"Neither does the City of Orange even oppose the construction of sewers in the subject area to serve the residents thereof to be paid for solely by the residents of Orange Park Acres provided the following concerns of the City are satisfied: "l. The Orange Park Acres Association does not request connection to any City-owned sewers in the subject area unless the property owner or owners requesting connection effect annexation to the City of Orange. 2. Subject to proper legal acquisition of necessary easements for such purposes, neither the property owners nor the Orange Park Acres Association will object to any future placement of City sewer lines through the subject area in order for the City of Orange to serve areas north, east, west and south of Orange Park Acres. 3. That property owners and the Orange Park Acres Association express their intention to provide 1. sewer services only to the subject area surrounded by the City of Orange city limits on the west, north, and east and Chapman Avenue on the south, comprising approximately 556 acres and more particularly set forth on a map to be placed on file with the Sanitation District with a copy of said map to be supplied to the City of Orange. Because the intention of the Association is to serve the area known as Orange Park Acres com- prising approximately 556 acres, the Association and residents therein should commit themselves, not only to refrain from attempting to annex new territory to this sewer assessment district, but should commit themselves to assist the City of Orange in promoting-·:annexation ·to the City of the area south of Chapman -Avenue . as well as· all other· areas within the sphere of influence. 4. Neither the Board of Supervisors, the Sanitation District, the Local Agency Formation Commission nor any other public_:_entity shall utilize the conduct of the Orange Park Acres sewer study nor the proceedings for the formation of any assess- ment district in the Orange Park Acres area com- prising approximately 556 acres as a reason to delay or hinder future annexations by the~city of 2. Orange of territory within the approved area sphere of influence of that City. "In summary, gentlemen, the City of Orange does not object to persons forming districts to serve their own needs for sewers. However, such legitimate desire of the residents of the Orange Park Acres area should never be used as an excuse to hinder or delay the annexation and development of land to the north, east, west and south of said area which is within the sphere of influence of the City of Orange as approved by the Local Agency Formation Commission. "Of course, we of the City of Orange are certain that the residents of Orange Park Acres have no such desire to impede the annexation of territory to the City of Orange and the future development of such territory ip accordance with the Webb Plan which plan these very same Orange Park Acres residents participated in creating. Pursuant to the Board's instructions the .Staff has prepared a brief report with a map indicating the area proposed for annexation by the Orange Park Acres Association. The Santiago Creek area, better known as Orange Park Acres, is included in the Mas~er Plan of Trunk Sewer Faci lities for County Sanitation District No. 7 because it is likely to be annexed into the district in the future. This 2,682 acre area drains naturally in a northerly direction from the north shoreline of the upper Pe t e rs Canyon Reservoir into Sa.nitago Creek. Included in the Santiago Creek a r ea are the Viila Park Dam and Irvine Par·k recreation areas, which are expected to contribute sewage flow through small force main systems . The Peters Canyon are a , which was originally inc luded in the study area, was eliminated from further analysis in 1969 at the instruction o f the Di s trict Board of Directors. This action was a result of testimony by Irvine Company representatives before our Board that .the Irvine Ranch Water District (IRWD) plans to provide sewage service to the Peters Canyon drainage basin since the l an d is within the IRWD boundaries. The a r ea out lined in yellow on the enclosed map is proposed for annexation by the Orange Park Acres Association. The map also indicate s segments of the District trunk sewe r system still to be constructed and/or purchased by the District. Th·e District is currently cons tructing Reaches 10, 11 a nd 1 2 of the Master Pla n Sewer and our Master Plan construction schedul e anticipates construction of Reaches 13, 14, 15 and 16 beginning sometime this fiscal year. The schedule anticipates construction of Reach 18 in 1977; however, the greater .portion of th{s area i s not now within Sanitation District No . 7 and may not be constructed until econom ically feasible. The City of Orange has cons t ructed a s ewer in Santiago Creek Road which may be purchase d by the Di strict in the future. TI1is sewe r is designated as Reach 17 on the attached map. Currently, this sewer serves areas within District No. 7 which are within the City of Or a nge. Presently, a segment of Reach 18 extending southerly from the intersection of Meads Avenue and Rand a ll Street to the Mead annexation south erly of Amapol a is being constructed by the City of Orange to serve a residential development on the property known as the Mead Annexation. (District No. 7 Annexation No. 27) The District's General Counsel has advised that the enclosed pencilled Orange Park Acres Counsel's schedule, which was handed out at last nights meeting, appe ars to be quite optimistic. However, Mr. Woodruff has stated that it correctly sets forth the step-by-step procedures. Lewis, Chief Engineer P.O.Box8127 · Founta.in Va I ley, CA 92708 · Orange Park Association, Inc. -Engineering Report and Preliminary Environmental Review Request c:onsultlnq enq1ncers / archlt~cts 714 I 752 O!~dJ5 August 1, 1975 In accordance with Mr. Lewis' request, we submit our proposal for preparing an engineer's report in conformanc~ with .Section 4748 of the Hea Ith and Safety Code (Sanitation Dis- trict Act) and a preliminary environmental review in conformance with the California Environmental Quality Act. The area proposed for sewer improvements, as shown on the sketch furnished by the Orange Park Association, is qpproximately 556 acres. The northwe~tei'ly; northerly, end easterly boundaries coincide with the city limits of Orange, the southerly boundary is Chapman Avenue, and the southwesterly boundary for the most part is the westerly property line of subdivided lots that front on. Orange Park Boulevard. The engineer's report will set forth the following information in accordance with Sec- tion 4748: A. A general description of existing district facilities for sewage collection, treat- ment, and disposa I. B. A genera I description of the work proposed to be done to carry out the objectives of the district. C. A general plan and general specifications of the work. D. A genera I description of the property proposed to be acquired or damaged in • carrying out the work. E. A map showing the boundaries of the district and in genera I the location of the work proposed to be done, property taken or damaged, and any other information useful.to an understanding of the proposed work. · F. An estimate of the cost of the proposed work. . ' County Sanitation District No. 7 of Orange Couhty -2- We propose to prepare the engineer's report for a fee of $4, 180. August 1, 1975 We wi II prepare an environmental study of the proposed project. This will serve as an initial study, which is required of the district by the California Environmental Quality Act to assess the probable impacts of implementing the proposed project and to make a determination of the need to prepare an environmental impact report (EIR) or a negative declaration. Other responsible and jurisdictional agencies, such as the Local Agency Formation Commission of Orange County, wil I be consulted as a part of this in itia I study. We propose a fee of $965 for the in.itia I sf'udy. If the in itia I study indicates that an EIR is necessary, such a report wi 11 be prepared for the district in accordance with the California Enviro.nmental Quality Act. The report will include a discussion of the local and regional environment, alternatives to the pro- posed project, an evaluation of environmenta I impacts, and other content requirements of the Act. Because a comprehensive EIR has a !ready been prepared by the district for the construction of the Tustin-Orange Sewer, Reaches 10 through 18, much of the data is· readily available. Our fee for the EIR would be $2, 100. Included in the fees for the engineer's report, the initial study: and the EIR are repro- ducible plates of the t-ext, chaits, and maps for the district 1s use in printing the desired number of copies. BOX 81 2 7 108.C.C ELLIS AVENUE FOUNTAIN VALLEY, CALIFORNIA 92708 (71.C) 540-2910 (71.C) 962-2.C 11 The General Counsel has included a report relative to the proposal of the Orange Park Acres Association for concurrent annexation and bond authorization for the Orange Park Acres area. The following is a brief staff report of two possible alternate methods which could provide annexation to the District and eventual installation of local collection sewers: ALTERNATE A Hold an election in the affected area to annex to District ·No. 7 with the annexation fees collected from the property owners over a five year period through a special tax assessment on the real property and improvements. Once the annexation proceedings were complete (approxi- mately six months to one year) an assessment district or districts could be formed to install the local collection sewers with District No. 7 providing the Master Plan Trunk known as Reach 18. The current annexation fee to District No. 7 is approximately $995 per acre. While the assessment district costs are somewhat higher because of the manner in which the financing is handled, the success or failure of the proceedings is based on a majority protest by property owners while the proposal of the Orange Park Acres Association will require a 2/3 voter majority for approval .of bonds for the construction of the local system and payment of the annexation fees . . Al TERNATE B Since this area is ln the zone of influence of the City of Orange, an election could be held for the residents in the area for concurrent annexation to District No. 7 and the City of Orange. If this alternative were successful, the District No. 7 annexation fees would be collected by a special tax assessment as proposed In Alternate A. It would then be the responsibility of the City of Orange to work out the local sewering arrangements with the affected residents and property owners. FAH:hje . •. ORANGE PARK ASSOCIATION, INC. P.O. BOX 2365 ORANGE, CALIFORNIA 92669 The Honorable Board of Directors Sanitation District No. 7 of Orange County • Re: Proposal for Concurrent Annexation and Bond Authorization -Orange Park Acres Pursuant to the provisions of the District Reorganization Act of 1965 and the County Sanitation District Act, it is hereby requested that the Board of Directors of Sanitation District No. 7 of Orange County consent to and implement the following proposal: 1. Petitioners are the owners of more than 5% of the assessed value of land within the boundaries of Orange Park Acres, shown generally on the attached map. In order to assure that sanitation facilities may be provided most expeditiously and with a minimum of cost, it is proposed that such properties be annexed to District No~ 7 with the concurrent submission to the voters of the area of the proposition of issuance of bonds of an Improvement District. Such bonds would be general obligations of the area and would be paid by taxes or revenues, whichever is more appropriate, without contribution from the remainder of Sanitation District No. 7. 2. Because of th~ requirements of the Sanitation District Act ( 4748 of the Health and Safety Code), it is requested that you authorize the District Engineer to prepare a report concerning the proposed work as the basis for the hearing, which is a precondition of any construction by the District. Since such a report should be prepared prior to the actual formal hearings on annexation, the under- signed propose to guarantee the costs thereof, with the understanding that if bonds are approved, the proceeds of the bonds will reimburse the costs. 3. It is further requested that a preliminary determination be made by the District of a maximum maintenance and operation tax which would be submitted to the voters as a part of any election which may be called on the questions of annexation and authorization of bonds. 4. It is also further requested, subject to the same guarantee mentioned in Paragraph 2 hereof, that a preliminary environmental review, pursuant to the California Environmental Quality Act, be undertaken. It is our understanding that the Local Agency Formation Commission of Orange County would be the Lead Agency in connection with.the question of annexation. However, in order to assure that the entire matter be facilitated, it is suggested that a supple- · mental environmental review be made by the District, encompassing the specific construction which is proposed to be installed within the area. .. !". t . ;, ORANGE PARK ASSOCIATION, INC. Recognizing that the proposal that is here made is complex, we would request the appointment of special counsel by the District for the purpose· of preparing the necessary proceedings and assuring their ultimate legality. \For this pu~pose, we would recommend the appointment of ·such firm as may be determined appropriate by the District, and we hereby agree to deposit with you such sum of money as may be necessary to assure payment of appropriate legal fees in the event the project fails to proceed. · · We have -had preliminary discussions, at the recommendation of your staff, with the law firm of Wilson, Jones, Morton & Lynch, San Mateo, California. That firm has agreed that. they would undertake the necessary analysis and preparation of proceedings, together with the issuance of a bond opinion, at a fee to be negotiated with the District, payable from the proceeds of the bonds. Their fee, which would be payable in the event of the abandonment of proceedings, or the failure of the bonds to pass, would be based on an hourly rate of $75.00, and in an amount of not to exceed $2,500.00. Peggy McElligott pointed out area on a large hand-drawn map and explained backgrotmd of request and step by step procedure required for this p!JI\osal. MUCH DISCUSSION ( {!µ-~ _/ Burton then said that he would make a motion but Chairman Garthe asked that the General Counsel state what the proper motion would be at this time. Woodruff stated that if recommendation is to go forward and approve, initial motion ~~ould be somewhat broad and yet authorize specific things: Approve the initiation of necessary proceedings to annex the described area to County Sanitation District No. 7 subject to concurrent approval of improvement financing; and, /! Authorize the District's Engineer to prepare the necessary report for consideration by County Sanitation District No. 7 and the Local Agency Formation Commission, including an EIR as required by the California Environmental Quality Act; and, Authorize retention of special legal counsel for purpose of approving financing and procedures. All of this is conditioned upon the Orange Park Association, Inc. depositing ,. the sum of $5, 000. 00 cash as payment for costs of these proceedings and as a guarantee of payment of all other attendant costs related to these proceedings, i.e., $10,000.00 after LAFC approval and before any election. This will also be in accordance with their proposed procedure. If recommendation is to disapprove proceeding, Mr . Woodruff said that motion should basically be that the staff not be authorized to continue the proceedings and that no application be made to the Local Agency Formation Commission for annexation. Burton stated that his motion was the first statements the General Cotmsel made to proceed with annexation upon acquisition of up-front money and all the other things . Mr. Woodruff asked if the engineering report included the necessary EIR to go to LAFC, and was answered, yes, it should include that. Motion should also include Economic Statement--not just the cost of connection to sewer but also the costs of ~all overlying taxes to City of Orange rather than simple annexation to District 7. ) Was added that EIS will also include financial impact to surrounding areas as the people should have understanding of impact on them. Woodruff mentioned that the staff report estimated costs that might be incurred in proceeding with this. Some of the costs are reasonably accurate and others are ( not so accurate. Total project is about $15,000. Request by proponent--and General \ Manager & General Counsel concurred--was that the sum of $5,000. be deposited up < front with guarantee filed to pay any additional costs that are incurred with additional $10,000 and that those costs be paid in advance if LAFC approves and election is authorized. Burton then state d that is what my motion i s. Motion SECONDED by Clark . Perez then asked if they were to presume that Alternates A & B presented at August 13th meeting were not being considered. Burton answered, yes, Alternates A & B are not contemplated in the motion.
