January 28 , 1976, the Board of Directors of District No. 7 received a request for concurrent annexation and bond authorization from a group of residents and property owners on behalf of. the Orange Park Acres Association, Inc . March 10, 1976, the Board of Directors of District No . 7 autho- rized initiation of annexation proceedings and in June, the Local Agency Formation Commission approved the proposed annexation desig- nated Annexation No. 51 , subject to twelve conditions . Public Hearing - Public hearing agendas , as well as notices , have been mailed to all property owners within the proposed annexa- tion, to advise them of tonight ' s public hearing for the annexation of approximately 500 acres and an improvement bond election authori- zation in the amount of $1, 025 ,000. The public hearing notices in- cluded a map of the area under .consideration and a description of the facilities to be constructed and/or acquired, as well as cost estimates involved for the individual property owners to obtain sanitary sewer services. %W Election - The annexation and bond election, if approved, will involve the issuance of $1, 025 ,000 in bonds which will be repaid over a 15-year period by ad valorem taxes based on the assessed valuation of land and improvements within the annexed area. It is contemplated that the election will be held in March, 1977 . Bond Proceeds ($1, 025, 000) will pay the District No . 7 annexa- tion fees of $828 per acre approximately $418 ,000) . In addition, funds will be provided for the construction and/or acquisition of District Master Plan sewers, Reaches 17 and 18 (approximate value, $495,000) . It will also provide for the financing of the bond election ($35, 800) and pay the $250 residential hookup fee for each parcel ($100,000) . Annexation Fee - The $828 annexation fee was established by the Board of Directors by Resolution No . 76-53-7 on March 102 1976 . The annexation fee was established as follows : The District ' s assets minus its liabilities, divided by the number of acres within the District . On July 1, 1976, the annexation fee increased from $828 per acre to $961. Each subsequent July 1, the annexation fee will increase, based on the annexation fee formula. Installation of Local Sewers - The improvement district pro- ceedings will not provide the local sewers . However, it does provide for annexation to the Sanitation District and the Master Plan trunk sewers for the area. Local sewers can be provided for by the following methods : (1) Through a local sewering entity, such as a city (2) Through assessment district proceedings by Petition of 60% of the property owners within a described area (3) By private financing During consideration of Agenda Items 3-g and 3-h, we will address questions on the annexation proposal to make sure the property owners and residents have all the facts . BOX 8127 10844 ELLIS AVENUE FOUNTAIN VALLEY, CALIFORNIA 92708 (714) 540-2910 (714) 962-2411 November 24 , 1976 NOTICE TO PROPERTY OWNERS IN THE ORANGE PARK ACRES AREA Public Hearing Thursday, December 16 , 1976 Fire Station No . 23 5020 Santiago Boulevard Villa Park, California A proposal for concurrent annexation to County Sanitation District No. 7 and a sewer bond authorization of $1,025 ,000 have been proposed for the Orange Park Acres area. The proponents for annexation to County Sanitation District No. 7 have stated that older septic tanks are presently failing and an alternate method of disposing of sewage would be desirable for the entire area. The area proposed for annexation to District No. 7 encompasses approximately 500 acres and is divided into 400 parcels . Of the 400 parcels , over 75% are improved. Currently, the improved prop- erties in Orange Park Acres have individual on-site disposal systems and are not served by a sanitary sewer system. On January 28 , 1976, a proposal for concurrent annexation and bond authorization for the Orange Park Acres area was submitted to the Board of Directors of District No. 7 . The Board, on March 10, 1976, authorized initiation of annexation proceedings and in June, the Local Agency Formation Commission approved the proposed annexa- tion,designated Annexation No. 51 , subject to twelve conditions which will be described later in this text . The Directors of District No. 7 have ordered a public hearing on the proposed election for annexation and bond authorization to determine if there is reasonable property-owner support within the Orange Park Acres area to warrant the expense of conducting the election. Enclosed for the property owner and/or registered voter ' s information is a breakdown of anticipated sanitary sewer costs which will be borne by the property owners within Annexation No. 51, estimated to be $61,813 .75 per acre . Improvement District Bonds , $1,025 ,000. The annexation and bond election , if approved by a 2/3 majority of the registered voters within the territory to be annexed, will involve the issuance of $1 ,025 , 000 in bonds which will be repaid over a 15-year period by ad valorem taxes , based on the assessed value of land and improvements within the annexed area. The bond proceeds ( $1, 025, 000) will be used to pay the District No. 7 annexa- tion fee of $828/acre , for the construction or acquisition of District No. 7 Master Plan Sewers , Reaches 17 and 18 (approximate value $495 ,000) , financing of the bond election ( $35,000,) and the $250 residential hookup fee for each parcel ( $100 ,000) . The Improvement District bonds will be retired over a 15-year period and the estimated tax rate will vary from $0. 48 to $1. 66 during the life of the bonds . Attached is an estimated tax rate schedule for NO CALLED BONDS and for CALLED BONDS . The District No. 7 Directors will determine how the bonds will be 'sold after a successful election. Assessment District Bonds , $2 ,100 Per Acre. In addition to the Improvement District costs , each property owner will be subject to an assessment district cost of approximately $2 ,100 per acre to construct the local collection system, thereby providing sewer service for each property. Five Assessment Districts are proposed (see map) to construct the local 8-inch street sewers and the 4-inch house laterals to the property lines. The individual Assessment District proceed- ings will commence when the District No. 7 Board receives a petition signed by 60% of the property owners within a proposed Assessment District . Each parcel will be assessed (estimate , $2, 000-$2 ,200/acre) for a share of the construction costs . The assessment may be paid in cash at the time the property owner is billed or the assessment can go to bond as a first lien against the property and be paid for over a 12-15 year period at 7% simple interest . Actual Hookup Costs . The actual hookup is at the property owner' s option and expense. There is no District requirement that a residence be connected to the sewer. We estimate that the on-site sewer hookup cost will vary from $500 to $750 depending on how far each residence is from the 4-inch lateral which has been installed by the Assessment District to the property line. The District No. 7 connection charge of $250 is in- cluded in the Improvement District bond issue for each parcel of record as .of the date of the bond election. -2- County Sanitation District No. 7 Property Taxes . In addition to the taxes for the retirement of the Improvement District bonds , the properties within Annexation No. 51 will be subject to District No. 7 ' s property tax. The current rate is $0. 3485 per $100 assessed valuation on land and improvements only. Sewer Maintenance District Taxes . The local sewers will be maintained by the 7th and 70th Sewer Maintenance Districts . The areas within Annexation No. 51 served by the District No. 7 gravity sewer system will be annexed to the 7th Sewer Maintenance District . There is a portion of proposed Assessment District No. 5 which will be served by a pumping station and the maintenance of this particular system will be the responsi- bility of the 70th Sewer Maintenance District . There is no Sewer Maintenance District annexation fee; however, the ad valorem tax rates for the 7th and 70th Sewer Maintenance Districts are $0. 02 and $0. 17 respectively. Payment by the landowners of the annexed territory of $828 per acre for the acreage involved, being the amount established as the standard annexation fee by action of the Board of Directors, being equal to the cost of rights of service and use of the existing treatment and outfall facilities of District No. 7 . 3. The proponents for annexation to County Sanitation District No. 7 have stated that older septic tanks are presently failing and an alternate method of disposing of sewage would be desirable for the entire area. The Board, on March 10, 1976, authorized initiation of annexation proceedings and in June , the Local Agency Formation Commission approved the proposed annexa- tion,designated Annexation No. 51 , subject to twelve conditions which will be described later in this text . The Directors of District No. 7 have ordered a public hearing on the proposed election for annexation and bond authorization to determine if there is reasonable property-owner support within the Orange Park Acres area to warrant the expense of conducting the election. Enclosed for the property owner and/or registered voter ' s information is a breakdown of anticipated sanitary sewer costs which will be borne by the property owners within Annexation No . 51 , estimated to be $6,813. 75 per acre . Improvement District Bonds , $1,025 ,000 . The annexation and bond election, if approved by a 2/3 majority of the registered voters within the territory to be annexed, will involve the issuance of $1 , 025 ,000 in bonds which will be repaid over a 15-year period by ad valorem taxes , based on the assessed value of land and improvements within the annexed area. The bond proceeds ($1,025, 000) will be used to pay the District No. 7 annexa- tion fee of $828/acre , for the construction or acquisition of District No. 7 Master Plan Sewers , Reaches 17 and 18 (approximate value $495 ,000) , financing of the bond election ( $35,000.) and the $250 residential hookup fee for each parcel ( $100,000) . The Improvement District bonds will be retired over a 15-year period and the estimated tax rate will vary from $0 . 48 to $1. 66 during the life of the bonds . Attached is an estimated tax rate schedule for NO CALLED BONDS and for CALLED BONDS . The District No. 7 Directors will determine how the bonds will be sold after a successful election. Assessment District Bonds , $2 ,100 Per Acre. In addition to the Improvement District costs , each property owner will be subject to an assessment district cost of approximately $2 ,100 per acre to construct the local collection system, thereby providing sewer service for each property. Five Assessment Districts are proposed (see map) to construct the local 8-inch street sewers and the 4-inch house laterals to the property lines. The individual Assessment District proceed- ings will commence when the District No. 7 Board receives a petition signed by 60% of the property owners within a proposed Assessment District . Each parcel will be assessed (estimate , $2,000-$2 ,200/acre) for a share of the construction costs . The assessment may be paid in cash at the time the property owner is billed or the assessment can go to bond as a first lien against the property and be paid for over a 12-15 year period at 7% simple interest . Actual Hookup Costs . The actual hookup is at the property owner' s option and expense. There is no District requirement that a residence be connected to the sewer. We estimate that the on-site sewer hookup cost will vary from $500 to $750 depending on how far each residence is from the 4-inch lateral which has been installed by the Assessment District to the property line. The District No. 7 connection charge of $250 is in- cluded in the Improvement District bond issue for each parcel of record as .of the date of the bond election. -2- County Sanitation District No. 7 Property Taxes . In addition to the taxes for the retirement of the Improvement District bonds , the properties within Annexation No. 51 will be subject to District No. 7 ' s property tax. The current rate is $0. 3485 per $100 assessed valuation on land and improvements only. Sewer Maintenance District Taxes . The local sewers will be maintained by the 7th and 70th Sewer Maintenance Districts . The areas within Annexation No. 51 served by the District No. 7 gravity sewer system will be annexed to the 7th Sewer Maintenance District . There is a portion of proposed Assessment District No. 5 which will be served by a pumping station and the maintenance of this particular system will be the responsi- bility of the 70th Sewer Maintenance District . There is no Sewer Maintenance District annexation fee ; however, the ad valorem tax rates for the 7th and 70th Sewer Maintenance Districts are $0 . 02 and $0. 17 respectively. Environmental Health Engineering Specialist Orange County Health Department- SUT`irfARY OF FINDINGS: During the months of January and February, 1972, the Orange County Health Department conducted a survey of individual sewage system conditions in Orange Park Acres, an unincorporated area of Orange County. The' survey consisted of personal interviews with residents, field observations and a review of all available individual sewage disposal pumping records, soil maps, well logs and both chemical and bacteriological sampling of domestic well water and suspected sewage overflows. The findings of the survey are summarized as follows: 1. A review of geological information of the Orange Park Acres area indicates that sub-surface soils are variable in composition. As. a result, the percotative capacity of the sub-soils varies from one sub area to another, ranging from very poor in 65% of .the area, marginal in 30% and good in 5%. 2. In some sections of the area, the variable surface topography adds to the problem -of poor soil infiltration characteristics, making these areas entirely unsuitable for the disposal of sewage effluent. 3. Reports from commercial sewage pumpers, submitted to the Health Department, show that during the past three (3) years, fifty (50) systems have been pumped, with seven (7) of these requiring two or more pumpings within a period of one hundred twenty (120) days. WOW 4. . Interviews with 143 of the 300 homeowners in the area indicate a system failure rate of 16% over the most recent five year period. Also, 297 of the persons interviewed admitted to having their system pumped out at least once since installation. 5. During- the field survey, two sewage disposal. systems were observed to be overf lowing. 6. Currently, no soil borings or percolation tests are required by the Depart- ment of Building and Safety prior to the issuance of a permit for the con- struction of an i.ndivi.dual sewage disposal system. CONCLUSION AND RECOMENDATIONiS: Orange Park 4cres area is generally not well suited for disposal of sewage by indivi- dual systems.. This is evidenced by the recent history of disposal system failures and the very 101•7 soil infiltration rates exhibited in 65% of the area. Since much of the developed and developable land lies within this area, it is our opinion that sewage disposal system failures will continue, even if no further development occurs, and will increase in frequency in proportion with future development. It 'is, therefore, recommended that the necessary steps be initiated to provide alter- nate means of. sewage disposal in the areas of poor infiltration characteristics. The most obvious alternative is, of course, to provide sanitary sewers. However, if expense is no object, elaborate, well-engineered individual. systems, uti.lizi-ng advanced techniques such as soil replacement and evapo-transpiration, might _possibly function in.such areas. The chances of success are not too great. It is further recommended that if individual sewage disposal systems are permitted in the future, they be approved only on the following conditions: 1. That, prior to issuance of a building permit, a log of soil borings and results of percolation test be submitted to the Department-of Building and Safety for evaluation on each lot for which an application is made. The aforementioned percolation test should be performed and reported by a Registered Sanitarian, Registered Civil or Sanitary Engineer, Registered Geologist or Registered Engineering Geologist. , 2. That each proposed individual disposal system be designed by a Registered Civil or Sanitary Engineer or Engineering Geologist. 3. That the proposed building site not be less than one acre. 4. Tha--t an additional percolation system, equal to 100% of the original design capacity, be constructed and connected at the time of original construction. 5. That means be provided -for assured routine preventive maintenance of such systems, such as by the formation of a septic tank maintenance district. DISCUSSION: Scope of Investication The Health Department cgnducted a survey of individual sewage disposal systems con- ditions in Orange Park Acres community, an unincorporated area in Orange County-. This area is located in T4S, R9W, Sections 13, 14, 23, 24, 25 and 26. The survey was con- ducted during the months of January and February, 1972, and consisted of the folioclir�g investigations: . -3- 1. Available geological data on sub-surface soil and water conditions was reviewed. •3. Interviews were held with personnel of the Orange County Water District, Orange County Flood Control District, U. S. Geological Survey Office, Orange County Building Department and the Orange Park Acres Mutual Water Company. 4. All available Health Department pumping records for septic tanks, seepage pits and cesspools in the area were reviewed. 5. Samples from water i..clls and suspected sewage overflows were collected for chemical and bacteriological analysis. Background of the Area The community of Orange Park Acres northern boundary begins at the western portion of the Sully-14iller sand and gravel operation and follows Santiago Creek to Villa Park Dam, The eastern boundary begins at Villa Park Dam and continues south through the Villa Parl; Dam Regional .Park site to Chapman Avenue. The southern boundary proceeds west- along Chapman Avenue to Newport Avenue, southeast along Newport Avenue, approximately 2000 feet to the southern range of h'i.l.1s, following the ridge line West- erly to a point where the hills intersect Chapman Avenue. The western boundary begins at Chapman Avenue and proceeds north following the ridge of the hills to Santiago Creek. In 1929, a deep water well was drilled near Santiago Creek in T4S, h9W, Section 27, and the Orange Park Acres Mutual Water Company was formed to serve the area. With v:ater piped in, Orange Park Acres was divided into parcels of land for orchards. Homes were established in some of the groves. In the late 1940's and early 1950's, chicken :anchcrs began to establish operations in the area that threatened the continued existence of the pastoral setting. As a result, residents in the late 1950's, working in conjunction with established poultrymen, obtained one acre minimum lots (there are some one-half acre lots), single family residence zoning in most of the area to maintain a desirable balance between residen- tial and ranching activities in the community (Ord. No. 685, passed by the Board of Supervisors on March 9, 1954, designated the area E4-1 acre minimum lots). The number of residents doubled in the decade of the late 1960's. At the present time, there are approximately 300 families living in the area. Currently, twelve (12) new homes are under construction in the area. Many owners are subdividing their land and offering one, two, and three acre parcels for sale. Since most lots in the area are large (one acre) , the Orange County Department of Building and Safety does not require that percolation tests or soil borings be made in advance of construction of individual sewage disposal systems. The "rule of thumb" applied is a septic tank, plus one seepage pit per bedroom. In other words, it is assumed that a leaching area can be depended upon to dispose of sewage effluent regardless of the physical properties of the soil. i r -• • • Veol.o and SON. Field Survey of Existing. Individual Sevave Disposal stems. A house to house survey was conducted and homeowners were interviewed to gather data on the history of disposal system failures and make observations for evidence of any faulty systems. A system failure is defined as the inability of the disposal system to function prcperl:y 4:ithout clogging and the resultant overflowing conditions. One hundred and forty- three (143) of the approximately three'llundred _(300) homeo�,-ners in the area were interviewed. All of the homes were visited but over half of the residents were not at home. The data below represents the results obtained from the interviews conducted during the survey and 11calth Department records: 1. Forty-tcro (42) persons, or twenty-nine percent (29%) of those interviewed, edniitted to at least one pumping since their disposal system was installed. v H0-icvcr, when pressed they were vague regarding the exact number of times the system had been pumped and the time lapse between pumpings. 2. :• Twenty- three (23) persons, or sixteen perocent (16%) of those interviewed, ..i reported leaching system failures withina five year period. Information was not giver► during the interviews indicating the occurence of more than one failure. 3. Of the approximately 300 homeowners in Orange Park Acres, .157, or about fifty-six percent (56%) of the total, were not at .home or unavailable 'for intCrviewing during the survey. Durin€, the lnfcrviews, the residents in' general were uncooperative when we attempted to elicit information about- their sewage disposal. systems-. There iias a. pervasive feeling .among residents that the survey would accelerate incorporation into the City of Orange, resulting in zone clianoes which would destroy the present rural atmosphere. -Many of the persons interviewed were house%i.ves, who in most cases had little know- ledge about their sewage disposal systems. There was complete agreement, among all persons interviewed, that homeox..ners relied entirely upon cesspool pumpers to avoid sewage overflows when problems arc-first noted. During the survey there were two homes where sewage was observed overf.l.ol•:ing from the leaching lines due .to a system failure. The most frequent complaint made by the residents- of the 23 homes reporting system failures, was that the permeability of the soil is poor, which causes oversaturation of the leaching lines and seepage pits. In addition, they encountered problems with their disposal systems not f_unctioni.ng properly due to rain water infiltration during the rainy season. ; Chemical and. bacteriological analyses of the eight :O) water wells in the area were performed in an attempt to establish what effect, if any, .the sub-surface disposal of sewage has upon the quality of the underground water in tbt; area. The results of the analyses are pending; therefore, no data is available at this time. Environmental Health Engineering Specialist Division of Environmental Health Orange County Health Department DATE: April11, 1972 SUBJECT: Addendum to the Health Department Report of February 25, 1972, entitled "A Survey of Individual Sewage Disposal Systems - Orange Park Acres" } Since the writing of the subject report, this Department has continued to investi- gate chemical and bacteriological quality of wells in the Orange Park Acres area. In addition, we have made further investigations of the soil conditions relative to the use of individual sewage disposal systems. In reviewing the additional data.presented in this addendum, we find that it further supports our original recommendation; that if individual sewage disposal systems are to be constructed in the area, they should only be allowed on a selective basis, after the findings of soil borings or percolation tests have shown the feasibility of such systems. Chemical analyses were run on samples collected from nine (9) wells. The results of these analyses appear in Table A I. A review of the data indicates that all nine (9) wells were high in total dissolved solids, not unlike shallow wells in adjacent areas. There is one notable exception and that is the Lazy "B" Golf Course well which exhibited twice the number of TDS and high nitrates than other wells. There is not sufficient information available at this time to make a judge- ment regarding the cause of high mineralization in this water. The well has been resampled and the results of the chemical analysis is pending. This problem will be investigated further. 'Bacteriological analyses were run on the nine (9) wells in the area. The results of these analyses are contained in Table A II. A review of this data indicates that water from these wells met the bacteriological standards for domestic use. There is no indication at this time that these wells are being contaminated by sewage disposal systems in this area. Additional soil information was obtained by drilling four (4) test holes. The results of these test borings are contained in Tables A III, A IV, A V and A VI. A review of this data is found in the following summaries: Test Hole #1 was located in the northeast corner of Division of Land 1323. From 2' to 40' , the soil is verycompact, having little or no absorption capacity. It is interrupted with one layer at 20' to 22.5' which may have some absorption capacity. However, we find this portion of the property unsuited for seepage pits. Test Hole #2 was located in the southwest corner of Division of Land 1323. From 2' to 20' , the soil is very compact, having little or no absorption capacity. From 20' to 30' , the soil is permeable. However, water was reached at 30' and in wet years the water table would-be higher. ' 4 r -2- Test Hole #3 was located at 10722 Morada. From 1.5' to 20' , the soil exhibits medium to poor infiltration characteristics. This indicates that a well engineered sewage disposal system may be expected to function properly. Test Hole #4 was located on Lot K of Tract 918. From 2' to 13' , the soil exhibits low permeability. From '13' to 30' , the soil is very compact, little or no absorption capacity. This area is unsuited for seepage pits. Environmental Health Engineering Specialist Orange County Health Department SUMARY OF FINDINGS: Durint the months of January and February, 1972, the Orange County Health Department conducted a survey of individual sewage system conditions in Orange Park Acres, an unincorporated area of Orange County. The' survey consisted of personal interviews with residents, field observations and a review of all available individual sewage disposal pumping records, soil maps, well logs and both chemical and bacteriological sampling of domestic well water and suspected sewage overflows. The findings of the survey are summarized as follows: 1. A review of geological information of the Orange Park Acres area indicates that sub-surface soils are variable in composition. As. a result, the percolative capacity of the sub-soils varies from one sub area to another, ranging from very poor in 65% of -the area, marginal in 30% and good in 5%. 2. In some' sections of the area, the variable surface topography adds to the problem -of poor soil infiltration characteristics, making these areas entirely unsuitable for the disposal of sewage effluent. 3. Reports from cor,riercial sewage pumpers, submitted to the Health Department, show that during the past three (3) years, fifty (50) systems have been pumped, with seven (7) of these requiring two or more pumpines within a period of one hundred twenty (120) days. 4. Interviews with 143 of the 300 homeowners in the area indicate a system failure rate of 16% over the most recent five year period. Also, 297. of the persons interviewed admitted to having their system purged out at least once since installation. • `2" r S. C0NCLUSION AND RFCO,2-1ENDATIO,;S: - 1 Orange Park 4cres area is generally not well suited for disposal of sewage by indivi- dual systems., This is evidenced by the recent history of disposal system failures and the very low soil infiltration rates exhibited in 65% of the area. Since much of the developed and developable land lies within this area, it is our opinion that sewage disposal system failures will continue, even if no further development occcirs, and will increase in frequency in proportion with future development. It is, therefore, recommended that the necessary steps be initiated to provide alter- nate means of. sewage disposal in the areas of poor infiltration characteristics, The most obvious alternative is, of course, to provide sanitary sewers. However, if expense is no object, elaborate, well-engineered individual. systems, utilizing advanced techniques such as soil replacement and evapo-transpiration, might }possibly function in.such areas. The chances of success are not too great. It is further recommended that if individual sewage disposal systems .are permitted in the future, they be approved only on the following conditions: 1. That, prior to issuance of a building permit, a log of soil borings and results of percolation test be submitted to the Department-of Building and Safety for evaluation on each lot for which an application is made, The • aforementioned percolation test should be performed and reported by a Registered Sanitarian, Registered Civil or Sanitary Engineer, Registered Geologist or Registered Engineering Geologist. , 2. That each proposed individual disposal system be designed by a Registered Civil or Sanitary Engineer or Engineering Geologist. 3. That the proposed building site not be less than one acre. 4. Tha-t an additional percolation system,* equal to 100% of the original design capacity, be constructed and connected at the time of original construction. S. That means be provided -for assured routine preventive maintenance of such systems, such as by the formation of a septic tank maintenance district. DISCUSSION: Scope of Investigation The Health Department cgnducted a survey of individual sewage disposal systems con- ditions in Oran-e Park Acres community, an unincorporated area in Orange County. Background of the Area The coip-munity of Orange Park Acres northern boundary begins at the western portion of the Sully-Miller sand and gravel operation and follows Santiago Creek to Villa Park Dam. The eastern boundary begins at Villa Park Dam and continues south through the Villa Park Dam Regional Park site to Chapman Avenue. The southern boundary proceeds west along Chapman Avenue to Newport Avenue, southeast along Newport Avenue, approximately 2000 feet to the southern range of hills, following the ridge line west- erly to a point where the hills intersect Chapman Avenue. The western boundary begins ' at Chapman Avenue and proceeds north following the ridge of the hills to Santiago Creek. In 1929, a deep water well was drilled near Santiago Creek in T4S, R9117, Section 27, and the Orange Park Acres Mutual Water Company was formed to serve the area. With v.-ater piped in, Orange Park. Acres was divided into parcels of land for orchards. Homes were established in some of the groves. : In the late .1940's and early 1950's, chicken ranchers began to es,taolish operations in the area that threatened the continued existence of the pastoral setting. As a result, .residents in the late 1950's, working in conjunction with established poultrymen, obtained one acre minimum lots (there are some one-half acre lots), single family residence zoning in most of the area to maintain a desirable balance between residen- tial and ranching activities in the community (Orel. No. 685, passed by the Board of Supervisors on March 9, 1954, designated the area E4-1 acre minimum lots). The number of residents doubled in the decade of the late 1960's. At the present time, there are approximately 300 families living in the area. Currently, twelve (12) new homes are under construction in the area. Many owners are subdividing their land and offering one, two, and three acre parcels for sale. Since most lots in the area are large (one acre) , the Orange County Department of Building and Safety does not require that percolation tests or soil borings be made in advance of construction of individual sewage disposal systems. The "rule of thumb" applied is a septic tank: plus one seepage pit per bedroom. In other words, it is assumed that a leaching area can be depended upon to dispose of sewage effluent regardless of the physical properties of the soil. Field Survey of Existlnp Individual Sewa,e Disposal Systems. • _ - A house to house survey was conducted and homeowners were interviewed to gather data on the history of scv-sge disposal system failures and make observations for evidence of any faulty systems. A system failure i-s defined as the inability of the disposal system to function properry without clogging and the resultant overflowing conditions. One hundred and forty-three (143) of the approximately three-'hundred .(300) homeowners In the area were 1ntervicwed. All of the homes were visited but over half of the residents were not at horse. ' The data below represents the results obtained from the interviews conducted during the survey and Health Department records: • .1. Forty- two (42) persons, or twenty-nine percent (29%) of those interviewed, _ admitted to at le, one pumping since their disposal system was installed. '—Elotaever, when pressed they were vague regarding the exact number of times the system had been pumped and the time lapse between pumpings. . 2. Twenty-three (23) persons, or sixteen percent (16%) of those interviewed, reported leaching system failures wi thin a fiveyear period. Information was not given during the interviews indicating the occurence of more than one failure. • 3. During the i.ntrcrvievs, the residents in' general were uncooperative when we attempted to elicit infbrmati.on about their sewage disposal. systems-. There i•ias a pervasive feeling among resideuts that the survey would *acceleratc incorporation into the City of Orange, resulting in zone changes which would destroy the present rural atmosphere. -Many of the persons interviewed were housei:,ives, who in most cases had little know- ledge about their sewage disposal systems. There was complete agreement, among all persons interviewed, that homeowners relied entirely upon cesspool pumpers to avoid sewage overflows when problems are -first noted. During the survey there were two homes where sewage was observed overflocaing from the leaching lines due to a system failure. The most frequent complaint made by the residents- of the 23 homes reporting system failures, was that the permeability of the soil is poor, which causes oversaturation of the leaching lines and seepage pits. In addition, they encountered problems with their disposal systems not fLnctioning prope'r.ly due to rain water infiltration during . the rainy season. Chemical and bacteriological analyses of the ei.ght '(8) water wells in the area were performed in an attempt to establish erhat effect, if any, .the sub-surface disposal of sewage has upon the quality of the underground water in the area. The results of the analyses are pending; therefore, no data is available at this time. Environmental Health Engineering Specialist ' Division of Environmental Health Orange County Health Department DATE: April 11, 1972 SUBJECT: Addendum to the Health Department Report of February 25, 1972, entitled "A Survey of Individual Sewage Disposal Systems - Orange Park Acres" Since the writing of the subject report, this Department has continued to investi- gate chemical and bacteriological quality of wells in the Orange Park Acres area. In addition, we have made further investigations of the soil conditions relative to the use of individual sewage disposal systems. In reviewing the addi tional data•presented in this addendum, we find that it further supports our original recommendation; that if individual sewage disposal systems are to be constructed in the area, they should only be allowed on a selective basis, after the findings of soil borings or percolation tests have shown the feasibility of such systems. Chemical analyses were run on samples collected from nine (9) wells. The results of these analyses appear in Table A I. A review of the data indicates that all nine (9) wells were high in total dissolved solids, not unlike shallow wells in adjacent areas. There is one notable exception and that is the Lazy "B" Golf .�r Course well which exhibited twice the number of TDS and high nitrates than other wells. There is not sufficient information available at this time to make a judge- ment regarding the cause of high mineralization in this water. The well has been resampled and the results of the chemical analysis is pending. This problem will be investigated further. Bacteriological analyses --were run on the nine (9) wells in the area. The results of these analyses are contained in Table A II. A review of this data indicates that water from these wells met the bacteriological standards for domestic use. There is no indication at this time that these wells are being contaminated by sewage disposal systems in this area. Additional soil information was obtained by drilling four (4) test holes. The results of these test borings are contained in Tables A III, A IV, A V and A VI. A review of this data is found in the following summaries: Test Hole #1 was located in the northeast corner of Division of Land 1323. From 2' to 40' , the soil is verycompact, having little or no absorption capacity. It is interrupted with one layer at 20' to 22.5' which may have some absorption capacity. However, we find this portion of the property unsuited for seepage pits. Test Hole #2 was located in the southwest corner of Division of Land 1323. From 2' to 20' , the soil is very compact, having little or no absorption capacity. From 20' to 30' , the soil is permeable. However, water was reached at 30' and in wet years the water table would- be higher. i 1 1 -2 Test Hole #3 was located at 10722 Morada. From 1.5' to 20' , the soil exhibits medium to poor infiltration characteristics. This indicates thaL a well engineered sewage disposal system may be expected to function properly. Test Hole #4 was located on Lot K of Tract 918. From 2' to 13' , the soil %we exhibits low permeability. From '13' to 30' , the soil is very compact, little or no absorption capacity. This area is unsuited for seepage pits. Said proposed portion of the District as set forth on said map shall hereupon constitute and be known as "Improvement District No. 7-1 of County Sanitation District No . 7 of Orange County, " and said improvement district is hereby declared to be formed. Section 7 . The determinations made in this resolution relative to said improvement district shall' be final and conclusive . Section 8. The territory proposed to be annexed is inhabited , as such term is defined in Government Code Section 56045 . Section 9 . Written protests to the proposed annexation filed and not withdrawn represent less than 50% of the assessed value of land therein and less than 50% of the voting power of voters entitled to vote as a result of residing in or owning property within such ..� territory and that therefore the Board of Directors has acquired jurisdiction to order the annexation of said territory to the Dis- trict. -4- Section 10. Having given due consideration to the Commission' s resolution making determinations and to all other matters relevant and material to said annexation, this Board hereby orders the territory described in said Exhibit "A" and designated Annexation No. 51 to County Sanitation District No . 7 annexed to said County Sanitation District No. 7 subject to the confirmation of the voters within said territory. Section 11 . Said annexation is subject to the terms and condi- tions as set forth in Exhibit "B" attached hereto. Section 12 . An election is hereby called and ordered to be held and conducted only within the territory proposed to be annexed on Tuesday, the 8th day of March, 1977 , for the purpose of submitting to the voters of said territory the following proposition, to wit : Shall the order adopted on December 16 , 1976 , by the Board of Directors of County Sanitation District No . 7 of Orange County, ordering the annexation to said dis- trict of the territory described in said order and designated therein as Annexation No. 51 (No . 76-1) to County Sanitation District No. 7 be confirmed subject to the terms and conditions specified in said order? Such terms and conditions including the concurrent formation of a new improvement district and approval of general obligation bonds by the voters therein, all as more particularly set forth in said order. Section 13. A special bond election is hereby called and ordered to be held in said proposed Improvement District No . 76-1 on Tuesday, the 8th day of March, 1977 , for the purpose of sub- mitting to the qualified voters of said Improvement District the proposition of incurring a bonded indebtedness by the issuance of bonds of the District for said Improvement District to obtain funds with which to acquire the rights and property and do the work set forth in the heretofor-referred engineering report. -5- �.. Section 14. The amount of debt to be incurred is $ including all costs and estimated costs incidental to or connected with the acquisition, construction, improving, or financing of the project and all engineering, inspection, legal and fiscal agent' s fees , costs of the bond election and of the issuance of said bonds , bond reserve funds and working capital, and bond interest estimated to accrue during the construction period and for a period of not to exceed 12 months after completion of construction. Section 15 . The proceedings for the purpose of the bond elec- tion shall be limited and shall apply only to the improvement dis- trict benefited by the acquisitions and improvements and as herein described, and taxes for the payment of said bonds , if authorized, and the interest thereon shall be derived exclusively from an annual tax upon the real property in the improvement district. Section 16. The number of years not to exceed which the whole of the bonds are to run is forty (40) years . Section 17 . The bonds shall bear interest at a rate not to exceed eight percent (8%) per annum, payable semiannually after the first year . Section 18 . The bond proposition to be submitted to the voters of Improvement District No. 7-1 is as follows : Shall County Sanitation District No . 7 of Orange County incur a bonded indebtedness for Improvement District No. 7-1 of County Sanitation District No. 7 (Orange Park Acres) in the amount of Dollars ($ ) for the objects and purposes of the acquisition of rights of service and use in existing treatment and outfall facilities of District No. 7 and for the purpose of the acquisition or construction of major trunk lines , facilities , and appurtenances to `� serve said improvement district , and the acquisition of easements , rights of way, and other property or -6- structures necessary or convenient therefor , together with all costs and estimated costs incidental to or connected with the acquisition, construction, improving , or financing of the project? Section 19 . Said special elections shall be held and conducted, the votes thereof canvassed, the returns thereof made , and the results thereof ascertained and determined as herein provided; and in all other particulars not prescribed by this Resolution, the elections shall be held and conducted pursuant to law for the conduct of elections within the Sanitation District . Section 20. The Board of Supervisors and the County Superin- tendent of Schools of the County of Orange , State of California, are hereby requested, pursuant to Chapter 4, Part 2 of Division 12 (comprising Sections 23300 to 23314, inclusive) of the Elections Code of the State of California, to consent to and order the con- solidation of the Special District Elections proposed to be held March 8, 1977 , with the School District Election to be held within the same territory, or in territory that is in part the same , as the territory comprising the proposed Improvement District No. 7-1 of County Sanitation District No. 7 of Orange County, on the same date . Section 21. This Board consents to and orders the consolida- tion of said elections . Section 22 . (a) The special elections provided herein are hereby consolidated with the School District Election which will be held within the territory proposed for annexation and Improvement District No. 7-1 on said date. The elections shall be held in the ..� manner provided for the School District Election with which they are consolidated, and, within the territory affected thereby , for -7- said purpose the election precincts , polling places , and officers of election shall be the same. (b) All persons who reside within said territory to be annexed and said Improvement District No. 7-1 and who are registered voters qualified pursuant to law to vote at an election held on said date shall be qualified to vote upon the propositions herein submitted at the special elections . (c) The elections hereby consolidated shall be held in all respects as if there were only one election and only one form of ballot shall be used. Ballots for said special elec- tions shall be provided of the form and number provided by law. On said ballots , in addition to any other printed matter which may be required by law, two voting squares shall be set off to the right of each of the propositions submitted at said election, in the manner provided by law, one having the word "YES" printed before it , and the other having the word "NO" printed before it . (d) Each voter to vote for either of said proposi- tions hereby submitted shall stamp or write a cross (+) in the blank space opposite the word "YES" on the ballot to the right of said proposition, and to vote against either of said propositions shall stamp or write a cross (+) in the blank space opposite the word "NO" on the ballot to the right of said proposition. Section 23 . The Board of Supervisors of the County of Orange is hereby authorized, pursuant to Section 23306 of the Elections Code , to canvass the returns of the Special District Elections . The canvass may be made by the County Clerk when the Board of ..� Supervisors so orders , pursuant to Section 18401 or Section 18462 . -8- .� Section 24. The polls shall be opened at 7 : 00 a.m, of the day of election and shall be kept open until 8 : 00 p .m. of the same day, when the polls shall be closed, except as to voters in line as provided in Section 14436 of the Elections Code . Section 25 . If, at the special elections provided herein, it shall appear that a majority of the votes cast on the proposi- tion set forth in Section 12 hereof were in favor of the proposi- tion and in favor of the annexation, then said proposition shall be deemed to be accepted and approved, subject , however, to the terms and conditions herein set forth in Exhibit "B. " If, in addition, it shall appear that two-thirds of the votes cast on the proposition set forth in Section 18 hereof are in favor of incurring the bonded indebtedness as proposed, the annexation shall be deemed confirmed, and bonds of the County Sanitation District No. 7 of Orange County, issued in the name of said District and designated "Bonds of County Sanitation District No. 7 of Orange County for Improvement District No. 7-1" for the amount stated in this resolu- tion, shall be issued and sold in the same form and manner as bonds of the entire Sanitation District. In the event of approval of both propositions , the Certificate of Completion shall be filed with the Secretary of State , and such annexation shall thereafter be effective . Section 26 . This Resolution shall be published once a week for three successive weeks by the Secretary of the Board in the , a newspaper of general circulation within ..W County Sanitation District No. 7 of Orange County and Improvement District No. 7-1. The Secretary of the Board shall further cause -9- a certified copy of this resolution to be transmitted by registered mail within five (5) days of its adoption to the executive officer of the Local Agency Formation Commission, pursuant to Section 56119 of the Government Code . At their request, I have circulated a one-page letter/ petition seeking to measure the degree of opposition to the subject Annexation and Bond Authorization. A copy of that letter/petition is attached for your information. The letter was mailed late this past week with returns coming in contin- uously since that time. On the weekend just past, the circular entitled "Orange Park Acres Sewers" was distributed in the neighborhood. Subsequently, the letter of December 14, 1976 on the letter- head of Orange Park Acres Association, Inc. was distributed. Copies of both are attached. Both documents invite attendance at the Public Meeting of December 16, 1976 , prior to making a decision on signing my petition. The letter of December 14 , 1976 specifically states: "Don' t sign anything until you know the complete costs , and realize that if you don' t need sewers you don' t have to hook up to them. " It is submitted, that the circular and letter have mislead the residents into not signing my petition until after the December 16 , 1976 hearing. The only fair position to take is to continue the hearing until all those who have Board of Directors December 16, 1976 Orange County Sanitation Page Two District #7 not signed the petition because of the urging of the circulars , can decide, sign and return the petition. In that way, the Board will have a measure of the level of opposition without the expense of calling an election. Further, the completeness of the contents of the Notice sent by the District is raised by those documents when they urge attendance at the meeting to '�jet all the facts and answers about sewers" . If the Notice is deficient, then that alone should be reason to continue the hearing until a corrected Notice is sent. The Chair then recognized the Districts' Special Bond Counsel who reviewed the proposal; and vemimmag the findings of the Orange County Health Department dated February 12, 1972, and December 15, 1976, concerning sewerage problems in the Orange Park Acres area. The Districts' Secretary then summarized the actions taken to date by the Board relative to the proposed concurrent Annexation and bond Authorization. The Chairman then called for oral comments following which a lengthy discussion and question and answer period took place, including an explanation of what would constitute a majority protest for purposes of determining whether or not the proceedings would be terminated or an election called. Thomas J. Skane, Jr. , Attorney at Law, also addressed the Board and stated that he had been engaged by several property owners in the proposed improve- ment district and was in the process of circulating petitions in protest of the proposal. He requested that Directors continue the hearing to allow 12/16/76 sufficient time for the petitions to be returned. Upon questioning Mr. Skane stated that he was not at liberty to disclose the identity of the Protestants. Upon advice of the General Counsel the chairman then called for any and all written protests to be filed with the Secretary. Peaker, 10462 Marada Dr. , Orange. - Letter dated December 8, 1976, from Milton Garrett, 20212 Amapola, Orange The Secretary also read a letter dated December 10, 1976, signed by Fred A. Harper, General Manager of the District, in response to the communication from Milton Garrett. The Chairman then called for all those wishing to orally protest to come forward and register their name and address, following which he declared the hearing closed at 10:15=p.m. 6 The General Counsel then reported that all written and oatenotests had Z. .. been tabulated, including 89 written petitionspsigned by 100 property owners and/or registered voters, 32 oral protests by registered voters, and 25 oral protests by property owners. He stated that although there appeared to be 12/16/76 duplications, none had been eliminated for purposes of calculating the number of protestants Mr. Woodruff then declared that, based upon the unofficial results of the tabulation, in his opinion both the number of protests of registered voters, and the assessed value of the land of protesting property owners was, in fact, significantly less than 50% in each instance.
