This is to notify you that the Board of Directors of County
Sanitation District No. 6 intends to adjourn its regular meeting
of June 8 , 1983 to June 9, 1983 at 7 : 30 p.m. at the Costa Mesa
City Hall Council Chambers.
The purpose of the adjourned meeting is to conduct a public
hearing regarding establishment of a sewer service charge for all
properties connected to the sewer in the District and to consider
adopting an ordinance fixing the charges for the 1983-84 fiscal
year .

SEWER SERVICE CHARGE REPORT FOR FISCAL YEAR 1983-84
This report is prepared pursuant to the requirements of California Health and Safety Code
Section 5473.
County Sanitation District No. 6 is responsible for the collection, treatment and
disposal of wastewater generated within its boundaries. These services are essential to
the protection of the health and safety of the public served by the system. District No.
6 revenues from ad valorem taxes on real property decreased significantly after passage
of Proposition 13 in 1978. Future tax revenue, estimated in reports on file in the
office of the Secretary of the District, will be insufficient to provide the funding
necessary to operate, maintain and rehabilitate the system. Therefore, a sewer service
charge is necessary to supplement the District's revenue sources in the upcoming fiscal
year.
The Board of Directors of County Sanitation District No. 6 proposes consideration of an
ordinance that will prescribe fees and charges for sanitary sewer services provided by
the District to be charged to the respective parcels of property within the territorial
jurisdiction of the District. This report contains a description of each parcel of real
property that will receive the services of the District and have access to utilization of
the facilities, said parcels of real property being described by reference to maps
prepared in accordance with Section 327 of the California Revenue and Taxation Code and
on file in the office of the County Assessor, which maps are hereby incorporated herein
by reference. The Ordinance under consideration by the governing Board of Directors of
the District will provide revenues that shall be used only for the acquisition,
construction, reconstruction, maintenance, operation and rehabilitation of sanitary sewer
facilities, and shall not be used for the acquisition, construction or maintenance of new
local street sewers or laterals as distinguished from main trunk, interceptor and outfall
sewers provided by the District.
The proposed sewer service charge for fiscal year 1983-84 to be assessed against each
user of the District's sewerage system based upon the average volume of wastewater
discharged by a series of user classes is set forth in Table A, attached hereto. Said
table also sets forth exemption provisions. The estimated 1983-84 charge for each parcel
based on the last ecrualized assessment roll is on file in the office of the Secretary of
the District.
If the proposed ordinance is adopted, the Board of Directors may elect to have such
charges for the forthcoming fiscal year collected on the tax roll in the same manner, by
the same persons, and at the same time as, together with and not separately from, the
general taxes of the District and the County of Orange.
At the time stated in the notice setting the public hearing on this report, the governing
Board of Directors shall hear and consider all objections or protests, if any, to said
report referred to in said notice, and may continue the hearing from time to time.

recognition of the limited potential use of small, converted dwelling units, the owner of
a single unit may apply for a reduction of the annual rate from $26.40 to $15.85,
provided the unit has less than 11 plumbing fixture units (determined as follows) :

Commercial/Industrial: To recognize buildings in this classification where the use of
the sewer system may not be directly related to the size of the building such as in a
warehousing type of use, any owner of a single building may apply for• a reduction of the
calculated fee to a minimum annual fee of $15.85, provided said building contains less
than 11 plumbing fixture units (as determined above) .
In recognition that certain legal parcels of real property exist within the District
which are not connected to the District system and that other properties acquire
considerably greater potable water than is ultimately discharged to the District's
system, it is the intent of the District that said parcels be exempt totally or in part
from the payment of charges as prescribed herein.
Any property owner may appeal the assessment of the charges and submit a claim for rebate
to the District on the forms prescribed and provided by the District, within one hundred
twenty (120) days after the annual property tax bills are mailed by the Orange County Tax
Collector. All applications for rebate of an assessment will be determined by the
General Manager of the District, who may grant a partial or full rebate or adjustment of
the charge based on receiving satisfactory proof that an inequity exists between the
amount of assessment and the amount of wastewater discharged to the District's system. —
Such inequities may include, but are not limited to:

a) no service connection to the District system exists from the parcel assessed
b) the actual use on the parcel differs from the use indicated by the assessment
c) principal water use is agricultural
d) any other use wherein the amount of wastewater discharged to the District's
system is significantly less on a regular basis than the amount that would
normally be expected to be discharged by the class of property in question.
Pursuant to the authority granted by California Health and Safety Code Section 5473, all
charges established herein shall be collected on the County Tax Roll in the same manner,
by the same persons and at the same time as, together with and not separately from, its
general taxes.
In the event District determines that errors or inequities exist in the amount of charges
to be collected by the County Tax Collector, District may submit a bill for any
difference directly to the property owner. Said invoiced amount shall be due and payable
within thirty (30) days of invoice date.
A credit shall be allowed to all dischargers permitted pursuant to Article 3 of Ordinance
No. 606 for the annual sanitary sewer service charge established by this Ordinance in the
same manner as credit is allowed for ad valorem taxes pursuant to Sections 302.6, 303.6
and 304.5B4 of Ordinance No. 606.

ESTABLISHING SANITARY SEWER SERVICE CHARGES
The Board of Directors of County Sanitation District No. 6 of
Orange County, California, does hereby ORDAIN as follows :
Section 1: Purpose. The purpose of this Ordinance is to
establish a system of sanitary sewer service charges required to
be paid by property owners for the services and facilities
furnished by the District in connection with its sanitation
treatment works and sewage collection system.
Revenues derived under the provisions of this Ordinance shall
be used for the acquisition, construction, reconstruction,
maintenance and operation of the sewage collection facilities and
wastewater treatment and disposal facilities of the District,

together with costs of administration and provisions for
necessary reserves.
Section 2: Annual Sanitary Sewer Service Charge. Each
parcel of real property located within the District whichAs
improved with structures designed for residential, commercial or
industrial use and connected to the District' s system, shall pay
a sanitary sewer service charge based on the average volume of
wastewater discharged by a class of users in the sum or sums as
set forth in Table A of this Ordinance.
Section 3: Application of Ordinance. The provisions of this
Ordinance shall be in addition to Ordinance No. 606 of the
District establishing regulations for use of District's sewage
facilities, including provisions for payment of charges or fees

related thereto.
Section 4: Exceptions. The provisions of this Ordinance
shall apply to all properties in the District, and no exception
shall be provided for properties otherwise deemed exempt by
provisions of the State Constitution or statute, such as
properties owned by other public agencies or tax exempt
organizations, except as expressly provided in Section 5 hereof.
Section 5: Exemptions and Appeals. In recognition that
certain legal parcels of real property exist within the District
which are not connected to the District system and that other

sewer service charge established by this Ordinance shall be for
the fiscal year commencing July 1 and terminating June 30, and
there shall be no proration of such charges.
Section 7: Method of Collection. Pursuant to the authority
y, granted by California Health and Safety Code Section 5473, all
charges established herein shall be collected on the County Tax
Roll in the same manner , by the same persons and at the same time
as, together with and not separately from, its general taxes.
The County Tax Collector is authorized and hereby ordered to make
said collections in accordance with the terms and conditions of
agreements between the County of Orange and this District.
In the event District determines that errors or inequities
exist in the amount of charges to be collected by the County Tax
Collector , District may submit a bill for any difference directly
to the property owner. Said invoiced amount shall be due and
payable within thirty (30) days of invoice date.
Section 8 : Credit for Industrial Permittees: A credit shall
be allowed to all dischargers permitted pursuant to Article 3 of

Ordinance No. 606 for the annual sanitary sewer service charge
established by this Ordinance in the same manner as credit is
allowed for ad valorem taxes pursuant to Sections 302.6. 303.6
and 304. 5B4 of Ordinance No. 606.
Section 9: Severability. If any provisions of this
Ordinance or the application to any person or circumstance is
held invalid by order of court, the remainder of the Ordinance or
the application of such provision to other persons or other
circumstances shall not be affected.
Section 10: Effective Date: This Ordinance shall become
effective July 9, 1983.
Section 11: The Secretary shall certify to the adoption of
this Ordinance and shall cause the same to be published in a
newspaper of general circulation in the District as required by law.

WHEREAS, the Board of Directors of County Sanitation District No. 6 has
heretofore adopted Ordinance No. 607, An Ordinance of the Board of Directors of
County Sanitation District No. 6 Establishing Sanitary Sewer Service Charges;
and,
WHEREAS, said Ordinance provides that such charges shall be collected on
the County tax roll in the same manner, by the same persons, and at the same
time as, together with and not separate from, its general taxes.
NOW, THEREFORE, the Board of Directors of County Sanitation District
No. 6 of Orange County, California.
DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the County Auditor-Controller is hereby ordered and
directed to include sewer service charges adopted for 1983-84 pursuant to
Ordinance No. 607, on the 1983-84 property tax bills for collection; and,
Section 2. That the General Manager be, and is hereby, authorized and
directed to execute any necessary documents or agreements to effect the order
set forth in Section 1 herein.

THE ROOTS OF THE PROBLEM ARE REALLY THREEFOLD;
( 1 ) THE DISTRICTS' SEWER SYSTEMS ARE AGING
AND IN NEED OF MAJOR REHABILITATION WORK
(2) INCREASING OPERATING COSTS BEYOND OUR
CONTROL, CAUSED BY
- SKYROCKETING ENERGY COSTS OVER THE
PAST SEVERAL YEARS
- DOUBLE DIGIT INFLATION AVERAGING
OVER 10% PER YEAR FOR THE LAST 5

- MORE STRINGENT TREATMENT

- WE RECOGNIZE THAT PROPOSITION 13 IS AN
IMPORTANT ISSUE WITH THE TAXPAYERS, THAT
IT WAS A VOTE TO REDUCE THE COST OF
GOVERNMENT. THERE PROBABLY ISN' T A
PERSON IN THIS ROOM THAT DOESN' T AGREE -
AT LEAST IN PRINCIPLE - WITH ITS CONCEPT
- BUT MANY CITIZENS HAVE TOLD US THAT WHEN
THEY VOTED FOR IT THEY THOUGHT THAT THE
�..' SO-CALLED ESSENTIAL SERVICES - THE
PROPERTY-RELATED SERVICES - IF YOU WILL -
POLICE, FIRE, WATER AND SEWER, WOULD BE
FULLY-FUNDED AND THAT OTHER GOVERNMENTAL
SERVICES WOULD SHARE IN WHAT WAS LEFT
OVER FROM THE 1% LEVY
- UNFORTUNATELY FOR OUR DISTRICTS, THAT
DIDN' T HAPPEN. THE STATE LEGISLATURE
DECIDED THAT ALL GOVERNMENTAL AGENCIES
WOULD DIVIDE THE MONEY BASED ON THEIR
PREVIOUS HISTORICAL RATIO OF TAX REVENUE

- IN FACT, IN THE IMPLEMENTING LEGISLATION,
SB 154, SIGNED BY THE GOVERNOR ON JUNE
24, 1978 (WHICH WAS LATER SUPPLEMENTED BY
AB 8), THE LEGISLATURE WENT SO FAR AS TO
DECLARE ITS INTENT TO REMOVE ANY SPECIAL
DISTRICT WITH THE STATUTORY AUTHORITY TO
LEVY USER CHARGES - WHICH OUR DISTRICTS
HAVE - FROM THE TAX ROLL ENTIRELY
- FORTUNATELY, THAT HAS NOT COME TO PASS, OR
WE WOULD ALL BE PAYING HIGHER TAXES
- CMSD & CSDOC ARE OPERATING UTILITIES -
JUST THE SAME AS THE GAS COMPANY AND THE
EDISON COMPANY - THE ONLY DIFFERENCE IS
THAT THEY OPERATE UNDER A DIFFERENT
SECTION OF THE LAW
- THEIR SOLE FUNCTION IS THE COLLECTION,
TREATMENT AND DISPOSAL OF SEWAGE
- THEY PERFORM NO OTHER SERVICES (WITH THE
ONE EXCEPTION THAT CMSD ALSO PERFORMS
TRASH COLLECTION SERVICES)
- WE DO NOT HAVE THE PROBLEM OF CONVINCING
ANYONE THAT WE HAVE A SERVICE TO OFFER
THAT THEY NEED
- THE DISTRICTS' ROLE IS TO PROTECT THE
PUBLIC HEALTH AND SAFETY

UNFORTUNATELY, PROPOSITION 13 REDUCED
DISTRICT REVENUES BY OVER 60%. FIVE
YEARS LATER WE ARE STILL RECEIVING LESS
THAN WE DID PRIOR TO ITS ADOPTION. WITH
HIGHER ENERGY COSTS, THE EFFECTS OF
LONG-TERM INFLATION AND MORE STRINGENT
TREATMENT REQUIREMENTS MANDATED BY
FEDERAL AND STATE REGULATORY AGENCIES, WE
SIMPLY CANNOT PROVIDE THAT PROTECTION
FACED WITH SUCH A DEFICIT
- WITH REGARD TO WHETHER IT IS A TAX OR A
FEE THERE IS NO DOUBT THAT IT IS A
FEE
- THE PROPOSED FEES ARE BASED UPON USE
WHEREAS PROPERTY TAXES ARE BASED ON THE
VALUE OF THE PROPERTY AND HAVE NO DIRECT
RELATIONSHIP TO USE
- FURTHER, THE DISTRICTS HAVE HAD STATUTORY
AUTHORITY SINCE THEIR ENABLING
LEGISLATION - LONG BEFORE PROPOSITION 13
- TO ADOPT USE FEES AND TO COLLECT THEM
ON THE PROPERTY TAX BILL
- THE REASON WE PROPOSE TO COLLECT THE FEE
ON THE TAX BILL IS THAT IT IS THE MOST
COST-EFFECTIVE METHOD
- THE PROPERTY TAX BILL IS A MECHANISM THAT
IS ALREADY IN PLACE AND IS THEREFORE THE
MOST CONVENIENT AND LEAST COSTLY METHOD.
ANY OTHER METHOD WOULD BE CONSIDERABLY
MORE EXPENSIVE, THE COST OF WHICH WOULD
HAVE TO BE ADDED TO THE USE FEE AND,
THUS, INCREASE IT
- THERE IS NO USE FEE SYSTEM FOR SEWER
SERVICES THAT IS TOTALLY EQUITABLE
- THIS IS THE REASON THE PROPOSED
PROCEDURES PROVIDE FOR AN APPEAL PROCESS
TO ENABLE AN ADJUSTMENT OF FEES 'WHERE A
GROSS INEQUITY IS DEMONSTRATED
- WE HAVE DEVELOPED OUR PROPOSED CHARGES
FROM STUDIES THAT HAVE DETERMINED THE
AVERAGE USES FOR THE VARIOUS CLASSES OF
USERS
- BASED ON THIS AND THE FUNDING
REQUIREMENTS OF THE DISTRICTS, WE HAVE
PROPOSED SEPARATE RATES FOR SINGLE-FAMILY
DWELLINGS, MULTI-FAMILY DWELLINGS AND
COMMERCIAL/INDUSTRIAL USERS
I MIGHT ADD PARENTHETICALLY THAT LARGE
COMMERCIAL OR INDUSTRIAL DISCHARGERS THAT
PLACE AN INORDINANT DEMAND ON OUR SYSTEM
ARE SUBJECT TO A SURCHARGE UNDER A

SEPARATE INDUSTRIAL WASTE ORDINANCE THAT
HAS BEEN IN EFFECT SINCE 1976
NOW, SOME HAVE SUGGESTED THAT WE INSTALL
METERS AND MEASURE THE SEWAGE DISCHARGE
- FIRST, THERE IS NO RELIABLE SEWAGE METERING
DEVICE THAT MEASURES FLOW FROM HOUSEHOLD
AND OTHER SMALL CONNECTIONS
EVEN IF THERE WERE, I WOULD NOT HAZARD A
GUESS AT THE COST TO PURCHASE 27, 000
METERS, DIG 27, 000 HOLES IN THE STREET
AND THE FRONT YARDS OF PROPERTY OWNERS TO
INSTALL THEM AND THEN THE ONGOING EXPENSE
`..� OF MAINTAINING
OTHERS HAVE SUGGESTED THAT WE BASE THE
CHARGE ON THE WATER USAGE. THIS METHOD
IS WROUGHT WITH PROBLEMS ALSO
- FIRST, THERE ARE INHERENT INEQUITIES
BECAUSE ALL OF THE WATER THAT IS USED
THAT DOES NOT END UP IN THE SEWER
- AN EVEN BIGGER PROBLEM IS THE FACT
THERE ARE FOUR SEPARATE WATER
PURVEYORS IN THE DISTRICTS

- EACH WITH ITS OWN SEPARATE SYSTEM
SOME OF WHICH ARE NOT VOLUME BASED
BUT, RATHER, USE A FLAT RATE, NONE OF
WHICH ARE CURRENTLY COMPATIBLE WITH
OUR SYSTEMS
- IT WOULD BE MOST DIFFICULT AND
EXPENSIVE TO DESIGN A BILLING SYSTEM
THAT WOULD BE COMPATIBLE FOR 6
SEPARATE AGENCIES, EITHER TO TRANSFER
TO THE PROPERTY TAX BILL OR TO
INSTITUTE A SEPARATE BILLING SYSTEM
AND WOULD SUBSTANTIALLY INCREASE THE
COSTS OF ADMINISTERING THE SYSTEM,
ADDING 15% TO 20% TO THE COST
- FURTHER, OUR EXPERIENCE IS THAT THE
WATER AGENCIES ARE NOT OVERLY
ENTHUSIASTIC ABOUT UNDERTAKING THE
HEADACHES ASSOCIATED WITH COLLECTING
A SEWER SERVICE CHARGE VIA THEIR
WATER BILL
THAT IS WHY WE FEEL - ALL FACTORS
CONSIDERED - THE PROPOSED SYSTEM IS THE
BEST ONE AVAILABLE AT THIS TIME, THAT IT
ACHIEVES REASONABLE EQUITY WITHOUT
INCURRING HIGH COSTS OF
ADMINISTRATION

AT THIS TIME I WOULD LIKE TO POINT OUT THAT
BASED ON THE PUBLIC COMMENTARY ON THE EQUITY
ISSUE, WE ARE RECOMMENDING A CHANGE IN THE
PROPOSED FEE SCHEDULE. THE PROPOSED
MODIFICATIONS ARE SUMMARIZED ON THE GOLDENROD
SHEET IN THE DIRECTORS FOLDERS AND MADE
AVAILABLE TO THE PUBLIC IN THE LOBBY.

CMSD IS FURTHER RECOMMENDING A REDUCTION OF

COMMERCIAL/INDUSTRIAL PROPERTIES
IT MUST BE UNDERSTOOD THAT WE ARE WORKING
WITH AN IMPERFECT DATA BASE, BUT AS WE ARE
ABLE TO REFINE THE DATA BASE IN THE FUTURE,
THE STAFF WILL CERTAINLY PRESENT APPROPRIATE
RECOMMENDATIONS TO THE BOARD TO LEVEL OUT ANY
OTHER APPARENT INEQUITIES THAT SURFACE
- HOWEVER, I REITERATE, THE PROPOSED PROCEDURES DO
PROVIDE A MECHANISM WHEREIN GROSS INEQUITIES
CAN BE CORRECTED ON A CASE-BY-CASE BASIS

TO ADMINISTER THE BUSINESS OF ALL SEVEN.
COSTS ARE CHARGED TO EACH DISTRICT AS
SERVICES ARE PERFORMED FOR IT THROUGH A
SOPHISTICATED COST ACCOUNTING SYSTEM
- THROUGH TIGHT BUDGETARY CONTROL AND
ADMINISTRATION, THE SANITATION DISTRICTS
PRESENTLY HAVE FROZEN 14% OF ITS AUTHORIZED
PERSONNEL CLASSIFICATIONS WHICH REMAIN VACANT
- THE DISTRICTS CONTRACT MANY SERVICES WITH
PRIVATE FIRMS RATHER THAN HIRE FULL-TIME
PROFESSIONAL STAFF MEMBERS

SEWER SERVICE CHARGE REPORT FOR FISCAL YEAR 1983-84
This report is prepared pursuant to the requirements of California Health and Safety Code
Section 5473.
County Sanitation District No. 6 is responsible for the collection, treatment and
disposal of wastewater generated within its boundaries. These services are essential to
the protection of the health and safety of the public served by the system. District No.
6 revenues from ad valorem taxes on real property decreased significantly after passage
of Proposition 13 in 1978. Future tax revenue, estimated in reports on file in the
office of the Secretary of the District, will be insufficient to provide the funding
necessary to operate, maintain and rehabilitate the system. Therefore, a sewer service
charge is necessary to supplement the District's revenue sources in the upcoming fiscal
year.
The Board of Directors of County Sanitation District No. 6 proposes consideration of an
ordinance that will prescribe fees and charges for sanitary sewer services provided by
the District to be charged to the respective parcels of property within the territorial
jurisdiction of the District. This report contains a description of each parcel of real
property that will receive the services of the District and have access to utilization of
the facilities, said parcels of real property being described by reference to maps
prepared in accordance with Section 327 of the California Revenue and Taxation Code and
on file in the office of the County Assessor, which maps are hereby incorporated herein
by reference. The Ordinance under consideration by the governing Board of Directors of
the District will provide revenues that shall be used only for the acquisition,
construction, reconstruction, maintenance, operation and rehabilitation of sanitary sewer
facilities, and shall not be used for the acquisition, construction or maintenance of new
local street sewers or laterals as distinguished from main trunk, interceptor and outfall
sewers provided by the District.
The proposed sewer service charge for fiscal year 1983-84 to be assessed against each
user of the District' s sewerage system based upon the average volume of wastewater
discharged by a series of user classes is set forth in Table A, attached hereto. Said
table also sets forth exemption provisions. The estimated 1983-84 charge for each parcel
based on the last equalized assessment roll is on file in the office of the Secretary of
the District.
If the proposed ordinance is adopted, the Board of Directors may elect to have such
charges for the forthcoming fiscal year collected on the tax roll in the same manner, by
the same persons, and at the same time as, together with and not separately from, the
general taxes of the District and the County of Orange.
At the time stated in the notice setting the public hearing on this report, the governing
Board of Directors shall hear and consider all objections or protests, if any, to said
report referred to in said notice, and may continue the hearing from time to time.

Condominiums: Condominiums are considered single-family dwellings. However, in
recognition of the limited potential use of small, converted dwelling units, the owner of
a single unit may apply for a reduction of the annual rate from $26.40 to $15.85,
provided the unit has less than 11 plumbing fixture units (determined as follows) :

Commercial/Industrial: To recognize buildings in this classification where the use of
the sewer system may not be directly related to the size of the building such as in a
warehousing type of use, any owner of a single building may apply for, a reduction of the
calculated fee to a minimum annual fee of $15.85, provided said building contains less
than 11 plumbing fixture units (as determined above) .
In recognition that certain legal parcels of real property exist within the District
which are not connected to the District system and that other properties acquire
considerably greater potable water than is ultimately discharged to the District's
system, it is the intent of the District that said parcels be exempt totally or in part
from the payment of charges as prescribed herein.
Any property owner may appeal the assessment of the charges and submit a claim for rebate
to the District on the forms prescribed and provided by the District, within one hundred
twenty (120) days after the annual property tax bills are mailed by the Orange County Tax
Collector. All applications for rebate of an assessment will be determined by the
General Manager of the District, who may grant a partial or full rebate or adjustment of
the charge based on receiving satisfactory proof that an inequity exists between the
amount of assessment and the amount of wastewater discharged to the District's system. -..-
Such inequities may include, but are not limited to:

a) no service connection to the District system exists from the parcel assessed
b) the actual use on the parcel differs from the use indicated by the assessment
c) principal water use is agricultural
d) any other use wherein the amount of wastewater discharged to the District's
system is significantly less on a regular basis than the amount that would
normally be expected to be discharged by the class of property in question.
Pursuant to the authority granted by California Health and Safety Code Section 5473, all
charges established herein shall be collected on the County Tax Roll in the same manner,
by the same persons and at the same time as, together with and not separately from, its
general taxes.
In the event District determines that errors or inequities exist in the amount of charges
to be collected by the County Tax Collector, District may submit a bill for any
difference directly to the property owner. Said invoiced amount shall be due and payable
within thirty (30) days of invoice date.
A credit shall be allowed to all dischargers permitted pursuant to Article 3 of Ordinance
No. 606 for the annual sanitary sewer service charge established by this Ordinance in the
same manner as credit is allowed for ad valorem taxes pursuant to Sections 302.6, 303.6
and 304 .5B4 of Ordinance No. 606.

ESTABLISHING SANITARY SEWER SERVICE CHARGES
The Board of Directors of County Sanitation District No. 6 of
Orange County, California, does hereby ORDAIN as follows :
Section 1: Purpose. The purpose of this Ordinance is to
establish a system of sanitary sewer service charges required to
be paid by property owners for the services and facilities
furnished by the District in connection with its sanitation
treatment works and sewage collection system.
Revenues derived under the provisions of this Ordinance shall
be used for the acquisition, construction, reconstruction,
maintenance and operation of the sewage collection facilities and
wastewater treatment and disposal facilities of the District,
together with costs of administration and provisions for
necessary reserves.
Section 2: Annual Sanitary Sewer Service Charge. Each
parcel of real property located within the District which, is
improved with structures designed for residential, commercial or
industrial use and connected to the District's system, shall pay
a sanitary sewer service charge based on the average volume of
wastewater discharged by a class of users in the sum or sums as
set forth in Table A of this Ordinance.
Section 3: Application of Ordinance. The provisions of this
Ordinance shall be in addition to Ordinance No. 606 of the
District establishing regulations for use of District's sewage
facilities, including provisions for payment of charges or fees

related thereto.
Section 4: Exceptions. The provisions of this Ordinance
shall apply to all properties in the District, and no exception
shall be provided for properties otherwise deemed exempt by
provisions of the State Constitution or statute , such as
properties owned by other public agencies or tax exempt
organizations, except as expressly provided in Section 5 hereof.
Section 5: Exemptions and Appeals. In recognition that
certain legal parcels of real property exist within the District
which are not connected to the District system and that other

ultimately discharged to the District's system, it is the intent
of the District that said parcels be exempt totally or in part

Section 6: Assessment Based on Fiscal Year. The sanitary
sewer service charge established by this Ordinance shall be for
the fiscal year commencing July 1 and terminating. June 30, and
there shall be no proration of such charges.
Section 7: Method of Collection. Pursuant to the authority
granted by California Health and ,Safety Code Section 5473, all
charges established herein shall be collected on the County Tax
Roll in the same manner, by the same persons and at the same time
as, together with and not separately from, its general taxes.
The County Tax Collector is authorized and hereby ordered to make
said collections in accordance with the terms and conditions of
agreements between the County of Orange and this District.
In the event District determines that errors or inequities
exist in the amount of charges to be collected by the County Tax
Collector , District may submit a bill for any difference directly
to the property owner. Said invoiced amount shall be due and
payable within thirty (30) days of invoice date .
Section 8: Credit for Industrial Permittees: A credit shall
be allowed to all dischargers permitted pursuant to Article 3 of

Ordinance No. 606 for the annual sanitary sewer service charge
established by this Ordinance in the same manner as credit is
allowed for ad valorem taxes pursuant to Sections 302. 6, 303. 6
and 304. 5B4 of Ordinance No. 606.
Section 9: Severability. If any provisions of this
Ordinance or the application to any person or circumstance is
held invalid by order of court, the remainder of the Ordinance or
the application of such provision to other persons or other
circumstances shall not be affected .
Section 10: Effective Date: This Ordinance shall become
effective July 9 , 1983 .
Section 11: The Secretary shall certify to the adoption of
this Ordinance and shall cause the same to be published in a
newspaper of general circulation in the District as required by law.

WHEREAS, the Board of Directors of County Sanitation District No. 6 has
heretofore adopted Ordinance No. 607, An Ordinance of the Board of Directors of
County Sanitation District No. 6 Establishing Sanitary Sewer Service Charges;
and,
WHEREAS, said Ordinance provides that such charges shall be collected on
the County tax roll in the same manner, by the same persons, and at the same
time as, together with and not separate from, its general taxes.
NOW, THEREFORE, the Board of Directors of County Sanitation District
No. 6 of Orange County, California.
DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the County Auditor-Controller is hereby ordered and
directed to include sewer service charges adopted for 1983-84 pursuant to
Ordinance No. 607, on the 1983-84 property tax bills for collection; and,
Section 2. That the General Manager be, and is hereby, authorized and
directed to execute any necessary documents or agreements to effect the order
set forth in Section 1 herein.

Dear Sir,
We received our notification regarding the new charge for sewer systems. We don't
mind paying our share along with the rest of the taxpayers, but our real concern is the lack
of care given to the sewer in our area. There is a drain on the corner of VanBuren and
Paularino which is always full and running over down the gutter for at least two blocks.
The stench is nauseating. When called, the City does come & clear the drain, but this only
lasts for a few days & it is running over once again. I'm sure if the Health Department were
to inspect the area they would consider it a health hazard.
Again, we aren't complaining primarily about the charge, but we definitely are
regarding the mess on the corner.

Gentlemen:
Our Corporate Tax Department forwarded your proposed sewer fee structure
for our bank offices in Costa Mesa. The proposed fee structure appears to be
completely out of line with amount of water used by a commercial store.
In the case of our Security Pacific Bank offices, we do not have dishwashers
and showers and the public does not have access to our restrooms. We are like
any small commercial store that uses less water than a private residence and
less than 5% of a restaurant of equivalent size.
It is definitely unfair to charge a sewer fee based upon square footage. A
sewer use fee should be based upon metered water consumption less the estimated
use for lawn irrigation. This would provide a fair and sound basis for getting
the necessary operating fees while being fair to all participants. A fee based
upon square footage or connection size is not fair or equitable to anyone.
I am enclosing our three parcels located within the Sanitation District that
shows proposed fess to exceed $275 per year when our water bill (including
irrigation) is less than this amount.

Subject: Proposed Sewer Use Fees
I know you to be of good will and I am sure you are motivated
by the best of intentions. host of us recognize your need for
more money .
however, we are concerned about the criteria you are basing the
"Fee" on. 'the most equitable base would be on water consumption.
Those figures can be had from co-operating water purveyors using
their computer systems . Lacking that, at least use the 1980 census
as to bathrooms, sinks, sewer size or number of occupants in resid-
ential units.
After talking to only a few commercial and industrial users the
square footage base appears unfair. Some C&I users take only a
V../ token amount of water, and others relatively large amounts.
Again water consumption seems the only fair way to base a fee.
Considering the political climate in Sacramento and the attitude
of some board of supervisors in some counties toward SPECIAI DISTRICTS
I think you would want to present yourselves in a more fair minded
and favorable light. Your timing on the workshops and the Public
Hearing leaves much to be desired . You slated them for the Memorial
Day, Fish Fry and School Graduation periods. You allowed , very-. lit:tle
lead time for sanitation users to study your proposal. I 'd like
to believe that was not ycur intention. Your credibility will be
injured if you now claim their is no time left to rectify the base
for the "Use Fee" .
We are going to live with these fees for a long time. Establish
them fairly.

Proposed Costa Mesa Sanitary District User Fee
Dear Mr. Wright :
Your letter to Mayor Donn Hall has been referred to me for
response. First , the Costa Mesa Sanitary District is not
a part of the Costa Mesa City government; it is a separate
independent district involved in liquid and solid waste
collection.
Secondly, there are several areas of north and northeast New-
port Beach which are within the boundaries of the Costa Mesa
Sanitary District. I have reviewed the district ' s maps and .
�..d found your area is in and served by the Costa Mesa Sanitary
District .
Thirdly, the proposed fee is a "user fee" and not a tax. The
County of Orange acts as the District ' s assessor, treasurer ,
and collector and therefore would place the user fee on the
tax bill . The fee is not a flat rate applied to all properties
like the ad valorem tax. It is a user fee based on sewerage
flow for various property type categories , i .e . , single
family, multiple family, commericial/industrial , etc . The
Costa Mesa Sanitary District no longer has the authority to
establish ad valorem tax rates but has been empowered through
State Legislation (The Sanitary Act of 1923) to establish fees
for the purpose of generating revenues to pay for services
rendered . Included would be the day to day operation, main-
tenance , repairs and rehabilitation of existing facilities
(sewer lines and pump stations) .

Pursuant to the adjournment of the regular meeting of June 8, 1983, the Board of
Directors of County Sanitation District No. 6 of Orange County, California met in an
adjourned regular meeting at the above hour and date in the Costa Mesa City Hall Council
Chambers.
The Chairman called the meeting to order at 7:30 p.m. The roll was called and the
Secretary reported a quorum present.

Public Hearing on proposed The Chairman declared the hearing on
Ordinance No. 607 Establishing Ordinance No. 607, An Ordinance of the Board
Sanitary Sewer Service Charges_ of Directors of County Sanitation District
No. 6 of Orange County, California,
Establishing Sanitary Sewer Service Charges, and the County Sanitation District No. 6
Sewer Service Charge Report for Fiscal Year 1983-84, open at 7:30 p.m.
The Assistant General Manager reported that this was the time and the place noticed
for the purpose of receiving a written report pertaining to the providing of sewer
service for all properties within the District and to consider Ordinance No. 607 to
establish a fixed service charge to be collected on the property tax roll for the
1983-84 fiscal year.
Official notice of this hearing (held jointly with a public hearing of the Costa Mesa
Sanitary District) for the purpose of establishing sewer service charges, was mailed
on May 23, 1983, to over 27,000 property owners of record on the last equalized
assessment roll of the County of Orange, in accordance with the provisions of Section
5473.1 of the California Health and Safety Code.

As prescribed by law, a legal notice of the hearing was published in the Orange Coast
Daily Pilot on May 17, 1983 and again on May 25, 1983. In addition, advertisements
describing the proposed sewer service fees and announcing the public workshops and
hearing were published in the Daily Pilot on May 23, 26 and 31, 1983, and in the
Costa Mesa News on May 25 and June 1, 1983. News releases were also provided to the
press on May 23, 1983.
The Assistant General Manager then described other staff efforts to inform the public
of the proposed sewer service fee program, including:
- Three public workshops as follows:
No. 1 - On May 31 in the Costa Mesa City Council Chambers
Attendance: 26
No. 2 - On June 2 in the Costa Mesa City Hall Council Chambers
Attendance: 26
No. 3 - On June 6 at the Neighborhood Community Center on Park Avenue
Attendance: 35
- Meeting with the Board of Directors of the Costa Mesa Chamber of Commerce on
May 17th; Attendance: 11
- Letters mailed to the presidents of the 14 homeowner associations in the City
of Costa Mesa. ,
- Contact with the presidents and/or program directors of several professional
and service clubs in the District and offering to speak to their membership,
including the Lions, Kiwanis, Rotary, Optimists and the Newport-Costa Mesa
Board of Realtors.
Mr. Sylvester reported that the purpose of the hearing was to consider a resolution
of the serious financial problems faced by District No. 6. He reported that there
were three major reasons for these financial problems. First, District No. 6 has an
old sewer system which is in need of major rehabilitation. Second, operating costs
have increased dramatically over the past several years due to factors beyond the
control of the Districts, such as, skyrocketing energy costs, escalating inflation,
and more stringent treatment requirements imposed by Federal and State agencies.
Finally, the District's revenues have decreased by over 60% since 1978.
Following a brief slide presentation depicting the issues facing the District, Mr.
Sylvester summarized the public commentary to date which dealt primarily with the
issues of:
- Proposition 13 and the issue of tax vs. fee
- The equitability of the proposed system of charges
- Whether or not the proposed fees would be used to pay for sewers to
accommodate growth
- The relationship of the local sewer system operated and maintained by the
Costa Mesa Sanitary District and the regional system of County Sanitation
District No. 6

He also reported that 512 of the response cards attached to the mailed notice of the
hearing were returned.
- 161 property owners indicated that their properties were not connected or they
were unsure whether their properties were connected to the local sewer system
- 213 owners questioned the accuracy of the data upon which their charge was
based or the calculation of the charge
- 12 owners advised of a change in ownership
- 19 owners questioned the Proposition 13 issue
- 91 owners merely returned the card with no response
- 16 owners had miscellaneous comments
- 2 owners sent in checks in payment of the fees
The Districts staff also received 205 telephone calls asking the same kinds of
questions raised at the public workshops.
The Assistant General Manager then addressed each of the issues raised in the public
meetings. He explained the role of the District as an operating utility providing an
essential service necessary for the protection of the public health and safety, and
indicated that the District was established solely to provide wastewater collection,
treatment and disposal services to the community. Mr. Sylvester further explained
that while the District has always had the statutory authority to levy a sewer
`ard service fee, it had historically financed its operations, maintenance and
rehabilitation activities from the property tax. The 60% reduction in tax revenues
resulting from the passage of Proposition 13 and its implementing legislation
combined with higher energy costs, the effects of high inflation over the past
several years, and more stringent treatment requirements mandated by Federal and
State regulatory agencies have resulted in operating deficits for the District.
He indicated that the proposed sewer service fee is based upon usage of the sewer
system, whereas property taxes are based upon the value of the property and have no
direct relationship to use, and further pointed out that it was the Board's declared
intent that the fee be as equitable as possible, all factors considered. Mr.
Sylvester also explained that the reason for collecting the fee on the property tax
bill is that it is the most cost-effective billing and collection method available,
and results in lower costs to each property owner.
The Assistant General Manager and the General Counsel highlighted the appeal process
available to all property owners to allow for an adjustment of fees in the event of a
demonstrated inequity, and stated that property owners had been encouraged to send in
the postcards attached to their notices to initiate staff evaluation of any problems
perceived by the property owner.

Mr. Sylvester then outlined recommended adjustments to the proposed District fee
schedule published in the notice. The downward adjustments in the proposed fees for
small apartments with only one bathroom facility that had been converted to
condominiums and for commercial operations such as warehouses which have limited
sewer usage were developed based upon public comments made at the three workshops.

reasons therefor being those previously summarized by staff from the public meetings.
Following responses to the public oral comment by Directors, counsel and staff, the
Chairman declared the hearing closed at 10:58 p.m.
