Revising Sewer Con.~ection Charges for Use of District Sewerage Facilities (3) Other business and conmrunications, if any.· (4) Consideration of motion to adjourn ORDINANCE NO. 717 AN ORDINANCE AMENDING ORDINANCE NO. 716, REVISING SEWER CONNECTION CHARGES FOR USE OF DISTRICT SEWERAGE FACILITIES The Board of Directors of County Sanitation District No. 7 of Orange County, California, does hereby ORDAIN as follows: Section 1. Section 402.2 of Ordinance No. 716 is hereby repealed. Section 2. Section 402.2 is hereby added to Ordinance No. 716 to read: 402.2 DISTRICT NO. 7 CONNECTION CHARGES Before any connection permit shall be issued, the applicant shall pay to the District or its agent the charges specified herein. (a) Connection charge for new construction, family dwelling buildings. For each new family dwelling building constructed, the connection charge shall be $250.00 per dwelling unit. (b) Connection charge for existing family dwelling buildings. For the connection of each existing family dwelling building, the connection charge shall be $250.00 per dwelling unit. (c) Connection charge for new construction and existing structures, other than family dwelling buildings. For all other new construction, including but not limited to commercial and industrial buildings, hotels and motels, and public buildings, the connection charge shall be $50.00 per 1,000 square feet of floor area contained within such construction, provided that the minimum connection charge for such new construction shall be $250.00. -1- (d) Connection charge for replacement buildings. For new construction replacing former buildings, the connection charge shall be calculated on the same basis as provided in Paragraphs (a) and (c) above. If such replacement construction is commenced within two years after demolition or destruction of the former building, a credit against such charge shall be allowed and shall be the equivalent connection charge for the building being demolished or destroyed, calculated on the basis of current charges for new construction. In no case shall such credit exceed the connection charge. (e)' Connection charges for additions to or alterations of existing buildings. In the case of structures where further new construction or alteration is made to increase the occupancy of family dwelling buildings or the area of buildings to be used for other than family dwelling buildings, the connection charge shall be $250.00 for each dwelling unit added or created and in the case of new construction other than family dwelling buildings, it shall be $50.00 per 1000 square feet of additional floor area contained within such new construction, provided such new construction shall contain additional fixture units. (f) Trunk Connection Charge, Residential Uses. Family Dwelling Unit. $6.00 per front foot for the real property fronting on and connecting to a trunk sewer provided that no such charge shall be less than $400.00 plus the applicable regular connection charge for family dwelling units hereinabove specified. -2- (g) Connection Charge, Offsite Sewers not a Part of Master Plan Relative to Reimbursement Agreements. The charges for connections to offsite sewers which are not included as a part of the District Master Plan and for which a Non-Master Plan Reimbursement Agreement has been entered into between the District and the property owner shall be in the amount provided for in said agreement. The amount set forth in said agreement shall be the amount due whether the original agreement is still in force, has been extended or has expired. These connection charges shall be in addition to any other charges hereinabove established for the property connecting to said facilities. (h) Trunk Connection Charge, Commercial or Industrial Establishments. $10.00 per front foot for the real property fronting on and connecting to a trunk sewer, provided that no such front foot charge shall be less than $500.00, plus $50.00 per 1,000 square feet of floor area contained in said property. (i) Assessment District Connection Charge. The regular connection charges provided in the preceding subsections of this Article, plus a sum of money equal to the assessment charge without interest, or Treasurer's charge which would have been made against the real property on which said improvements are located had said real property been assessed within the Assessment District which constructed or acquired the Assessment District sewer to which connection is made. (j) When charge is to be paid. Payment of connection charges shall be required at the time of -3- ,..'-... <# ..... '\·_ issuance of the building permit for all construction within the District. (k) Schedule of charges. A schedule of charges specified herein will be on file in the office of the Secretary of the District and in the Building Department of each City within ·the District. (1) Biennial Review of Charges. At the end of two years from the effective date of this Ordinance, and every two years thereafter, the Board of Directors shall review the charges established by this article and if in its judgment such charges require modification, an amendment to this Ordinance will be adopted establishing such modification. Section 3. The effective date of this Ordinance shall be --------------~ Section 4. The Secretary of the Board is directed to certify to the adoption of this Ordinance and cause it to be published in a newspaper of general circulation ·within the County. NOTES JANUARY 19, 1983 -5:30 P.M. Mr. Harper gave a brief staff report. He indicated that the Board is being asked to amend the current connection fee charge on industrial development. District 7 was the first District to have a connection fee adopted many years ago when it was mostly a residential area. Started with $50 and escalated to $250. For industrial and commercial property is on an acreage basis, $625/acre. With the type of development occurring in the District now, it is not going to cover the capital cost for the development because they are getting into some highrise type of development. Are recommending the ordinance be modified so property can be served on a square footage basis -$50 per 1000 s q. ft. Wieder asked if there was an average square footage and was advised no. Affects Irvine Industrial Complex. Some tall buildings and others single story. FAH advised that we are using the same rate as we are using in other Districts. Is consistent with other Districts. Vardoulis gave an example re one acre, normally get 5-7 dwelling units or 11,000 to 15,000 sq. ft. for residential acre. $400-500. For commercial development may put 10 stories on an acre: many, many hundreds of thousands of square feet. Usage high also. Heather asked if there was much vacant land left? Vardoulis answered, yes, property is so valuable that new buildings will either be modified or demolished and will build highrises. Smith added the east Orange area has a potential of 20,000 acres. FAH explained that the first reading of this ordinance was at the January 12th meeting and the second reading is today. Ordinance will take affect 30 days from today. Not required to hold hearing. Ordinance will be published in local newspaper within 15 days of adoption . The Chairman called the meeting to order at 5:35 p.m. The roll was called and the Secretary reported a quorum present. Butler, Secretary, Rita Brown * * * * * * * * * * * * * * Following a brief staff report, it was moved, seconded and duly carried: That proposed Ordinance No. 717, An Ordinance Amending Ordinance No. 716, Revising Sewer Connection Charges for Use of District Sewerage Facilities be read by title only; and, FURTHER MOVED: That the second reading of said ordinance in its entirety be, and is hereby, waived, whereupon the Secretary read Ordinance No. 717 by title only.
