HomeMy WebLinkAboutMinutes 1972-02-19DISTRICT NO.7 MINUTES OF THE ADJOURNED REGULAR MEETING February 29,1972 —5:00 p.m l08l~14 Ellis Avenue Fountain Valley,California Pursuant to adjournment of the regular meeting held February 9,1972,the Board of Directors of County Sanitation District No.7,of Orange County,California,met in an adjourned regular meeting at the above hour and date,in the District offi,ces. The Chairman called the meeting to order at 5:00 p.m. The roll was called and the Secretary reported a quorum present. DIRECTORS PRESENT:Clifton C.Miller (Chairman), Ralph Clark,Henry Quigley, Lorin Griset,Ellis Porter, Howard Rogers and Don E.Smith DIRECTORS ABSENT:None STAFF MEMBERS PRESENT:F~’ed A.Harper,General Manager, Paul G.Brown,Assistant General Manager,J.Wayne Sylvester, Secretary and Ray E.Lewis OTHERS PRESENT:Conrad Hohener,C.Arthur Nisson, Joe Muroney and Fredrick R.Bates Statement of policy re The Districts’Deputy Chief Engineer sewerage service for reported on a meeting which had been Orange Park Acres area held between the Planning Department, Flood Control District,Road Department, Health Department,and Building Department,of the County of Orange,and County Sanitation District No.7,in connection with the Orange Park Acres Community Plan being developed by the County Planning Department.The Department has requested a state ment of policy from the District regarding future sanitary sewer service for areas outside the District In the vicinity of Orange Park Acres. The Board entered into a lengthy discussion of various proposals under consideration in connection with sanitary service for the area In Orange Park Acres.The Board reiterated its previously stated concern that development of areas presently outside the District’s boundaries not exceed the land use densities incor porated into the District’s Master Plan.Following the discussion it was moved,seconded and duly carried: That this Board of Directors re—affirms its policy of providing sewerage ‘service for areas presently outside the District’s boundaries,subject to said areas annexing to County Sanitation District No.7 in accordance with the provisions of the DIstrIct’s established annexation policy as set forth in Resolution No.68—88—7. and,provided,that the development of the area so annexed conforms to the land use densities contemplated in the District’s 1969 Master Plan of Trunk Sewers;and, FURTHER MOVED:That the staff continue to assist the Orange County Planning Department with its development of the Orange Park Acres Community Plan. 2/29/72 #7 Receive,file and Director Smith advised the Board refer to staff that the City of Orange is proposingletterfromCityoftoconstructseweragefacilities Orange re proposed 1~the Orange Park Acres area to sewerage facilities serve properties within their city.to serve Orange Park He requested consideration of a Acres area letter dated February .15,1972, from their Director of Public Works soliciting comments as to.whether this proposed facility would eventually be included under the District’s jurisdiction as a master plan sewer when the area is annexed to District No.7 It was moved,seconded and duly carried: That the letter from the City of Orange,dated February 15, 1972,regarding proposed sewerage facilities to serve portions of the Orange Park Acres area within the City of Orange be received and ordered filed. FURTHER MOVED:That the matter be referred to the staff and District’s engineers for study and report back to the Board. Denial of request The Chair recognized Mr.Fredrick to waive increased R.Bates,171 Rainbow Drive,Santa connection fees for Ana,Californ~~a,who stated he was p~perty owners of a concerned property owner that had record on September not received due notice of the ~,1970 Board’s action adopting Ordinance No.712,escalating connection fees effective January 1,1971.Mr.Bates requested that the Board authorize provisions in the ordinance to allow property owners of record on September 1,1970,a period of 30 days )(2)to obtain a connection permit at the fee in effect prior to January 1,1971,and that said property owners be so notified by direct mail. The staff reviewed the efforts of the District to notify the public of the increase,as outlined in the memorandum dated November 6,1970.The General Counsel pointed out that the District had done more than legally required in an attempt to advise the public of the fee increase.He also observed that it would not be practical to notify all of the property owners in the District by direct mail. Following further discussion it was moved,seconded and duly carried: That the request of Mr.Fredrick R.Bates to allow property owners of record on September 1,1970,a 30—day period in which to obtain connection permits under the fee schedule in effect prior to January 1,1971,be denied. Denial of request of It was moved,seconded and duly carried: C.L.Clair for reduction of connection charges That the letter from C.L.Clair,dated February 17,1972,requesting that connection charges be reduced for his property at 18825—18829 Center Street,Orange (Lot 21,Block A.C.M.Frasiers Addition), be received and ordered filed;and that said request be denied. 0 —2— 2/29/72 #7 Adopting Ordinance 7lL~The General~Counsel reviewed the Amending Connection and proposed Ordinance No.7lL~, Use Ordinance providing for an increase in connection fees for multiple dwelling units from $150 to $250 per unit effective April 1,1972.In this regard,Mr.Nisson recommended that motels and hotels be excluded from the definition of multiple dwelling units,and considered as commercial or industrial establishments.During the discussion that followed the relationship between connection fees and additional charges for use in excess of that defined as reasonable were explained.It was pointed out that establishments which generate flows In excess of reasonable use are also subject to other charges under the Uniform Connection and Use Ordinance. It was then moved,seconded and duly carried by the following roll call vote: AYES:Directors Clifton Miller (Chairman), LQrin Griset,~Ra].ph Clark,Henry Quigley,Ellis Porter,Howard Rogers and Don E.Smith NOES:None ABSENT:None That the Board of Directors adopt Ordinance No.7111,amending Ordinance No.712 and repealing Ordinance No.713,establishing Increased sewer connection charges for multiple dwelling units. Certified copy of this ordinance is attached hereto and made a part of these minutes. Adjournment Moved,seconded and duly carried: That this meeting of the Board of Directors of County Sanitation District No.7 be adjourned.
