recommended 208 plan which includes all the disciplines.This recommended 208 plan would then be passed to the utility agencies for certification by their governing bodies that the wastewater management portion of the plan fortheir service areas is approved by the governing body of each local agency prior to submittal to the SCAG executive body for approval and submittal to the State and EPA. EPA has inferred that they would prefer SCAG being designatedl as the planning agency.However,considerable concern has been expressed by others because SCAG is only~a planning agency without implementation powers. The staff recommended that the Boards direct the staff to work with EPA, the State,SCAG,the counties and other local entities in the development of an areawide “208”plan in accordance with Alternate (4),whereby SCAG would be designated as the lead agency with a provision that the waste- water management portions of any plan be approved by the governing bodies of the local agencies prior to SCAG approval and submittal to State and Federal authorities. The Board then entered int’o a lengthy discussion concerning the alternates and the relative advantages and disadvantages of each.,the propriety of SCAG participation i~th~~astcw~tcr ~gc~cnt ~!anning effort)ard • direction to the staff regarding testimony on the proposals at a hearing on the matter scheduled for November 17th. A motion was then introduced and seconded to informally poll the Directors regarding their posture on the several alternatives. After further discussion,a substitute motion was offered and seconded that Alternate (4)be endorsed,substituting the term “sub-regional agency”wherever “SCAG”appears. Following a roll call vote on the substitute motion,the General Counsel reported that said motion had failed to pass by virtue of one District voting in favor of the motion,three Districts voting against the motion and three Districts failing to cast a ballot by virtue of a tie vote. A vote was then taken ~on the original motion to informally poll the Directors regarding their posture on the several alternatives.The Joint Chairman announced that the motion had passed,and following the informal poll indicated that the staff’s general direction was that the Boards preferred Alternate (3). ALL DISTRICTS The General Manager reported that Staff report re SWRCB pursuant to the discussion of the comments on ordinance Boards at the ordinance hearing on October 29,1975,the staff had sent a letter to the State Water Resources Control Board clarifying the position of the Districts on the points raised by the State in their letter of October 24,regarding certain provisions of the ordinance. The State contacted us and advised that although they cannot give tacit approval of certain provisions in the ordinance,i.e.ad valorem taxes, all in all they consider it the best regulation they have seen to date and urged adoption by the Districts in order that the source control program could begin.
