Pursuant to adjournments of the regular meeting held May 8,
1968,the Boards of Directors of County Sanitation Districts
Nos.1 and 7,of Orange County,California,met in an adjourned
regular meeting at the above hour and date.
The Chairman called the meeting to order at 4:00 p.m.The roll
was called and the Secretary reported a quoruni present for each
District’s Board.

DISTRICT 7 This being the time and place fixed
Public hearing re by the Boa±’d of Directors for the
Proposed Annexation public hearing on proposed Annexation
No.14 No.14 to County Sanitation District
No.7 (Newport Avenue Annexation),
the Chairman declared the hearing open and called upon the Gereral
Manager to review for the Directors arid interested parties in
the audience,the proposal to annex an inhabited area (37.3
acres)contiguous to the District’s boundary.
The General Manager read Resolution No.68-51 adopted by the
Local Agency Formation Commission of Orange County,dated
April 10,1968,which directed the Sanitation District to
Initiate proceedings for annexation of the territory in compliance
with the Commission’s resolution making determinations.The
Commission’s resolution also assigned to said territory the
short form designation “Newport Avenue Annexation No.14 to
County Sanitation District No.7.”

Written protests
The Chair recognized Mr.Carl
Carison of Boyle Engineering,who
described the area proposed to be
annexed and gave a detailed ex
planation as to the costs involved
in the installation of sewers by
Act of 1911.
The Secretary was then directed to
report on any written protests
filed against the proposed annexation.
The Secretary announced that one protest letter had been filed
by a property owner,Mr.John Gilbert and that fifteen protests
had been filed by resident voters.
The Secretary ~as directed to read aloud the written protest
letters.

DISTRICT 7 The Secretary was directed to read
Letter from Orange a letter dated May 23,1968,from
County Health Depart John R,Philip,M.D.,Orange County
rnent~received and Health Officer,recommending that

Avenue Annexation No,14 in the
interest of public health and sanitation for the residents of
the affected area.It was then moved,seconded and duly carried:
That said letter be received and ordered filed.

The Secretary advised the Board that notice of the public
hearing had been published in The Tustiri News for the time and
in the manner prescribed by law,and that notice of said hearing
had been mailed to all property owners of record in the area.

Following a lengthy discussion and

an explanation by the District’s
-staff,it was moved,seconded and

duly carried:That the public
hearing on proposed Annexation No,
14 to County Sanitation District No.7 be ciosed,and that a
recess be declared to allow time to determine the sufficiency
of the protests.
The Board was advised by the General Counsel that if less than
25~of the property owners protested,or less than 25%of the
registered voters within the proposed annexation protested,
the Board could order the territory annexed without any further
proceedings,
Mr.Nisson further advised that if either the property-owner

protests or registered voter protests exceeded 25%,the Board
would have two courses of action available,i.e.,
(a)Abandon the proceeding
(b)Call an election within the area to be.annexed

The General Counsel further advised that because of the June
14th general election the registered voter files were not readily
accessible;therefore the sufficiency of these protests could
not be immediately determined~Mr.Nisson recommended a 30
day continuance to allow sufficient time to verify the registered
voter protests.
Following a question concerning the right of the protestants
to withdraw their written protests,and a determination by the
District’s Counsel that the protestants may withdraw their pro
tests so long as the hearing remains open,it was moved,seconded
•and duly carried:That the Board of Directors rescind its
previous action closing the public hearing.
The Chair then announced that the matter of the public hearing
on Annexation No.l~4 to County Sanitation District No.7
(Newport Avenue Annexation)would be continued to 5:00 p.m.,
June 19,1968,in the District’s offices at i08~4~4 Ellis Avenue,
Fountain Valley,California.

Temporary Relief Measures for the
Gisler Red Hill Trunk,and verbal review of the report by the
engineers for District No.7,and discussion regarding the
temporary joint use by Districts 1 and 7 of the Dyer Street
Trunk owned by District No.1,be deferred to June 19,1968,
