Subject: Certification of Negotiated Fee for Engineering Services
in Conjunction with Rehabilitation of the Pacific Coast
Highway Trunk Sewer from Dover Drive to Rocky Point
Pump Station, Contract No. 5-18R
In accordance with the District's procedures for selection of professional
engineering services, the Selection Committee, as authorized by the Districts
Board of Directors pursuant to minute order of April 29, 1981, has negotiated
the following fee with Shaller & Lohr, Inc. for engineering services in
conjunction with the Rehabilitation of the Pacific Coast Highway Trunk Sewer
from Dover Drive to Rocky Point Pump Station.

Preparation of Plans and Specifications
Phase II -Construction
Field survey and construction consultation
Phase I shall be at the per diem basis not to exceed $35,000.
Phase II shall be at the per diem basis not to exceed $20,000.
The Selection Committee hereby certifies the above final negotiated fee as
reasonable for the services to be performed, and that said fee will not result
in excessive profits for the consultant.

A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY
SANITATION DISTRICT NO. 5 OF ORANGE COUNTY,
CALIFORNIA, APPROVING AGREEMENT WITH SHALLER &
LOHR, INC. FOR ENGINEERING SERVICES RELATIVE TO
REHABILITATION OF PACIFIC COAST HIGHWAY TRUNK

WHEREAS, the Boards of Directors of County Sanitation Districts
Nos. 1, 2, 3, 5, 6, 7 and 11 of Orange County have heretofore adopted
a policy establishing procedures for the selection of professional
engineering and architectural services; and,
WHEREAS, pursuant to said procedures an agreement has been
negotiated with Shaller & Lohr, Inc. for engineering services relative
to Rehabilitation of the Pacific Coast Highway Trunk Sewer from Dover ,,
Drive to Rocky Point Pump Station, Contract No. 5-18R, which said
certification has been approved by the General Manager.
NQW, THEREFORE, the Board of Directors of County Sanitation
District No. 5 of Orange County, California,
DOES. HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the certain agreement dated
by and between County Sanitation·District No. 5 of Orange County
and Shaller & Lohr, Inc. for engineering services in connection
with Rehabilitation of Pacific Coast Highway Trunk Sewer from Dover
Drive to Rocky Point Pump Station, Contract No. S-18R, is hereby
approved and accepted; and,

Section 2. That payment for said services is hereby
authorized in accordance with the provisions set forth in said
agreement on a per diem fee basis, for a maximum amount not to
exceed $35,000.00 for Phase I work and for a maximum amount not to
exceed $20,000.00 for Phase II work; and,
Section 3. That the Chairman and Secretary of the District are
hereby authorized and directed to execute said agreement in form
approved by the General Counsel.

APPROVING AGREEMENT WITH THE IRVINE COMPANY FOR
ADVANCE PAYMENT OF CONNECTION FEES AND REIMBURSE-
MENT THEREOF
A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY
SANITATION DISTRICT NO. 5 OF ORANGE COUNTY, CALIFORNIA,
APPROVING AN AGREEMENT WITH THE IRVINE COMPANY FOR
ADVANCE PAYMENT OF FEES AS AN AID IN CONSTRUCTION
OF FACIL-ITIES TO SERVE THE BIG CANYON DRAINAGE AREA
AND PROVIDING FOR REIMBURSEMENT THEREOF

WHEREAS, the District and The Irvine Company entered into an
agreement on May 12, 1976, for advance payment of connection charges
in order to construct the Back Bay Trunk Sewer; and,
WHEREAS, since execution of said agreement with The Irvine
Company, conditions pertaining to financing and constructing of
said facilities to serve the Big Canyon Drainage Area have
substantially changed; and,
WHEREAS, because of said changes, it appears in the best
interests of County Sanitation District No. 5 and The Irvine Company
to terminate said agreement and enter into a new agreement for
advance payment of fees as an aid in construction of facilities to
serve the Big Canyon Drainage Area.
NOW, THEREFO~, the Board of Directors of County Sanitation
District No. 5 of Orange County, California,
DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the certain agreement dated _______ ,
by and between District No. 5 and The Irvine Company, providing for
advance payment of connection fees of up to $600,000.00 to the District
to aid in the construction of facilities to serve the Big Canyon
Drainage Area (Back Bay Trunk Sewer, Contract No. 5-24.), and providing
for reimbursement to The Irvine Company, is hereby approved in form
approved by the General Counsel; and,

Section 2. That the agreement dated May 12, 1976, between
District No. 5 and The Irvine Company, be terminated and
made of no further effect; and,
Section 3. That the Chairman and S~cretary are hereby
authorized and directed to execute said new agreement on behalf

NOTE TO DISTRICT 5 DIRECTORS:
RE: ORDINANCE NO. 511 IMPLEMENTING SEWER SERVICE CHARGES
At the staff's request, the General Counsel is revising the
attached ordinance draft to clarify the provisions for adjustments
to charges for significant differences in actual volume versus
expected volume based on meter size, and the appeals procedures,
as provided for in Section 5.
Commercial and industrial dischargers permitted under
existing Ordinance No. 508 are monitored by our Industrial
Waste Division and billed quarterly based upon the actual
volume and loading of sewage discharged into the system. They
are allowed a credit against the total charge for taxes paid.
Therefore, a section will be added to Ordinance No. 511 to
allow any sewer service charges paid on the tax bill to be
included in the credit against the total fees billed under
Ordinance No. 508.
The revised wording for the above changes will be available for
review by the Board at Wednesday's meeting.
The attached draft ordinance has been distributed to District
Directors only.

ORDINANCE NO. 511
AN ORDINANCE OF THE BOARD OF DIRECTORS OF COUNTY
SANITATION DISTRICT NO. 5 ESTABLISHING SANITARY
SEWER SERVICE CHARGES
The Board of Directors of County Sanitation District No. 5
of Orange County, California, does hereby ORDAIN as follows:
Section 1: Purpose. The purpose of this Ordinance is to
establish a system of sanitary sewer service charges required
to be paid by property owners for the services and facilities

furnished by the District in connection with its sanitation treat-
ment works and sewage collection system.
Revenues derived under the provisions of this Ordinance shall
be used for the acquisition, construction, reconstruction, mainte-
nance and operation of the sewage collection facilities and
wastewater treatment and disposal facilities of the District,
together with costs of administration and provisions for necessary
reserves.
Section 2: Annual Sanitary Sewer Service Charge. Each par-
cel of real property located within the District which is improved
with structures designed for residential, commercial or industrial
use and connected to the District's system, shall pay a sanitary
sewer service charge in the sum or sums as set forth in Table A
of this Ordinance.
Section 3: Application of Ordinance. The provisions of this
Ordinance shall be in addition to Ordinance Nos. 508 and 510 of
the District establishing regulations for use of District's
sewage facilities, including provisions for payment of charges
or fees related thereto.
Section 4: Exceptions. The provisions of this Ordinance
shall apply to all properties in the District, and no exception
shall be provided for properties otherwise deemed exempt by
provisions of the State Constitution or statute, such as properties
owned by other public agencies or tax exempt organizations, ex-
cept as expressly provided in Section 5 hereof.
Section 5: Exemptions. In recognition that certain legal
parcels of real property exist within the District which are, not
connected to the District system, it is the intent of the Dis-
trict that said parcels be totally exempt from the payment of
charges as prescribed herein.
Any property own~r may appeal the assessment of the charges
and submit a claim for rebate to the District on the forms pre-
scribed and provided by the District within one hundred twenty
~ (120) days after the annual property tax bills_ are mailed by the
Orange County Tax Collector. All applications for rebate will
be determined by the General Manager of the District, who may
grant a partial or full rebate based on receiving satisfactory
proof that the number of connections on the parcel differs from
the assessment or that no service connection to the District
system exists from the parcel assessed, and his decision shall be
final.
Section 6: Assessment Based on Fiscal Year. The sanitary
sewer service charge established by this Ordinance shall be for
the fiscal year commencing July 1 and terminating June 30, and
there shall be no proration of such charges.

Section 7: Pursuant to the authority granted by California
Health and Safety Code Seetion 5473, all charges established
herein shall be collected on the County Tax Roll in the same man-
ner, by the same persons and at the same time as, together with
and not separately from, its general taxes. The County Tax
Collector is authorized and hereby ordered to make said collections
in accordance with the terms and conditions of agreements between
the County of Orange and this District.
Section 8: Severability. If any provisions of this Ordinance
or the application to any person or circumstance is held invalid
by order of court, the remainder of the Ordinance or the appli-
cation of such provision to other persons or in other circumstances
shall not be affected.
Section 9: Effective Date: This Ordinance shall become
effective immediately upon its adoption by vote of two-thirds of
the members of the Board.
Section 10: The Secretary shall certify to the adoption of
this Ordinance and shall cause the same to be published in a
newspaper of general circulation in the District as required by
law.

SANITARY SEwER SERVICE CHARGES
The Board of Directors of County Sanitation District No. 5 of
Orange County, California, does hereby ORDAIN as follows:

including provisions for payment of charges or fees related thereto.

c) principal water use is agricultural

d) any other use wherein the amount of wastewater dis-
charged to the District's system is significantly less
· on a regular basis than. the amount of potable water
received as measured by the meter on the property
Section 6: Assessment Based on Fiscal Year. The sanitary sewer
service charge established by this Ordinance shall be for the fiscal
year commencing July 1 and terminating June 30, and there shall be no
proration of such charges.

Welcome. This presentation is brought to you by
the Orange County Sanitation Districts. Our
organization--which is made up of 7 separate districts
serves an area of some two million people. We have
the responsibility of collecting, treating and
disposing of more than 215 million gallons of
sewage a day.
In this presentation we'd like to tell you about
the proposed sewer use fee that would be added to
your property tax bill this fall. We hope this
presentation answers many questions you may have on
this new fee.
We feel that the fairest way to apply this fee is
to base it on the size of your water meter. We
believe the volume of water going into a property
can be used to judge the volume of water flowing
from the property as sewage. Almost 94 percent of
all properties in District 5 have a meter size of
one inch or less.
Because of current reserves, the sewer use fee will
be less this year than in the following four years.
As you can see by this chart, the charge for a one
inch or less meter connection for the 1981-82 property
tax year will be equivalent to two dollars and twenty
cents a month, or twenty-six dollars and forty cents
for the year.

For the following four years, for the one-inch or
smaller meter, the fee is projected to be three
dollars and ninety cents a month or forty-six
dollars and eighty cents a year, dependent upon
federal regulations and inflaction factors.
This additional fee is in no way related to the sewer
service charge you pay for on your monthly water bill.
That charge is for maintenance and operation of the
City sewer system--which is connected to the
Sanitation Districts' trunk sewer system. The
District 5 use fee will be used for operation and
rehabilitation of District sewer facilities.
But why a sewer use fee for District 5?
Because of insufficient revenues, District 5, shown
here, is becoming increasing unable to finance
operation, maintenance and rehabilitation costs of
its sewer system to comply with State and Federal
regulations for public health and protection of the
environment.
The green area, shown here, traces the network of
existing pumping stations, which appear as triangles,
and interceptor sewers, which appear as lines.
Pumping stations lift sewage from low areas to a
higher level in regions such as District 5 where
gravity flow is not possible.
Because of rising energy costs, operating cost of
these pumping stations are continua~ly rising. That
means that the amount of electrical energy you consume
in your home in a month, is consumed by the average
pump station in a day.
Energy costs are currently consuming twenty-eight
percent of the sewer operating expense in District 5.

Additional funding is also required to cover the
cost of rehabilitation projects (shown here in red)
currently underway in District 5.
Over the next five years a total of ten projects
involving the renovation of pumping stations and
sewer lines will be completed --at a cost of seven
million, seven thousand dollars (at today's costs).
Aside from rehabilitating our sewer syste, these
improvements are needed to comply with State and
Federal requirements for public health •••
••• and to meet the ever more stringent environmental
regulations that protect Newport Bay. To insure this
protection --we have to impose this use fee. But
why does District 5 lack funds?
In order to gain a clear perspective of our District's
financial condition, it's important to understand a
little about the organizational structure of the
Orange County Sanitation Districts.
Our Sanitation Districts were formed in 1947. While
each District collects its own sewage and manages its
own finances, all seven districts jointly own and
operate sewerage processing and disposal facilities
thereby significantly reducing costs.
Briefly, our joint processing involves the operation
of two plants. The first, in Fountain Valley, provides
both primary and secondary treatment facilities for
the processing of up to sixty million gallons of
wastewater a day.

Our second plant, located in Huntington Beach at
the mouth of the Santa Ana River, is treating up
to one.hundred and fifty-five million gallons of
wastewater a day using primary treatment techniques.
Currently under construction at this facility is
a seventy-five million gallon a day advanced
treatment facility scheduled for completion in
mid-1982. This eighty-nine million dollar facility
is being added to comply with State and Federal
regulations.
While the Districts are united for economic sewage
processing and disposal, each is still a very
separate entity --and must meet its own expenses.
This means that each District must pay for its share
of the sewage treatment plant operations. This
share of the cost is based on the diversion structure,
where sewer lines for all seven districts converge.
Finances for each District differ, depending upon
the region served, the size of the region, the
condition of its trunk sewers, its' elevation above
sea level and other factors.
Now that you have a little background on our
collective, yet individual Sanitation Districts we
can answer the question, "Why does District 5 lack
funds?"
First of all we aren't alone in our needs. Here is
a partial list of other California areas having a
similar sewer use fee program.
The answer to the question of why we lack funds is
three-fold. First, the effects of inflation. Second,
the effects of Proposition 13 on District 5. And
third, District S's geographic location.

Here's a graphic illustration of what happened after
the passage of Proposition 13. As you can see by
this graph, our expected 1978-79 revenue was about
one million, seven hundred and seventy thousand
dollars. However, because of Proposition 13, revenue
amounted to only six hundred and seventy thousand
dollars which is a reduction of over sixty percent
.•... a situation that still exists today.
Up until this year, the Orange County Sanitation
Districts and the Board of Directors of District 5
were able to forstall the need for any additional
fee. Our reserve funds have allowed us to postpone
the fee until now. And even now we have enough in
reserve to keep the use fee at a minimum for the
1981-82 fiscal year.
Without any use fee, as this graph indicates, District
5 would plunge rapidly into a deficit condition by
the end of 1982-83 fiscal year. By the 1985-86
fiscal year, for example, total expenditures would be
a forecasted four million, two hundred thousand
dollars, while revenues and reserves would amount to
only two million, two hundred thousand dollars. We
simply cannot operate with such a deficit.
In contrast, with the proposed use fee, there will be
enough money to pay for operating and maintaining our
system over the next five years. Looking at this
graph, you can see how money allocated for rehabilita-
tion will be greater than for operating expenses from
now through the 1983-84 fiscal year --when much of
the major work will be completed. Money for operating
however, will be steadily increased over the next
five years in anticipation of continuing inflation
and operating costs of federally mandated higher
levels of treatment.

Our District is unique in many wonderful ways --but
some of the reasons why it is unique also,
unfortunately, add to our costs for sewer maintenance
and sewage pumping.
First of all, we are located at sea level. And,
while· Newport wouldn't be Newport without the Bay
and Harbor, our low elevation means high sewage
pumping costs.
And second, while we love our saltwater communities,
that same saltwater plays havoc with our sewer
system --attacking and weakening our system.
Seawater intrusion tends to corrode sewer pipes.
Two examples of this have occurred in the past three
years, one as recently as last March when a sewer
break resulted in the closing of Newport Harbor.
The site of this highly publicized break· was on
Pacific Coast Highway, directly across from the
Balboa Bay Club.
Orange County Sanitation Districts employees responded
quickly even though the break occurred on a Saturday
and they were able to divert the flow, excavate and
repair the sewer in just thirty hours.
But until repairs could be completed, there was no
choice but ot discharge directly into Newport Harbor,
through the storm sewer system. Some six million
gallons of sewage flowed into the Bay, forcing the
Health Department to quarantine the Harbor.
Obviously, District S's sewer system must be maintained
and rehabilitated. Without proper funding the
increased frequency of pipe rupture is a certainty.

We have been asked if the funds collected from the
fees would be used to expand the system to accommodate
growth of the area. We want to make it very clear
that the sewage use fee will· not be used for the
construction of growth inducing facilities.
The sewer use fee will go exclusively toward
maintaining and rehabilitating our present sewer
system --not toward an increased capacity system.
Any expansion of the system will be paid for by
private developers and not by the use fee.
In summary, we propose a sewer use fee. It will
appear as a separate item on your property tax bill
this fall. It will be based on the size of your
water meter. The charge for almost ninety-four
percent of all properties the first year will be
equivalent to two dollars and twenty cents per month,
or twenty-six dollars and forty cents for this year.?
In future years we expect the fee to be equal to
three dollars and ninety cents a· month, or forty-six
dollars and. eighty cents· -a year..
The sewer use fee is needed because District 5 is no
longer able .to finance the operating, maintenance
and rehabiritation costs of its present sewer system
w.±th current revenues.
The reason is because of a decrease in funds,
resulti~g from Proposition 13.
An increase in operating expenses because of
inflation •
... and the higher pumping costs of District 5.
Higher operating costs of federally mandated advanced
treatment processes.

We are sending you this mailer because you own property located in
District 5 of the County Sanitation Districts. Through its
system of large trunk sewers, District 5 transports sewage collected
by the City of Newport Beach's network of street sewers to the
sewage treatment plants which are jointly owned and operated
by the seven regional Sanitation Districts. The two treatment
plants treat and dispose of nearly 215· million gallons of sewage
daily. While the Districts are united to treat and dispose of
sewage economically, each is a separate public entity, with its

1981. That's why we're proposing a sewer use fee.

Because of current reserves, the fee will be less for the 1981-82
property tax year, and would be equal to $2·~ 20 ·a month C.$26,. 4Q pe~
year) for almost 94% of all sewer connected properties. For the
following four years, the fee is estimated to equal $3.9Q a month
($46.80 per year), again for almost 94% of all properties affected.
The charges for the remaining 6% are more because of higher sewage

To achieve equity, the fee is calculated on sewage volume based
upon your water meter size. Most single family homes have meters
that are 1-inch or less in size~ For economy, the fee will be
collected on your property tax statement be·ginning with the

How do I know what nIY fee will be and when will I
pay it?
Your annual fee has been printed above your name on
the maili~g label on the reve·rse side of this
hearing notice. To achieve equity, the fee is
calculated on sew~ge volume based on your water meter
size. The fee will appear on your 1981-82 tax bill.
What can I do if I feel my calculated fee is incorrect?
Complete the attached card and mail it to us. Be
sure to include the assessor's parcel number which
appears on your mailing label.
What if I feel I should be exempt from the charge?
If your property isn't connected to the city sewers,
you are exempt. Simply complete and return the
attached card and we'll contact you.
I already have a charge for sewer service on my
water bill. Why this charge?
Your water bill re£lects a modest charge for the
maintenance and operation of the City sewer system.
The City's system connects to the Sanitation
District 5 trunk sewer system. The District 5
use fee will be used £or operation and rehabilitation
o·f the District facilities.
Is this money to be used for expanding the system to
accommodate more. growth?
No. New sewe·r lines are funded by connection fees
collected on new development.
Why do you need the money?

need for extensive rehabilitation of the existing
system make this charge necessary to insure
continued operation and reliability of the system.
What do you mean by rehabilitation?
The existing sewers indicated in red on the District
map include six miles of older force mains which
need to be relined in the next five years. Four
pump stations must be revamped to insure reliability.
District engineers estimate these costs to be
$7.7 million (in today's dollars).
Can District 5 borrow from another Sanitation
District?
No. Each District is a separate entity. The money
belongs to the property owners of that District.
Likewise, District 5 money cannot be used by any
other District.
When the rehabilitation program is over, will our
use fee drop?
It is doubtful. Because of inflation we project the
operating costs will continue to climb due to high
pumping (energy) costs and the mandated higher degree
of treatment, as indicated on the graph. We hope we
can maintain the projected $3.90 per month for the
next few years. This .. ; of course, is dependent on
many thi~gs --inflation, State and Federal
requirements and other factors beyond our control.
I tho~ght under Proposition 13 any increase in taxes
had to be approved by the voters.
The proposed use fee does not require a vote under
Proposition 13. Federal Water Pollution Control
r~gulations and State Health laws require certain
public health standards be met. We really don't

the District to institute this fee are in accordance
with the Health and Safety Code of the State of
California.
What other ways could you collect this money without
putting the charge on the property tax bill?
The District could establish a separate direct
billing and collection system but this would add
$5.29 to the currently proposed annual charge.
What if the District does not implement a use charge?
The District will have insufficient revenue fo~
sewer system rehabilitation and on-going operating
costs to assure protection of ·the public health and
safety and prevent more problems such as the recent
sewer break in Pacific Coast Highway which polluted
Newport Harbor.
How do I get more information?
We'll be holding four public workshops to explain the
situation in full detail. We are making every effort
to inform all the people of District 5 -~ at each
workshop we'll have a slide presentation and District
staff will be available to answer any additional
questions you may have. The last scheduled meeting
is the public hearing on July 1st.
