(a) Consideration of motion accepting Committee's
recommendation that the matter regarding the new
carpeting for the Administration-Engineering
Building Additions, Job No. J-7-2, be resolved
as follows:

rloor pads, rubber caster replacements for
the desk chairs, and a rotary-brush type
conunercial vacuum cleaner to the Districts,

1973, for consulting architectural services in
connection with design of treatment facilitie~
in accordance with State and Federal regulations
for construction grant eligibility, .on a per diem
fee basis in an amount not to exceed $15,000 for

No . 14 -CONSIDERATION OF ALTERNATE HEALTH PROGRAM -Under
the provisions of the Memorandum of Agreement with the Orange
County Employees Association, approved by the Boards in
January, it is stipulated that the Districts shall make
available to the emp loyees, a prepaid health care medical
plan (HMO) as an alternative choice to the existing group
health insurance plan . The staff has prepared a separate
report on this matter and it is included with the agenda
material.
No . 15 -REPORT OF SPECIAL COMMITI'EE TO INTERVIEW ENGINEERING
FIRMS FOR DESIGN OF PROJECT NO . 2 . Due to the lack of State
and Federal funding, this project will have to be postponed.

Seminar site .

Seminar a nd the concurrent meeting of AMSA . Since our
Districts are active in both organizations and these con -
ferences have proved ·to be extremely valuabl e, the Boards

NO . 11-12 -On July 12, 1972, the Board accepted a proposal
and employed the engineering firm of Keith and Assoc iates
for engineering services in connec tion with the design of
the Slater Avenue Trunk Sewer Exten sion, Contract No . 11-12.
The District 's connecting Slater Avenue Pump Station is
badly in need of repair and mo d ification~ and we believe
that a savings could be effected if the required recon -
struction design is done at this time by the engineer .
Therefore, it is recommended that the proposal from Keith
and Associates (included i n the agenda material) be accepted,
and that the firm be emp loyed to prepare a report and plans
and specifications on the recomm ended method of r epairs',
for a total fee not to exc eed $3000 , based upon the hourly
r ates set forth in the p r oposal .

Conceµtrated efforts are being made by the staff to e~pedite
t he construction along the Coast Highway to minimize the in -
convenience to the public and businesses. The Contractor
has given full cooperation and his progress has exceeded all
expectations . On -street parking has been restored on t he
North side of the Highway and we are now ho l ding discussions
with the State Di vision of Highways and the City of Newport
Beach in, an effo r t to restore on-street parking on the Bay
s i de· of the Highway (see enc l osed letter). The staff would
l ike specific di r ection f r om the Board re ga rding possibl e
traffic lane re -striping i n the completed construction area
i f arrangements can be made with the State Division of Highways .

The actions appearing on the agenda dec l are the intent
of t he Dis trict to enter in t o a standard Master Pl an
Reimbursement Agreement for t he construction of a segment
of t he Distr ict's trunk sewe r Master Pl an. In addition ,
it accepts the proposal of Boyle Engineering to prepare
the p l ans and specifications for the project . The project
will be financed by the Irvine Industrial Complex which
will then be reimburs ed from sewer connection receipts
over a three -or -mo r e -year period for the constructi on
costs invol ved .

INDUSTRIAL COMPLEX -Resoluti on No . 73 -13 -7 approves and
authori zes the execut i on of a Reimbursement Agreement fo r
the constructi on of several segments of the Distri ct 's
trunk sewe r Master Pl an in the southeasterly port ion of
the District knovm as the Irvine Industrial Complex area .
The fina l costs have been reviewed by the Di strict's
engineers and it i s recommended t hat the agreement be
approved in a total amount of $329 ,708 .80 .

EA~~MENT -We have a r eques t on behalf of Mr . Sterling
Graydon , Jr ., of 2081 Woodb ine Drive, Santa An a , that the
Distri ct quit c l aim to him a portion of the sewe r easement
on his property . Recent l y Mr. Graydon became a wa r e that a
portion of his house and pati o encroac hed on the Di strict 's
easement, t he r eby clouding t he title t o his property . The
District 's staff has investigated the matter a n d r ecommen d s
that that portion of the easemen t involving t he property
own e r's impr ovements be quitc l aimed . The staff is con-
tinuing to investigat e whether o r not the easement shou l d
be quitclaimed gratuitou s l y . A r ecommendation concerning
thi s will be ma d e at Wednesday 's meeting .

No . 61 -CLAIMS FOR DAMAGES -CONTRACT NO . 3-17 -Gene r a l
Telephone Company has filed a total of six c laims against
t he District in connection with damage to the company 's
facilities allegedly caused by the Contractor for the
Knott Avenue Interceptor , Contract No . 3 -17 (J . F . Shea
Company). Copies of these claims have been sent to the
Contractor as it is his responsibility to resolve this
type of damage claim. It is recomme nd ed that these claims
be r ece ived, filed, and deni ed .
No. 62 -CHANGE ORDER NO . 1 TO CONTRACT NO . 3-17 -The ·
Contractor, J. F . Shea Company , encountered inadequate sub -
grad e (peat) on this project a n d was required to install
additional rock bedding. The recommend ed motion appea ring
on the agenda approves payment for the additional bedding
in the amount of $3,168 .oo , in accordance with the specifi -
castions and contract .
No. 64 -FURTHER CONSID ERA TION OF ROUTING OF THE KNOTT AVENUE
INTERCEPI'OR ( CONTRACT NO . 3-18) THROUGH THE CITY OF WESTMINSTER.-
As of this date, the staff and District engineer have been
unable to obtain an af f irmative committme nt from the Edis on
Company obtaining an easement along their property_; therefore ,
the staff reque sts direc tion from the Boa rd with the possi -
bility of further consi dering pre viously p roposed alt ernat e
routes in an effort to expedite this proj e ct . These facilities
are urgently ne e ded and if the matt e r of the routin g is not
resolved soon, we will miss a very favo r able construction
bidding period.
No. 65 -DEFERMENT OF HEARING ON PROPOSED CONNECTION CHARGE
ORDINANCE -It is t he staff 's recommendation that the scheduled
hearing on the Dist rict's p r oposed connection charge ordinance
be deferred f r om Ma r ch 7 to March 1 5 . This delay will give the
District 's Municipal F inancing Consultant additional time to
d eve lop r ecommendations to the Board concerning short-t e rm and
long -term financial needs of the Dis trict .

The term "secondary treatment" may not be defined under .
§304{d){1) to include primary treatment for ocean outfalls --even
where it is shown that a primary treated effluent will not harm the
aquatic environment. / ~ . ·.
Discussion
Both the Act and its legislative history clearly show that the
1977 standardSof "best practicable" for industry and "secondary
treatment" for municipalities were to be technology-based rather
than based on water quality effects. Water quality comes into play .
only through the provision that stricter standards than "best
practicable11 or "secondary treatment" inay be imposed where necessary
to meet water quality standards (§30l(b)(l)(C)). The Senate Report
makes. this point clear:
"The application of Phase l tectrnology to
industrial point sources is based on the control
~i technologies for those sources and to publicly

of Directors may intend to keep our committee intact
for the purpose of considering and recommending
engineering firms for a specific joint works project

As Chairman of the Committee, I have instructed the staff to
advise the twelve engineering firms who submitted proposals that
the Districts will not proceed with Project No. 2 at this time.

Transmitted herewith, is the regular quarterly financial report for
the six months ended December 31, 1972, prepared pursuant to the
Boards' policy directive of June 14, 1972. ·
The statements summarize the fiscal activities of the joint
cpcr~tic~s ~~d the individual Di8trictc for the first half 8f th8
1972-73 fiscal year, and the status of each with respect to the
approved budgets. The most significant item of expenditure for the
Districts is, of course, the outlay for capital facilities improvements
and additions. Included in each District's statement is an itemization
of their trunk sewer construction projects and respective share of the
joint works expansion. Separate staff progress reports on the projects
have been prepared and are included in the agenda material for the
February 14th meeting.
Summarized below are comments relative to the financial statements.
If you have any questions concerning the material, I would be pleased
to discuss them with you at your convenience.
CASH AND INVESTMENTS
Our continuing program of investing reserve funds (primarily capital
funds ·accumulated for construction oT requifed sewerage facilities) has
earned interest of $708;000 during the first six months of 1972-73. As
of December 31., 1972, 96% of the Districts' cash funds were invested in
short term government s~curities as shown below. The cash on hand
includes $1.23 million returned from investments to provide funds for
Districts 2, 3 and 11 1958 bond redemptions due Januar.y 1st.

Insurance -Annual premium expense charged at time of payment.
A budget transfer is not anticipated to be necessary.
Chemical Coagulants -Sludge dewatering experimentation under way.
Upon completion, materials purchased for operating dewatering
facilities will be charged against this account.
Research & Monitoring -Chemical precipitation experimentation at
Clarifier "K" approved by Boards in October and is progressing
satisfactorily. Expenditures for materials will be reflected in
this account.
Utilities -Power bill for sixth month ~stimated at $15,oorohas
not been received and is not reflected in the statement. Break-
downs in major mechanical equipment have increased the electrical
power demand somewhat. As a result a budget transfer may be
necessary later in the year.
Prior Years Expense -This acdount represents adjustments to an
operating or non-operating account balance of a ~rior year.
CAPITAL OUTLAY REVOLVING FUND
During the quarter $4.88 million was expended on joint works treatment
and disposal facilities expansion, representing expenditures on fifteen
major construction contracts and several minor projects. The share of
the joint works expansion costs are reflected in the financial statements
of the respective Districts.

for Six Months Ended December 31, 1972
Transmitted herewith, is the regular quarterly financial report for
the six months ended December 31, 1972, prepared pursuant to the
Boards' policy directive of June 14, 1972. ·
The statements summarize the fiscal activities of the joint
0peb:t.ti0ns afJ.d the individual Distrie;ts fo1: the fir>st hal.L of tiJ.t:~
1972-73 fiscal year, and the status of each with respect to the
approved budgets. The most significant item of expenditure for the
Districts is, of course, the outlay for capital facilities improvements
and additions. Included in each District's statement is an itemization
of their trunk sewer construction projects and respective share of the
joint works expansion. Separate staff progress reports on the projects
have been prepared and are included in the agenda material for the
February 14th meeting.
Summarized below are comments relative to the financial statements.
If you have any questions concerning the material, I would be pleased
to discuss them with you at your convenience.
CASH AND INVESTMENTS
Our continuing program of investing reserve funds (primarily capital
funds accumulated for construction of required sewerage facilities) has
earned interest of $708,000 during the first six months of 1972-73. As
of December 31,. 1972, 96% of the Districts' cash funds were invested in
short term government securities as shown below. The cash on hand
includes $1.23 million returned from investments to provide funds for
Districts 2, 3 and 11 1958 bond redemptions due Januar~ 1st.

Insurance -Annual premium expense charged at time of payment.
A budget transfer is not anticipated to be necessary.
Chemical Coagulants -Sludge dewatering experimentation under way.
Upon completion, materials purchased for operating dewatering
facilities will be charged against this account.
Research & Monitoring -Chemical precipitation experimentation at
Clarifier "K" approved by Boards in October and is progressing
satisfactorily. Expenditures for materials will be reflected in
t,his account.
Utilities -Power bill for sixth month ~stimated at $15,00~has
not been received and is not reflected in the statement. Break--
downs in major mechanical equipment have increased the electrical
power demand somewhat. As a result a budget transfer may be
necessary later in the year.
Prior Years Expense -This account represents adjustments to an
operating or non-operating account balance of a.prior year.
CAPITAL OUTLAY REVOLVING FUND
During the quarter $4.88 million was expended on joint works treatment
and disposal facilities expansion, representing expenditures on fifteen
major construction contracts and several minor projects. The share of
the joint works expansion costs are reflected in the financial statements
of the respective Districts.
INDIVID'UAL DISTRICTS
Taxes -47% of the 1972-73 tax levy has been apportioned as of
December 31, 1972.
Federal and State Grants -Summarized below is the amount Federal
and State construction grant funds received during the first
six months.

Duties and Powers
Dear Mr. Harper:
Generally speaking, the powers and duties of the
Grand Jury are described in Chapter 3 of the California
Penal Code, commencing with §914. Article 2 of Chapter 3
is entitled "Investigation of County and District Affairs".
Pertinent provisions of Article 2 with reference
to County Sanitation Districts are as follows:
"§933.5 [Examination of books and records of
special purpose assessing or taxing district wholly or
partly within county]
A grand jury may at any time examine the·books
aaJ records of any special-purpose assessing or taxing district
located wholly or partly in the county, and, in addition to
any other investigatory powers granted by this chapter, may
investigate and report upon the method or system of performing
the duties of such district."
This section appears to give the Grand Jury sufficient
authority to investigate and report on County Sanitation Districts.
With reference to the effect of such repo~t, Penal
Code §933 appears to provide the answer .. It reads as follows:
"933 [Grand jury's ·findings and reconunendations:
Conunent by board of supervisors: Report of county officer:
Filing]
"On or before December 31 of each year, each grand
jury impaneled during that calendar year shall submit to the
presiding judge of the superior court a final report of its
·findings and recommendations that pertain to county government.

"No later than the 60th day after the discharge of
said grand jury, the board of supervisors shall comment on
the findings and recommendations of a grand jury that pertain
to county government matters under the control of the board
and every elective county officer shall ·report to the board
of supervisors on the findings and recommendations pertaining
to such county officer. All such comments and reports shall
forthwith be submitted to the presiding judge of the superior
court who impaneled the grand jury for the previous calendar
year. A copy thereof shall be placed on file with the
county clerk and shall remain on file in the off ice of the
county clerk."
It would appear that 933 does not require any action
on the part of the Sanitation Districts in that the Districts
are not under the jurisdiction of the board of supervisors.
Likewise, there is no elective county officer who would have
the duty to report on recommendations of the Grand Jury pertain-
ing to County Sanitation Districts.
If the Districts wish to respond to the report made
by the 1972 Grand Jury pertaining to the conduct of the Districts'
affairs, I think such a report should point out that although
consolidation of the Districts into one District is legally
permissible, there is no way to reduce the number of Directors
to 5 or 10 in number.without new legislation.
If such a report is made on behalf of the Sanitation
Districts, it should be submitted to the Presiding Judge of the
Su~erior Court and a copy placed on file with the County Clerk.

If anyone is interested in any more detailed analysis
of the California Grand Jury system, an article in Vol. 43 of
the California Law Review at page 251 devotes 17 pages to tracing
the historical origins and development of the Grand Jury in
California. Emphasis is primarily on the judicial duties of the
Grand Jury which are to investigate and bring to prosecution all
crimes discovered or known about in the county. Perhaps a comment
from the. conclusion of that article would be of benefit:
"The California Grand Jury is endowed with broad
powers as an inquisitorial and judicial body, but it is
enjoined to exercise those powers with mature discretion.
It is not to engage in 'fishing expeditions', that is,
initiate investigations not specifically enjoined upon it

METAI~S IN MUD
The existence of massive heavy
metal deposits at Jeast 1,400 miles
long and 300 miles wide on the South
Pacific Ocean floor has been reported
by Dr. James L. Bischoff of the Uni-
versity of Southern California. The
metals include iron, manganese, cop-
per, zinc, and barium. They are com-
bined in mud below the 12,000-foot
depth in waters between the Galapagos
Islands at the Equator on the no~th
and Easter Island on the south. Evi-
dence of heavy metal deposits in the
South Pacific area was first discovered
in 1966, but the vast extent of the
metal-rich mud was not known until a
recent expedition aboard the Soviet re-
search vcssei Dmitry Mendeleev.
The deposits arc on the flanks of the
East Pacific Rise, a chain of undersea
mountains which nms in a northeast-
erly direction across the South Pacific
and terminates in the Gulf of Califor-
nia. Along this ocean floor ridge, new
crust constantly is being forn .ed by
molten material oozing up fr< '.n the
interior of the earth. Prcsum tL! y, the
metal deposit formation is associated
with this process.
Despite the vast area of the ~cposits,
·mining or extraction of them probably
· will not be economically feasible be-
. cause no one metal is present in suf-
ficiently rich quantity in the mud,
according to Bischoff. The heavy metal
deposits will, .however. be of substan-
tial· and continuing interest to geolo-
gists and other scie•Hists because they
are ~till in the process of formation
and provide a valuable opportunity for
study of the metal formation process.,
Scientists will have an opportunity to:
trace the process in "slow motion," a~·
~
the deposits accumulate at the rate of
about V.. inch per thousand years.
Another area of interest is in the
possible role that the deposits might
have in the regulation of the chemical
composition of seawater. It is thought
that such inorganic processes might
have some influence in maintaining
delicate chS!mical balances that make
the oceans a viable habitat for li'r:ing
organisms.
Soviet expedition chief, Dr. A. P.
Lisitzin, invited Bischoff to plot the
course between Callao, Peru, and Eas-
ter Island, because of his experience in
locating heavy metal deposits. Bischoff
· did so and established close working
relationships with the Russian scien-·
tists in sampling and studying the
samples taken from the ocean floor.

Dear Mr. Lewis:
We appreciate the opportunity to submit a proposal to provide the necessary
consulting architectural services as requi!ed by the Districts to insure
compliance with State and Federal regulations and to coordinate the activities
of the design engineer to produce an aesthetically pleasing facility.
Inasmuch as it is difficult to define accurately the scope of the service at
this time, we agree ·with your recommendation that the compensation for
services shall be on a time and material cost. We propose two methods
of compensation for the above required architectural services on a time and
material cost. One is two and one-half (2. 5) times the direct labor cost of
each person working on_ the pr0ject, to be billed mpnthly. The second 'method
is two and one-half (2. 5) times an hourly rate on a per diem ra.te schedule
per classification, to be billed monthly. The schedule is attached. Other
exp .. enses such as printing, etc., shall be at an actual invoice cost plus a
15% service charge, or as per agreed upon.

We are most interested in being.of service to the County Sanitation District
and are familiar with working under these conditions.
Our firm has been Master Planners for t~e Jet Propulsion Laboratory.for
the.past six· years on ':1-time and material compensation. I have been
assigned as the Supervisil').g Architect for JPL.and have been a member
of the JPL Maste_r Planning Board for the past six years. _Besides being
commissioned to do numerous architectural and engineering projects for
JPL, our firm has done the ~rchitectural design of the following projects

contractor, such as: The Spacecraft Assembly Facility, The Isotope
Thermo-Electric Systems Application Laboratory, The Uninterrupted
Power Plant and the JPL Arroyo-Seco Bridge. The arrangement proved

A Joint Committee, representing the Orange County Employees
Association membership and the Districts' management, was formed during
the 1972 meet and confer sessions on salaries and fringe benefits to
study the feasibility of providing the employees with a prepaid health
care plan as an alternative choice to the existing group health insurance
plan. The basic conceptual diff'erence between the two programs is a·s
f'ollows:
Health Insurance -This plan provides for reimbursement to the
patient for medical and hospitalization expenses, after the
costs have been incurred.
Prepaid Heal th Plan -Commonly refe.rred to as an HMO plan (health
maintenance organization) this approach emphasizes clinical
services wherein the patient receives. his medical attention at
• the organization's clinic or contract hospital. All services are
essentially covered by the monthly premium.
'-"' Early in the Conmuttee's study, it was determined that if an
alternate health care plan were to be provided, it should be at least
comparable to the Districts existin.g group insurance plan.
Four health maintenance organizations were contacted by the
Committee: Kaiser Foundation Health Plan, Inc.; Ross-Loos Medical
Group; Family Health Program, Ir.c.; and California Medical Group, Inc. -We were informed Kaiser Foundati0n is not accepting new groups and has
not written a new contract in this area since 1965. The Ross-Loos
Medical Group was eliminated froill consideration because their closest
hospital racility is Queen of Angels in Los Angeles.
Specifications were prepared outlining the type of program which
was deemed necessary to provide an adequate alternative health plan·
:ror employees and their families. On January 16th~ formal proposals
were received from Family Health Program, Inc. and California Medical
Group, Inc. The committee met on several occasions with representatives
o:r Family Health Program, Inc. and California Medica1·aroup, Inc. to
discuss their, capabilities and fa_cilities, for providing an HMO. plan.
The proposals have been evaluated and re.viewed with the representa-
tives of the repsecti ve organizations. It is .the Committee's recommenda-
tion that the plan submitted by Family Health Program, Inc. be approved
as an alternate group medical program for Districts employees effective
March 1, 1973. Committee members have visited the facilities of FHP in
Fountain Valley and they appear adequate.
There will be no additional cost to the Districts for ·providing this
alternate Health plan; however it will give our employees a choice.

Acceptance of Construction Dewatering by Metropolitan
Water District from Areas Outside District
By the attached letter dated January 26, 1973, the Metropolitan
Water District has requested the Districts acceptance of con-
struction dewatering associated with construction of a feeder
line transmitting state project water to the Diemer Filtration
~lant in Yorba Linda.
Although the Districts have accepted construction ground water,
assuming adequate capacity in the trunk facilities, a portion of
this construction project falls not only out of the District
boundaries, but extends through·Orange County and into Los Angeles
County as well. The attached map, indicating the extent of the
construction project, shows approximately 7500 feet lying north-
easterly of the District No. 2 boundary and extending an
additional 8500 feet ·into the County of Los Angeles.
Their request for acceptance by the Districts has been
precipitated by discharge limitations imposed by the California
·Regional Water Quality Control Board limiting discharge to the
national watercourse to 2000 micromhos. ·Previous geological
exploration indicates conductivities may vary from 1600 to 4400
micromhos which would require N.W.D. to seek alternative methods
of disposal other than the natural watercourse.

We have evaluated the ·capacity in the District No. 2 facilities
to accommodate their projected 150,00Q gallons per day and,
finding sufficient capacity available, it is recommended their
request for a temporary permit be granted ... · This permit would
expire at the completion of the construction project.,
Although the District gallonage charge for construction dewater-
ing has been established at· $250 per million gallons, the
Districts, by contractual agreement with Waste Water Disposal
Company, charge $350 per million gallons for waters originating
out of the District. Consistent with the agreement, it is
~ecommended that Metropolitan Water District also be charged
~350 per million gallons. ·

Metropolitan has construction of its Tonner Tunnel
No. 2 under contract. This tunnel is part of the Yorba Linda
Feeder transmitting State project water to the Robert B. Diemer
Filtration Plant located in the City of Yorba Linda. The tunnel
will be constructed in the Chino Hills southeast of Diamond Bar
in unincoroorated areas of Los Angeles Cuunty, Orange ~ouuty;
and the City of Brea.
Geologic exploration revealed that tunnel construction
will pass through formations containing groundwater with elec-
trical conductivities varying from 1600 to 4350 mi.cromhos. Water
above 2000 micromhos is not acceptable to the Regional Water
Quality Control Board for discharge into the natural watercourse.
Therefore, a temporary permit is requested to discharge this ·water
into your sewer system.
Water so discharged will be free of oil and the turbid-
ity will not exceed 50 J.T.U. Dissolved.sulfides are not expected
in the groundwater, but will be controlled if present.
· Arrangements have been made with the Yorba Linda County
Water District to discharge this groundwater into their sewer
system at Pacific Avenue. Since Yorba Linda discharges its ·
effluent into the Orange County sewer system, it was agreed that
Metropolitan.would obtain the necessary permit and pay fees if
applicable for public.agencies to the Sanitation Districts of
Orange County.

It is anticipated that the rate of flow of groundwater
from the tunnel will increase as excavation progresses. This
flow could average 100 gpm with higher maximum rates occurring
during short periods of time.
The groundwater with less than 2000 ~1icromhos of elec-
trical conductivity will be automatically discharged into the
natural watercourse. The groundwa:ter with greater than.2000
micromhos of electrical conductivity will be automatica'lly
discharged into a 5-acre foot retention basin to permit con-
trolled pumping into the sewer system. The agreement with
Yorba Linda County Water District would permit the pumping of
the 2000 plus micromhos water from the retention basin into
the sewer system at continuous rates not exceeding 100 gpm.
Any discharge in excess of 100 gpm would be coordinated
between Yorba Linda County Water D:Lstrict and Metropolitan
as to the time and rate of discharge.
The present construction schedule indicates that

Metropolitan ·would appreciate issuance of the tempo-
rary permit to discharge groundwater from Tonner Tunnel No. 2

and size. The property owner has requested a zone change to
Commercial. His applicati\:n has been denied by the Planning
Commission and is presently pending before the City Council.
The ·City Council has discussed this matter and if the property
is a~quired by the Sanitation Districts the City is amenable
to entering into a joint powers agreement for maintenance of

those repairs, it is our reconunendation that we work closely with

method of repairs.
Upon approval by you, we would then prepare the final plans and
specifications for the repair of 'the subject pump station.
Since we cannot make an accurate estimate ·of time for this report,
we would request that the pro:ect be completed at an hourly rate
schedule at our normal· rates, with a maximum not to exceed $3000.
If this meets with your appro\al a letter of confirmation will con-

Construction has proceeded to 400-feet northwest of the
Arches and from 500-feet southeast of the Arches to across
. from the Balboa Bay Club. Th~ connection at Bitter Point
· Pump Station is scheduled for the evening of February 8th.
A meeting is scheduled with the State Division of Highways
to request modifications in consi:;ruction proceeding -co
expedite crossing of Pacific Coast Highway at the Balboa.
Bay Club. A request has also been made to the State to
restore on-street parking as soon as possible.
The north offramp at the Arches was. bored for about
12-feet and then open cut due to a sandstone out-cropping.
Pacific Coast Highway was restriped from the Balboa Bay
Club to the Arches prior to work in this area.
Contractor is planning to commence work on the 24-inch· ·
VCP gravity sewer in the vicinity of old Newport
Boulevard later this month.
The road in the oil field was restored to a point where
the Oil Company could shoot it with oil when the rains
came and made a mess out of it. Contractor is currently
waiting for it to dry out.

The Irvine Industrial Complex respectfully requests permission to
construct a portion of the Master Planned Sewer System located in
Jamboree Boulevard from Barranca Road to approximately 1400 feet
southerly.
Since the line will be located within street right of way which will
be fully improved and dedicated to the City of Irvine, an easement
will not be required.
The District's engineers will design, stake, inspect and prepare
the necessary bid documents for the above project, and the Complex
will award the contract, after the District's approval, to the
lowest bidder.
After construction is completed and the final costs have been tabu-
lated, the Complex will request the District prep?re the usual reim-
bursement agreement with the Complex for said improvements.·

In response to your request, we submit the following proposal for engineerin~
services. to prepare plans and specifications and to provide construction staking
for sub iect master plan foci lity.
The proiect will begin approximately 1,080 feet north of Alton Avenue in
Jamboree Boulevard and extend approximately 1,545 feet in Jamboree Boulevard
to Barranca Road. Estimated construction cost is $42, 000. Design oi: the sub-
trunk will conform to the district's standards. The Irvine Industrial (:>mp lex
.will be the contracting agency and wi II let the contract to the lowr-:s! responsi-
ble bidder through public bidding procedures. Specification format will conform
to Irvine Industrial Complex standards.
Our fee for preparing plans and specifications wi II be a lump sum amount of
$2,200. Fief~ surveys will be required in order to prepare the plans and speci-
fications. These surveys include taking topography and culture within the
proiect limits. We· propose that all field ·surveys for design, construction staking,
and as-built conditions,· be performed on a per·diem basis at $54 per hour for a
three-man survey crew, $41 per hour for a twol-man survey crew, and $21 'per
hour for a licensed surveyor.

DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That construction of the Main Street Subtrunk
East, Reaches 41 and 42, Contract No. 7-2C-l; Jamboree Subtrunk No. 1,
Reach 47, Contract No. 7-2C-2; Von Karman Avenue Subtrunk, Contract
No. 7-2C-3; McGaw Avenue Subtrunk, Portion of Reach 49, Contract
No. 7-2D-4; Jamboree Road Subtrunk No. 2, Reach 52, Contract No. 7-2D-5;
and Jamboree Road Subtrunk No. 2, Reach 53, Contract No. 7-2D-6
has been completed.
Section 2. 1rhat by letter, Boyle Engineering, District~~
engineers, have recommended acceptance of said work as having been
completed in accordance with District requirements; and,
Section 3. That the Chief Engineer of the District has
concurred in said engineers' recommendation, which said recommenda-
tion is hereby received and ordered filed; and,
Section 4. That the certain Sewerage Facility Reimbu~sement
Agreement (Master Plan), between County Sanitation District No. 7
and IRVINE INDUSTRIAL COMPLEX, providing for reimbursement by the
District for said facilities is hereby approved and accepted; and,
Section 5. That reimbursement in the total amount of
$329,708.80 as detailed on the attached Exhibit A is hereby authorized
to be made from the Facilities Revolving Fund of th~_District in
accordance with the terms and conditions outlined in said agreement.

are hereby authorized and directed to execute said agreement on behalf

Gentlemen:
Pursuant to my recent correspondence and conversations
with Mr. Ray Lewis of the Orange County Sanitation District
I am hereby requesting on behalf of Mr. Sterling Graydon,
Jr., of 12081 Woodbine Drive, Santa Ana, California, that
. the Orange County Sanitation Distric.t quitclaim to Mr.
Graydon a portion of the sewer easement of his prop-
erty at the above addres~. Until Mr. Graydon recently
opened an escrow to sell this property he was unaware that
a portion of his house_~nd patio slightly encroached upon
your easement. This encroachment caused the sale to be
lost and renders the title unmarketable.
The portion which is requested to be quitclaimed to
Mr. Graydo~ is depicted in yellow on the enclosed topographic
survey of the property, a copy of which was previously
supplied to Ml?.· Lewis on January 15, 1973, and which area
is described in the enclosed legal de·scription. , .
It was my understanding that• this portion of your
easement would be denominated excess land and, because of
th~ nature of its acquisition, would be gratuitqusly quit-
claimed to Mr. Graydon •

DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the certain Quitclaim Deed for portions of
existing District easement relative to sanitary sewers constructed
under Assessment District No. 5 proceedings; dated
from County Sanitation District No. 7 to Sterling Graydon, Jr., be
approved; and,
Section 2. That the real property to be quitclaimed is more
particU;larly described on Exhibit "A" and Exhibit "B" attached hereto

West Relief Trunk Sewer, Contract No. 7-5-lR
Contractor completed installation of the 15-inch VCP Sewer
in Tustin Avenue and Fruit Street. It was decided that
the Contractor would pave over the ~rench on Fruit ~treet
with ·temporary pavement hoping that the ground wi.11 dry .
out so that he can get compaction.
All pipe has been installed on Edinger, however, here
too the Contractor is having difficulty getting his
compaction. The Contractor has been notified. that he
will start no other worJ.· anywhere on the• project until
all the compaction has passed on Edinger and the first
course of permanent pav0 m.ent is placed. Weather has
been only part of the problem with compaction. Con-
tractor is not too responsive to public inconvenience
being created by construction. Barring any more weather
delays, Edinger should be complete in approximately ten

The Board of Directors of County Sanitation District No. 2 of

ARTICLE 1
Ar~icle 2 of Ordinance No. 202 is hereby amended by adding
thereto the following sections:
(o) District Connection Charge. Is a connection charge
imposed by District No. 2 as a charge for the use of District's
sewerage facilities whether such connection is made directly to a
District sewerage facility or to a sewer which ultimately discharges
into a District sewerage facility.
(P) District Sewerage Facility. Shall mean any property
bel~nging to CoWlty Sanitation District No. 2 used in tne treatment,
transportation, or disposal of sewage or industrial wastes • .
(q) Domestic Sewage. Shall mean the liquid and water .. borne
. wastes derived from the ordinary living processes, free from indus-
. trial wastes, and of su~h character as to permit satisfactory
disposal without special treatt'.ent, into the public sewer or by
means of a private disposal system.
(r) Sewera~e Facilities. Are any facilities used in the
collection, transportation, treatment or disposal of sewage and
industrial wastes.

Schedule of Charges. A schedule of charges
specified herein will be on file in the office of
the Secretary of the District and in the Building

Biennial Review of Charges. At the end of two
y~ars from the effective date of this ordinance, and
every two.years thereafter, the Board of Directors
shall reyiew the charges established by.this article
and if in its judgment such charges require modifi-
cation, an amendment to this ordinance will be adopted
establishing such moqification.
ARTICLE 3
Section (b) of Article 6 of Ordinance No. 202 is amended by
adding ther~to Section (3) to read as follows:
(3) When an excess capacity connection charge is
payable by a user, as hereinabove provided, a credit
equal to the connection charge paid by the user, if
.any, shall be allowed against such excess capacity
connection charge.
ARTICLE 4
Except as herein amended, Ordinance No. 202 is ratified, re-

SUBJECT: Request for Authorization to Issue Change Order
Santa Ana River Interceptor, Contract No. 2-14-1
On February 6th, District's personnel observed the under-
mining of the Olive Subtrunk crossing of the Santa Ana
River southerly of Katella Avenue. Attached with this memo
is a sketch showing the conditions as observed. A similar
cuudl i...lu11 uecu.rred '-m the Orange Subtrunk and remedial ,
repairs were made in the Fall of 1970 to avoid damage to ·the
pipe by debris and waters in the Santa Ana River. The cost
:for this remedial Nork on the Orange Subtrunk in 1970 was
approximately $9,500.
To eliminate the potential of' damage to the Oliv.e Subtrunk,
I am hereby requesting the authority to issue a change ord~r
to the Sully-Miller Contracting Company who can perform this
emergency repair. A change order, if authorized, would be
written on a time and material basis not to exce-ed a maximwn
of" $11,000. Attached is a sketch showing the contemplated ·
emergency remedial work as required. ·

SqBJECT: Santa Ana River Interceptor, Project No. 2-14-1
Work on this project has progressed from just north of
Seventeenth Street to 4,ooo feet north along the Flood Control
District's levee in the golf course. Due to inclement weather
the Contractor is unable to maintain his schedule through the
golf course. Has been shut down .for· six days because of rain.
• A new schedule has been submitted. The 84-inch RCP will start
north of Harbor and proceed northerly about March 1st. When
the 84-inch is completed to Fairview, work will conunence at
Plant No. 1 proceeding north to Harbor. This phase is .
scheduled for August to December 1973 with the project being
essentially completed by January 1, 1974.
There are still prqblems with pipe deliveries due to delays
in production. The pilot tunnel under Seventeenth Street is
complete and the invert haB been poured. Lsndscaping oper-
ations are progressing sat.i.sfac~orily.

SUBJECT: Knott Interceptor Sewer, Contract· No. 3-17
Work has progressed on Magnolia nearly to Slater. The intersection
of Talber~ and Magnolia has been paved and is open in all four
directions: Traffic on Magnolia is limited to two lanes, one in
each direction, from just south of Talbe.rt to Slater. . The vent. line
at Bushard and Ellis is complete and final paving of Ellis and
Bushard should take place soon.
~ The Contractor is having difficulty getting his compaction on
Magnolia due to the.amount of rain during the month of January and
early February. Backfill may have to be removed and replaced to
achieve required compaction. ·
There is still some complaining by the homeowners in Greenbrook. The
Contractor has been making an effort to alleviate these by keeping
his operation 100-feet·or more from the walls of the s~bdivision.·
There has been little or no dust due to the weather a~~ the
Contractor's watering during the drier periods.
Work on the crossing of the Miller-Holder Trunk·is complete. The
Knott Interceptor encroaches into the existing 72-inch ~iiller-Holder
Sewer approximately two feet because of grade restrictions. Work.
was done in two stages, preparation and the actual crossing itself.
The preparation was started early in January with.the excavation and
shoring of the pit .. A cradle was constructed under the existing
72-inch RCP sewer up to spring line •. The 72-inch was t~en cut down
through the concrete to the PVC liner, which remained intact, and
the con,cretie removed. After the concrete of the 72-inch pipe was
shaped properly and expansion material placed, the PVC liner was
cut, laid back and heat welded to the new 96-inch pipe. More PVC
was heat welded to it and the section of 96-inch RCP was set in the
opening on shims and the PVC liner welded to the PVC on the outside
of this section of pipe. Then the 96-inch RCP was cradled in con-
\_,/ crete.
Work at the Oceanview Channel at Newland and Arnett is progressing.
The manholes are set and part of the pit has been backfilled. The
transitions are being formed. Excavation to be backfilled to two
small pits, approximately 15'xl5' by February 15, 1973.

SUBJECT: Alignment of Knott Interceptor; Reach 4, Contrac·t No. 3-18
Attached herewith is a memo from Mr. Conrad Hohener of Boyle
Engineering regarding the establishment of the alignment for
Reach 4 of the Knott Interceptor Trunk Sewer.
In a recent conversation with Mr. Marty Carver, Right-of-way
Manager for the Southern California Edison Company, he reiterated
the comments stated in Mr. Hohener 1 s letter and felt that compen-
sation to 1he Edison Company would definitely be a requirement of
acquisition. The precedent has been established by the Orange
0oun~y ~Loou Control District in establishing tne right-oi-way for
the Westmins·ter Channel through the Edison Company 1 s ~roperty··. · He
stated that the evaluation of the Edison property is ~36,000 per
acre.
In recent meetings with representatives of the pipe industry in
establishing construction schedules for Districts• contracts now
under construction, it became apparent that this pro.ject should be
advertised for bids as soon as possible. The Metropolitan Water
District, Los Angeles County Flood Control District and the City of
Los Angeles have proposed projects which will be in competition with
the pipe requirements for this project. Some of the difficulties
in scheduling the Santa Ana River Project and the present contract
for the Knott Interceptor are due to pipe deliveries to the contractors. . .
Although the staff c~siders the ·original alignment, as presented to
the Board, as the most preferable al.ignment because of the elimination
of sewer siphons, it mignt be in order to propose, for the Boards'
consideration, an alignment which would avoid construction on Main
·street easterl~ of Chestnut Street and also avoid acquisiti~ri of
right-of-way from Southern California Edison Company. I suggest an
alignment proceeding northerly in Hoover Street from Bolsa Ave. to Hazard

imperat.ive that the alignment be established in order that the
design engineer can complete the plans and the project can be
advertised. Continued delays not only increase the cost of the
project, but, I am ~urc, will jeopardize tha progres3 during

~ince the board of directors meeting of January 10, 1973, I have talked with
'two Edison Company officials several times regarding the status of the proposed
PnsemP.nt across their property in the city of Westminster for the subiP.ct prn!P.ct.
You will recall I reported to the directors that Mr. William Compton, Area
Manager for Edison, had told me Edison would have a decision on the right-of-
way request within a week. On January 17, I called Mr. Compton and was
informed that a decision had not been reached because they were still waiting
for their Substation Design Department to report on the matter. Mr. Compton
asked that in the future we contact Mr. Marty Carver, Right-of-way Manager,
since the final decision would be made by his office. After repeated calls and
leaving my name with his secretary, I finally contacted Mr. Carver on January 23.
He informed me that they sti 11 had not received comments from Substation Design.
He stated that in his opinion, since this was a· permanent easement reques~, it was
un.likely that a favorable decision would be reached in that the property already
was greatly encumbered, especially with the new flood control channe I right-of-·
way across the northerly end of the property. He cited various other reasons why
Edison does not parHcularly like this kind ·of encroachment on their property.
Mr. Carver asked me if the district expected to get the easement at no expense,
providing it was approved by the various Edison departments, and I said yes·. I
told him that I thought this was the circumstance under which Edison was

approached by the city of Westminster. Mr. Carver then told me that under no
circumstances does the Southern California Edison Company grant easements of
this type without reimbursement. He said the Orange County Flood Control
District had purchased the easement for realignment of Westminster channel.
At this point I dropped the conversation, since I had no authority from the
board or the staff to discuss possible easement charges, and asked Mr. Carver
· to call me as soon as he had heard from Substation Design. Since this ·C~n
versotion on January 23 with Mr. Carver, I have called him several .times.
Each time he has been out and I have asked his secretary to have him call me
back. As of th is date I have not heard from Mr. Carver.
Last week we checked with the Flood Centro I District staff on the construction
schedule for the Westminster channe I. They have received bids, are about to
award the contract pending the clearing up of a few right-of-way problems,
and expect to start construction within a month. In the design of Contract
No. 3-18, we had worked out a cooperative construction schedule with the
Flood Control District on the Route B ali£mment. On Hoover Street,, we hod
proposed to insta!I savcrol secf'ions of pipe which would cross under the new.
flood control construction. Considerable savings could be incurred since this
would eliminate tunneling or tearing out the flood control works in the future
to build the pipeline. With the sanitation district's schedule being. delayed as
much as it has been, we may not be able to work out similar arrangements on
the new alignment that is fi na lfy dee ided upon.

V the early part of March. Finnell then asked for the Directors ' approval

mocion was seconded and carried . Duke asked abou t what the tri p would cost
and if the Districts wou l d be paying for the trip, and Finnell answered
the Districts would pay the cost of the air far e and expenses .

Six-hour session . Are three major areas concerned for municipalities
and for the Stat8 in implementing the regulations being put together by
EPA. One thing that came out of meeting from Mr . Cahill was regarding
definition of secondary treatment that EPA published l ast Friday (haven 't
seen yet) includes 85% BOD removal; are talking about activated sludge .
Mentioned letter in Directors ' folders from EPA and said the r eason this
memorandum was prepared was because of the efforts of the Districts when
Finnell and FA H went to Washington the early part of December . During
discussion with Mr . Sansom gave him copies of th e statements of Con gressman
Johnson out of Congressional Record with specific reference made to that
which denies this is what the law meant. In disc ussion with EPA people
last week they are in agreement with our position that 85 % BOD removal
is not significant for ocean discharge . Say tl1eir hands are tied because
of way Congress passed the law. One comment was that for ocean dischargers,
th ey are going to put these requirements on the "back burner ." EPA is
making a new "Needs" survey. Contacting dischargers through state and
regional offices for updated numbers for construction of facilities to
reach the lev el of tre atment of 85% BOD. We have been using $10 5 mil l ion
for next five years . Now will probably have to add $20 million to that
figure. Think we have a lot of support at State level and regional l evel
of EPA and am sure we can pick up support from othe~ agencies on th e coast.
Appear s that we are go ing to have to go back to PubJ_ic Works Committ ee in
House and Senate and ge t something changed in this area . Once Needs Survey
is complete d a nd EPA has the numbers, think we c an talk in pretty good terms .
Will prepare some i~forrnation for thos e that are going to Wash ington next
month and will g;Lve them the name and telephone number of attorney for AM~A
(Le e White) who will help Directors in any way h e can . AMSA people have

that when spe akjng of secondarytreatment, they are taking literal interpreta-
tion of what it stat es in the law and EPA administrators have def i ned what
definition of seconda ry t reatment wil l be to everyone in U.S . First
definition approached tertiary· treatment but was c hanged from that . Back
to original concept of 85% BOD removal . The fact that we are asking for
waiver of the 85% BOD remov al is becau s e of what was published by EPA and
Federal Regis ter to allow exce ption on this . The Chairman of the State
Board spoke at me eting in San Diego and said costs for Ocean Plan are going
to be $400 -$7 00 million and if they go to 85% BOD removal , will go to
over $1-l/2bil lion .
#7 -Report of the General Counse l
Regarding Norman Tremblay against Districts, court's decision a llows them
to collect overtime accrue d from December 1, 1966 to October 1, 1 970 which
is $2,974.30. The reason they allowed thi s recovery was because in 1 966
the Districts adopt ed two resolutions which said no compensation f or
overtime in one se ction and then in another section it leads to uncerta-inty
with regard to de ath. No compensation for overtime from October 1 963 until
Dec ember 1966 . Al s o awarded a refund of $600 which had been withheld
be cause o f di~ability paid. Wasn't any particular r esolution governing this .

Regarding SB 889 (B ill to try to clean up the Environm e ntal Quality Act),
are to put study on for 120 days. Some of the highlights of this legislature
is that there are g uidelines that are suppose to be put out through
Resourc es· Agency of the State . Due February 1st put not o ut yet. When
we get tho se, will have guidelines with which to set up our rules and

Regar ding SB 90 (Bi ll that limits the tax rate), th e Districts wi ll be
limit e d to the tax rates i n effect for 1972-73 for the ir maximum . Are
exce ptions to tha t and ways to get some relief. One feature which Districts
will be lookin g forward to is reimbursement for mandated acts enacted after
January 1, 1973. Language in Bill quite uncertain . Effective date for
l egislation enacted in l ast legislature is Ma rch 7th. Some of the admini -
strative interpretation wo uld indicate that they int end to try io avoid
Stat e fundi ng of this typ e o f activity . Anticipate substantial problem.
Chairman o f thi& comm ittee is Peggy McG illigott(?) and is on a special
commi ttee to re solve uncertaint ie s of SB 90 . Wi ll try to get an amendment

we could win in court if we have to . Will be an amendment passed by this
le gislature affect ing SB 90 as it is now. One of the things to be aware
of if any inc rea sed l eve l of service is required, ~e must submit claims
for reimbursement to th e State within 45 days after the effective dat e .
Staff will b e looking to see if there is any extra costs involved to the
Districts by new l aws and must get them in .to the State . After the first
year, claims wjll be fi led annually on October 31 st .

Ray Lewis report ed that some of th e pro blems encountered h ave resulted
because of some of the requirements imposed by encroachment permi t of
Stat e Division of Highways. No parking on so uth side of highway unti l
street improv ements are done . Because of inc onvenience to merchants,
have approached Divis ion of Highways to be gin parking again but they
said it will cost Districts about $5,500 to go a h e ad \·lith partial restriping .
Lewis s a id in his op inion this was not an investment the District should
go into at thi s time as contractor shou ld be out of the highway in a very
short period of time . State is proceeding with their construction and
should have it completed by June 1 st . Appro ached State in s h ar ing this
cost and it is no t accept ab le to Divi si on of Highways. Mot ion was made

north and east changed configuration and if we had them i n Mas ter Plan .

Conrad Ho hener reported that he re ceived a call from Southern Califor11ia
Edison Comp any and they informed him that Edison had den i ed the Districts
request t o obtain easement across property . The princ ipa l reason being
that property was heavily encumbered which would cau se th em prob lems in
t h e new sub stat i on b eing built on their property. Un der no circumstances
wou l d they approve easement even i f we Hould p urchase it . Mr . Hohener
said as far as condemning the property , wou ld have to go t hrough Pub l ic
Utilities Commissi o n and wo uld entai l a l ong proc ed ure . Sugge sted t hat
District s go a long with Alternative 2 subjec t to being able to wo r k
out construction s ch ed ul e with OCFCD where re -ali gning channel . If this
could not b e wo rke d out, would consider Alternative 3, c ontingent with
City of West minster approval ; and if this could not be wo rked out , would
go to Alternative 4 . Re commend either 2 , 3 or 4, or a comb in at ion th ereof .
Would probably take about a week to get a ll parties toge ther and g et
tentative agreements, and then would immediately final ize the plan s
wh ic h wou l d take a bout six weeks .

Questions was asked since we are now back a lmos t to or i g inal plan, what

Route B or Alternative 1 because of ro uting through several block s of
r esidential area on easterly side of Main Street. At that time we o nly
submitted Routes A, B , & C and h ave not seen thes e other alternatives .
Have not discussed with City Council whether they wou l d go along with
westerly s id e of Ma i n Street. Would pro bab ly go along with gree n r oute
on map .
McWhinne y stated he thought we shoul d r econs ider cheapes t route .
Nisson restated that you don't have to have City's approval . Submit it
to them and if they deny it, can try to wo rk with them or take actions
necessary .
Comment wa s made that we didn 't worry about Hunt;ington Be ach , so why worry
about Westminster, and McWhinn ey added that since we have been wo rry ing
about mo n ey, why not save her,e .
Finnell announced that they were ready for a motiori to adopt Ro ute B.
Th e motion was made and seconded .
Culver re minded Directors that the reason Mr . Hohener had stayed awa y
from Route B was because City of Westminster and citizens gave us so much
opposition and if we run into a stone wall on this, wi ll delay it longer ;.
Finne ll then stated that if they moved to go ahead on Route B , General
Counsel would have to do the same thing as wit h Huntington Beach .

Scott commented that it was true that they will have problems with citiz ens
but have had prob lems in Fountain Valley a lso.
Voted on motion approving Route B and carried.
Finnell stated t his was certainly no t an arbitrary decision by the Directors
and had really attempted to work something out . The effort of the Directors
was commendable .
Ni sson recommended that in order not to delay work, that the General
Counse l be authorized to institute a suit , if nec essary, to allow Di s trict
to move ahead o n Route B. This was made into a motion , seconded and
carried.

across their right of way i n connection with construction of the
Knott Interc eptor, Reach 4, Contract No . 3-1 8 through the Ci ty
of Westminst er. Mr. Hohene r then reviewed the several alternative
routes for the project which have been considered.
~he Board then entered int o a lengthy discussion concerninK
Route B which had o riginall y been recommended by the engineers ,
but recon sidered by the Board at the. request of the City of
Westminster . Several Directors expr essed their co ncern ove r possib le
further delays of the ur ge ntly needed fac ility and that inasmu ch
as · attempts to work out a r ea li gnment of the interceptor thro ~g h
the City of Westminster had proven unsuccessful, that Route B
be adopted as the best and most economic a l alignment.
Following further discussion, it was moved, seconded and duly
carried that Route B for the Knott Interceptor, Reach 4, Contract -
No. 3-18, be adopted ; and ,
FURTHER MOVED : That in the e v ent necessary permit~ required for
the cons truction of said interceptor are not issued by the City
of Westminster or other jurisdictional a ge nc i es, th e General
Counsel be authorized to take necessary l egal action to allow
the Distri ct to p roceed with con struction of the Knott Interceptor ,
Reach 4, Contract No . 3-18, in accordance with the adopted
alignment.
