ORDINANCE NO. 515
AN ORDINANCE OF THE BOARD OF DIRECTORS OF
COUNTY SANITATION DISTRICT NO. 5 OF ORANGE
COUNTY, CALIFORNIA, AUTHORIZING THE
COLLECTION OF SEWER SERVICE CHARGES ON THE
PROPERTY TAX ROLLS FOR FISCAL YEAR 1983-84
WHEREAS, District Ordinance No. 513 establishes a schedule of sanitary
sewer service chages for all properties connected to the District system; and,
WHEREAS, California Health and Safety Code Section 5473 authorizes the
District to elect to have the sewer service charges for the forthcoming fiscal
year collected on the tax roll with the general taxes.
NOW, THEREFORE, THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 5
OF ORANGE COUNTY, CALIFORNIA, DOES HEREBY ORDAIN:
Section 1: Pursuant to the authority of California Health and Safety Code
Section 5473, the Board of Directors elects to have those certain sewer service
charges established by Ordinance No. 513 collected on the County property tax
rolls.
Section 2: The Orange County Assessor, Orange County Tax Collector and
Orange County Auditor are directed to take all necessary actions to have the
charges for Fiscal Year 1983-84 collected on the tax roll in the same manner, by
the same persons and at the same time as, together with and not separately from,
its general t~xes.
Section 3: The Secretary shall certify to the adoption of this Ordinance
and shall cause the same to be published in a newspaper of general circulation
in the District as required by law.

In 1981, the Boards adopted a user fee program to make up the
shortfall of ad valorem tax revenues and provide needed
additional financing for operations and major rehabilitation work
on the sewer system. Following is the fee schedule currently in
effect:

If a parcel contains more than one water meter,
then the charge applicable to each meter shall be
added together, and the sum levied against the parcel.
MULTI-UNIT PARCELS
PER UNIT 15.85
When the program was originally adopted it was anticipated
that it would be necessary to increase the fees by approximately
77% beginning with the second year of the program to finance the
needed rehabilitation work . However, because of deferred
expenditures in 1981-82 and higher than anticipated interest
earnings the District was able to forego an increase in the fee
in 1982.
Staff is now in the process of preparing the 1983 -84
budgets. Attached is a preliminary projection of the District's
cash flow for next year . Based upon these estimates it appears
as if the District could once again forego any increase in the
user fee for 1983-84. This is because of extremely favorable
bids that have been received on contracts that h ave been awarded
since the inception of the program and the delay of completion of
treatment plant facilities and the resultant avoidance of
increased operating costs. District No. 5 has also experienced
higher ad valorem tax re v enues than most other Districts .
Staff wi ll review the District 's financial projections and
1983 -84 user fee recommendations for Boar d members at the June
22nd meeting .

Pursuant to the adjournment of the regular meeting of June 8, 1983, the Board of
Directors of County Sanitation District No. 5 of Orange County, California, met in an
adjourned regular meeting at the above hour and date in the Newport Beach City Hall
Annex.
The Chairman called the meeting to order at 5:30 p.m. The roll was called and the
Secretary reported a quorum present.

The Assistant General Manager reviewed the
District's existing user fee program that was
initiated in fiscal year 1981-82 and revised
last year to incorporate a fee for multi-unit parcels. The purpose of the user fee
program is to make up the shortfall of ad valorem tax revenues experienced by the
District since the 1981-82 fiscal year and provide necessary financing for operations
as well as major rehabilitation work on the District's sewer system. The following
fees are currently in effect:

Mr. Sylvester indicated it was anticipated when the user fee program was originally
adopted·in 1981 that it would be necessary to increase the fees by as much as 77%
commencing with the second year of the program to finance ongoing system \;...,)

1982-83 fiscal year. Mr. Sylvester further reported that based upon staff review of
the cash flow projections prepared for the preliminary 1983-84 budget, it appears
that the District can again fore90 an increase in the user fee for the 1983-84 fiscal
year. The District has received extremely favorable bids on its rehabilitation
projects since 1981, and the delay of completion of the advanced treatment facilities
at Plant No. 2 has also resulted in avoidance of increased operations and maintenance
costs over the past two years. These factors, combined with receipt of higher than
anticipated levels of ad valorem tax revenues over the past two years, will allow the
District to delay increasing the current use fee schedule until the 1984-85 fiscal
year.
