The Chairman called the meeting to order at 7:30 p.m.Following the Pledge of Allegiance and invocation,the roll was called,and the Secretary pro tern reported a quorum present. Excerpt re Board Moved,seconded,and duly carried: Appointment That the minute excerpt from the City of Orange,dated August 20,1975,appointing Councilman Jess Perez as the City’s alternate representative on the Board of Directors of County Sanitation District No.7 for the adjourned meeting of.August 20,1975, be received and ordered filed. •1 ~:~ 8/20/75 ~pprovingproceedings for The Chair recognized Peggy McElligott, concurrent annexation and attorney for the Orange Park Association, bond authorization of the proponents for concurrent annexation and Orange Park Acres Area bond authorization of the Orange Park Acres Area,who reviewed in detail the proposal and the steps required to proceed with said proposal. The Board then entered into a lengthy discussion of the impact of the proposal on future annexations and the economic impact on the District and annexible territory surrounding the area contained in the proposal,with particular consideration to the sphere of influence of the City of Orange, and the wishes of the property owners within said territory proposed to be annexed. The following motion was then moved and seconded: That the Board of Directors declares its intent to initiate necessary proceedings to annex the area described in the Orange Park Associa tion’s proposal for concurrent annexation and bond authorization of the Orange Park Acres Area,subject to approval of said proposal by the electorate of the area;and, That the proposal of Boyle Engineering,dated August 1,1975,for preparation of engineering report and environmental impact report including economic impact analysis for consideration by the District and the Local Agency Formation Commission,be received,filed and accepted for a total fee not to exceed $7,245;and, That the General Manager be authorized to retain the services of special legal counsel for the purpose of preparing necessary docu ments and procedures for the proposed concurrent annexation and bond authorization proceedings;and, FURTHER MOVED:That the proponents be required to pay any and all costs incurred in connection with said proceedings;and further, that all proceedings be subject to an.advance deposit by the proponents in the amount of $5,000 to cover expenses through a determination by the Local Agency Formation Commission;and,if said proceedings are approved by the Local Agency Formation Commission,the proponents be required to deposit an additional $10,000 in cash before any further costs are incurred to complete the proceedings. During the discussion that followed concerning the proposal and the motion thereon,Director Perez,representing the City of Orange,requested that the following statement be read into the record: —2— I i I ~~i:~i I ______ iiii~1itfi ~ 8/20/75 “The City of Orange has no objection to the conducting of a study concerning the establishment of sewers in that area comprising approximately 556 acres known as the Orange Park Acres area which study would involve no expense to the City of Orange. Neither does the City of Orange even oppose the construction of sewers in the subject area to serve the residents thereof to be paid for solely by the residents of Orange Park Acres provided the following concerns of the City are satisfied: 1.The Orange Park Acres Association does not request connection to any City-owned sewers in the subject area unless the property owner or owners requesting connection effect annexation to the City of Orange. 2.Subject to proper legal acquisition of necessary easements for such purposes,neither the property .owners not the Orange Park Acres Association will object to any future placement of City sewer lines through the subject area in order for the City of Orange to serve areas north,east,west and south of Orange Park Acres. 3.That property owners and the Orange Park Acres Association express their intention to provide sewer services only to the subject area surrounded by the City of Orange city limits on the west, north,and east and Chapman Avcnue on the zouth, comprising approximately 556 acres and more •particularly set forth on a map to be placed on file with the Sanitation District with a copy of said map to be supplied to the City of Orange. Because the intention of the Association is to serve •the area known as Orange Park Acres comprising approximately 556 acres,the Association and resi dents therein should commit themselves,not only to refrain from attempting to annex new territory to this sewer assessment district,but should commit themselves to assist the City of Orange in promoting annexation to the City of the area south of Chapman •Avenue as well as all other areas within the sphere •of influence. 4.Neither the Board of Supervisors,the Sanitation District,the Local Agency Formation’Commission nor any other public entity shall utilize the conduct S / -3- of the Orange Park Acres sewer study nor the proceedings for the formation of any assessment district in the Orange Park Acres area comprising approximately 556 acres as a reason to delay or hinder future annexations by the City of Orange of territory within the approved area sphere of influence of that City. In summary,gentlemen,the City of Orange does not object to persons forming districts to serve their own needs for sewers. However,such legitimate desire of the residents of the Orange Park Acres area should never be used as an excuse to hinder or delay the annexation and development of land to the north,east, west and south of said area which is within the sphere of influence of the City of Orange as approved by the Local Agency Formation Commission. Of course,we of the City of Orange are certain that the residents of Orange Park Acres have no such desire to impede the annexation of territory to the City of Orange and the future development of such territory in accordance with the Webb Plan which plan these very same Orange Park Acres residents participated in creating. Therefore,we assume that these Orange Park residents will have no hesitancy in affirming their intention to serve only the 556 acres involved in the present sewer study proposal.” After further discussion,the question was called for and following a roll call vote the General Counsel advised that the motion had carried by virtue of four .Directors -voting in f3vor thereof,and three Directors voting against said motion. Adjournment Moved,seconded,and duly carried: That this meeting of the Board of Directors of County Sanitation District No.7 be adjourned.The Chairman then declared the meeting so adjourned at 8:51 p.m.,August 20,1975.
