The Board of Directors met in regular session at -the hour of
8:00 p.m.,July 28,1954 in Room 239 at 1104 West Eighth Street,
Santa Ana,California.
Chairman Chandler called the joint meeting of the Districts’
Boards to order at 8:00 p.m.
The roll was called and the Secretary -reported a quorum of
the Board to be present:

a report would not be returned to the Boards until after
vacation periods in September or October.

Report of the Finance Director Chandler,Chairman of
Committee the Finance Committee,reported
the Committee had met on July
21,19.51+and reviewed and studied written budget report and
estimates submitted by the General Manager,which were then
mailed to each of the Directors;and that the Committee,
by roll call vote had unanimously recommended acceptance
and adoption of the General Manager’s budget report and
detailed estimates for the Joint Administrative Organ
ization’s budget for the fiscal year 1954-1955.
Whereupon,the Boards of Directors took the following

be and it is hereby adopted and approved for the signature
of the Chairman of County Sanitation District No.1.The
General Manager is hereby directed to transmit the required
number of approved and signed copies of said 1954-1955
Joint Administrative Organization’s budget to the County

ORDINANCE NO.100
AN ORDINANCE OF COUNTY SANITATION DISTRICT
NO.1 OF ORANGE COUNTY,CALIFORNIA,PRO
VIDING FOR THE CREATION AND ACCUMULATION
OF A FUND FOR CAPITAL OUTLAY
The Board of Directors of County Sanitatinn District No.1
of Orange County,California,do ordain as fo]~lows:
SECTION I.That,as authorized by Secti~n 53730 to 53737,
both inclusive,of the Government Code of the State of California,
provision is hereby made for the levy and collecti~n of assess
ments or taxes for the creation and accumulation of a fund for
capital outlays.
SECTION 2.Such funds shall be designated as ~Accumu1ative
Capital Outlay Fund~and all or part of the fund may be shown
in the budget as reserved for future expenditure in future years,
and when so shown shall be identified as to purpose but need not
be itemized.
SECTION 3.At the time of the levy of County taxes,the
County Board of Supervisors shall levy a tax upon the taxable
real property in the District sufficient to raise the amount
specified in the final budget for the fiscal year after allowing,
for delinquency,the amount fixed by law or this Board for the
Accumulative Capital Outlay Fund.
SECTION 4.At any time after the creation of the Accumul
ative Capital Outlay Fund as in this Ordinance provided,the Board
of Directors of County Sanitation District No.1 of Orange County,
California,may transfcr to such fund any unencumbered surplus
funds remaining on hand at the end of the fiscal year,and may
make such other transfers as may be authorized by law.
SECTION 5.No disbursement shall be made from the Accumul
ative Capital Outlay Fund except as authorized by Sectinn 53736
and 53737 of the Government Code of the State of California.

SECTION 6.This Ordinance shall take effect and be in
full force and effect thirty (30)days from and after its
passage,and,prior to fifteen (15)days after passage thereof,
this Ordinance,together with the names of the
members of the Board of Directors of County Sanitation District
No.1 of Orange County,California voting for or against the
same shall be published once in the Santa Ana Register
a newspaper published in the said District.

Sanitation District No.1 of Orange County,California,at
a regular meeting held on the 2~th day of July ,1954

RESOLUTION NO.386-1
RESOLUTION OF INTENTION
TO APPROVE CONTRACT PROVIDING FOR
PARTICIPATION IN
STATE EMPLOYEES’RETIRE~NT SYSTEM
WHEREAS,the State Employees’Retirement Law permits the
participation of Public Agencies in the State Employees’
Retirement System,making their employees members of
said System,and sets forth the procedure by which parti
cipation may be accomplished;and
WHEREAS,one step in said procedure is the adoption by the legis
lative body of the Public Agency of a resolution giving
notice of intention to approve a contract between said
Governing Body and the Board of Administration of said
Retirement System,providing for said participation,which
said resolution shall contain a summary of the major pro
visions of the proposed Retirement System;and
WHEREAS,the following is a summary of the major provisions of the
proposed Retirement System:
1.The system is administered by a board of eight
members,composed of three members of the System,
an official of a bank,an official of a life
insurance company,the Director of Finance,a
member of the State Personnel Board,and an
official of the University of California.
2.Retirement for service is optional upon attain
ment of age 55 by Local Safety Members (local
firemen,local policemen,and county peace
officers)and age 60 or age 55 at the election
of the Public Agency,by other employees,and
completion oftwenty years of service for the
Public Agency,and is compulsory at age 65 for
Local Safety Members,and at age 70 for other
employees.
3.The monthly retirement allowance payable upon
retirement for service is dependent upon factors
as age,sex,salary,and years of service.For
Local Safety Members retiring at age 55 in para
graph 2,or at a higher age with 20 years of
service,the monthly allowance is approximately
one-half the average monthly salary (salary over
4~4l6.66 being excluded unless Agency elects other
wise)during the five years immediately preceding
retirement,unless the Public Agency elects to
provide prior service benefits at less than the
full amount,For other Agency employees,the
monthly allowance,upon retirement at age 65 if
the Agency elects 60 as the lowest optional ser
vice retirement age,is 1/70th of the average
monthly salary during the five years immediately
preceding retirement,for each year of service
after the effective date of participation,plus
approximately 1/70th,or less as may be provided
in said contract by the Public Agency for its
employees,of “Final Compensation”or the average
monthly salary during the three years immediately
preceding the effective date of participation,
for each year of service prior to that date.Upon

retirement at age 60,if the Agency elects 55 as the
lowest optional service retirement age,the fraction
is approximately 1/60th instead of 1/70th,or
exactly 1/60th,if the guaranteed fraction also is
elected.The fractions are reduced for both current
and prior service if retirement is below 60,and
increased only for current service,if retirement is
above 60.
4.,A minimum service retirement allowance of ~40 per
month is guaranteed upon retirement at age 70 with
credit for service rendered prior to said effective
date,if the Public Agency elects age 60 as the
lowest optional service retirement age,or a minimum
allowance of $60 per month upon retirement at age 65
or over with twenty years of service,or upon retire
ment at age 70 with credit for prior ser’vice,if the
Public Agency elects age 55 as the lowest optional
service retirement age.
5,Retirement for disability,except in the case of
Local Safety Members disabled from injury arising out
of and in the course of employment,is permitted
only after ten years of service and upon proof of
incapacity for the performance of duty~(see item
10 below,)
6.The monthly retirement allowance pe.yahle upon dis..
ability retirement,described in preceding item 5,
is dependent upon such factors as age,salary and
years of service,but generally is equal to 90%of
1/70th,or 1/60th as the case may be,of the average
monthly salary during the five years i~imediately pre
ceding retirement,for each year of servi~e~with a
guarantee of 25%of said salary,subject to certain
restrictions and modifications0
7.Disability retirement of Local Safety Members,in the
event of disability arising out of and in the course
of employment,is permitted regardless of age and
service,the monthly retirement allowance being one—
half the highest average monthly salary earnable
during any five years of membership.
~.The benefit payable at death before retirement except
in the case of Local Safety Members dying from in-
jury arising out of and in the course of employment,
consists of the contributions of the member plus in
terest,and plus 1/12th of the ~ieniber~s annual salary
during the year immediately preceding death,for each
year,not exceeding six years,of service as a member
of the systems Upon death after retirement,and at
the election of the Public Agency,a benefit of ~400
is payable.
9.The monthly allowance payable to the widow and chil
dren at the death of Local Safety Members,arising
out of and in the course of employment,is orie—heif
the average monthly salary during the five years
immediately preceding death.
10.The benefit upon separation from service by other
cause than death or retirement,is the refund of the
member’s contributions,with interest,Members hav
ing accumulated contributions of at least ~500 upon

resignation or discharge,may elect irrevocably,within
ninety days,to leave contributions in the Retirement
Fund,and then upon reaching the lowest optional service
retirement age or becoming disabled,to be entitled to
receive such retirement allowance as will be provided by
their and the Agency’s contributions and their credited
service,regardless of service rendered.
11.Contributions required of Local Safety Members,without
credit for prior service,depend upon salary and upon
age of entry into the Retirement System,the contribu
tions per ~l00 of salary varying from ~7.63 at entry age
21,to ~14..35 at entry age 35.Contributions of Local
Safety’Members having credit for prior service~depend on
salary,entry age,and amount of prior ~ervice the
amount of contributions per ~l00 being ~l6.33 i’or
example,at entry age 54,with 19 years of prior service.
12.For other Agency employees,the contributions depend
upon salary,sex and age of entry into the Retirement
System,the contributions per ~lOO of salary varying
from ~4.62 atage 2Otoçp7.99 at age 64,for men,and from
~5.36 at age 20,to ~9.45 at age 64,for women,all
based on the Public Agency’s election of age 60 as the
lowest optional service retirement age.If the Public
Agency elects age 55 as the lowest optional service re
tirement age,the contributions per ~1OO of salaryvary
from p7.36 at age 20;to ~at age 59,for men,and
from 4p~.35 at age 20,to ~p12.~l at age 59,for women.
13.The Agency is required to contribute the balance of the
funds necessary to meet the cost of the benefits pro
vided under the retirement system for the Agency
employees.The Agency is also required to pay its
proportionate share of the administrative costs of the
system.
14.Ability of the Retirement System to pay benefits is
safeguarded by a provision authorizing the Board of
Administration to revise contributions of both employees
and the Agency,in the light of experience under the
system.
NOW,THEREFORE,BE IT RESOLVED,that the Board of Directorsof
County Sanitation District No.1 of Orange County,
California gives,and it does hereby give notice of
intention to approve a contract between said Board of
Directors and the Bo~~rd of Administration of the State
Employees’Retirement System,providing for participation
of said County Sanitation District No.1 in said
Retirement System,a copy of said contract being
attached hereto and marked “Exhibit a”,and by reference
made a part hereof.

WITNESSETH:
In consideration of the covenants and agreements hereinafter
contained and on the part of both parties to be kept and per
formed,Public Agency and Board hereby agree as follows:
1.Public Agency is to participate in the State Employees’
Retirement System,subject to the provisions of the State
Employees’Retirement Law.
2.Public Agency shall participate in said Retirei1ient
System,making its employees members of said System,from and
after October 1,1954.
3.Employees of Public Agency in the following classes shall
become members of said Retirement System in accordance with the
provisions of said Retirement Law,governing membership in said
Retirement System,and subject to the further exclusions from
membership in the next following sentence:

In addition to the employees excluded from membership by said
Retirement Law,the following employees shall not become members of
the Retirement System:
NO ADDITIONAL EXCLUSIONS
Board and Public Agency agree that,except as provided in paragraph
12,no adjustment shall be made in the amount of contributions
provided in paragraph 12a on account of prior service,or in the
percentage provided in paragraph 12b,because of variations in the
numbers of employees who become members of said Retirement System
on the effective date hereof,from the number listed above,due to
termination of service by such causes as death,resignation or
discharge,or the employment of individuals not included in said
number0
4~Age 60 shall be the normal minimum age for retirement
for service,of miscellaneous members employed by public agency,
that is,members other than Local Firemen,Local ~o1icemen and
County Peace Officers,and one—sixtieth shall be the fraction of
final com~ensation,as defined in said Retirement Law,to be
provided on the average,for each year of service as a member,by
the members’and Public Agency’s normal contributions,upon
retirement at said minimum age0

5.Benefits on account of prior service,that is,service
credited hereunder as rendered to Public Agency prior to the
effective date of participation,to respective members employed
by Public Agency as Local Firemen,Local Policemen or County Peace
Officers shall be allowed only as a percentage of the average
salary specified in said Retirement Law,for each pear of
such service,and said percentage shall be percent of the
fraction of final compensation,as defined in the State Employees’
Retirement Law,for each year of service rendered after said date,
as determined for said respective members under said law,for re
tirement for service at age 55,or upon qualification for service
retirement at a higher age.If a member retires for service before
attaining age 55,his prior service pension shall be reduced to
that amount which the value of the pension as deferred to age 55
will purchase at the actual age of retirement.
6.Prior service benefits to miscellaneous members employed
by Public Agency,that is,members other than Local Firemen,Local
Policemen or County Peace Officers,upon retirement for service at
the normal minimum age entered in paragraph 4.hereof,shall be
allowed only as a percentage of the average salary specified in
Section 21253 of said Retirement Law,for each year of such service,
and said percentage shall be 100 per cent of the percentage
determined under said section.If a member retires for service
before attaining the normal minimum age entered in paragraph 1+
hereof,his prior service pension shall be reduced to that amount
which the value of the pension as deferred to said minimum age will
purchase at the actual age of retirement.
7.If the fraction stated in the preceding paragraph is
one—sixieth,the provisions of Section 21251.1 of the State
Employees’Retirement Law,providing for a guaranteed percentage
of final compensation for each year of current service as a
member,SHALL apply to employees of Public Agency who become

members of said Retirement System.
~.The provisions of Section 21252~4.of the State Employees’
Retirement Law,providing for a guaranteed percentage of final
compensation for each year of current service as a member,apply
to employees of Public Agency who become members of the ~etirement
System as Local Firemen,Local Policemen or County Peace Officers.
9,The provisions of Section 2l25~b of the State Employees?
Retirement Law,guaranteeing a minimum retirement allowance under
certain conditions shall apply to employees of Public Agency who
become members of said Retirement System.
10.The r~rovisions of Section 21367.51 of the State Employees’
Retirement Law,providing a $400 death benefit after retirement
shall apply to employees of Public Agency who beco;~e members of
said Retirement System0
11.The provisions of Section 20025 of the State Employees’
Retirement Law,providing for the portion of compensation which
shall be included in computations under the Retirement Law shall
apply to employees of Public Agency who become members of said
Retirement System.
12.Public Agency shall contribute to said Retirement System
as follows:
a.~The sum of ~297~O~per annum,payable in equal monthly
~r more or less frequent installments as Board shall
require,for a period of 25 years,on account of the
liability for benefits based on servic~e rendered to
Public Agency prior to the effective date hereof.
b.5.25~per cent of total salaries paid by Public Agency
each month to its employees who are members of said
Retirement System,provided that only salary earned
as members of said System shall be included in said
total salaries,and the employees who are members of
said System shall include employees who becoriie
members upon the effective date hereof arid employees

who become r~iembers thereafter.
c.~reasonable amount per annum,as fixed by Board,to cover
the costs of administering said System as it affects the
employees of Public Agency,not including the costs of
special valuations or of the periodical investigation arid
valuation required by law,provided that said amount shall
be determined on the basis of the number of employees of
Public Agency who are members on July 1st of the
respective fiscal years,or with respect to the first year
of participation,on the effective date of said partici
pation.
d.A reasonable amount as fixed by the Board,payable in one
installment from time to time as the occasions arise,to
cover the costs of special valuations on account of
employees of Public Agency,and the costs of the periodical
investigation into the experience under said Retirement
System,as it affects said employees,and the valuation
of the assets and liabilities of said System on account
of said employees.
Contributions required of Public agency and its employees
shall be subject to adjustment by the Board of Administration on
account of amendments to the State Employees’Retirement Law,and
on account of experience under the Retirement System,as determined
by the periodical investigation,valuation and determination
provided for by said Retirement Law,
13.Contributions required of Public Agency under paragraph
12 immediately preceding,and contributions required of’Public
Agency’s employees who are members of said System,shall be paid
by Public Agency to the State Employees’Retirement System within
thirty days after the end of the month or longer period to which
said contributions refer.If more or less than the correct amount
of contribution required of Public Agency or its employees is paid
for any period,propar adjustment shall be made in connection with

subsequent remittances of Jublic Agency to the Board,to rectify
the errors;or such adjustments on account of errors made in
contributions required of employees,may be made by direct cash
payments between the employee in connection with whom the error
was made,and Board.Payments of Public Agency to Board may be
made in the form of warrants,bank checks,bank drafts,certified
checks,money orders,or cash0
14.The provisions of Section 20024.01 of the State Employees
Retirement Law,which provide that “final compensation”shall mean
the highest average annual compensation earriable by a member during
any period of three consecutive years during his membership in the
System,SHALL APPLY to employees of Public Agency who become members
of said Retirenient System~
