Cruz,Arthur Field,Howard Dietz,Harold Sipe, Harold Cirou,Frank Crawford,Mr.Cram, Thomas F.Morrissen,Frank Gambrell and Fred A.Harper,Secretary An adjourned regular meeting of the Board of Directors of County Sanitation District No.7 was held at 7:00 p.m.,December 19,1963 in Room 239 at 11OLL West Eighth Street,Santa Ana,California. The Chairman called the meeting to order at 7:00 p.m.The roll was called and the Secretary reported a quorum present. ____________________________ The Secretary r,eported that this -was the time and place fixed for the hearing of protests or objections,against the work or the District,as described in Resolution of Intention No.63-178—7,in the matter of the construction of sanitary sewers and appurtenant work in “ASSESSMENT DISTRICT NO.3-B,”as described in said resolu tion. The Secretary also reported that affidavits In support of the publication of the Resolution of Intention,the mailing of printed notices of the adoption of said resolution,and the posting of the Notice of Improvement,as required by law, had been made and are on file in the office of the Secretary. The Chairman then inquired of the Secretary if any written protests or objections against the work or the District had been filed with him in said matter.The Secretary reported that six written protests had been filed with him prior to the time set for the hearing by the fOllowing: Charles A.Owen,and others The Chairman then announced that this was the time and place set for the hearing of protests or objections against the work or the district,each as set forth in the Resolution of Intention hereinbefore mentioned,and asked if anyone present desired to be heard in said matter. .1 12-19-63 DISTRICT NO.7 Public hearing re:Assess ment~District No.3~B 12-19-63 After all protests and objections had been made,It was moved by Director Hall and seconded by Director Parks,and unanimously carried by the roll call vote of all Board members present,that all protests be referred to the Engineer of Work for checking and report as to the percen tage of the area represented thereby. The Engineer of Work reported that the protests.represented less than one percent (1%)of the total area of.the assess ment district. All protestants having been heard and an opportunity having been given to all persons desiring to be heard,and a full, fair and impartial hearing having been given to;all persons desiring to be heard,and a full,fair and impartial hearing having been granted,the Board of Directors having before it a diagram of the Assessment District and being familiar with the assessmen~district and also having considered all protest8 filed,and having considered the matter as to the area of property represented by said protestants,Director Featherly presented the following resolution and moved Its adoption: WHEREAS,certain protests have been flled.’by.Charles A. Owen,and others,protesting against the doing of the work and improvement described In Resolution’of Inten tion No.63-178-7,or.against the Assessment:District therein described;and .0 WHEREAS,the Board of Directors has carefully con sidered all protests or objections,and ‘havil-ig considered the area of the District represented by said,protests; NO~’i,THEREFORE,BE IT RESOLVED by this Board of Directors that it does hereby find and determine that the said protests or objections have been made by the owners of less than one-half of the area of the property to be assessed for said work and improvement,as set forth in said Resolution of Intention No.63-178-7;and BE IT FURTHER RESOLVED that each and all of the said protests or objections.,be and they are hereby overruled and denied..: . Said motion was duly secoflded by Director Parks and carried by the following roll call..vote: AYES:Directors Doney,Hall,Meyers,Parks and Featherly NOES:Directors NONE ABSENT:Director Cook Director Featherly then’offered and moved the adoption of Resolution Ordering Work No.63-192-7,in the matter of the construction of sanitary sewers and appurtenant work in “ASSESSMENT DISTRICT NO.3-B,”which motion was seconded by Director Parks and upon roll call vote was adopted by the following vote: -2- 12-19-63 AYES:Directors Doney,Hall,Meyers,Parks and Featherly NOES:NONE ABSENT:Director Cook Approving proposed annexa Moved,seconded and duly tion of territory (Hodges carried: Annexation ~bJ •That the Board of Directors •adopt Resolution No.63-193-7,approving proposed annexation of territory to the District (Hodges -P4rlnexation #6)upon payment by the petitioners of the sum of $175.00 per acre •or any part of an acre to be annexed.Certified copy of this resolution is attached hereto and made a part of the3e minutes. Adjournment Moved,seconded and duly carried: That this meeting of the Board of Directors of County Sanita tion District No.7 be adjourned.
