LANDFILL, IRVINE AREA, COUNTY OF ORANGE,
AND PROVIDING FOR NOTICE THEREOF

The Board of Directors of County Sanitation District No. 1
of Orange County, California,
DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the project concerning which this determination
is made is described as follows:
SEWAGE SLUDGE MANAGEMENT FACILITY
·coYOTE CANYON LANDFILL
IRVINE AREA, COUNTY OF ORANGE
Section 2. That, whereas, ari Initial Study and Environmental
Impact Assessment, which said study is attached hereto-as Exhibit 11 A",
of the environmental effects of said project have been undertaken and
completed by the District, and the results thereof have been reviewed
by this Board; and,
Section 3. That, for the following reasons it is hereby found
that said project will not have a significant effect on the environment:
(a) It is not in conflict wit~ environmental plans and goals
that have been adopted by the cominunity where the project
is to be located.
(b) It does not have a substantial and demonstrable aesthetic
effect.
(c) It will not substantially effect a rare or endangered
species of animal or plant, or habitat of such a species.

(d) It docs not cause substantial interference with the~-•~
movement of any resident or migratory fish or wildlife
species.
(e) It does not breach any published national, state or local
standards relating to solid waste or litter control.
(f) It will not result in a substantial detrimental effect
-on air or water quality, or on ambient noise levels
for adjoining areas.
· (g) It does not involve the possibility of contaminating
a puQlic water supply system or adversely affecting
ground water.
(h) It could not cause substantial flooding, erosion or
siltration.
(~) It could not expose people or structures to major
geologic hazards.
(j) It is not likely to generate growth.
Section 4. That the Secretary be, and is hereby authorized
and instructed to file a certified copy of this resolution and of
the aforesaid Initial Study at the Districts' office to be available
for public inspection and.copying.

Description of Project The proposed project is a drying/composting operation
consisting of mixed dry sewage sluqge and 80% wet sewage sludge that is mixed
and aerated on a daily basis until the solids content reaches 35-50%. The

DO HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the written recommendation this day submitted to the Boards
of Directors by the Districts' Chief Engineer that award of contract be made to
PASCAL & LUDWIG, INC. for INSTALLATION OF GAS ENGINES WITH GEAR DRIVES AT
ROTHROCK OUTFALL BOOSTER STATION, JOB NO. J-3-1, and the bid tabulation and
proposal submitted for said work are hereby receiyed and ordered filed; and,
Section 2. TI1at the contract for said Job No. J-3-1 be awarded to Pascal &
Ludwig, Inc. in the total amount of $247,225.00 in accordance with the terms of
thier bid and the prices contained therein; and,
Section 3. That the Chairman and Secretary of District No. 1, acting for
itself and on behalf of Districts Nos. 2, 3, 5, 6, 7 and 11, are hereby authorized
and directed to enter into and sign a contract with said contractor for said work
pursuant to the provisions of the specifications and contract documents therefor,
in form approved by the General Counsel; and,

WHEREAS, County Sanitation Districts of Orange County are parties to that
certain joint powers agreement dated June 27, 1978, with County Sanitation Districts
of Los Angeles County, Orange County Water District, The Metropolitan Water District
of Southern California, City of Los Angeles and the City of Los Angeles Department
of Water and Power to conduct a regional water resuse (reclamation) study of the
Orange/Los Angeles Metropolitan area; and,
WHEREAS, the joint powers authority has requested that a data search relative
to said study be conducted by Districts' staff personnel;and,
WHEREAS, the joint powers water reuse study is the recipient of a State,and
Federal. grant for said study, which said grant conditions require the grant
administering member of the joint powers authority to enter into a contract with
the performing agency for any reimbursable work to be performed by said agency; and,
\~iEREAS, the Orange County Water District is the grant administering member of
the water reuse study joint powers authority.
NOW, THEREFORE, the Boards of Directors of County Sanitation Districts Nos.
1, 2, 3, s·, 6, 7 and 11 of Orange County, California,
DO HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the certain agreement dated , by and between --------
County Sanitation District No. 1 of Orange County and the Orange County Water

to the Orange/Los Angeles Counties Water Reuse Study and providing for reimbursement

WHEREAS, Section 1771 of the Labor Code of the State of California requires
that not less than the general preva~~ing rate of per diem wages shall be paid to
all workers employed on public works contracts; and,
WHEREAS, Section 1770 of the Labor Code of The State of California requires
that the Director of the State Department of Industrial Relations shall determine
the prevailing rate of per diem wages for the locality; and,
WHEREAS, the Director has determined and published the prevailing rate of
per diem wages for Orange County; and,
WHEREAS, Section 1773 of the Labor Code of the State of California requires
that any body awarding any contract for public works shall obtain from the State
Department of Industrial Relations the general prevailing rate of per diem wages
and general prevailing rate for holiday and overtime work in the locality in which
the public work is to be performed for each craft, classification, or type of
workers needed to execute the contract, and further allows such public body to
incorporate, by reference thereto, said prevailing rates in the Notice Inviting
Bids, specifications and contract, and indicate that a copy is on file in the
office of the Secretary of the Districts rather than setting forth said per diem
rates in each call for bids, in the bid specifications and in the contract itself.

Re: Solid Waste Management Board Hearing
On February 1 and 2, 1979, I appeared before the Solid Haste
Management Board in Sacramento for purposes of presenting the
position of the District relative to our pending application before
the Orange County Enforcement Agency to dispose of our solids
waste at the Coyote Canyon Landfill. That hearing was also
at,tended by Dennis Reid of our Staff, and Mr. Michael Loop, the
E'xecuti ve Officer of the Orange County Enforcement Agency.
Essentially, the position of the District was set forth in our
written prepared statement, which was filed with the Solid Waste
Board on the preceding Monday.
In summary, I .can indicate to you that while the State
Board's Staff initially had posed three basic objections to the
permit, each of which was basis for their recormnendation of denial,
they were most receptive to our efforts to expedite and make
necessary changes in order to allow the Board to approve the permit.
The three basic objections were:
1. The permit application was incomplete. The incompleteness
took the form of not having The Irvine Company sign the application
which was required of them since they are the landowners. This
signature was obtained prior to the hearing and was presented to them
by hand on February 1 by the Orange County Enforcement Agency.
2. Two essential legal findings were not set forth in the Orange
County Agency permit. These findings are spelled out in California
Government Code 66792.34, and frankly were an oversight on the part
of the County. In their defense, however, it should be pointed out
that the published guidelines of the State Board do not refer to this
as a requirement. In any event, the amended permit by the Orange
County Enforcement Agency did specifically contain these findings, and
this deficiency no longer existed at the time of the hearing. It should

be further pointed out that the original permit issued by the Agency
recited that our permit application was not in conformance with the
County's approved plan for landfill. This too was corrected as not
·being the actual finding of the Orange County Regency Board, and was
not included in the final amended permit, and therefore, was not an
issue at the time of the hearing.
3. The finding of a categorical exemption from CEQA by our
. Di strict and by the Orange County Enforcement Agency was not support-
able, and therefore, the State required at the very least an environ-
mental assessment which would produce a negative declaration.
As you are aware, the basic position of the District could be
summarized as relying on each of the two major. points--namely: .
1. That we were totally exempt from even securing a solid
waste discharge permit under the existing provisions of law relating
to Class II disposal sites; and
2. That we did qualify as being categorically exempt under the
published guidelines of the State for the California Environmental
Quality Act. ·
While the State Board Staff did not verbally or in writing
oppose our claim of permit exemption under the Solid Waste Discharge
Laws, they also did not support, endorse or concur with us. It
should be noted, however, that the three Board members who comprised
the Review Committee which met on February 1, all accepted the basic
argument of the District that we were probably totally exempt. The
dispute centered about a factual question as to whether the Regional
Water Quality Control Board (Santa Ana) would in fact allow us to dis-
charge our dewatered sludge into the dump site with or without drying.
We argued with a fairly successful measure of persuasion that the
permit issued for the dump site by the Regional Water Board in fact
authorized dewatered sludge that contained 20% solids or greater. How-
ever, the State Board Staff maintained that in a conversation they had
with some Staff member in the Regional Board office, that we could not
do so. Again, we referred specifically to the provisions of the
California Administrative Code (Sections 2510 et seq., Title 23), as
well as the 1977 permit order. Hm·1ever, even this became somewhat
academic when the Board members realized that the County of Orange had
not yet had their own landfill permit issued by the Orange County Enforce-
ment Agency and the State Solid Waste Management Board .

With regard to the CEQA objections, the end result of our
attendance at the hearings, was effectively to compromise. By this,
it took the position that the Solid Waste Board Staff obtained
assurances from the Resources Agency -Office of Planning and
Research, which acts as the official State clearinghouse for
environmental assessments, that they would, as authorized by law,
waive the time requirements to process a negative declaration. In
my conversations with OP&R, they confirmed that they would do so,
and therefore, it could be handled within 15 days. With this
·assurance, we realized that we could then be placed back on the
agenda of the Solid Waste Management Board for their hearing of
·February 23, and we stipulated that the matter could go over to that
date without prejudice to either party. I would parenthetically note
that the Solid Waste Board Staff reported to the Board on February 2
that they were confident that the negative dec1aration would be
processed before the 23rd, and immediately upon receipt of that,
the matter would be processed as a consent calendar item for approval.
The Chairman of the Board then inquired as to whether any of the
m~mbers h_ad any concerns with the application or the positions
represented by either our District or the County. There were absolutely
no concerns expressed, and the only remarks were those of a favorable
nature indicating approval of the manner in which we attended to the
environmental concerns.
In summary, the matter will be calendared for the February
23rd Solid Waste Management Board hearing, and at that time, it should
be approved without further presentation or argument, provided the
negative declaration is submitted and reviewed prior to that date.
I have full confidence that it will be approved, and that we could rely
on the present status to consider the award of the contract to
Artukovich for the initial site preparation and grading.

Senior Citizen Housing Project
Honorable Board of Directors:
I am requesting an opportunity to speak before you at
your next regular meeting of January 10, 1979.
The Brea Rotary Club and all local organizations are
building 30 units of low-cost housing for the senior
citizens of Brea without the aid of County, State or
Federal fundse The City has leased to our non-profit
corporation (Breal, Inc") a piece of City mmed property
for 50 years at a cost of ~"Pl.00 per yearo When the
lease is up, all property and improvements enure to the
City. The City has waived all fees for this project.
All labor on the project is free and much of the mater-
ials is also free or at cost~
If we were to pay for land and improvements, the pro-
ject would cost approximately ~?900 ,ooo. The local
United California Bank in Brea has loaned to Breal, Inc.
$350,000, which we feel will complete the project.
Projected rents are approximately ~~125.00 per month per
unit pecause there is no profit motive involved.
The Breal Board is made up of 7 members, 5 Rotarians,
1 representative from the Brea Ministerial Association,
and 1 representative from the City of Brea selected by
the City Council.
We are within 30 days of ground breal{ing. We are asking
for relief of the usual sanitation fees connected with
this project at an approximate price of $6,600.

At the Board of Directors meeting held on January 10, 1979 for
District No. 2 a request was received from the City of Brea for
a w~iver of the sewer connection fees for a Senior Citizens
liousing Development being constructed by a non-profit organization
on municipally owned land.
The Anaheim City Council at its meeting ~f January 16, 1979
passed a Motion by unanimous vote in support of County Sanitation
District No. 2 amending its Ordinances to permit a waiver of
sewer connection fees for projects being constructed on
municipally owned land.
I would appreciate your advising this off ice of any proposed
action regarding this matter so that we may give this proposal
our vigorous support.

Re: Possible Alternative Provisions of Ordinance
Amendments re Waiver of Connection Fees ·
At the January 10, 1979, District Board Meeting you received
a request from Breal, Inc., a nonprofit organization which is
~undertaking to construct a senior citizen housing project on a
parcel of property owned by the City of Brea and leased to the
applicant. Specifically, they made a request for the District
to waive the $6,600.00 in connection fees that would be otherwise
owing pursuant to the provisions of eiisting Ordinance No. 204.
After the presentation, the matter was continued by vote
of the Directors, and at that time, informal suggestions were made
to the Staff and my office to provide possible alternatives that
could be considered by the Boa rd in order to a 11 ow for this
waiver. At that time, and I re-emphasize, the existing provisions
of Ordinance Ho. 204 do not authorize the waiver of these fees.
To do so, an amendment to the Ordinance will be required.
ALTERNATE NO. 1.
This alternate would provide that any member agency of the
District (i.e., the individual Cities) and no others could be granted
a waiver by action of the District Board of Directors. To do so,
Ordinance No. 204 would have to be amended in form substantially as
follows:
11 402 (I) At the request of any member agency of
this District, the Board of Directors may grant a
waiver of the connection charges due under the pro-
visions of this Ordinance for connection permits to be
issued for properties owned by the member agency."

ALTERNATE NO. 2.
This alternate would provide that the Board of Directors
could grant an exemption from the connection fees to any public
agency making a request for properties located within the District.
This would of course then include school districts, the County,
other special districts, etc. To accomplish this, the existing
Ordinance would have to be amended in substantially the followi~g
form:
11 402 (I) At the request of the governing body of
any public agency whose territory lies within the boun~
daries of this District, the Board of Directors may grant
a waiver of the connection charges due under the provisions
of this Ordinance for connection permits to be issued for
properties owned by the applicant _agency. 11

ALTERNATE NO. 3.
This alternate would authorize the Board of Directors of the
District to grant an exemption from the payment of the full fees owing
to the District for connection permits upon the application of either
a member agency only (similar to Alternate No. 1 above) or to any
governmental agency (similar to Alternate No. 2 above). Specifically,
the Ordinance could be amended to provide for a waiver of a percentage,
i.e., 50% of the fees otherwise owing from other property owners.
To accomplish this, the Ordinance would be amended in substantially the
same form as Alternate No. 1 or Alternate No. 2 above, except that it
would specify that in lieu of a waiver, that it would be a waiver of
X% of the fees due and owing.
ALTERNATE NO. 4.
This alternate would provide for a deferral of the fees, but
not a waiver and exemption. Specifically, it would provide that the
fees would become due and owing as of the date of the connection, but
that actual payment could be deferred for any number of years. Again
a distinction could be drawn if this alternate would be considered to
make it available only to the member agencies of the Di strict or to
any public agency. To accomplish this, the existing Ordinance would
need to be amended in substantially the following form:

"402 (I) At the request of any member agency
(any governmental agency located within) of this D·is-
trict, the Board of Directors may approve the deferral
of payment of the connection charges due under the
provisions of this Ordinance for connection permits
to be issued for properties owned by the member agency
(governmental agency). The term of the deferral and
the other specifications pertaining to the payment and
other obligations of the requesting agency, shall be
as approved by action of the Boa rd of Di rectors. 11
ALTERNATE NO. 5.
This alternate would authorize the Board of Directors to grant
a waiver of the connection fees (or a deferral as per Alternate No.
fi above) to any nonprofit organization which would be those groups
other than governmental agencies. To accomplish this, the existing
Ordinance would have to be amended in a form substantially as set
forth in Alternate No. 2 above, except the inclusion of language to
define an all-encompassing definition of nonprofit organization.
The Staff i~ not making any specific recommendations with regard
to any of the alternatives listed above) and they are not set forth
in any order of priority. I would point out, however, as I did at
the Board of Directors meeting in January, that such an ordinance
must be carefully prepared to avoid any legal challenge on the
basis of being discriminatory. A deferral or even an exemption of
fees for governmental agencies, on its face, can likely withstand any
judicial attack of discrimination for the reason that it is simply a
shifting of tax burdens to adopt an ordinance that requires payment
of such fees. However, exempting other nonprofit organizations could
raise additional serious legal questions as to its validity.
I would further point out that the existing provisions of the
Clean Water Act of 1972 (PL 92-500) and the 1977 amendments, contain
provisions relating to the Revenue Program which, although are yet
subject to more definitive regulations, do call for an across-the-board
imposition of user charges without exemptions to any property owner,
including governmental agencies. If that Revenue Program in fact is
required to be adopted by tt11s District, it would negate the legal
possibilHy of having such a waiver provision in force in the future.

for the Addition to Anaheim Stadium and the Anaheim Convention
