On March 9th bids were opened for the Knott -Ellis Interceptor,
Contract No. 3-17. The State Water Resources Control Board certified
t he grant application on April 17; however , we have not yet recei~ed the
grant offer from the Environmental Protection Agency (EPA). The total
contrac t is $5,755,480 . The grant on this contract amounts to $222 ,000 .
On April 12th the Board authorized the award of the contract, the
date of which, based on the contract specifications·, will be May 23rd .
Recently we were advised that the federal regulations. have been modified
and we will not receive a grant if we award a contract prior to receipt
of a formal grant offer from the EPA . Since it is doubtful that a grant
offer will be received before May 23rd , it is the staff's recommendation
that we be authorized to date the contract June 30th which should allow
sufficient time for the grant offer to be received.
The contractor is anxious to proceed with the project, as he bid
the job expecting to take advantage of the dry weather . If we can
present a signed , dated contract to the contractor, he will then be in
a position to order the large diameter pipe for the project which requires
approximately three months delivery time . ·
As of this writing, our General Counse l is reviewing the legal
aspects of this recommended action . Al so, we have asked for a special
meeting with the representatives of the state and federal grant programs
to possibly expedite the grant offer or to obtain additional information
concerning this situation.

NOTICE TO AGENCIES SEEKING CLEAN WATER GRANTS
The following information is important and applies to all
municipalities, districts, counties, state and other governmental
agencies seeking 800/o grants pursuant to the Clean Water Bond Law
of 1970 and the Federal Water Pollution Control Act.
Item 1
Current existing federal law does not provide for "reimbursable
grants". Reimbursable grants are grants offered to-an agency after
initiation of construction. Provisions of federal law making such
grants available terminated on July 1, 1971. Our notice dated
March 22, 1972, described the problem in detail and suggested a
remedy which would. require action by the U.S. Congress. Any remedy
enacted by Congress, however, is not expected to extend the reimburse-
ment provision beyond June 30, 1972. Therefore, agencies who award
construction contrac~s without first havin received formal a roval
from oth the State and the Environmental Protection Agency will not
be eligible for any Clean Water grant assistance.
Item 2
It is highly probable that amendments to the Federal Water Pollution
Control Act now being considered by Congress will require that before
plans and specifications can be approved:
"that no specification for bids in connection with
such works shall be written in such a manner as to
contain proprietary, exclusionary, or disriminatory
requirements other than those based on performance,
unless such requirements are necessary to test or
demonstrate a specific thing or to provide for
necessary interchangeability of parts and·equipment,
or at least two brand names or trade names of
comparable quality or utility are listed and are
followed by the words 'or equal'."
In order to avoid costly delays in obtaining plans and specifications
approval, applicants are cautioned to anticipate this requirement and
henceforth only submit specifications which comply with the letter
and the spirit of this requirement.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
COUNTY SANITATION DISTRICT NO. 2, OF ORANGE
COUNTY, CALIFORNIA, AUTHORIZING THE
INITIATION OF PROCEEDINGS TO ANNEX TERRITORY
TO THE DISTRICT ( ANNEXATION NO. 6 -ANAHEIM

WHEREAS, the City of Anaheim has requested annexation of
app~oximately 312.35 acres of territory to County Sanitation Dist~ict
No. 2 by means of a letter dated March 6, 1972, received and filed
by the Board of Directors on April 12, 1972; and,
WHEREAS, as Anaheim Hills, Inc. and Texaco Ventures, Inc. have
requested annexation of approximately 1,024.89 acres of territory
to County Sanitation District No. 2 by means of a letter dated
April 3, 1972, received and filed by the Board of Directors on
April 12, 1972.
NOW, THEREFORE, the Board of Directors of County Sanitation
District No. 2, of Orange County, California,, does resolve, determine
and order:
That an application for annexation of territory to itself be
made to the Local Agency Formation Commission as follows:
Section 1. That this proposal is made pursuant to Division l
(District Reorganization Act of 1965) of Title 6 of the Government
Code of the State of California; and,
Section 2. That this application is for the purpose of annexing
1,337.24 acres as requested by the owners of said property; and,
Section 3. That the territory to be annexed in uninhabited;
and,
Section 4. That said territory.requested to be annexed by the
City of Anaheim and Anaheim Hills, Inc., and Texaco Ventures, Inc. can be
most expeditiously annexed by combining into one proceeding to be
designated "Armexation No. 6 -.Ana.heim Hills Annexation No. 1, the

boundaries of i.·1hich are mere partic'J.la:r:ly described and
delineated on Exhibit "A" and Exhibit 11 B11

The City of Anaheim desires to annex to Orange County Sanitation
District #2 the property described in the enclosed legal
descriptions. The legals describe the City's Anaheim Hills
Golf Course and Walnut Canyon Reservoir comprising about 300
acres.of the former Nahl Ranch.
With the exception of the club house on the golf course, this
land will not need sewer service. Therefore, we request
consideration of the Board of Directors that annexation fees
be waived with the exception of the club house and parking
lot. This area is approximately 4 acres.
The City of Anaheim is endeavoring to create a green belt area
in this portion of· Santa Ana Canyon. If these areas are to be
preserved, government agencies should cooperate so that undue
financial burdens are not placed on the taxpayers.

Subject: Request For Annexation Into Sanitation

Gentlemen:
On behalf of Anaheim Hills Inc., and Texaco Ventures, Inc., I respectfully
submit to you this request for annexation into Sanitation District Number
Two for 1021f. 89 acres of l.:ind as described in the map and legal description
attached. Also, enclosed is a check in the amount of $325 to cover the orig-
inal application fee. Anaheim Hills is presently developing on part of the
former Nohl Ranch. During this first phase of annexation, we are requesting
annexation into the district for that portion of the An~heim Hills project
for which more specific plans of development are now being prepared. I would
like to draw your attention to the fact that within the annexation area there
presently exists three easements which prevent any development from occurring
on these three areas. He therefore, request that the acre fee for these un-
developable easements be waived although they will be enclosed in the total
annexation area. These easements are as follows: Four Corners Pipeline, Me-
tropolitan Water Distric·t and Southern California Edison. This amounts to a.
total of 19.15 acres •.
We understand that the present annexation fee per acre into Sanitation District
Number Two is $369. Because of the large area of land requested in this annex-
ation, we respectfully request another payment method of these fees. We have
discussed this matter with members of your staff and have been advised that we
may proceed by placing our total a~ount of fees on our taxes and prorate them
over a five year period of time in five equal encrements.

1n followup to the conversation between Mr. Schlange, Mr.
Harper, and Mr. John Nelson on April 13, 1972 in Sacramento,
it is our understanding that Orange County Sanitation Districts
is issuing an addendum extendin~ the bid award date to 120
days after receipt of bids for the Orange County Santa Ana
River Interceptor, Reach One, to allow as much time as possible
for the acquisition of grant funds.
Our current contracts indicate that this District may withdraw
from the Interceptor and Waste Water Treatment Capacity Con-
tracts to the date of bid opening only. It would be appreciated
if that withdrawal period could be extended, conditioned only
on the fact that the grant offer would not be forthcoming,
to 10 days prior to the contemplated award date.

The primary reason f o r the s chedu led adj o urned ~ee t ing of the
Distri ct Board is to consider further the requests of the City o f
Anaheim and the firm of Anaheim Hills , T11c., to annex approximately
1,337 acres in the Santa Ana Canyon area to the Distr ict. D..:t r i n g the
Board discussion on April 12th, two concerns were expressed: (1 ) Is
t here adequate capacity in the District's trunk sys tem to accept
developme nt presently outside the District without restricting deve l op-
ment of areas within the Distric t ; and (2) is the curr ent annexati on
fee equitable?
As of this date we have not received specific.information
c oncerning the propos e d developme n t of the area requested to be annexed
by Anahej_m Hills, In c. Therefore, this matter may be deferred to the
May 10th meetin g of the Board .
With regard to the annexation fees, the staff has i ncluded for
t he Directors' information a summary of the cur:cent annexat:i.on and
connection charges for all of the Districts . District No . 2 's c urrent
atJ.nexation fee is $369 per acre which j_s based on a 1965 estimate of
t runk sewer facilities to serve annexable territory. This fee is
escalated annually on the basis of rising construction costs . If the
Board wishes to consider adopting a charge for annexation simil a r to
that currently in effect in District No . 3 , which is the net worth of
the District per acre plus $1 50, the annexation fee would be $576 per
acre. The reasoning for adding $1 50 per acre to the .net Horth of the .
Dist r ic t per acre is to add some equal izing char ge to adjust to present
day va l ues . Th e $150 figu re was a r bitrarily sel ected .
I n addition to the afo rementioned matters, the agenda for the
meeting will contain othe r items of business which are presentl y
p ending .
