as not requiring discussion or further explanation and
unless any particular item is requested to be removed from
the consent calendar by a Director, staff member, or member
of the public in attendance, there will be no separate

will be enacted by one action approving all motions, and
casting a unanimous ballot for resolutions included on the

General Electric's report dated November 7, 1980, "Tortional

of the couplings, and controls to insure optimum running
conditions to avoid future gear failures, for consideration
by the Boards at the January 14th Joint Board Meeting

Early this year, the District sold a 20-foot parcel of land
held by the District in fee to C.J. Segerstrom & Sons, because it
cut diagonally across~heir property which they sought to develop.
Although the District sold its fee for the full fair market
value (approximately $147,000.00), we got an underground ease-
ment in return at no charge. The District did agree to allow
expanded surface uses (i.e., pavement and landscaping, but no
structures) rather than simply farming.
Now the Segerstroms wish to develop their property located
easterly of Harbor Boulevard and southerly of MacArthur Boulvard.
The extension of our same sewer line (Santa Ana Trunk) also
crosses that property, but the District has only an easement.
However, the grant to us reserved to the fee owners only the
rights to farm and raise crops. Once again, the fee owner seeks
expanded surface use rights.
We secured the services of an appraiser to ascertain the
value of the expanded use. The area in question is 17,679 sq.
ft. (34 feet in width x 520 feet in lengh [approximately]). The
appraiser has set the value at $3.50 per sq. ft. or $62,000.00.
We have presented the appraisal to the owner, C.J. Segerstrom
and they have agreed to purchase it from the District at a price
of $62,000.00 payable in one lump sum, concurrently with the
execution of documents. It is recommended by your Manager and my-
self that the District approve the sale and authorize the execution
of documents.

WHEREAS, the Districts are the owners of a certain underground easement
for the installation and maintenance of sewer lines and appurtenances over a
certain portion of property owned by C. J. Segerstrom & Sons; and,
WHEREAS, C. J. Segerstrorn & Sons, as the fee owner of said property, has
the right to certain limited surface uses in the area of the Districts' underground
easement; and,
WHEREAS, the surface rights possessed by the fee owner are presently
limited to raising crops thereon and farming said land; and,
WHEREAS, the Districts have determined that granting additional surface
uses will not impair its rights in said land; and,
WHEREAS, Districts and fee owner have agreed upon the fair value of the
expanded surface rights to be granted to the fee owner.
NOW, 1HEREFORE, the Boards of Directors of County Sanitation Districts
Nos. 1 and 6 of Orange County, California,
DO HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the Chairman and Secretary of District No. 1, acting for
itself and on behalf of District No. 6, are hereby authorized and directed to
execute that certain agreement wherein, in exchange for the payment of Sixty-Two
Thousand ($62,000.00) Dollars, Districts will grant to the fee owner, C. J.
Segerstrom & Sons, and their successors-in-interest, expanded rights of use of the

surface area located over, upon, and within the Districts' sewer right-of-way
and easement area; and,
Section 2. That the Chairman and Secretary of District No. 1, acting for
itself and on behalf of District No. 6, are hereby authorized and directed to
execute that certain Declaration of Easement Rights in favor of C. J. Segerstrom &
Sons, a partnership, in form approved by the General Counsel; and,
Section 3. That the Declaration of Easement Rights shall be duly
recorded in the official records of the County of Orange.

I have reviewed the proposals submitted for the above projects and find that the Engineer's
estimate was low and that the low bid is a responsible bid. I, therefore, recommend award
to Sully-Miller Contracting Company of Long Beach, California, in the bid amount of $36,000
as the lowest and best bid for Schedule A (Contract No. 2-SA); recommend award to C.K. Pump
and Dewatering Corporation of Long Beach, California, in the bid amount of $5,235 as the
lowest and best bid for Schedule B (Contract No. 3-23R-l); and recommend rej~eion of all
bids on Schedule C (Contracts Nos. ll-6A and 11-llA). I further r end re ue ting authority

with the provisions of Section 4755 of the State Health and Safety Code, and on
December 9, 1980, publicly opened and read all bids submitted; and,
WHEREAS, the bids received have been evaluated by the Chief Engineer and
the apparent low bid exceeds the engineer's estimate by approximately one-hl.Dldred
thirty-eig~t percent (138%); and,
WHEREAS, the Chief Engineer has this day submitted a written reconunendation

The following is a brief explanation of the more important,
non-routine items which appear on the enclosed agenda and which
are not otherwise self-explanatory. Warrant lists are enclosed
with the agenda material summarizing the bills paid since the last
Joint Board meeting.
To minimize the amount of redundancy and duplication in the
agenda material and reduce the number of comments in the Manager's
Report, we have expanded the description of the agenda items in
the agenda itself, particularly with regard to change orders and
contracts which have been publicly bid and are within the contract
budget or engineer's estimate. Detailed change orders are included
in the supporting material as well as the bid tabulations for the
contracts being reconnnended for award.
Joint Boards
No. 9-a -Approving Addendum No. 1 to Job No. Pl-18.
Addendum No. 1 to these plans and specifications provides for
technical changes and clarifications in the detailed specifications
and modifies three sheets of the plans. The staff recommends
approval of this addendum.
No. 9-b -Change Order No. 1 to Job No. PW-068R-A -Rehabilitation
of Incinerator No. 2 at Headworks "C" Treatment Plant No. 2.
Change Order No. 1, in the amount of $6,222 .80, is for additional
work required to repair the stack of the incinerator. The plans for
this project were for the repair of the fire-box only. After shutting
down the incinerator and beginning work on the fire-box , a large
vertical crack, running the entire length of the stack, was dis-
covered and a portion of the fire brick was in danger of becoming
dislodged.
No time extension is recommended in this change order . The
staff reconnnends approval which increases the total contract price
from $41,395 to $47,617.80.
No. 9-c -Accepting PW-068R-A as Complete.
The contractor, J . T. Thorpe, Inc., has completed all work
within the time provided and has fulfilled all contractual obliga-
tions. One change order was issued for this project increasing
the total contract cost from $41,395 to $47,617 .80 .
The staff reconrrnends acceptance of this work, execution of
the Final Closeout Agreement and filing of the Notice of Completion
as required .
No. 9-d -Approval of Change Order No. 1 to PW-079.
This change order covers the replacement of malfunctioning
valves on the pump at "D" basin which were not originally included
in the contract. The contractor was unable to perform the tasks
included in the project until these valves were replaced.
The staff recommends approval of this change order which adds
$1,236 .15 to the contract price. There are no time extensions
included.
No . 9-e -Change Order No . 5 to Job No. J-3-1.
Change Order No. S is for the removal of a 36-inch check valve
and its replacement with a blind flange as well as to supply a
spare drive shaft and stub shaft for the engine drives in the
complex . When the work was in progress, it was discovered that
the No. 3 pump, which was to be removed, repaired and replaced,
was in a severely deteriorated condition. Because the No. 4 pump
at this Outfall Booster Station was not being used hydraulically,
a decision was made to replace the No . 3 pump with the No. 4 pump.
In order to effect this replacement, the work under this change
order is necessary to seal the discharge connection for the other
pump. In addition, it is necessary to obtain spare parts to
properly maintain these units.
The staff reconrrnends approval of Change Order No. 1 which adds
$6 ,200 to the contract price with no time extension.
No. 9-f -Change Order No. 1 to Job No. Pl-3-2.
Change Order No . 1 provides for contract revisions at two
manholes and one sanitary drain. The original plans for this
project called for the abandonment of one manhole and the construc-
tion of one manhole. Because the first manhole drains several basins,
it cannot be abandoned. Both the exi sting and the new manholes will
be coated to provide corrosion protection.
The second part of this chang e order is the relocation of an
existing 4-inch sanitary drain from the Control Center.
The amount of this chang e order is $15,534.96 and no t ime
extension is required.

No. 9-g -Authorization for Selection Committee to Negotiate
with John Carollo En ineers/Greele and Hansen for Start-U and
Training Services in Connection with Jobs Nos. P -3 and P -
The Directors, at their regular meetings of April, 1976 and
August, 1978 approved contracts with John Carollo Engineers/Greeley
and Hansen and with John Carollo Engineers separately to perform
the necessary engineering services for design and construction of
the major secondary treatment facilities, including solids handling,
at Plant No . 2 . Included in these contracts is a provision to
provide start-up and training services to Districts' personnel in
order to insure successful operation of these facilities and to
negotiate fees and addenda to the engineering contracts for these
services .
The projects are now to a point where this training can be
undertaken and the staff is requesting authority for the Selection
Committee to negotiate for these services which will be partially
grant funded.
No. 9-h -Purchase of Reconditioned Crank Shaft for No. 8
Engine in "C" Headworks.
The Districts have eight sludge gas engines of a like size in
service. The staff has located a reconditioned crank shaft for
$8,720 . The purchase of a spare crank shaft would provide in-
creased equipment reliability and would also expedite repairs to
these engines when needed. The cost of a new crank shaft would
be $15,000 and would require a twelve week delivery period.
The staff recommends approval of this item.
No. 9-i -Authorizin Staff to Solicit Pro osals and Ne otiate
Repair of Gear Boxes in B ower Bui ing.
At the August Board meeting, the Directors authorized the
General Manager to negotiate for testing services to determine the
cause of extreme wear to the drive gears on two 1500 horsepower
gas engines for the blowers supplying the air to the activated
sludge aeration basins.
A report entitled , "Tortional Vibration Studies for 1500
Horsepower Diesel Western Gear Blower Drive", dated November 7th,
has been received from General Electric. The action appearing on
your agenda requests authority to negotiate with known firms to
accomplish the recommendations set forth in the General Electric
Report . The selected firm will implement the recommendations for
the repair of the gears, modification or replacement of the couplings
and controls to insure optimum running conditions to obtain a more
reliable and less energy-consuming system for the air requirements
for the activated sludge system.

The results of the negotiations will be presented to the Boards
for consideration at the January 14th Board meeting .
No . 9-j -Claims Aga~nst the Districts .
Four claims have been made to the Districts for damages to
automobiles ranging from under $100 to in excess of $900 . The
staff recommends that they be received and filed and denied, and
referred to the Districts' liability claims administrator for
appropriate action.
No . 9-k -Purchase of Sequential Samplers.
The Districts hav e thirty of the Model 1680 samplers sold
e x clusively b y ISCO Company, C/O R. C. Hoffman Compan y. The Districts
have standardized on this model to monitor industrial discharges .
The total price for four samplers including batteries, suction lines
and strainers is $9 ,333 .30 (1980-81 Budget , $7,500).
The staff recommends that authorization be given to purchase
the four samplers with accessories from ISCO Co ., C/O R. C. Hoffman
Compan y .
District No . 2
No . 9-1 -Approv al of Change Order No . 1 to Contract No . 2-21,
Carbon Canyon Dam Interceptor .
This change order for $31 ,893 .56 covers several field altera-
tions necessitated b y utility interferences not shown on the plans .
In addition , it includes the reconstruction of six house laterals ,
additional resurfacing o f Rose Drive and sand backfill at 24 cross-
ing s of existing water mains . A time extension of 15 calendar day s
was required to perform this additional work .
The staff recommends approval of Change Order No . 1 in the
amount of $31,893.56 and the concurrent 15-day time extension .
No . 9-m -Change Order No . 2 to Contract No . 2-21.
Change Order No . 2 is an adjustment in engineer's quantities
based on the unit prices bid , to accurately reflect the actual work
performed. This change order represents an increase of $1 ,349 to
the contract price. There is no time extension associated with
this change order
The staff recoIIllllends approval of Change Order No. 2.
No . 9-n -Accepting Contract No . 2-21 as Complete.
The contractor , Prkacin Company and Runje Corporation , a joint
venture, have completed all work and have fulfilled all contractual

obligations. There are two change orders to this contract which
increase the contract price (3 .27%) from $1,015,195 to $1,048,437.56.
In addition, a time extension of 15 calendar days is included.
The staff recommends acceptance of this contract as complete,
execution of the Final Closeout Agreement and filing of the Notice
of Completion.
-Authority to Increase Purchase Order to Sladden
for s ·oils Testin on Carbon Can on Trunk Sewer, Contract
Authority is requested to increase the purchase order amount
for soils testing services from $4500 to $5180 for the Carbon Canyon
Trunk Sewer . Due to unstable soil conditions encountered during
construction, additional soils investigations have been necessary.
The staff reconnnends approval of authority to increase Purchase
Order No. 3572 to Sladden Engineering from $4500 to $5180.
No. 9-q -Authority to Expend Up to $12,600 to Repair Corroded
Manhole Channels on the Imperial Trunk.
In April, 1978 the Districts received $12,600 from Collier
Chemical Corporation to be used to repair manhole channels on the
Imperial Trunk which had corroded due to a high annnonia discharge
from Collier Chemical. It was understood at the time that the
repair work would be done at a future date when flows reduced to
a level that would allow corrective action. Authority is requested
for the staff to negotiate with known qualified contractors to
perform this work during the scheduled shutdown of the chemical
plant in January.
Districts Nos. 5 and 6
No. 9-r -Change Order No. 3 to Contract No. 5-21-1 -Construction
of "A" and "B" Trunk Sewer Facilities, Schedule "A" Alternate
Alignment Within Plant No. 2, Schedule "B" J "unction s ·tructure
Connection East Side Santa Ana River .
This change order in the additional amount of $4,092.22 is to
protect or relocate utilities not shown on the plans including
cables and pipes. In addition, the pumping of sewage from the
trench, caused by a power failure, is included. A time extension
of 10 calendar days to allow for this extra work is a part of this
change order.
The staff recommends approval of Change Order No. 3.
Reconstruction of Peninsula
Bids for this work in Districts Nos. 5 and 6 were received on

November 20th. Six bids were received ranging from a low of
$78,750 to a high of $140,000. The engineer's estimate for the
work was $52,000. There were two major items of work in these
specifications, one in District No. 5 and one in District No. 6.
In reviewing the bids, there there appears .to.., he ... an imbalance in the
bids indicating that the contractors may not have understood the
scope of the work.
Therefore, it is the staff's recommendation that all bids be
rejected and the project be readvertised after clarifications
are made in the plans and specifications.
District No. 5
No. 9-t -Approval of Change Order No. 3 to Bayside Drive
Trunk Sewer, Contract No. 5-22.
This change order covers two items of work. The first is the
location and abandonment of an unidentified connection to a 10-inch
sewer no longer in use, including excavation and road patching.
This item cost $4,731.87 and is the responsibility of the District.
Item No. 2 is extra work requested by the City of Newport
Beach and will be paid for by the City. It includes changes to
a water line thrust block, relocation of gas service and replace-
ment of four concrete driveways . The amount to be reimbursed by
the City is $7,396.56.
There is a time extension of 112 calendar days included in
this change order for extra work and delays in material procure-
ment.
The staff recommends approval of Change Order No. 3.
District No. 11
No. 9-x -Change Order No. 7 to Coast Trunk Sewer Reach 1 & 2 Portion
of Newland Street Interceptor Sewer and Lake Avenue Relie·£ s ·ewer,
Contract No. ll-13-2.
This change order of $75,624.13 covers modifications necessary
to protect the Southern California Edison Company's two sea water
cooling lines and the dewatering necessitated by the lowering of
the siphon under those cooling lines. Also covered is additional
landscaping within the City of Huntington Beach parking lot. A
$24,000 deduction to the contract because of a change in excavation
and backfill requirements is included.
A time extension of five calendar days is authorized for per-
formance of this additional work. These changed conditions have

been discussed with the Corps of Engineers and meet all the
criteria of eligibility for grant funding .
The staff recommends approval of Change Order No . 7.
Joint Boards
No . 11 -Re ort of the Executive Committee and S ecial
Committee on Personne Gui e ines or Management.
The two Committees met jointly on November 26th and enclosed
for Board members is a written report of their discussions and
recommended actions for consideration by the Boards.
No . 13 -Award of Contract No. Pl-18 -Sludge System Improve-
ments at Reclamation .Plant No. 1 .
At the August 13th Board meeting, the Directors approved the
plans and specifications for sludge handling improvements at
Reclamation Plant No. 1 including sludge pumps, piping and
digester modifications.
Six bids were received for this non-grant funded project on
November 20th, ranging from a low of $1,592,000 to a high of
$1,769,000 . The engineer's estimate for the work was $1,850,000.
The bids have been reviewed by the staff as well as the consult-
ing engineer, Lee and Ro, and award to the low bidder, Hoagland-
Artukovich, a joint venture, is recommended .
No . 14 -Receive and File Selection Committee Certification
re Preliminary Engineering Studies for Site Selection for Ultimate
Solids Dis osal and A rove A reements for En ineerin and Environ-
men ta Services.
At the October 8th meeting, the Directors approved the Final
EIS/EIR for Los Angeles/Orange County Metropolitan Areas (LA/OMA)
which covered ultimate sludge disposal for the Los Angeles and
Orange County areas. As reported in your Manager's Agenda Report
for that meeting, specific site selection for the Orange County
area was deferred until a supplemental EIS/EIR could evaluate
five potential sites in the Round Canyon vicinity on the Irvine
Ranch.
The staff prepared requests for proposals (RFP ), one for pre-
liminary engineering services and one for environmental services
for this project. Requests were sent to ten engineering firms
and five firms specializing in environmental docume~tation . Six
firms responded to the engineering RFP and three to the environ-
mental RFP.
On November 3rd, a screening committee, comprised of the

Districts' Chief Engineer , Deputy Chief Engineer, Chief of
Operations, Superintendent and Senior Engineering Aide , as well as
Bill Davis, Project Manager of the LA/OMA project and Ann Godfrey
of EPA, San Francisco met to study the proposals. After a careful
review, three engineering firms and two environmental firms were
chosen for further screening by the Districts' Selection Cormnittee,
comprised of the Joint Chairman , Vice Joint Chairman and Chief
Engineer. An oral presentation was made by each of the three
engineering firms. The same procedure was followed for the environ-
mental firms. Negotiations were then conducted with representatives
of the two firms selected.
The firm of John Carollo Engineers will perform the preliminary
engineering work for this project at a per diem fee not to exceed
$65 ,800. The firm of EDAW, Inc./K. P . Lindstrom & Associates, a
joint venture, will prepare the environmental documentation for
the project at a per diem fee not to exceed $50,000.
The Selection Committee recommends approval of John Carollo
Engineers to perform preliminary engineering services and EDAW,
Inc ./K. P. Lindstrom & Associates to prepare the supplemental
EIS/EIR .
No. 15 -Staff Report on Meet -and-Confer Process.
The staff will report in executive session on the status of
the meet-and-confer process with the Engineering/I .W. Unit and
the Supervisory Unit .
No. 20 -Award of Contract No . 2 -5A (Rebid), 3-23R-l , ll-6A
and 11-llA.
Bids will be received on Tuesday, December 9th, for Orange
Subtrunk Diversion Manhole at Santa Ana River Interceptor, Contract
No. 2-5A (Rebid), Replacement and New Frame and Cover at Magnolia
Trunk Sewer, Contract 3-23R-l, Construction of Manholes on Springdale
Trunk Sewer, Contract No. ll-6A and Slater Springdale Relief Sewer ,
Contract No. 11-llA. These contracts are for work on manholes in
three Districts as follows:
District No . 2 -The addition of one diversion manhole
from the Orange Subtrunk to the Santa
Ana River Interceptor. This diversion
will allow greater reliability in the
event of damage to the Orange Subtrunk.
District No . 3 -Modifications to an existing vault on
the Magnolia Trunk Sewer in order to
facilitate cleaning of a siphon under
a Flood Control Channel.

on the Springdale Trunk Sewer and
one new manhole on the Slater-
Springdale Relief Sewer. The
manholes will reduce the distance
between manholes from 1300' to 650',
thereby allowing better maintenance
of these extremely flat g radient
sewers.
The Directors will consider the award of a contract on
Wednesday evening. The engineer's estimate for the work is
$37,000, broken down as follows :

AND APPROVING FINAL CLOSEOUT AGREEMENT

The Boards of Directors·of County Sanitation Districts Nos. 1, 2, 3, 5, 6,
7 and 11 of Orange County, California,
DO HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the contractor, J. T. Thorpe, Inc., has completed the
construction in accordance with the terms of the contract for Rehabilitation of
Incinerator No. 2 at Headworks "C", Treatment Plant ·No. 2, Job No. PW-068R-A,
on November 30, 1980 ;· and,

accordance with the terms of the contract therefor, dated September 22., 1980; and,
Section 4. That the Districts' Chief Engineer is hereby authorized and
directed to execute a Notice of Completion therefor; and,
Section 5. '11lat the Final Closeout Agreement with J. T. Thorpe, Inc.
setting forth the terms and conditions for acceptance of Rehabilitation of Incinerator
No. 2 at Headworks "C", Treatment Plant No •. 2, Job No. PW-068R-A, is hereby approved
and accepted, in form approved by the General Counsel; and,
Section 6. That the Chairman and Secretary of District No. I, acting for
itself and on behalf of Districts Nos. 2, 3, 5, 6, 7 and 11, are hereby authorized

contract for Carbon Canyon Dam ·Interceptor, Contract No. 2-21, on December 4, 1980;.and,

of said Carbon Canyon Dam Interceptor, Contract No. 2-21; is hereby approved and
accepted, in form approved by the G~neral Counsel; and,

1he Boards of Directors of County Sanitation Districts Nos. 5 and 6 of

WHEREAS, the Districts have published Notice Inviting Bids for Reconstruction
of Peninsula Trunk at Short Street~ Contract No. 5-23, and Abandonment of Newport
Trunk Meter Vault at the "Arches", Contract No. 6-7, in accordance with the
provisions of Section 4755 of the State·Health and Safety Code, and on November 20,
1980, publicly opened and read all bids submitted; and,

and the apparent low bid .··exceeds the engineer• s estimate by approximately fifty-one

3, S, 6, 7 and 11 of Orange County, on October 8, 1980, approved· the Final EIS/EIR
relative to the proposed Sludge Management Program for the Los Angeles/Orange County
Metropolitan Area (LA/OMA); and,
WHEREAS, specific site selection for ultimate disposal of solids was deferred
until completion of. preliminary. ~ngineeririg "studies· and" ·-a-Stipp"ieriientai. EIS/BIR" ... _ ...
evaluating the five potential sites in the Bee and Round Canyon vicinity of the
Irvine Ranch no~herly of the El Toro Marine Corps Air Station; and,
WHEREAS, it is now deemed desirable to engage a consultant to proceed with
the preliminary engineering studies relative to site selection for ultimate solids
disposal; and,
WHEREAS, the Boards of Directors have heretofore adopted a policy establishing
procedures for the selection of professional engineering and architectural
services; and,
WHEREAS, pursuant to said procedures an agreement has been negotiated with
John Carollo Engineers for preliminary engineering studies_ relative to site
selection for ultimate solids disposal in accordance with the Sludge Management
Program for the Los Angeles/Orange County Metropolitan Area (LA/OMA); and,

3, S, 6, 7 and 11 of Orange County, on October 8, 1980, approved the Final EIS/EIR
relative to the proposed Sludge Management Program for the Los Angeles/Orange Col.Ulty
Metropolitan Area (LA/OMA); and,
WHEREAS, specific site selection for ultimate disposal of solids was deferred
·tmtil ·completion of a Supplemental EIS/EIR evaluating·the five potential sites in·
the Bee and Round Canyon vicinity of the Irvine Ranch northerly of the El Toro
Marine Corps AiT Station; and,
WHEREAS, it is now deemed desirable to engage a consultant to proceed wi~h
preparation of said Supplemental EIS/EIR; and,
WHEREAS, the Boards of Directors have heretofore adopted a policy establishing
procedures for the selection of professional engineering and architectural
services; and,
WHEREAS, pursuant to said procedures an agreement has been negotiated with
EDAW, Inc. and K. P. Lindstrom and Associates, a Joint Venture, for environmental
consulting services in connection ~ith preparation of a Supplemental EIS/EIR on the
Sl~ge Man_agement Program for the Los Angeles/Orange Col.Ulty Metropolitan Area (LA/OMA)
·relative to selection of the ultimate solids disposal site; and,

WHEREAS, the Selection Committee established pursuant to said procedures
has certified the final negotiated fee for said se4vices, which said certification
has been approved by the General Manager.
NOW, THEREFORE, the Boards of Directors of County Sanitation Districts
Nos. 1, 2, 3, S, 6, 7 and 11 of Orange County, Ca~ifornia,
DO HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the certain agreement dated by and
between County Sanitation District No. 1, acting for itself and on behalf of
Districts Nos. 2, 3, 5, 6, 7 and 11 of Orange County, and EDAW, Inc. and K. P.
Lindstrom and Associates, a Joint Venture, for environmental consulting services
in connection with preparation of a Supplemental EIS/EIR on the Sludge Management
Program for the Los Angeles/Orange County.Metropolitan Area (LA/OMA) relative to
selection of the ultimate solids disposal site, is hereby approved and accepted;
and,
Section 2 •· That payment for said services is. hereby authorized in
accordance with the provisions set forth in said agreement on a cost plus fixed-fee
basis for a maximum amount not to exceed $50,000.00; and,
Section 3. That the Chairman and Secretary of District No. 1, acting for
itself and on behalf of Districts Nos. 2, 3, 5, 6, 7 and 11, are hereby authorized
and directed to execute said agreement in form approved by the General Counsel.

On behalf of the County Sanitation Districts, we hereby
request that the Board of Supervisors take no action at its
meeting of December 9, · 1980, pertaining to the items scheduled
for action on the agenda relating to the A.B. 8 determination
for special districts. ·
On December 3, 1980, I learned indirectly of a report
being prepared by the office of the County Administrative Of-
ficer on this subject, and knowing of its grave concern to the
Sanitation Districts, I checked with the General Manager and
Finance Director to determine what, if any, meetings and ne-
gotiations had yet taken place with the County Staff on this
subject. I was advised that absolutely none had occurred and
none had been requested by the County. I was also advised that
they were totally unaware of the fact that this matter was being
presented to the Board for action on December 9.
The proposed action affects 14 annexations for District
No. 2 and 27 annexations for District No. 7, which in total
encompasses several thousands of acres of land, some of which
will be included within incorporated cities and some will remain
in the unincorporated territory.
It is the position of the County Sanitation Districts
that they in fact are in a somewhat different position on this
subject than most, if not all, the other special districts
throughout the County, in that they provide the necessary back-
bone service of trunk sewers as well as the exclusive waste-
water treatment facilities. Perhaps more importantly, under the

\..,/ provisions of the Federal Clean Water Act. The Districts, as
a discharger, were obligated to adopt a revenue program es-
tablishing an equitable system of charges for all dischargers •.
The program adopted by the Districts is based upon receiving
a portion of the ad valorem tax revenues from all properties.
If these revenues are not received, the Districts coqld be in
violation of federal law.
It is the Districts' position that the County should be
willing to negotiate in good faith as required by the new provi-
sions of Revenue and Taxation Code Section 99, prior to taking
any action, sp that ·the positions of both s.ides can be· fully
apprised. We would therefore respectfully request that the
Board defer any action on this item for a period of thirty (30)
days to allow the respective Staffs to attempt to bring a package
to the Board with a mutual recommendation.

In a recent _Regional Water Quality Control Board staff memorandum to· the
Regional Board regarding more restrictive limitations on the Districts' NPDES
discharge requirements, there appears to be certain conflicts which adds to
the continual frustration of dealing with our regulatory agencies. These are
as follows:
PROPOSED NPDES MODIFICATIONS
EXCERPT FROM REGIONAL BOARD STAFF REPORT NOVEMBER 24, 1980:
While the two enforcement dates differ1 Board staff believes that
there are circmnstances which warrant a delay from the Board's
specified September 1, 1980,. compliance date. In a status report
dated July 30,.1980, the District5 indicated that significant delays
had occurred in the second phase secondary plant construction and in
the procurement of certain sludge handling facilities. The Districts,
in this report, indicate that the 75 MGD second phase A/S facilities
are scheduled for completion. in the Spring of 1981 while the sludge
facilities are scheduled for completion by October 1981.
EXCERPT NO. 1 FROM CSDOC STATUS REPORT (PAGE 4):
Construction delays on the 75-MGD Improved Treatment facilities at
Plant No. ·2 have occurred due to inclement weather, iabor strikes,
equipment delivery delays and the intricate coordination required
with several major projects being constructed at the same location
at· the same time. The anticipated completion da:te·for these facili-
ties is December 1981. It is necessary for the facilities constructed
under the P2-23 and P2-24 projects to be operational before compliance
with levels of 130 mg/l BOD and 100 mg/l Suspended Solids can be
achieved.
EXCERPT NO. 2 FROM STATUS REPORT (.CONSTRUCTION PROGRAMS PAGE l):
1. P2-23-2 Oxygen Generat~on and Dissolution Facilities.
The currently scheduled date of completion for this $8,273,000 grant
funded project is September, 1980. Because .. of .the interdependency
between this project and P2-23-6, Major Facilities, which is not
expected to be complete until December, 1981, a meeting has been
scheduled in Philadelphia for the week of July 21 between the Districts'
Chief Engineer and the· principals of Air Products and Chemicals, Inc.
to try to negotiate an equitable solution to this contract.
EXCERPT NO. 3 FROM STATUS REPORT (CONSTRUCTION PROGRAMS PAGE 2):
2. P2 23-6 Major Facilities.
This $31,214,945 project, which is funded under the clean water
grant program, has had numerous delays and the completion is now
scheduled for December, 1981.

Joint Chairman Vardou lis announced that Di rector s Sharp , Ho lt,
Hutch ison and Fox and the General Counsel and General Manager
attended the CASA Fa ll Qua rterl y Meeting November 9 & 10th.
Dir ector Holt br ief ly reported that it was a very good meeting.
Commented to Directors with rega r d to the tremendous respect the
CASA members had for our staff , TLW & FAH. Both had oppor tunit ies
t o speak and both came away with a round of applause from everybody
in attendance. Said he wa s very i mpre ssed .
Vardoulis then reported re Agenda Item No . 14 relati ve to pre liminary
engineer ing status re Supplementa l EIS/EIR . Advi sed that the
Selection Committee ,made up of REL and Directors Vardo ulis and Holt ,
spent t wo days interviewing after reviewing the E IR's. Interviewed
several environmenta l firms and engineering firms. F in a lly selected
engineer and e nvironmental firm . Thanked both Don Holt and REL
fo r the time put in on this. Wa sn't an easy choice. Narrowed it
down and got the bes t dea l we po ssibly cou ld get .
Announced that th ere will be no meeting of the Executive Committee
in December.
(7-b) Report of the General Ma nager oY~
FAH reported that he had been to Washington, D.C. twi ~ince the last
Board meeting . Said Districts have been involved i i ~ -·"1990 strategy "
for the construction grant projltgram for the next 10 flays . EPA
admitted that the process is so complicated that for a $10-15 million
project, t he time from the start of planning to building, would be
about 9.7 years. Advised that he and some others projected on a
graph and showed them what $4 billion would be in 10 years 10%
inflation factor . Wou ld be down to zero. Might as well forget the
whole program if it will take 10 years. Recommended that they
delegate these programs to the State . Recommended block grants to
State and let them decide where to put the grants . Should work on
things that are going to improve the water quality . Not just because
it is in the law. Is hoping that there is a good administration
coming in and that these suggestions are going to be listo/1e~ to. They
did pay a little more attention to California people now.~~u ~o~)
Advised that one area of some concern is that there are some people
in EPA that have been working on re gulations and are anxious to get
regulations published as quickly as possible in the Federal Register
before new administration. One of them he is really concerned about
is proposed rule on ocean dumping under Marine Protection Sanctuary
Act. We are not directly involved because we are not involved in the
business of dumping but are conc erned there may be something in there
about institutional sludges in the marine environment. Staff is
thinking about talking to the Fiscal Policy Committee re long pipe
line out 10,000 ft. (?) Met with Lee White and other consultants
inthe Washington area that are very familiar with this Act. Said he
thought he would have some kind of proposal for Directors or to take
to FPC but what they sent wasn't what he thought it should be . So
may b e corning to Directors next month. Will be kind of a rush job i f
they put those regulations out between now and the next Board meeting.

Reported on another problem. Said we received letter o n November 25th
from Executive Officer o f Regiona l Board detailing some proposed
mod i ficat i ons to NPDES Permit. Th e modif i cations that they are talking
about assumes that we c omp lete the 75 mgd i mproved t r eatment fac ilities
a t Plant No . 2 which they say we shoul d have ready by May 14 , 1 981.
RE L then made a brief slide presentation showing the problems we have
encountered and reaso ns for de l ays that make it impossible to be complete
by May , 1981 . We received our permit in 1 971 . Requirements based on
30/30 . Did not have facilities at that time but they put us on k ey
milestones to meet . In 1978 o ur facilit i es at Plant 1 came on line .
We are right now meeting our requirements since we started taY ing o ur
sludge to Coyote Canyon l andfi ll site for processing . The MGD on
these i nterim limits was structur ed in 1977 when you could get something
done i n 1 9 months. Hearings on belt presses delayed us 6 -9 months .
Just can't get these things built in time . We are the only discharger
for this region . Inland dischargers have to meet higher qua lity
requirements because of ground water . Reviewed staff report in
Directors ' folders indicat ing excerpts of i nformation provided to
the Regional Board re stat us of projects and excerpt of Regiona l
Board report ind icating a d iffe re nt date from that stated in our
progress report . REL stated that h e and FA H will be work ing with
Regional Board . We don 't have the equipment to get the numbers they
want. Don't want a Cease & Desist Order put on us.
Yamamoto asked why there was just a big difference between requirements
for Orange County and LA? REL advised we are in different regions.
LA is Region IV, We are Region IX a nd S a n Diego is Region VIII.

TLW reported that two or three weeks prior to CASA Mtg. in November ,
the SWRCB adopted new operating rules and regulations by which the
State Board and Regional Board must now conduct all t heir h e arings
for discharge permits as wel l as Cease and Desist Orders. Bas e d on
Mr . Harper 's report a nd Ray Lewis' report , we may be one of the first
ones to test them to the limit with r egard to the hearing procedures .
These new regulations came about b e cause of CASA. They are greatly
beneficial to all discharger age nci e s such as ourselves. Will ma k e
for a fair and more eq uitable proceedings when we come b efo r e a
Regional or State Board.
He then advised t hat anoth er item he had to report on pertains to a
subject all of the Directors are familiar with in the ir ci t ies
relative to the tax allocation question . Advised that during the past
week it came to our attention that the staff of the County was
r ecomm e nding to the Board of Super v isors that they take certain
actions relative to annexations that have be e n processed with regard
t o numerous special districts throughout the county. Wou ld affect 41
of our annexations in process over the last 2~ years . Would not receive
a ny portion of the tax increment allocation . The cities have e ntered
into an agreement of concensus among the 26 cities and Board of Supv .
relative to tax allocations pertaining to annexations to the cities.
The special districts have a unique prob l em d i ffere nt from the cities .
The State Legislature really didn 't enact the l eg islature they should
have inacted . Is a lot of ambiguity . The Board of Superv isors received
a report from their staff based, in part , on AB 8 and sn 180 . Wa s
scheduled for action by the Board on 12 /9 . TLW said he met wi th FAH &
JWS and sent lette r to the Board asking that they continue this ite m

so we could sit down with them and see what could be resolved , if
anything . Is a most complex piece of l eg i slati on . Have made some
quick analyses in the l ast two days of the 4 1 annexations . 5000 acres
of land , most of which is in District 2 in the Santa Ana Canyon area .
Decision would affect all Districts with the poss ible excep tion of
Districts 1 & 6. We have annexat i ons that have occurred from 1978-79
and will occur in the future . Question is whether the District wi ll
get any portion of the ad va lorem tax incr ement when yo u have undeveloped
l a nd and there is an exchange of service . What h appens to the 5000
ac re s that have been completed at this end but are not yet completed
at the County or State l eve l. About half compl eted at LAFC but
suspended at Districts or State Board of Equa li zation. Sa id h e thought
tha t County Counse l's op i nion was we ll· prepared but is anot h er school
that thinks that th is is not the case and that we have the right to
share in the increment. Sa i d JWS roughly calcuated i mpact per year
if Dis trict not allowed to share . Said one of the i tems of gravest
concern to us is that under the Federa l Water Pollution Control Act
a nd Clean Wa ter Act Amendments , we are obligated to adopt a revenue
program . Among other thin g s , it requires that we set up an equ ity
based system . We h ave adopted a revenue program to comply wi t h that
act . If we were not in compli anc e , wo uld not qualify for receiving
grants, etc . However , the program the Boards approved included
considerab l e anticipation of ad valorem tax fo r each and every District
s ubj ect to Prop . 1 3 limitations. Ad v ised that it was his opinion that
if we are unable to obtain any ad va l orem tax , would have d i scrimi nitory
system of financing throughout the Distric ts . Is accumulatively
considerable. Would be getting a free ride and would not be paying
fo r service . We don 't h ave u se charges . We are now caught in this
di l emma if we don't get the ad valor e m ta x . May say we aren 't in
compliance with this pote ntia lly di scriminating system . Think we
can r easo nably expect to enter into agreement with County to get some
tax out of l evy. We .have a few choices :
(1) Do nothing and ignore probl em .
(2) Declare moritorium on a ll f uture annexations until problem
reso l ved beginning today.
(3) With r e spect to 41 annexations that have been presented to the
Board of Supervisors, not yet fully c erti fied and complete :
(a) Withdraw them at this point and keep them out of the District.
This has a myriad of secondary problems. Maybe coul d refile
tomorrow. I f withdrawn , District could just l evy a monthly
service charge .
(.b) Possibly declare a mo r itorium of all s ewe r connections in
this annexation area until r e solved.
Board of Supervisors deferred action for two wee ks. Not a great dea l
of time . Th ey are anxious to button this up by the end of the year .
Vardoulis added that dep e nding on the outcome of meeting with Supv.,
wil l possibly have an action to t ake at next me e ting . May have to
recommend something we don 't like to recommend .

Board meeting so they could discuss with the ir citie s.
Vardoulis stated he didn't intend to talk about this tonight but the
timing is interesting as h e was just go ing to ask two of the Directors
to stand because tonight is their l ast meeting, and they happen to be
Supervisors Anthony and Mille~.

Anthony stated that this issue came up pretty quick. As far as
the time extension, th ink the t hing to do in these two weeks might
be to justify a l onger period of time to work o n this. Thanked
Directors and said h e hoped to see them in the future at different
mee tings.

his association with them . Said Districts were one of the organizations
that warmly received him and it was appreciated .

Bill Clarke briefly explained that we have nine of these crank shafts
in service. Need a n extra one because wh e n doing a n overhaul on one
of them,it takes an extremely l ong time and we need them all in
service. This answered Director Reese 's quest i o n.
Heather asked whether we could separate the two items when rebidding
(Contract 5-23 & 6-7)? Qu estio n ed why bids were so much over engineer 's
estimate . REL explained that the reason for our r econune ndation for
rejection of bids is that we feel that there is an unbalance in the
bids and by separating the bids could attract smaller contractors .
District 6 project could be separate from District 5. She asked if
we could do the District 6 meter vault by force account and REL said
yes. The item was the n moved , seconded and carried .
Agreements with JCE and EDAW & K. P. Lindstrom re site selection for
sludge disposa l
Vardoulis conunented that this is going to be a subject of considerable
public debate and think we have two firms that will do a good job
in presenting this at the various public h earings . There is great
concern about these n ew sludge drying facilities so are going to hear
a lot more about this in the next six months.
(161 Actions re meet-and-confer sessions with employee units
Joint Chairman Vardoulis referred to the pink insert in the Directors '
folders with recommended actions. Advised that all of these actions
and resolution fall under the guidelines for salary and benefit
adjustments that they discussed in the last executive session, so
Board can go ahead and approve (a), (b), (c)&(d) or if they wish to
talk about it some more, can go into executive session . It was
moved and seconded to approve (a), (b), (c)&(d). No objections by
any Director. Motion carried by voice vote . SEE ATTACHED PINK SHEET .
(20~a) Award of Contract 2-5A (Rebid)
FAH advised that the bids came in considerable over the engineer 's
estimate ; however, we are still recommending that we award the
contract . REL added that the three projects were combined into one
bid and we .had th e opportunity of separating them into three contracts.
District 2's bid _ were ove r the engineer 's e stimate. However, after
reviewing it; he felt it was fair. Engineer was too low. District 3
was within engineer's estimate .· District 11 -Said in talking to some
other contractors that didn 't bid, fe lt that $25 ,000 is way over and
that we could negotia te a contract for this work for $15,000.
