The Chairman called’the.meeting to order at 7:00 p.m..The roll was called and the Secretary reported a quorum pr~sent.~” Directors present::G..W..Doney (Chairman),~Dee Cook,A.A. Moved,seconded and duly carried: That the bids publicly opened and read at this meeting for Contract No.7-1E,Revised, Sub-Trunks,be:referred to the engineers and the General Manager for tabulation and recommendation to the Board. nd,nI—i .,.....p — ________________________ The General Counsel reported to _______________________ the Board relative to the pro ______________________ posed agreement with the Navy _______________________ Department providing sewerage facilities for the Marine Corps Air Facility,Santa.Aria.He.advised that he was unable to find,any provision in Public Law 660 to require the District to g1ve~a credit ~o the Navy Department on any District connection charge,when a Federal Grant has been given to the District.He recommended that the Board continue the matter to the next regular meeting -~-i,.———.————~.—..~~~~-.~—-..——_.‘.~—....,~.,—-—---.---.--..- It was then moved,seconded and duly carried:That con sideration of the proposed agreement with the Navy Department be continued to the next regular meeting of the District Board. Anthony.J.Raymond John Kindybal Donald.F..Griset’ Gerald B.Peebler’ B.F.Tiernan The Chairman:then announced that this was the.time and place set for the:hearing of protests or objections against the work or the district,each as set:forth:in the Resolution of Intention hereinbefore mentioned,and asked’if’anyone present desired to be heard ii~said: matter., .‘. After’all,protests ‘and.objections had been ma~e,it was moved by Director Hall’and seconded by Director Meyers, and unanimously carried.,by the roll call vote;of all Board members-present,that all protests be.r ferred to the &€ineer of Work for checking and report ‘as to the percentage of,the area represented thereby.‘ . “l,’.~ ‘-2- 4- 4,—— —,.— — .~ The ~gineer of Work reported that the protests represented less than 4%of the total area of the assessment district. All ‘protestants ha~ring been heard and an opportui~ity t~ing been given to all persons desiring to be heard1 and a full, fair and impartial hearing having been granted,the Board of Directors having before it a diagram of the Assessment District and being familiar’with the assessment district and also having considered all protests filed,and having con sidered the matter as.to the area of property represented by said protestants,Director’Cook presented the following resolution and moved ite adoption:. WH~EAS;certain protests have been,filed by Howard Irving Stx’oupe,Jr~.,and others,pro testing against the doing of the work and improvement described in the Resolution of Intention No..64-35-7,or against the Assess ment District therein described;and WHEREAS,the Board of Directors has carefully considered all protests or objections and having - considered the area of the District represented by said protests; NOW,THEREFORE,BE.IT RESOLVED by this Board of Directors,that it does hereby find and determine that the said protests or objections have been made by the owners of less than one-half of the area of the property to be assessed for said work and improvement,as set forth in said Resolution of Intention No.64-35-7;and BE.IT FURTHER RESOLVED that each and all of the said protests or object~..ons be and they hereby are overruled and denied. Said motion was duly seconded by’Director Parks and carried by the~following roll call,vote: AYES:Directors boney,Cook,Hall,Meyers and Parks NOES:None ABSENT:Director Phillips Director Cook then offered and moved the adoption of Resolution Ordering Work No.64-57-7,i~the matter’of the construction of sanitary sewers and appurtenances and appurtenant work in “ASSESSMENT DISTRICT NO.2;”which motion was seconded by Director Parks and upon roll call vote was adopted by the following vote: AYES:Directors Doney,.Cook,Hall,Meyers and Parks NOES:None 0’’ ABSENT:Director Phillips -3-- .
