CALIFORNIA 92708 (714) 540-2910 (714)962-2411 FROM: RAY LEWIS, Chief Engineer SUBJECT: INTERIM ACTIONS RE VIOLATION OF DISTRICTS' INDUSTRIAL WASTE DISCHARGE PERMIT BY CHERRY FASTENERS At the Adjourned Regular Meeting of County Sanitation District No. 1, held on October 22, 1980, District Staff was directed by the Board to proceed with interim actions regarding Cherry Fasteners. The actions requested by the Board (in italics) and the steps taken by Staff since the meeting, are listed below. "Staff is direated to work atosely with Cherry Fasteners during (interim) period to develop a detailed plan and saheduZe for both short-term and long-term aorreative aation to enable aomplianae with the Industrial Waste Ordinanae for aonsideration by the Board": During the period of October 27, 1980, through November 26, 1980, District Staff was in nearly daily contact with Cherry Fasteners. Daily visits by a District inspector were conducted to pick-up samples and to discuss the ongoing program with Cherry Fasteners. Frequent tele- phone communication was conducted between the Districts' Chief Engineer and Cherry Fasteners' representatives. Short-term corrective actions were suggested by District inspectors. These consisted of making a minor piping change and adjusting procedures on housekeeping. However, no sig- nificant.short-term corrective actions were found to be feasible by Cherry Fasteners. CALIFORNIA 92708 (714)540-2910 Long-term corrective actions include the modi- fication of existing waste drain lines and the construction of waste treatment facilities. The engineering drawings of these works have been submitted and reviewed by the District Staff. On November 19, 1980, District Staff sent a letter to Cherry Fasteners reviewing the drawings. A response from Cherry Fasteners was requested by December 1, 1980. The drawings have been submitted by Cherry Fasteners to the City of Santa Ana for building permits and have received tentative approval pending modifications required by the City. As of noon on November 26, 1980, Cherry Fasteners had not received corporate approval for the bulk of the capital expenditures. Cherry Fasteners' project schedule was pro- vided to District Staff in a letter dated November 17, 1980. (714) 962-2411 "Cherry Fasteners is to be invoiced for the past-due non- compliance charges pursuant to ordinance provisions": District Staff mailed a notification of charges due to Cherry Fasteners on October 23, 1980. The amount is $252,862 and was due on November 22, 1980. Payment has not been received. "Staff shaZZ conduct extensive testing to determine compli- ance ~ith discharge limitations and non-compZianae charges, if any, from this date for1iJard ": Daily composite sampling was conducted from October 27, 1980, until November 19, 1980. During that time, Cherry Fasteners' discharge limitations were exceeded 20 times for cadmium, 5 for chromium, 1 for copper, and 2 for nickel. The invoiceable amount for these excessive discharges totals $18,202. WARNER AVENUE, SANTA ANA, CALIFORNIA. The following is a brief summary taken from the Inspector's Weekly Logs between October 27, 1980 and November 19, 1980. 10/27: 10/28: 10/29: 10/30: 10/31: Began 30-day sample program. Inspection of the plating facility showed no changes or modifi- cations within the plating area. Mr. Woolsey expressed difficulty in having Cadmium-Cyanide solution from the holding tank hauled away. Commented that, "I (we) may have to have an accidental spill". Suggested direct piping of rinse water to eliminate the wet floor. Reply was, "that would create an undesirable sludge build-up". Sample appeared normal. Informed Mr. Woolsey's secretary that all samples would be acidified inside our Laboratory for safety precautions. Sample normal. Sample normal. Bottles at 1830 and 1930 were pink. Mr. Woolsey did not know what it was. He stated, "You can tell people not to dump things, but you can't really control them". (714) 962-241 1 Mr. Woolsey said the blue bottle from the pre- vious day was from an overflow of their nickel-strike tank. Amount lost and concen- tration unknown. Cadmium-Cyanide solution to be hauled to Class I dump today. Mr. Woolsey stated that he was afraid that his company would exceed the Health Depart- ment limit for Cyanide hauling. Sample normal. Excavation started at proposed treatment facility. All bottles somewhat yellow. Cherry Rivet had a Cadmium-Cyanide spill, approximately 100 gallons at a concentration of 2 to 2.5 oz./gal. or about 15 pounds of Cadmium. Sample normal. Battery malfunction -no sample. Sample appeared normal; slightly yellow, some reddish sediment. Sample normal. Mr. Woolsey is questioning the permit in regards to the calculation of process discharge. Inspection of plating area revealed no changes to operation or design of area. Sample appeared uniform and typical of previous days. Composit sample yellow. Sample bottle at 1600 hours was purple. Most likely a dump from industry's dye tanks. Carol Gruber picked up samples for industry. Sample at 0300 was green in color. Ms. Gruber thought it might be from the ammonia nitrate tank, which is used as a cadmium strip solution. Sample appeared typical of past samples. No significant difference in sample from past discharge. Everything appeared normal. Sample bottle at 1800 hours was light blue with a heavy blue floe settled at the bottom. No representative showed up for a split of the sample. Sample bottles at 2100 and 0500 light blue. Bottle at 0200, clear with a pH of 5.0. Bottle at 0900, amber color with heavy amber sediment, pH 5.0. Last day of sample program. Ms. Gruber was present to split the sample. The inherent problems involved with late night operations concerning employee control, unreported spills, or unauthorized dumps, were discussed. Concrete expected to be poured next week for treatment facilities. 10/27: 10/28: INSPECTOR'S WEEKLY LOG Steve Chandler CHERRY RIVET Set unit to begin 30-day sample program. Dale Hoverman and myself inspected plating operation. No changes or modifications within plating area involving floor drains, spill containment, or rinse lines. Drainage channel adjacent to cadmium filters, outside plating area, now flows to a holding tank. Solution is pumped into drums which presently amounts to approximately 800 gallons. This area also produces a high concentrated cadmium sludge which is also present within plating area. Plating area also contains an experimental ammonia nitrate cadmium strip tank. The cadmium is to be plated out of solution prior to rinsing of parts. A Licon unit to recirculated concentrated cadmium rinse water was said to be a con- stant problem, per Mr. Woolsey. Mr. Woolsey also expressed difficulty in having cadmium- cyanide solution from holding tank hauled away. Commented that, "I (we) may have to have an accidental spill". Dale and myself suggested direct piping of rinse water to eliminate the wet floor. Reply was, "That would create an undesirable sludge build-up". Mr. Woolsey received two bids from contractors for piping and set up of treatment facilities at approximately Two Million Dollars each, with completion at nine months to one year. Treatment equip- ment would be an additional Half Million. Sample appeared normal. Hours from 1130 to 1330 were purple, probably a dye. pH - 10.0, flow -.210 MGD. Carol Gruber, Mr. Woolsey's secretary, was present to pick-up industry's split of sample. Informed her that all samples would be acidified inside the laboratory for safety precautions. /· INSPECTOR'S WEEKLY LOG Page 2 10/29: 10/30: 10/31: 11/01: 11/02: 11/03: 11/04: Sample normal. pH -9.0, flow -.218 MGD. Mr. Woolsey stated that someone would be at sample point daily at 0930. Sample appeared normal. pH -9.0, flow - .22 MGD. Mr. Woolsey mentioned that he had received a letter from Board of Directors indicating back-invoicing for Two Hundred Fifty Thousand Dollars. Bottles at 1830 and 1930 were pink. Mr. Woolsey did not know what it was. He stated, "You can tell people not to dump things, but you can't really control them." pH -9.0, flow -.215 MGD. Sample normal, some heavy sediment (reddish) . Battery died after eleven hours. Mr. Woolsey thought sediment might be from washing out parts-cleaning machines. Expressed concern on how a partial 24-hour sample could be used with a 24-hour flow. I explained that it would probably be used as an indicator of concentrations and not as pounds per day. pH -10.0, flow -.213 MGD. Sample normal. Only two or three people in plating to do odds and ends. pH -6.0, flow -.183 MGD. Difference in this flow and normal day must be a high pH to offset discharge from plating shop. Sample normal. Bottle A0200 was dark blue. pH -6.0. Mr. Woolsey felt it must be a dye. At time of pick-up and resetting sample unit, discharge was dark yellow for about one minute. pH -6.0, flow - .183 MGD. Bottle at 0930 was blue-green; pH -8.5. Bottle at 1130 was yellow; pH -7.0. Mr. Woolsey said that the blue bottle from the previous day was from an overflow of their nickel-strike tank. Amount lost and concentration was unknown. I was also told that liquid waste management was due to pick-up cadmium-cyanide solution this day. Mr. Woolsey stated that he was afraid that his company, Cherry Rivet, would ex- ceed the Health Department limit for cyanide hauling. pH -10.0, flow -.207 MGD. INSPECTOR'S WEEKLY LOG Page 3 11/05: 11/06: 11/07: 11/08: 11/09: Sample normal. pH -9.0, flow -.223 MGD. Mr. Woolsey mentioned that excavation had begun for site of proposed treatment facilities. Although Textron had not, as yet, funded the money, a Vice President had allocated Two Hundred Thousand Dollars to begin construction. Mr. Woolsey stated that had the company set plans and con- struction a year ago, they might be in-line today. But a year ago, they did not know what to do or where to begin . . All bottle somewhat yellow. Districts were informed at 0900 that a cadmium spill had occurred early that morning. Mr. Woolsey told me that it must have happened after 0200 when a Shift Super- visor makes a routine inspection of plating area. Spill was a plating tank resulting in a large leak. Situation was controlled at 0600. Approximately 100 gallons were lost at a concentration of 2 to 2-1/2 oz./gal. or about 15 pounds of cadmium. Mr. Woolsey was requested by Jim Wybenga on the phone to submit a letter explaining what occurred and what steps would be taken to prevent a similar situation. pH -9.0, flow -.221 MGD. N/A Battery died after six hours. No sample taken. Woman representative from Cherry Rivet to meet Districts' personnel. flow -.221 MGD. Sample appeared normal. Slightly yellow, some reddish sediment. Mr. Woolsey indicated that there would be enough work in plating area to justify leaving a unit through Monday. pH -8.0, flow - .180 MGD. INSPECTOR'S WEEKLY LOG Page 4 11/10: 11/11: 11/12: Sample normal. pH -9.0, flow -.161 MGD. Mr. Woolsey questioned the flow to con- centration ratio of our (Districts') analysis. This was based on his conten- tion that approximately .100 MGD flows north onto Warner Avenue from domestic and several machines and wash areas. Inspection of manholes along Warner Avenue, adjacent to Cherry Rivet, revealed no significant increase in flow. Upon inspection of plating facilities, Mr. Woolsey pointed out the areas in question, stating that the machines were not in full use at that time. Inspection of plating area revealed no changes to operation or design of area. Mr. Woolsey indicated that a Board Meeting on November 17, 1980, would decide on allocation of money for treat- ment facilities. Mr. Woolsey requested the Districts to install a flow meter at sample point for an accurate measure. I indicated that I could not make a positive or negative decision. Cadmium-cyanide solu- tion was picked up the end of last week per Mr. Woolsey. Copies of waste haulers manifest from landfill have not yet been obtained. flow -.205 MGD; pH -9.0. Sample appeared uniform and typical of previous days. Floe present, while not unusual. Some reddish sediment. Composite sample yellow. pH -10.0; flow -.206 MGD. Carol Gruber picked up samples for industry. Indi- cated that some samples are being sent back to consulting firm for treatment analysis. Mentioned that they have not received any results from their lab. Bottle at 1600 hours was purple. Most likely a dump from industry's dye tanks. INSPECTOR'S WEEKLY LOG Page 5 11/13: 11/14: 11/15: 11/16: 11/17: 11/18: pH -10.0; flow -.225 MGD. Carol Gruber picked up samples for industry. Bottles appeared generally cloudy or somewhat yellow. Sample at 0300 was green in color with a moderate amount of green floe. Miss Gruber thought it might be from the ammonia nitrate tank, which is used as a cadmium strip solution. A representative from Western Analytical Labs accompanied Miss Gruber. They wanted to discuss the possibilities of installing a flow meter (recorder) at the sample point. Due to structure of manhole, an accurate reading would be difficult to obtain. pH -10.0; flow -.240 MGD. Bottle at 1500 hours was a dark green-yellow. Ed Woolsey was present for split of sample. No discussion relevent to program or results of analysis. pH -9.0; flow -.233 MGD. Sample appeared typical of past samples. No problems were reported during the past 24 hours. Con- cern was expressed by Carol Gruber over a significant difference in a past sample analysis. She was told that an arrange- ment might be made to share a portion of the Districts' stored sample for a comparative analysis. pH -6.5; flow -.194 MGD. No significant difference in sample from past discharge. pH -10.0; flow .171 MGD. Everything appeared normal. Nothing of importance was discussed. pH -9.0; flow -.214 MGD. hours was light blue with a floe settled at bottom. No from industry showed up for the sample. We will have preliminary permit drawings sent to City of Santa Ana for their review and approvals on Monday, November 3, 1980. These drawings will display the scope of the project and type of treat- ment system selected. 3. Detailed prints for construction of treatment facility and segregation system will be forwarded to C.S.D.O.C. for review by November 17, 1980. 4. Monitoring of our effluent by Orange County and concurrently by Townsend is now taking place. Box 8127 Fountain Valley, CA 92708 Reference: Accidental Spill Dear Sir: We reported an accidental spill via phone to James Wybenga on Wednesday, November 5, 1980, at 9:05 A.M. This spill resulted from a valve that had been eaten through by plating solution. The leak started at about 2:00 A.M. and continued until 5:00 A.M. when observed by an employee. The tank was immediately pumped into barrels and the valve replaced. All tanks and valves on cadmium plating tanks have been inspected and found in good condition. We estimate we lost approximately 100 gallons of cadmium plating solution. This solution is normally made up as follows: 2.25 2.6 10.8 4.2 10.4 oz./gal. oz. /gal. oz./gal. oz./gal. oz./gal. cadmium cadmium oxide sodium oxide sodium hydroxide sodium carbonate We regret the loss of this solution, and will take measures to reduce the possibility of this accident recurring. Mr. Buster replied re period from October 22nd to November 26th re progress made. Said on October 22nd proposed site was leveled . At that time Textron had not yet approved this project. Also did not have final approval on finished drawings to get building permit. Added he understood that their building permit had not been approved . Was a holdup by the Fire Dept . Didn 't be lieve the permit fees had been paid yet. Commented that apparent l y there is no lack of completed drawings a t this time or cou ldn't have got t en a permit. Wanted to clear th e record on that. Ward stated that whethe r the plans were complete enough for the City or complete enough for District engineers to look at were two differen t things . Aske d s t aff if there was anyth ing major wrong with the p l a n s . Were a few chan ges in the e l ect ri ca l part and a few other ch anges needed to be made. REL said s t aff 's comments were constructive comments and believed discharger will comp l y with them. ~lr . Buster then added that Textron was never the holdup on this . Have had approval , in principle, for this entir e year. The group Vice President h as authori t y to approve $200, 000 . Tirn Pres iden t $500 , 000 (o r Chairman of the Board). But the Board of Directors has to approve someth i n g l ike this. Said t he first phase was rele ased during this 30-day period and quite a numbe r of things have taken place . Phase I was approved while awaiting action by the Board. We h a ve let contracts on this . Ha ve moved earth and l aid forms. Are awaiting permit . Have a l so placed orders for the equipment ($400-500,000). Asked for a possible b onding of this whol e project some mo nths ago because we h ave no proof that when we get this built , it is going to work. Have nothing to in s ure tha t but to come back on equipment suppliers and they aren't big enough to handle that kind of failure. Ward said he didn 't think the staff c an gua rantee it either but ass ume Cherry Fast ener's engineers are competent. Buster said their engineers have never done anything like this. They are dependent upon equipment supp liers for advice and the District's s taff . Buster wanted to be sure everyone understood that at no time did Textron hold this up. Was held up by themselves and lack of drawings in order to get building permit . Would like comments from staff on what could h ave been done that they hadn't don e in the past 30 days. Anthony commented that Mr. Buster felt that they are approximately on schedule with the plans. Buster replied, yes, are on schedul e at this time and think schedule is realistic. Asked him if he felt they could meet this date (May ?) He answered, yes. Said they welcomed monitoring and there was no problem between them and District 's staff. Welcome staff's criticism of their des ign. Ward asked if staff thought they were taking a fair amount of steps. REL said we felt overall that the discharger is working within good faith and methods of the ordinance, a lthough the results of the discharge have deteriorated. They are moving a h ead but results have not shown any improvement . Asked Cherry Fasteners what they had done for short -term corrective action . Answered that they had done a lot of hous e keeping that should have been done a long time ago. Don 't expect to meet 1978 limits until they get the plant operating . Based on sampling within the last 30 days, have decreased average of cadmium into the sewe r from 30 lb s. to 13 lbs. Showed substantial improvement but will still have hi gh days. Don 't think they can reach the 7 l b . limit . Are changing rinses and examining every flow. Before had everything going into a common sewer. Asked Cherry Fasteners if they were aware that if they are in excess n ext month again, will have another fee charged . Said, yes, they were aware. Buster said t h e y may have to shut that operation down and send it out but that would delay orde rs. Could hurt contractors b a dly including government contracts. The other thing we would recommend is that the Board authorize our staff to negotiate with C.F . on this billing to see if there is any leeway there . TLIY stated that based on determinat ions of this Board, think it would be appropriate to move : That the General Counse l be instructed to initiate and file proceedings to obtain compliance with th e ordinance standards together with the collection of al l charges owing ; and that action sh otJ.ld be filed on o r as soon as possible after January 15, 19 81. The filing will be based upon Ch erry Fastener's staff and t he Genera l Counse l's office n egotiating an agreemen t re l a tive to the payment of those charges, meeting the e nforcement compliance schedule and al l the terms necessary t o meet the compliance date of May 18 , 19 8 1, and this agreement will be presented to t he Board on January 14, 1981.
