HomeMy WebLinkAboutMinutes 1969-03-12 ADISTRICTS NOS.1 A~7 MINUTES OF TIlE ADJOURNED REGULAR HEETING March 12,1969 -7:00 p.m. 108414 Ellis Avenue —Fountain Valley,California Pursuant to adjournments of the regular meeting held February 13,1969,the Boards of Directors of County Sanitation Districts Nos.1 and 7,of Orange County,California,met in an adjourned regular meeting at the above hour and date. The Chairman called the meeting to order at 7:00 p.m.The roll was called and the Secretary reported a quorum present for each District’s Board. DISTRICT NO.1 Directors present:Thomas McMichael (Chairman), Clifton C.Miller,Ellis N. Porter,and Wm.Hirstein Directors absent:None DISTRICT NO.7 Directors present:Clifton C.Miller (Chairman), Thomas McMichael,Howard Rogers, Don E.Smith,Ellis N.Porter, and Wm.Hirstein Directors absent:None OTHERS PRESENT Paul G.Brown,Conrad Hohener, Jay Panchal,C.A.Nisson,Gordon Jones,and Fred A.Harper,Secretary **************** DISTRICTS 1 AND 7 The General Counsel advised the Consideration of Boards that the Engineer’s acquisition of right Report for District No.1,dated of way adjacent to the 1965,recommended a future trunk District No.1 Dyer sewer to lie in an easement Trunk Sewer parallel to the existing District No.1 trunk sewer along the Pacific Electric Railroad right of way between Main and Bristol Streets.Subsequent to the approval of the Engineer’s Report the General Counsel was instructed to take appro priate steps to acquire an additional 20-foot right of •way.Mr.Nisson reported that to date this right of way has not been acquired since this property is undeveloped and there was a possibility that the right of way would •be acquired for road purposes by the City of Santa Ana,in •which case the District would not have incurred any acquisi tion expense. Mr.Hohener of Boyle Engineering verbally reported that if Districts Nos.1 and 7 were to jointly construct the pro •posed sewer,he would recommend routing it along Sunflower Avenue.Mr.Hohener outlined the following construction costs 3-12-69 l&7 based on the particular alignments: District 1 District 7 Dyer Street Trunk $900,000 $4,728,000 Sunflower Avenue 1,420,000 3,952,000 Dyer Street Trunk 2,220,000 Sunflower Avenue 4,490,000 Following a lengthy discussion,the engineer was directed to submit a written report and recommendation and he was further instructed to discuss his findings and report with the Santa Aria Department of Public Works engineering staff. DISTRICT 7 The General Manager reported Request of The Irvine that this matter was placed on Company for withdrawal the agenda for this meeting in and annexation of order to provide the Directors territory the opportunity to ascertain whether any further information is required prior to making a determination on the request of The Irvine Company for withdrawal and annexation of terri tory to the District. Mr.Gordon Jones and Mr.Jay Panchal,representing The Irvine Company,were asked questions pertaining to the intent of the Company regarding the request to withdraw 1,015 acres from the District in exchange for annexation,without charge,of 80 acres bordering the District’s boundary along the Browning Avenue Subtrunk. The Chairman then requested that the General Counsel submit a written Legal Opinion regarding the Board’s authority to agree to a single-owner’s request to withdraw acreage from the District and simultaneously annex acreage to the District without payment of the usual and customary annexation fees. It was informally agreed that,if possible,a final decision on the request of The Irvine Company would be made at an adjourned Board meeting scheduled for March 25th.
