The Joint Chairman called on Report of the Directors Smith and Davis who Joint Chairman respectively reported on their attendance at the mid—year conference of the California Association of Sanitation Agencies in San Diego February 2nd and 3rd,and an informal meeting of Federal and State officials held in Los Angeles In conjunction with the workshop sponsored by the Water Pollution Control Federation on the 1972 Federal Water Pollution Control Act Amendments.The meetings were well attended by representatives of Federal-, State and local agencies and directors felt they were exceptionally informative and helpful. Chairman Finnell stated that as a result of the General Manager’s, work in organizing the Water Pollution Control Act workshop he had been requested to participate in a similar workshop in Hawaii during the early part of March.Following a brief discussion, it was then moved,seconded and duly carried: That the General Manager be authorized to attend and participate in a workshop on the 1972 Federal Water Pollution Control Act Amendments to be held in Hawaii the week of March 5th,and that •reimbursement for travel,meals,lodging and incidental expenses be approved. Mr.Finnell then called a meeting of the Executive Committee for 5:30 p.m.,Feb.27th and invited Directors Winn and Nevil to attend and participate in trie discussions. . - ALL DISTRICTS The-General Manager reported on the Report of the workshop conducted by the Water -General Manager Pollution Control Federation on the 1972 Federal Water Pollution Control •Act Amendments held February 8th in Los Angeles.The regional •workshop was sponsored by the Arizona,California,Hawaii,and Nevada Water Pollution Control Associations.Representatives of the Federal,State and local agencies and the private sector participated in the program which reviewed provisions,and the - implementation,of the new federal act. An official of the Environmental Protection Agency (EPA)stated that EPA was scheduled to publish a definition of secondary -treatment on February 9th in the Federal Register.However,in discussions with EPA representatives,it appears as if require— ments for ocean dischargers will be set aside until the matter •of priorities are resolved.Apparently the ocean dischargers,.,’ will have to work through the public works committees of the Senate and House in order to clarify the intent of the new •-legislation with regard to the requirement of secondary treatment. —3— 2/l~/73 Mr.Harper then briefly reviewed an EPA memorandum from the Office of the Assistant Administrator for Enforcement and General Counsel with regard to the definition of secondary treatment for ocean outfal1s,~which in essence literally interprets the new act as requiring secondary treatment for all dischargers in the country. EPA is presently conducting a new needs survey to determine the construction requirements for water quality control facilities throughout the nation.Updated projections of the Districts’previously estimated $105 million plant construction program for full secondary treatment facilities during the next five years indicate that project costs will be increased by approximately 20%to reflect the most recent engineering estimates. Once the needs survey is completed and EPA has the new construction est1mates~,:the~full economic impact of the new act will be quite apparent~. ALL DISTRICTS The General Counsel reported that Report of the the court had awarded a judgement. General Counsel in favor of deceased employee •Norman Tremblay in connection with a suit for ã~ccrued compensatory time brought against the Districts his estate. Mr.Nisson summarized the activities of the CASA Attorney’s Committee at the mid—year conference,of the California Association •of Sanitation Agencies held the first week in February.He briefly reviewed SB 889,.which is a bill to clarify the Environmental Quality Act and specifically addresses itself to the subject of environmental impact reports;and SB 90,the tax reform bill passed by the legislature at the close of the last year’s session, which seriously restricts the taxing authorIty of local agencies. • There is a provision in SB 90 which requires the State to reimburse local agencies for additional costs incurred as a result of State mandated programs.Under this section the local agency must submit claims to the State within k5 days after the effective date of the mandated program.It appears that if the State Water Resources Control Board sets standards for the Districts which will require an additional expenditure of funds,the Disricts may be eligible for reimbursement under this provision of ‘~he bill. However,in the final analysis the matter may have ~o be adjudicated in the courts.It is apparent that ad~tional legislation will be introduced this year in an attempt to clarify certain provisions of SB 90. The General Counsel also briefly discussed sections of the Federal Water Pollution Control Act which provide that the Governor Identify areas within the state which have substantial water quality problems and that he designate area—wide waste treatment management agencies for such areas.A de;ermInation • of these areas has not yet been made by the.Governor of California. However,he stated his concern over spiraling salaries of public administrators and respectfully requested that the Boards of Directors reconsider their action and rescind the salary increase granted him as General Manager. The Board then entered Into a lengthy discussion concerning Route B which had originally been recommended by the engineers, but reconsidered by the Board at the request of the City of Westminster.Several Directors expressed their concern over possible further delays of the urgently needed facility and that inasmuch as attempts to work out a realignment of the interceptor through the City of Westminster had proven unsuccessful,that Route B be adopted as the best and most economical alignment.
