The following is a brief explanation of the more
important non-routine items which appear on the enclosed
a genda and which are. not otherwise self-explanatory . Warrant
li sts are not attached to the agenda since they are made up
imm ediately preceding the meeting but will appear in the com -
plete agenda available at the meeting.
Joint Boards
No. 9 -Consent Calendar .
The following items fall into this category in
accordance with the definit ion established by the Boards :
No . 9 -a -Purchase of Hydraulic Crane .
Bids have b een received for a budgeted hydraulic
crane, Specification No . E-0 73 . Five bids were receiv e d rangi ng
from $14 ,376 .82 to $15 ,810.96 . The budgeted amo unt is $13 ,14 8 .50 ..
It i s the staff's recommendation that the Districts award purchase
of the crane to Bomar Industries . While the low bid exceeds the
budgeted amount by approx imate l y 10%, the Distric ts ' equipment
budg et for the year wi ll not be exceeded .
No . 9 -b -Substitut ion of Subcontractor , Job No . Pl -1 6.
Donovan Construction Company, Contr a ctor for Job No .
Pl-16 (4 6 MGD Activated Sludge Treatment ·at Rec lamation Plant
No . 1), has r equested the substitution of Jess B . Worthington,
Inc., for Walker Coating , Inc ., to provide necessary protective
coating and painting for this contract. Walker Coating has failed
to submit the necessary bonds, i nsurance , and workmens compensation
required for the pr ime contractor and was notified by the Districts
in accordanc e with the applicable provisions of the Government Code .
The s ub stitution of th is subcontractor will allow the contractor to
proceed on schedule .
No. 9 -d -Authorizine Issuance of Permit to the Orange
County Flood Control Distr ict for Widening of the San ta Ana Ri ve r.
The Flood Control District is preparing contract docum ~nts
for the widening of the Santa Ana River Channel from approximately
500 feet southerly of Garfield to 600 feet northerly of the San
Diego Freeway . This widening will require the resloping of the River
levees and encroachment into the Plant No . 1 site . Our staff has
worked with the Flood Control District staff to insure that the
Sanitation Districts' landscaping and manhole structures will be pro -
tected during construction . We recommend that the Board approve the
i ssuance of a permit to the Flood Control District in a form acceptable
to the General Counsel.
District No . 2
No. 9 -g -Substitution of Subcontractor for Walker
Coating , I nc ., re : Contract No. 2 -15 -Yorba Linda Pump Station .
Walker Coating, Inc ., the subcontractor on this project
to instal l the necessary plastic linings, has requested to be with-
d r awn as a subcontractor . The prime contractor , J . Putnam Henck,
wi l l perform this work. Walker Coating has r ecently been face d with
l egal difficulties and they wish to curtail their activities until
s u ch time as these matters have b ee n r esolved .
No. 9 -h & i -Award of Contract No. 2 -16 -1.
Eleven construction bids were received on March 20th
for Contract No . 2 -16-1 (Kra emer Bou l evard Int e rceptor Sewer from
Palm Drive to Imperial Highway). The bids range from $570,586 .80
to $777,231 .10. Bid items 9, 10 , a nd 11 wer e included in the bid
proposals for the convenience of the City of Placentia . We have
no~ been advised that they accep t the low bidder 's prices for bid
items 9 and 10, but recomme nd reje c t i o n of the contractor's bid
item No . 11. The staff concurs. 'The City of Placentia will be
responsible for the costs of bid items 9 and 10, which are approxi -
mat e ly $9,100 of the total contract. It is the staff's r ecommend at ion
t hat a construction c o nt ract b e awarded to Geor g e Mi ller Construction
in t h e amount of $563 ,936 .80 , for bid items 1 through 10 .
No . 9 -j -Change Order No. 1 to Contract No . 2 -17-1,
Carbon Canyon -Pa l m Drive Interceptor Sewer , Reach 1.
T he contractor has requested permission to jack a casing
under Alta Vista Street in lieu o f the open cut which is required
by the contract . If approved , this work will b e done at no addi -
tional cost to the District. It is the contractor 's opinion that
this will reduce the traffic disruption on Alta Vista . The staff
recomme nds approval of this change ord e r at no additional cost to
the District .

No . 9 -1 -Annexation No. 11 (7 .05 acres).
I n October , 1974, the Board authorized initiation of
proceedings for the annexation of Tract No . 8713, which encompasses
7 acres in the Santa Ana Canyon area l ocated on th e nort h east side
of Mohler, east of Del Giorio, in east Anaheim. This development·
is within the City of Anaheim and the densities were anticipated
in the District 's Master Plan (1 .5 dwelling units per acre). The
zoning is RH 22 ,000 . We have rec e ived approval from the Local Agen cy
Formation Commission. The annexation fees and other costs have been
paid by the proponents . It is the staff 's recommendation that the
resoluticn appearing in the agenda authorizing Annexation No . 11 be
approved. ·
District No . 3
No . 9 -0 -Change Order No . 2 to Contract No . 3 -19,
I mperial Relief Interceptor , Reaches 22 and 23.
The contractor was requi red by the plans and
specifications to jack a 42" steel casing under the Railroad
right of way at two separate locations. He has been permitted by ·
the Railway Company to open cut the railroad right of way during
restr icted hours and place the sewer pipe in a concrete encasement .
This was done at a substantial savings to the contractor, a nd t h e
District·has mutually agr eed with the contractor that the contract
amount be r educed by the amount of $7 ,35 4.23 .
Also included in this chang e order is wo rk performed by
the contractor to remove a n unknown subsurface concrete structure .
This work was done on a force account basis in accordance with the
specifications for $1,981 .30 . The staff recommends approval of
this change order , including an extension of 3 calendar days for
the extra work.
No. 9-p -Chang e Order No . 1 to Contract No . 3-20-1,
(Knott Interceptor, Reache s 5 and 6).
The contractor has requested permission to install an
additional 200 linear feet of tunnel and to realign the Knott
Interc eptor under the Garde n Grove Freeway overpass. Although
this request will cost the co ntrac tor more , the over-all savings
for traffic control and delays will o ffset his increased costs .
It is recommended that this change order be approved at no addi -
tional cost to the District . The requested changes have been
approved in the Department of Transpor tat ion Encroachment Permit
issued to the District .

District No. 5
No. 9-r -Substitution of Legal Counsel.
Th e General Counsel has recommended substitution of
·counsel in connection with the suit Garnier vs. County Sanitation
District No. 5, State of California, et al . Chairman Mcinnis has
reviewed Mr. Nisson's request and suggests that the firm of·
Portigal and Hammertort be substituted .
No. 9-s -Authorizing Preparation of Plans and Specifi-
cations for Wet Well Repair and Remodeling of 14th Street and "A"
Street Pump Stations.
A recent survey made by the staff indicates that there
is consid erable concrete corrosion and deterioration in these wet
wells. The Districts have recently completed repair and remodeling
of manholes on the sewer system in the Coast Highway and feel that
this repair procedure will be applicable and economical for the
repairs of these badly deteriorated wet wel ls. I t is recommended
that the staff be authorized to prepare the plans and prese nt them
to the Board for approval in order that this work can be done as
soon as possible . This work has been budgeted in a total amount
of $25,000.
District No . 7
No. 9-t -Purchase of Property from State of California .
Recently, the Department of Transportation declared
certain parcels adjacent to the San Diego Freeway as excess
property. Since the Districts have adjacent easements , the State
offered these rights of way to the District for $10. The acquis i-
tion of this property will provide better access to our manholes
for sewer maintenance.
No. 9-v -Condemnation Action re: Right of Way for
Contract No. 7-6-7.
On March 12th, the Board approved plans and specifica-
tions for the Tustin-Orange Trunk Sewer which will be constructed
in Southern Pacific Rai lway right of way from Irvine and Newport
to Fairhaven Aven ue. The staff has had discussions with Railway
Company personnel and it appears that no action will be taken by
them until the Board directs the condemnation of the rights of
way. Currently, Goode and Goode , appraisers for the District,
are making a determination as to the value of the property.

(ACTS)
No. 9-x -Authorizing Additional Work on the JPL
Process .
On March 12, the other Districts approved the action
appearing on the agenda . District No. 11 was unable to ·act for
lack of a quorum .

No. 11 -Resolut ion Declaring Emergency Situation re:
JPL Project .
The purpose of this res o luti on is to expedite the con-
struction of the 1 mgd JPL (ACTS) pilot unit in accordance with
the time schedule presented to the Boards on March 26th . If the
resolution is approved by the Boards , no monies will be obligated
without prior approval by construction grant personnel of the
State Water Resources Control Board and/or EPA.
No. 1 2 -Propos ed Connection and Use Ordinance .
Included with the agenda material is a copy of the
proposed connection and use ordinance for all active Directors .
We have incorporated the public comments received to date, as
well as the recommended changes re sulting from informal h earings .
We are recommending that the Board adopt the ordinance following
formal hearings not later than Thursday , May 29th, so that it can
become effective July 1st.
District No. 5
No. 23 -208 Planning Agency.
The State Water Resouices Control Board April 3rd
hearing panel was favorably impressed with the formation of the
Newport-Irvine Waste Management Planning Agency (NIWA), and it
appears that this Joint Powers agency will be designated as t he
planning agency for the San Diego Creek and Upper Newport Bay
Area. To date, the Joint Powers members are the Irvine Ranch
Water District, Orange County Water District and District No. 5.
The action appearing on the agenda appoints Chairman Mcinnis as
the Director to serve on the NIWA Board of Directors with Director
Ro gers serving as the Chairman's alternate on said Board.

District No. 7
No. 41 -Possible Amendments to the Districts'
Connection Charge Agreements.
The staff will make a verbal report to the Board ,
suggesting possible amendments to existing agreements with the
Cities of Orange, Santa Ana, and Tustin, and the Costa Mesa
Sanitary District, for the collection of the District's sewer
connection charges . Currently, the cities retain 75% of the
charges collected in a special District No. 7 sewer fund for
the purpose of constructing Master Plan sewers within their
boundaries. As the District's Master Plan nears completion,
some of these accumulated funds are needed for construction in
other areas of the District. The staff wishes to recommend that
this fund retention procedure be amended and permit the cities
to retain 5% of the funds collected for the administration of
the District's connection ordinance, with the remaining 95% being
forwarded to the District for construction purposes.

Section 1. That the First Amendment dated April 10, 1975, to
the agreement dated February 20, 1975, by and between County Sanitation
District No. 1 of Orange County, as agent for itself and County
Sanitation Districts Nos. 2, 3, 5, 6, 7 and 11 of Orange County, for
Sale of Digested Sewage Solids, Specification No. S-012, is hereby
approved and accepted; and,
Section 2. That the Chairman and Secretary of County Sanitation
District No. 1 are hereby authorized and directed to execute said
amendment in form approved by the General Counsel, on behalf of itself
and County Sanitation Districts Nos. 2, 3, 5, 6, 7 and 11 of Orange
County.

Dear Mr. Nissan:
This is to confirm our telephone conversation
of this ·date in which it was agreed that Musick, Peeler
& Garrett will serve as special labor relations counsel
to the Sanitation Districts.
It was further agreed that the retention of
this firm is undertaken in your capacity as general
counsel for the Sanitation Districts, and that the
fees and services rendered by this firm will be based
upon hourly guidelines of $50 to $70, with the time ·of
the undersigned being billed at a rate of $60 per hour.
It is our understanding that the matter of immediate
concern is the defense of a petition for Writ of Mandate,
in which a labor union is challenging the Districts'
recognition of the Orange County Employees Association as
representative of District employees. We understand that
the hearing in this matter will tentatively be set for
Tuesday, March 18, 1975.

Blower building basement floor nearly complete. This
building can be considered 30 percent complete.
The waste sludge thickener center gallery walls have been
placed. Work on the thickener tanks to begin this month.

Approximately 800' of 36" VCP has been installed and backfilled.
Contractor has requested to jack casing under Alta Vista at no cost
to the District. This was suggested by the Contractor in order to
refrain from any damage to an old bridge located nearby.
The Contractor estimates completing jacking operations by the
middle of April.

Carbon Canyon Channel to Kraemer Boulevard, Contract

·Approximately 2,600' of VCP on Palm Drive has been installed.
Backfill operations are in progress. Backfill is complete up to
Valencia Avenue. The siphon at Valencia Avenue has been completed.
Contractor was delayed with pipe installation due to recent rain
which washed sand into installed pipe. Base operations have been
scheduled for next month.
Contractor estimates installing 100' of VCP per day.

SUBJECT: Carbon Canyon Interceptor Sewer, Contract No. 2-18
Approximately 1,400' of 66" RCP has been installed. Backfill
operations are in progress on La Palma from Grove Street to
Miller Avenue. The curve at Grove and La Palma is complete.
The curve at La Palma and Miller is under construction. The
Contractor has moved op~rations up to Mira Loma in order to
excavate and install RCP across Mira Loma.
A 12" water main within the Contractor's excavation at Grove
Street and La Palma broke. Anaheim City Water Department
crews worked on the repair of the water line. The cost will
be absorbed by the Contractor.
Local traffic is allowed to flow up to Grove Street and Fountain
Way. All efforts have been made to alleviate hampering business
traffic.

SUBJECT: Imperial Relief Interceptor, Reaches 22 & 23

The Contractor estimates installing the rema1n1ng 550 L.F. of
VCP on Imperial Highway this month. Also the installation of
VCP under Harbor Boulevard has been scheduled to begin the
weekend of April Sth, if weather will permit. The Contractor
estimates completing all work by the middle of May.
As per State standards, east bound traffic is limited to one
lane from 7 A.M. to 2 P.M. After 2 P.M., east bound traffic is

follow after sheeting has been removed. This type operation calls
for close organization of excavation, installation and removal of
sheeting and backfilling.
The Contractor estimates installing 70' per day of RCP.
Traffic is hampered on Goldenwest from Westminster Avenue to Garden
Grove Boulevard due to construction and storage of materials. All
efforts have been made to alleviate traffic problems. One lane
south bound and one lane north bound from Westminster Avenue to
Garden Grove Boulevard exists at the time.

DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the Board of Directors of County Sanitation
District No. 7 , of Orange County, California, has found and determined,
and hereby does find and determine, that the public interest and
necessity require for public use the acquisition, construction,
completion, operation and maintenance by said County Sanitation District
of certain public improvements, to wit: A sanitary sewer and all
facilities and appurtenances necessary or incidental thereto including
manholes, measuring devices, pumping stations, and other structures for
the transporting and receipt of sewage and industrial wastes for the
purpose of transportation, treating and disposing of said sewage and

industrial wastes arising within the territories of said County
Sanitation District and such other territories as said District may have
contracted to serve pursuant to law; and that certain real property
situat~d in the County of Orange, State of California, is necessary
therefor; and,
Section 2. That the real property, the acquisition of which is
required by the public interest and necessity for the uses and purposes
set forth in Section 1 hereof, is situated in the County of Orange,

State of California, and is more particularly described on
Schedule "A" and shown on maps marked Exhibit "A" attached hereto
and made a part hereof as though set out in full hereiri; and,
Section 3. That the permanent easements and rights of way
above described and necessary to be acquired shall be acquired
subject to the rights of the owners, their successors and assigns,
to use the surface of the land within the boundary lines of such
easements and rights of way to the extent compatible with the full
and free exercise of said easements and rights of way; provided,
however, that:
(a) No building or structure of any kind shall be
placed, erected or maintained thereon;
(b) No streets, alleys nor roadways shall be constructed
upon, over, or along said easements and rights of
way to a grade less than four feet above the
top of any pipe or pipes located within the
lines of said easements or rights of way;
(c) No fill shall be placed or maintained over the
surface of the ground as it shall exist within
the lines of said easements and rights of way
upon the completion 9f the improvements to be
constructed therein greater than six feet in depth.
Section 4. That the permanent easements and rights of way to
be acquired shall include: I.
(~) The right to construct manholes, air valves,
blowoffs, pumping wells, pumping stations,
metering stations, standpipe and service
connection structures appurtenant to said line
or lines of trunk sewer pipe, which structures

shall not extend above the surface of the ground;
(b) The right during construction to use all existing
private roads within the properties of the owners
for ingress to and egress from the work, together
with the right, upon completion of the construction
of the pipeline or pipelines or other works, to
construct and maintain an access road upon, over,
and along such permanent easements and rights of
way as may be in the public interest from time to time.
Section 5. That the Board of Directors of County Sanitation
District No. 7 , of Orange County, California, hereby declares its
intention to acquire the property described in Section 2 hereof by
proceedings in eminent domain. That the District's General Counsel
be and he is hereby authorized and directed to commence an action
in the Superior Court of the State of California in and for the
County of Orange in the name and on behalf of County Sanitation
District No. 7 , of Orange County, California, against all owners and
claimants of the above-described properties for the purpose of
condemning and acquiring said properties for the use of said County
Sanitation District; that said condemnation action shall be prosecuted
in accordance with the provisions of law applicable thereto. That
said attorney is authorized and instructed to make application to said
Court for an order fixing the amount of security by way of money
deposits as said Court may direct and for an or9er permitting County
Sanitation District No. 7 , of Orange County, California, to take
immediate possession and use of said real property for the uses and
purposes herein described; and,
Section 6. That the Auditorof the District is authorized upon

receipt of a Court order and demand from the General Counsel of the
District, to pay to the County Clerk of the County of Orange such
sum or sums of money from District funds as may be required from
time to time to be deposited upon order of the Court granting immediate

Approximately 800' of 27" VCP has been installed in Mitchell Avenue.
Poor ground conditions have slowed progress. The Contractor estimates
installing 100' of VCP per day after passing Station 9+00 where
improved ground conditions exist. Approximately 400' of Mitchell
Avenue is closed to traffic from Green Valley Avenue to Utt Drive.
The manhole located at Utt Drive required moving upstream several
feet in order to alleviate conflict with existing utility.
A temporary chain link fence is installed around the excavation
during non-working hours.

DECLARING THAT THE PUBLIC INTEREST AND
NECESSITY DEMAND IMrJIEDIATE EXPENDITURE OF
MONIES TO SAFEGUARD LIFE, HEALTH AND PROPERTY
IN ORDER TO MEET ESTABLISHED DISCHARGE REQUIRE-

SECTION 4755 OF THE HEALTH & SAFETY CODE

WHEREAS, the California Regional Water Quality Control Board,
Santa Ana Region, of the State Water Resources Control Board of
the State of California, jointly with the Federal Environmental
Protection Agency, did on June 7, 1974, adopt and establish
effluent discharge requirements for wastewater discharge to the
Pacific Ocean by the County Sanitation Districts Nos. 1, 2, 3,
5, 6, 7 and 11 of Orange County, California, pursuant to the
Water Quality Control Plan -Ocean Waters of California, and
Section 402 of the Federal Water Pollution Control Act, as
amended (33 U.S.C. 1251 et seq); and
WHEREAS, said effluent discharge requirements, as set forth
in a National Pollutant Discharge Elimination System Permit
No. CA0110604, are established to safeguard life, health and
property, and said permit does establish prohibitions and limita-
tions on pollutants discharged to the Pacific Ocean; and
WHEREAS, to achieve the degree of treatment required to meet
said pollutant limitations, said Districts must construct
additional treatment facilities for further treatment beyond the
capabilities of the present treatment facilities now owned,
operated, and maintained by said Districts, and said permit does

provide that the Districts shall complete final construction
plans and specifications on or before April 1, 1976; and
WHEREAS, it is anticipated that the safeguards to life,
health, and property as provided in said National Pollutant
Discharge Elimination System Permit may not be provided unless
there is an immediate expenditure of public funds necessary to
meet those certain provisions of compliance, as set forth in
said permit; and
WHEREAS, said Districts did receive and accept a Step I
construction grant from the Environmental Protection Agency and
the State Water Resources Control Board in a total eligible amount
of $3.5 million for the purpose of assisting the Districts to
determine and set forth in a Facilities Plan the best apparent
alternative for said required additional facilities; and
WHEREAS, it is imperative that said Districts construct and
operate certain wastewater process treatment pilot facilities to
select the best apparent alternative for said required additional
treatment facilities; and
WHEREAS, to design said pilot facilities and to procure bids
by formal advertising as prescribed in Section 4755 of the Health
and Safety Code of the State of California and construct said
pilot facilities by normal contractual procedures established by
said Districts would create delays whereby said Districts would
be unable to determine the best apparent alternative for said
additional facilities in sufficient time to meet the requirements
of said National Pollutant Discharge Elimination System Permit.

NOW, THEREFORE, the Boards of Directors of County Sanitation
Districts Nos. 1, 2, 3, 5, 6, 7 and 11 of Orange County, California,
DO HEREBY RESOLVE, DETERMINE, AND ORDER:
1. That the foregoing premises do constitute an anticipated
great public calamity and an emergency as is contemplated and
provided in the pr~visions of Section 4755 of the Health and
Safety Code, and that the public interest and necessity demand
immediate expenditure of public money to safeguard life, health,
and property in order to meet the discharge requirements under
which the Districts must operate.
2. That the General Manager is hereby authorized and
directed to expend such funds as are necessary to complete the
Facilities Plan and other requirements as set forth in said
Step I construction grant without public bids as described in
Section 4755 of the Health and Safety Code of the State of
California.
3. That the General Manager is hereby authorized to
negotiate for the labor, materials, and services necessary to
meet the provisions of said Step I grant substantially in
accordance with the paragraph 6 of Procurement Standards as set
forth in Volume 38, No. 151, of the CFR dated Tuesday, August 7,
1973, provided that no monies shall be obligated by said Districts
unless approved by the State Water Resources Control Board and
Environmental Protection Agency officials pursuant to said Step I
grant.

4. That cost records of any labor, material or services
as authorized shall be kept in ~he manner provided in Sections
4000 to 4007, inclusive, of the Government Code of the State of

6. Procedure for Accidental Discharge
In the event the discharger is unable to comply with any of the
permit conditions due to a breakdown of waste treatment equ ipm e n t ,
accidents caused by hum an error, or 0tReF-eaHses-5Hefi -as-acts of
nature , the discharger s hall n otify the District by telephone
as soon as he or his agents h ave knowledge of the incident .
Confirmation of thi s notification shall be made i n writing within
two weeks of the telephone notification. The writt e n n otification
shall include pertinent information explaining reasons for ~he
non -comp liance and s ha ll indicate what steps were taken to correct
the problem and the date ·:of the incident , as well as what steps are
being t aken to prevent the problem from reoccuring.

CLASS II PERMIT APPLICATION
Users required to obtain a wastewater discharge permit shall file an
application on the forms prescribed by the District.
INSPECTION AND SAMPLING
The District may inspect the wastewater generating and disposal
facilities of any user to ascertain whether the 1ntent of this
Ordinance is being met and :the. user is complying with all require-
ments. Persons or occupants of premises where wastewater is created
or discharged shall allow the District or its representative.6 ready

of the wastewater generating and disposal facilities for the purposes

The District shall have the right to set up on the user's property such
devices as are necessary to conduct sampling or metering operations.
Where a user has security measures in force whiefi-weH±e-re~Hire-prepeF

user shall make necessary arrangements with-tfieiF-5ee\:lFity-gtiaFas so

District will be permitted to enter without delay for the purpose
of performing their specific responsibilities.
PRETREATMENT
Users shall make wastewater acceptable under the limitations established
herein before discharging to any public sewer. Any facilities required
to pretreat wa s tewater shall be provided and maintained at the user's

505. FALSIFYING INFORMATION
Any person who knowingly makes any false statements, representation,
record, report, plan or other document filed with the District or
who falsifies, tampers with; or knowingly renders inaccurate any
monitoring d evice or method required under this Ordinance, shall be
-deemetl--t-t>-.-00.Je violated-this Ordinance.
506 . APPEALS
Any user, peTillit applicant, or permit holder affected by any decision,
·action, or determination, including cease and desist orders, made by
the General Manager, interpreting or implementing the provisions of
this Ordinance or in any permit issued herein, may file with the
General Manager a written request for reconsideration within ten (10)
days of such decision, action, or deteTillination, setting forth in
detail the facts supporting the user's request for reconsideration.
If the ruling made by the General Manager is unsatisfactory to the
person requesting reconsideration, he may within ten (10) days after
notification of the General Manager's action, file a written appeal
with the Secretary of the Board of Directors.
A fee of $100 shall accompany any appeal to the Board of Directors
of the District for a ruling of the· District. This fee sha ll be refunded
if the appeal is sustained.
'Tile written appeal shall be heard by the body within 45 days from the
date of filing. 'Tile District's Board of Dire ctors shall make a fin a l
ruling on the appeal within 60 days from the date of filing. %e

AREAS TO BE EXECUTED PRIOR TO JUNE 30, 1975
1.-The Environmental Protection Agency is bound by the pro~
visions of Section 1B57h-4(c), Title 42 of the United States
Code and Office of Management and Budget Circular A-102 and
Attachment 0 to said circular which applies to "Administrativr.:
Requirement8 for Grants-in-Aid to State and Local Governements".
(Federal Register, Vol. 38, No. 151, August 7, 1973.)
2. Paragraph 4k of the above referenced Attachment 0 reads,
in pertinent part, as follows:
·"Contracts and subgrantE of amounts in excess of
$100,000 shall contain a provision which requires
the recipient to agree to comply with all applicable
standards, orders, or regulations issued pursuant to
the Clean Air Act of 1970 •••• "
J. The State Water Resources Control Board has agreed to
comply with the requirements of federal law in administra-
tion of the Clean Water Grants Program.
4. Section 2720 of the Board's Regulations for Implementation
of the California Environmental Quality Act (California
Administrative Code, Title 23, Chapter 3, Subchapter 17)
reads as follows:
"The state board may deny, postpone or condition
discretionary financial assistance for any project
which is to be undertaken by any person where the
state board determines that such action is necessary
to protect against environmental damage, to minimize
adverse environmental impacts, or to ensure long term
protection of the environment."
5. Pursuant to provisions of t.he Clean Air Act of 1970 and to
40 CFR 51.12, the California Air Resources Board has
designated eight Air Quality Maintenance Areas throughout
the State which have the potential to exceed adopted
ambient air quality standards during the period 1975
through 1985.

6. State grant contracts will be executed for a number c,f
projects in Air Quality Maintenance Areas prior to
June 30, 1975.
7. The Regional Administrator, Region IX, Environmental
Protection Agency, has stated that a special conditic~
such as Appendix A, attached, is necessary to permit EPA
to approve grants for projects in Air Quality Maintena:lce
Areas which it otherwise might not have been able to appr~rv··. ~
THEREFORE BE IT RESOLVED:
l. That the Executive Officer prepare a proposed regulation
which will subject all grant contracts to be executed on or
before June JO, 1975, for projects located in Air Quality
Maintenance Areas to a condition similar in form and effect
to the draft.condition set forth in Appendix A to this
resolution.
2. That the Executive Officer schedule and notice a hearing
to consider comments on said proposed regulation.
J. That the Executive Officer immediately begin preparation
for consideration of a regulation which will subject
projects located in Air Quality Maintenance Areas.which
receive grants after June 30, 1975, to similar conditions
with regard to air quality impacts.

The Joint Ownership, Operation and Construction Agreement
provides that the seven Sanitation Districts must employ the
same General Counsel. This does not 'preclude employment of
additional attorneys by any or all the Districts for special
legal work, as needed. In the past this has consisted of bond
counsel, assessment district counsel, special counsel for par-
ticular litigation, and special labor counsel.
The General Counsel is appointed directly by the Boards of
Directors, independently of the other staff, and serves at their
pleasure; however, the activities of the legal counsel are under
the direction of the General Manager. With respect to the employ-
ment of a General Counsel, the Districts have paid a monthly re-
tainer for which he furnishes "general legal services" as required.
These services include the following:
"General Legal Services"
(1) Consultation with staff members by telephone,
visits to the Districts' offices, or staff
visits to the General Counsel's office.
(2) Attends the Joint Board meetings and verbally
reports on his activities. At the request of
a District Chairman or the General Manager,
attends District Board meetings and special com-
mittee meetings. The Counsel is also responsible
to advise the Boards of Directors of the legal
ramifications of any actions they may consider.
(3) Prepares special resolutions or motions when
requested by the Districts' staff or directed
to do so by the Boards of Directors.
(4) Reviews and/or prepares contracts to be entered
into by the Districts (typical types of con-
tracts are for engineering design services, con-
struction contracts, license agreements, and
agreements with other public agencies).
(5) Assists the Districts' staff in acquiring
rights of way, including condemnation
actions authorized by the Boards of Dir-
ectors and necessary documents therefor.
(6) Assists the Districts' staff in the enforce-
ment of all ordinances and resolutions per-
taining to the use and operation of the
Districts' facilities
(7) Represents the Districts on the California
Association of Sanitation Agencies (CASA)
Attorneys Committee
(8) Prepares Legal Opinions on specific items
referred to him
(9) Prepares. correspondence on disputes of con-
struction contracts
(10) Prepares opinions on appeals and claims made
by individuals to the Boards of Directors
(11) Keeps the staff and Directors informed as to
changes in State laws affecting the Districts
and their operations
(12) Advises the Districts' staff and Directors of
pending legislation
(13) Advises and assists staff and Directors with re-
quired reports pursuant to conflict of interest laws
(14) Assists the Districts ' staff in public employer-
employee labor r elations
"Extra Work"
Additional services d es ignated as "extra work" are to be
provided at st ipulat ed per diem rates. These additional services
consist of:
(1) Preparation for lawsuit, court appearances, legal
briefs or petitions
(2) Appearances in any court of law, before any adminis -
trative or legi s lative committee or agency, or at
any public hearing on behalf of the Districts
(3) Other work on behalf o f the Districts which, in th~
opinion of the Gen e r a l Manage r and General Counsel is
not within the work contemplated under the r etainer,
subject to approval of the Boards of Directors

Joint Chairman Winn advised that he had no report but said Director
Cox had something to say. Cox suggested that in honor of Art Carney 's
Academy Award, maybe the Districts shoul d pass a resolution naming
him as "Sewer Man Of The Year". It was so moved, seconded and carried .
Report of the Genera l Manager
Mr . Harper invited the new Directors to tour the facilities and
learn about our f u nctions. Said to ca l l and we would make arrangements.
Generally, in the years with the heavy changeover of mayors and Directors,
we have an evening when all of the new members tour the facilities
but don 't think we need to do that this year . Just call at your
convenience .
FAH advised that he received several comments from some of the members
after the last meeting when staff recommended that the Board adopt
a resolution relative to 208 regional p l anning. Referred to resolu-
tion in Directors ' folders supporting pos i tion that this area not .
be designated . SCAAG recommended total p l anning of area. 208 planning
is primarily on water qua l ity problems , point and n o n -point sources .
Most of the planning by the SWRCB and Regional Boards. Our posit i on
i s diffe r ent from SCAAG 's Executive Comm i ttee . Feel actions taken
by Board are consistent with SWRCB . Hearing s pretty much went the
same way. Requests were for small designations wh ere local communities
could be the major participants in the planning area .
Reported that on April 3rd we represented our Districts at a hearin g
of the National Commission on Water Quality. Hearing was conducted
by General Clark , Congressman Johnson & Bill Geonelli on this .
Primarily on local financing and ability of local communities to fund
their portion of construction grant and maintain these facilities
aft e r construction . Were representatives from LA, Hawaii, Nevada,
San Diego and Orange County . The point made by all of these agencies
was pointed toward the fact that these agencies would prefer to spend
that kind of money on water reclamation in areas where it wou ld do
some good rather than just blanket secondary trea tment. Referred to
SWRCB resolution in folders and said this mi gh t l ook like a harmless
document but through the in sistence of the Air Re sour ces Contro l
Board and EPA, the SWRCB was going to adopt this resolution on April 2.
They called a special meeting and it would have restricted the number
of connections that could be made to sewer system by anyone who wou ld
take a federal grant between now and June 30th of this year . Referred
to Appendix A--would not let you connect any new territory and would
.limit the number of connections to the sewer system . Would have to
pass on to cities and sanitary districts a quota o f connections the y
could have . Only way to change this would have been through some
action or agreement with Air Resources Control Board. We think that
this type of attachment to a grant for improvement of water q u ality
goes int o the same category as the parking lot structures that EPA
came up with a year or so ago. The Stat e Board decided to hold a
hearing on this matter sometime in May . Said it might be well for
Direc tors to take this to their city managers and staff and ask them
to look this over and see what th ey think of it . You may want to
voic e your opinion on this particular document. As soon as we get
official notice of public hearing , will send it o u t to Dir ectors .

Report of the General Co unsel
Nissan advised that yesterday the hearing was set for the l abor
union against the Districts . Spent about four days trying to
get a c o urt room. New date now i s May 22nd . Special Labor Counsel
Larry Curt is has written a ? Point of Authority in our
favor and the Districts chances are better than 50%.
Did other routine business during the month.
Substitution of subcontractor for Pl-l6
Scott asked why such a range on this contract? Is it going to be
more or l ess t han regular contract? REL advised that this sub -
contractor has not met some of his requirements such as bonds.
We are asking prime contractor to give us range un der which this
subcontractor oper ates . Donovan solicited bids for another sub -
contractor or prime contractor would perform the work.
MacKain asked i f there was any penal ty assessed the subcontractor.
REL answered that damages were between the prime contractor and
subcontractor. Prime contractor cannot add subcontractor and can
only substitute when one fai l s to live up to his requireme nts.

Svalstad said he couldn 't understand why their letter was so late
in getting to the Board . He was advised by Nissan that he had agreed to
take labor matters on limited area with understanding that if we
got into trouble, he could employ a labor counsel. But in addition
to this author i ty, the firm wanted a direct recommendation from the
Boards by this action on the agenda. Svalstad also questioned range
of fees. Nissan expl ained that different persons in the firm were
paid at different rates but the primary responsibility person for
this case works at $60/hour.
This item was so moved, seconded and carried .
Condemnation re Contract No. 7 -6-7
Questioned why Schedule "A" was not attached to resolution . Nissan
explained that this was Southern Pacific right of way that goes up
to Tustin. Southern Pacific won 't deal with appraisers until they
have authorization for condemnation .
Saltare lli moved to approve this subject to the fact that this i s
the property we are talking about .
REL added that we retained Goode & Goode at the last Board meeting
to do appraising . This is from Southern Pacific and they can 't
discuss acquisition until we have this order of condemnation . This
property is being negotiated by County for bike trails and recreational
trails . This action is needed to discuss this.
It was then moved again to approve this subject to verification that
this is the property in question . Motion seconded and carried.

Ordinances
John Thomas reported on ordinance and said green copies in corporate
most of the changes due to public meetings over the last two weeks.
Had pa~ticipation of most of the industrial people in Orange Co unty
and cities. In addition, we have blue copies of material that staff
made changes to after ordinance was mailed out. Refe rred to page 12,
want to return to original numbers as proposed in Ma rch draft.
Explained that in order to change the numbers, we will have to go
to State and get their approval first as we have submitted these
numbers originally to_ therri. Also referred to page 27, dele ting
statement that public agencies will not be exempt from use charges.
Said that we feel that before we carry through on this particular
aspect, State is going to have to specifica lly request us to do so.
One of the major aspects of the ordinance is going to put wastewater
in the proper prospective as far as management and industry is
concerned. The second asp~ct is that this ordinance is not going
· to allow us to go out and wholesale a program. Our intention is
to permit only those industries who have a significant impact on
sewage disposal.
Chaput questioned deletion of statement that public agencies will
not be exempt. Asked what the reason was for that . Was answered
that we feel that in most cases we are dealing with cities and
counties and to charge them would be a useless manuever~ REL added
that with the Federal Act now, no one is exempt. No sense exchanging
tax dollars. Would like to proceed with policy used in the past .
Would prefer at this time to put that in the ordinance and to
continue our present Board policy and wai t until we get a directory
from Sacrame nto or Washington that we h ave to . Ar~ permitting sta te·
and f e deral institutions but will not start permit ting every c it y hal l,
fire and police station, etc. John Thomas exp l ained t hat they were
referring to was tewater permits -not connection permits. Connection
permits will continue.
Motions were then made and seconded for each Dis trict and carried .
FAH then thanked John Thomas for the outstanding job he has been
doing working with the industrial people and the Dis tricts on this
ordinance.
Joint warrants
Svalstad questioned the employees' mileage warrants . Asked if we
had a l ot of people who didn't have the u se o f the Sanit~tion
Districts' cars or what. FAH explai ned that many of these p eo p le
are part-time inspectors and they use their own automobiles . 15~
for f irst 150 miles. Some other employees do things like go t o
post office, et6. He asked if this was the cheapest way to handle
this and FAH answered , yes.
Amendment to contract with Jeanne Eddows
Questioned why we had amendment . Nissan stated that the risks
aren't that great in this case a nd insurance .woul d b e too expen sive
for contractor. REL added that man y of t he. insurance companies
do not write this type of coverage. In their contract the l i mits
us ed .were those for .construction contracts and we do not have that
much exposure here. Operation i s basically to process the sewage
solids after we dewater th e m. They are not in the contracting
bu sin ess of construction.

Norma Gibbs then thanked her committee for all their work in
se l ecting a legal counsel.
Question was asked when this would become effective and was
stated May 1st with one year review.

Board meeting with regard to the auditing services . Said it was
extremely well done . Said he hop ed staff and other committee members
listened to him carefully. There was no discussion because he was
well prepared and had answers to objections that they did make .
(41) Amendments to agreements with Orange, SA , Tustin & CMSD
FAH explained present procedure with regard to agreements . Said
our suggestion or r ecommendatio n is that we discuss this with the
cities and to be consistent with Districts 2 , 3 and 5 for collection
the way they want and sending 95% to the District s .
Jackman asked if we approve item, are we approving recommendatio n
or just discussion with cities?
Saltarelli asked what reasons were against this? FAH answere d that
from the City Manager 's viewpoint he •may be taking funds and
investing them and not putting th~ interest into the fund .

Mr. Harper advised that he had appeared at a hearing on April 3rd
to present the Board's resolution in support of the California
Regional Water Quality Control Board's position opposing a
"Section 208" planning area encompassing most of Southern
California. He also reported that he had testified
on the same day at a hearing of the National Commission on
Water Quality, and briefly reviewed the testimony at said
hearings.
The General Manager then reviewed a draft resolution of the
State Water Resources Control Board regarding proposed special
. clean water grant conditions that would limit the rate of sewer
connections in "air quality maintenance areas" and greatly
restrict local political decisions and considerations in
relation to the prevention, abatement, and control of environ-
mental pollution. The regulations have been proposed by the
SWRCB at the insistence of the Air Resources Control Board
and the Environmental Protection Agency. Mr. Harper
advised the Directors of the severe implications of the proposed
regulations and stated it might be necessary for the Boards to
hold a special meeting to formulate· a position on the matter
for presentation to the State Boa~d after they have set a
hearing date.
