Flnster~,Carl .Carlson,Domic San Feleppo, A.H.Day,Ken Robas,Jerry Weller, Marvin Rohrs,George Stolte,Fred Relnhardt,George Seebart,Lawrence Cram, A.Bergsettia and Fred A.Harper,Secretary ** An adjourned regular meeting of the Board of Directors of County SanitationDistrict No.7 was held at 7:00 p.m.,December 18,1963 in Room 239 at iiO)4 West Eighth Street,Santa Ana,California. The Chairman called the meeting to order at 7:00 p.m.The roll C was called and the Secretary reported a quorum present. Public hearing re:Assess The Secretary reportedthat this ment District No.3-A was the time and plaôe fixed for the hearing of protests or objections against the work or the District,as described in Resolution of Intention No.63-177-7,in the matter of the construction of sanitary sewers and appurtenant work in “ASSESSMENT DISTRICT NO.3-A,”as described in said resolu tion. The Secretary also reported thataffidavitsin support or the publication of the Resolution of Intention,the mailiiig of printed notices of the adoption of said resolution,and the posting of the Notice of Improvement,as required by law,had been made and are on file in the office of the Secretary. The Chairman then inquired of the Secretary if any written protests or objections against the work or the District had been flied with him in said matter.The Secretary reported that 22 written protests had been filed with him prior to the time set for the hearing by the following: Marvin A.Jarvis.and others.. The Chairman then announced that this was the time and place set for the hearing of protests or objections against the work or the district,,each as set forth in the Resolution of Intention hereinbefore mentioned,and asked if anyone, present desired to be heard in said matter. After all protests and.objections had been thade,it was moved by Director Hall and seconded by Director Parks,and 12-18-63 unanimously cari’ied by the roll call vote of all Board members present,that all protests be referred to the ~igineer of Work for checking and report as to the per centage of the area represented thereby. The ~gineer of Work reported that the protests represented less than two percent (2%)or the total area of:the assess ment district. All protestants having been heard and an opportunity having been given to all persons desiring to be heard,and a full, fair and impartial hearing having been granted,the Board of Directors having before it a diagram of the Assessment District and being familiar with the assessment district and also having considered all protests filed,and having considered the matter as to the area of property represented by said protestants,Directoi’Hall presented the following resolution and moved its adoption: WHEREAS,certain,protests have been filed by Marvin A. Jarvis,and others,protesting against the doing of the work and iniprovement described ~n the Resolution of Intention No.63-177-7,or against the Assessment •District therein described;and WHEREAS,the Board of D±rectors has carefully con sidered all protests ~or objections and having considered the area of the District represented by said protests; NO~1,THEREFORE,BE IT RESOLVED by this Board of Directors,that it does hereby find and determine that the said protests or objections have been made by the owners of less than one-half of the area of the property to be assessed for said work and improvement,as set forth in said Resolution of Intention No.63-177-7;and BE IT FURTHER RESOLVED that each and all of the said protests or objections be and they hereby are overruled and denied. Said motion was duly seconded by Director Meyers and carried by the following roll call vote: AYES:Directors Parks,Hall,Doney,Meyers NOES:Directors NONE ABSENT:Directors Featherly and Cook Director Meyers then offered and moved the adoptiOn of Resolution Ordering Work No.63-191-7,in the matter df the construction of sanitary sewers and appurtenant work in I?AssESs~NT DISTRICT NO.3-A,which motion was seconded by Director Hall and upon roll call vote was adopted by the following vote: AYES:Directors Parks,Hall,Doney and Meyers NOES:Directors NONE ABSENT:Directors Featherly and Cook -2- ~‘•~‘::~2’•~L~-“fl ~-‘•‘~-‘-~_~....._.~~~ Authorizing transfer of funds from Facilities Revolving to Operating 12-18-63 ---That a transfer of funds in the amount of $80,000,from the Facilities Revolving Fund to the Operating Fund,to be used for payment of Assessment District expenses,is hereby approved and authorized;and, That transfer back to the Facilities Revolving Fund at such time as the Di.atrict is reimbursed by the various Contractors awarded Assessment District contracts,is hereby authorized. Approving Reimbursement Agreement with Drenmo, Inc.,for sewer in Cameron Lane,Tustix~That the Board of Directors adopt Resolution No.63-190-7, approving and authorizing execution of a Sewerage Facility Reimbursement Agreement with Drerimo,Inc.,in the total amount of $500.00,in connection with an offsite sewer for Tract #4325 in Cameron Lane,Tustin.Certified copy of this resolution is attached hereto and made a part of these minutes. Approval of warrants Moved,seconded and duly carried: That the District’s Operating Fund warrant register be approved for signature of the Chairman and that the County Auditor be authorized to pay the following: Operating Fund C.Arthur Nisson &Jack J.Rimel Boyle &Lowry Orange County Title Company Adjournment Moved,seconded and duly carried: That this meeting of the Board of Directors of County Sanitation District No.7 be adjourned to 7:00 p.m., December 19,1963 in Room 239 at 1104 West Eighth Street, Santa Ana,California. The Chairman then declared the meeting so adjourned at 8:50 p.m.,December 18,1963.
