The Chairman called the meeting to order at 7:30 p.m.The roll was called and the Secretary reported a quorum present. DIRECTORS PRESENT:Lindsley Parsons (Chairman),Paul J. Gruber,and Alton E.Allen DIRECTORS ABSENT:None OTHERS PRESENT:Paul G.Brown,Donald C.Simpson, Harvey Huriburt,Gordon Jones,and Fred A.Harper,Secretary ************** Consideration of request Following the reading of letters of~C.L.Kirchner,for dated March 7th and March l24th, connection charge credit from C.L.Kirchner,General Contractor,requesting exemption from the $120 per unit connection charge for six new residential units which are replacing six dwellings that were demolished prior to July 1,1965,and a lengthy dis cussion by the Directors and representatives of Mr.Kirchner, It was moved,seconded and duly carried: That the request for exemption from connection charges be referred to the Genera].Counsel for a written legal opinion as to whether the District can,under Article 7 -entitled “Appeal”,of Ordinance No.502,as amended,waive the connection charge;and, FURTHER MOVED:That the matter be tabled until the legal opinion is submitted to the Board. Report of Donald C The Chair recognized Mr.Donald S1mpson~,Consulting C.Simpson,Dlstrictts Consulting ~ Engineer,received Engineer,who reviewed for the and ordered.filed Directors the recommendations se~ forth in the En*Ineers Report ~c;~ entIt3.~ed,“Sewerage System Study and Report ,submitted to ‘t~~ the Board of Directors in October,19624.Mr.Simpson then c~ submitted to the Directors a report dated March 124,1966, recommending a new sewer to replace the existing sewer between the intersection of Bayside Drive and Coast Highway,and the intersection of Back Bay Drive and Jamboree Road.He said the’flow information for this segment of the District’s trunk sewer indicates that it is near capacity and will be surcharged periodically by the spring of 1967.His report also recommended a further study regarding construction of a sewer line southerly and easterly along Bayside Drive and Coast Highway to the Corona del Mar Pumping Station ,-: 3-15-66 It was then moved,seconded and duly carried: written report dated March l~4,1966,submitted C.Simpson,District’s Consulting Engineer,be and or.dered filed. The Assistant General Manager and the Director of Finàn~e reviewed possible means of financing the recommended construction project, the cost of which has been estimated by the engineers at $320,000.The District,during the next fiscal year,will have $85,ooo in accumulated tax funds,and an estimated $100,000 in its connection charge fund. The staff further reported that they have conferred with officials of The Irvine Company,who have indicated a willingness to lend the District $150,000 to assist in financing the project.This loan would be repaid from connection charge receipts on the same basis as the existing $290,000 loan from The Irvine Company.In the event no loan is negotiated,the District’s tax rate will be increased approximately l0~for the 1966-67 fiscal year to provide the necessary funds. Following the verbal report of the staff,it was moved, seconded and duly carried: That the staff be instructed to con-tinue negotiating with The Irvine Company concerning a possible loan of $150,000 to help finance the consti~uction of the facilities recom mended by the District’s engineers. Moved,seconded and duly carried: That,as provided ir~the agreement dated January 13,1965,with Simpson and Stevlingson,Consulting Engineers,said agreement is hereby terminated. Moved,seconded andduly carried: That the proposal of Donald C. Simpson,Consulting Civil Engineer, dated March l~4.,1966,for furnishing engineering services in connection with construction of a trunk sewer from Coast Highway and Bayside Drive to Back Bay Drive-and Jamboree Road,Contract No.5-13,is hereby approved and accepted. Moved,seconded and duly carried: That.the ~oard of Directors adopt Resolution No.66-20-5,approving and authorizing execution of an agreement employing Donald C.Simpson,Consulting Civil Engineer,for engineering services including the design of a trunk sewer from Coast Highway and Bayside Drive to Back Bay Drive and Jamboree Road,Contract No.5-13,in accordance with the terms of the proposal for said work-dated March lLl.,1966.Certified copy of this resolution is attached hereto and made a part of these minutes Repprt of the staff re:Financing of construction That the by Donald received 0 Authorizing termination of agreement with Simpson and Stevlingson 0 Accepting proposal of Donald C.Simpson re: Contract No.5—13 Approving agreement employing engineer Actions regarding request of the City of Newport Beach The Assistant General Manager reviewed for the Board the existing agreement between the 0 -2- District and the City of Newport Beach,for collection by the City of the District’s connection charges.The agreement provides for retention by the City of i~~%Of the connection charges collected,as reimbursement to the City for its expenses. A recent study by the City’s staff revealed that the costs for collecting the connection charges were approximately $‘~LO0 per permit;therefore,they recoi~niended that the CIty Council request reconsideration of the agreement,and that negotiations be entered into with the District to revise the existing agreement to increase the City’s fee to $.OO per connection permit issued. It was moved,seconded and duly carried:That the letters from the City of Newport Beach,dated February 23,and March 10,1966,requesting a review of the agreement between the District and the City,be received and ordered filed; and, FtJRTHER MOVED:That,as recommended by the District’s staff, the Board of Directors adopt Resolution No.66-21-5,approv ing and authorizing~execution of a revised agreement with the City of Newport Beach to provide for a fee of $~~hOo per permit issued to be paid to the City for collecting the District’s connection charges.
