faciliti e s to both locations "A" and "B" as s hown on the area maps . Th re e
(3 ) ali g nm e nt" s tudie s have been made with the portions s h ade d in "ye llow"
d e linea ting th e area s that wo uld be exclud ed from se rvic e via g ravity flow
sewe r s .
Th e city i s propo s ing to construct Rout e 1 at an estimated cost of
$220,000.00. The estimated cost for Route 2 is $408,000.00 and a t the pre -
sent tim e , th ere h as b een no est imate prepare d for Route 3 . We ·a re asking
the Di s tri ct's c onun ents as to wh e t he r thi s fac i l ity would eventua lly be in-
cluded und e r the Di s tr1.ct's jurisdiction whe n the Di s trict b oundaries a re
revised. As th e fina l d esign progresses, we will be coordinating all line
sizing and final p lan preparation wi th your office .

OF TERRITORY TO THE DISTRICT "PROPOSED
CHAPMAN EAST ANNEXATION TO COUNTY SANITATION
DISTRICT NO. 7"

The Board of Directors of County Sanitation District No. 7,
of Orange County, California,
DOES HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That application has heretofore been made to
the Local Agency Fonnation Commission for annexation of territory
to County Sanitation District No. 7, ~Y means of a petition filed

with said Corrunission by the property owner; and,
Section 2. That the designation assigned by said Commission
to the territory proposed to be annexed is "Proposed Chapman East
Annexation -Annexation No. 25", the exterior boundaries of which are
described on Exhibit "A" and shown on Exhibit "B" attached hereto and
by reference made a part of this resolution; and,
Section 3. That the territory hereinbefore referred to is
uninhabited; and,
Section 4. That the reason for annexing said territory is
to provide public sanitary sewer service to said territory; and,
Section 5. That annexation fees in.the amount of $3,512.88
have been received; and,
Section 6. That, as. authorized by resolution of the Local
Agency Formation Corrunission pursuant to Division 1 (District
Reorganization Act of 1965) of Title 6 of the Government Code, Section
56261, the territory herinbefore referred to and described hereinabove,
be and it is hereby ordered annexed to County .sanitation District
No. 7.

Subject: Notification of Intention to Amend Ordinance No. 711
County Sanitation District No. 7
In accordance with Ordinance No. 711, Article 18, this letter
will constitute your formal notification of the intention of
the County Sanitation District No. 7 Board of Directors to
consider an amendment to said Ordlnance.
In this regard, the Board of Directors of Orange County Sanitation
District No. 7 will consider, on April 12, 1972, adoption of
Ordinance No. 715. ~he principal· change will be an increase in
the fee for multiple dwellings to the maximum charge under
Ordinance No. 712 of $250 per unit. Also included in this amend-
ment is a clarification indicating that hotels and motels will be
classified as "commercia.l or inclustrial" and subject to the
applicable rates for that category.
Any comments on the proposed change should be directed to
Mr. Robert Webber, Chief of the Industrial and Permit Division,
540-2910, prior to April 1, 1972.

Subject: MODIFICATION OF ARTICLE 18, DISTRICT'S UNIFORM
CONNECTION AND USE ORDINANCE
During the March 8th Joint Boards Meeting it was suggested
that in conjunction with the escalation of District No. 7
connection charges the Uniform Connection and Use Ordinance
be also amended, thereby eliminating the required notification
to industrial waste discharge permittees of proposed Ordinance
amendments· ..
As you will recall, during the formation of the Connection and
Use Ordinance this provision was requested by industry with
specific reference to modification in use charges or in discharge
requirements that would significantly effect their operation.
It was industries feeling that should modifications to the
Ordinance be contemplated by the Districts, they should be given
the opportunity to review and possibl~ comffient on the proposed
revisions. As this appears to be a reasonable request, I feel
the elimination of this provision may damage the excellent
rapport the Districts currently enjoy with the business
community.

Item No. 5 -Proposed Sewerage Facilities f or the Orange Park ·-
Acres area.
The staff h as b een revi ewing the three alternate a lignments
propose d by the Ci ty of Orange for construction of sewerage
facil i ties to serve portions of the Orange Park Acres area within
the Ci ty. Before Tuesday 1 s s chedul ed Board meeting the staff and
engineers will have a meeting wi th staff personnel from the City
to agree on the desired alignment which wil l provide the best
service to the are a a t the least cost . The staff will be prepared
to review the ma tte r in depth at the meeting .
Item No . 6 -Proposed Chapman East Annexation (Anne xation No . 25).
This proposed annexation to District has been approved by the
Local Agency F ormation Commission and the annexat i on fees
authorize d by the Boa.rd for this annexation have been rece i ved .
Resolution No. 72 -41 -7 ordering the annexation of territory to
the Di strict is recommended by the staff for approval .

Many of you have been anxiously awaiting the final determi-
nation by the Cost of Living Council regarding the exemption
of charges and fees for water and sewage disposal services
by the federal, state, and local governments.
Attached are new exemptions effective January 26, 1972,
which reflect changes in the 1971 amendments of the
Economic Stabilization Act.
Please note that you may now implement new or increased
sewer user charges in connection with your Revenue
Program since such adjustments are clearly exempt from
economic stabilization controls.

During the ffionths of January .and. February, 1972, the Orange County Heal th Dcpartr..~n t
conducted a survey of individual sewage system conditions in Orange· Park Acres, an
unincorporated area of Orange County. The" survey consisted of personal inte=viH:s
vith residents, field observations and a review of.all available individual se~age
disposal pumping records, soil maps, well logs and both chemical and bacteriological
sampling of dowestic well .water and suspected sewage overflows. The findings of the
survey are suJ' . ..-narized as follows:
I. A review of geological information of the Orange Park Acres area indicates
that sub-surfaci soils are variabl~ in composition. As a result, the
percolative capacity of the sub-soils varies from one sub area to anothe=,
ranging fro~ very poor in 65% of the area, marginal in 30% and good in 5%.
2. In so~e ·sections of the area, the variable surface topography adds to the
p~oblem of poor soil infiltration characteristics, naking these areas
entirely unsuitable for the disposal of sewage effl~ent.
' 3. Reports from ·corr:!ilercial sewage pumpers, submitted to the Health Departoer.t,
show that during the past three (3) years, fifty (SO) systems have be~n
pumped, with seven (7) of these requiring two or more pumpings withi~ a
period of one _hundred twenty (120) days.
~ 4. Interviews ~i th 143 of the 300 homeoKners in the area indicate a sys t2r:;
· failure rate of 16% over the nost recent five year period. Also, 29% of

'CONCLUSION AND RECm~IENDATIO~:s: . .
Orange Park Acres area is gcnerdly not well sui~ed for disposal of sewage by indivi-
dual systc~ns •. This is evidenced by the recent history of disposal system failures
and the very low soil infi 1 tr..:i tion ra tcs exhibi tcd in 657~ of the area. Since r.iuch
of the developed and dcvclop.:=.ble land lies within this area> · ~ t is our opinion. th~ t
sc1?agc clispo~;al system failu;:-cs will continue, even ff no further dcvclop;ncnt occurs,
and wi.11 increase in frc_qucncy in _proportion with future devclopr.1en t.
It is, therefore, recom~endcd that the necessary steps be initiated to provide alter-
nate raeans of sewage disposal in the areas of poor infiltration characteristics. The
m.os t obvious alternative is» ,of course, to provide sanitary sewers. However, if
expense is no object, elabor2tc, well-engineered individual systems, utilizing adva~ced
techniques suck as soil replacement and evapo-transp~ration, might possibly function
in such areas. The chances of success are not too great.

~~he community of Orange Park Acres northern boundary begins at the western portion
=~f the Sully-Miller sand and gravel operation and follows Santiago Creek to Villa
~P~rk-Dara. Thc'eastern boundary begins at Villa Par~ bam and cqntinucs south through
:the Villa Park D~m Regioaal Park site to Chapman Avenue. The southern bou~dnry
proceeds west along Chapoan Avenue to Newport Avenue, southeast'. along Newport Avenue,

In 19.29;·:a deep water well was drilled near Santiago Creek i11 T4S, R9W, Section 27,
and the Orange Park Acres ~futual W?-ter Company was fonr.ed to serve the area. With
water pip~d in, Orange Park Acres was divided into ~arcels of land for orc~ards;
Homes were· esta~lished in··same of the groves; · · --· · ----
In the late 1940's and early 19SO's, chicken ranchers began to establish operations in
the area-that threatened the continued existence of the pastoral setting.· -·As a result,
residents· in the late 1950's, working in_conjunc~ion with established poultrymen,
obtained oae acre minimura lots (there are some one-half acre lots), single faQily
residence· zoning in most of the area to maintain a desirable bala~ce between residen-
tial and ranching activities in the community (Ord. No. 685, passed by the Board of
Supervis~rs on March 9, 1954, designated the area E4-l a~re minioum lots).
The number of residents doubled in the decade of the late 1960's. At the present tine,
there are approximately 300 families living in the area. Currently, twelve :(12) ne•,.,
homes are under construction in the area. Nany owners are subd.ividin.g their land and
offering one, two, and three acre parcels for sale. --:-·.·----
Since ~ost lots in the area are large (one acr~), the Orange County Department of
:~~ildinz. and Safety does not require that percolation tests or soil borings be r:1ade ·
in advance ·of construction of individual se\}age disposal sys ter.is.. The "rule of thu.-:ib"
~ :applied is a septic.tank plus one seepage pit per bedroom. In other words, it is
:assumed that a leaching area can be depended.upon to dispo~e of sewage effluent
regardless of the physical proP.erties of the soil. ,

BRIEF:
·Gentlemen:
The Health Officer recommends that Condition of Approval No. 1,
on Division of Land No. 1323, Revised -Brock; be upheld, with
possible consideration of an alternative as prcsepted in the Health
Department report dated February 25, 197,2.
On January 12, 1972, your Honorable Board heard a_n -~ppeal from Mr. Norman Brock
._regarding Condition of Approval No. 1 imposed by. the Planning Commission on
Division of Larid No. 1323, Revised. This condition involved sewage disposal,
and was based on a·recornmendation of the Health Department. At the request of
the applicant you continued the hearing to March 8,. 1972. Mr. Brock also requested
this Department to restudy the matter in the interim and report our findings and
. r.ecommendations to you.
Subsequently, we were asked by the Planning Department to study the question of
sewage disposal in all ot Orange Park Acres as-part of a review of a proposed
·community plan prepared by residents of the area. This review also was requested
by your Board.
Attached hereto is a report entitled "A Survey of Individual Sewage Disposal Systems,
Orange Park Acres, County of Orange, California" dated February 25, 1972. We
believe the findings, conclusions and recorrunendations contained in this report
will serve to answer both of the above-mentioned requests, being applicable to
the subject division of land as well as the area generally.
You will note, upon reading the report, that so_il conditions in most of Ora.nge Park
~· Acres are .not well suited for the disposal of ~ewage by individual systems. Our ,

reconunendation is that alternate means of disposal be· provided, with sanitary
_sewers being the rnet~o_d of choice. Well-engineered individual systems, e1n-
ploying advanced design techniques, might possibly function, but the expense

of said work and improvement in "ASSESSMENT DISTRICT NO. 9" for County
Sanitation District No. 7 of Orange County, California, consisting of 4 sheets,
numbered 1, 2 (revised), 3 and 4, and identified as "Construction Plans for
the Sanitary Sewer System in Assessment District No. 9, County Sanitation
District No. 7 of Orange County, California, 11 dated March, 1972, all of
which Plans are on file in the office of the Secretary of County Sanitation
District No. 7 of Orange County, California, and in the office of the Engineer
of Work, and except as otherwise provided on said plans, in further accord-
ance with the specifications for the construction of said work and improvement,
said specifications being on file in the office of the Secretary of County Sanita -
tion District No. 7 of Orange County, California (and in the office of the
Engineer of Work), and to which plans, profiles, drawings and specifications,
heretofore approved by the Board of Directors of County Sanitation District
No. 7 of Orange County, reference is hereby made for a further, full and
more particular description of said work.
That work and grading and grades shall be in accordance with the
grades as shown on said plans, profiles and drawings hereinabove mentioned,
which said grades may be different from the grades heretofore existing,
established or adopted.
That all of the rights-of-way for public sewer purposes hereinabove
described are shown upon the said plans, profiles and drawings hereinabove
described.
DESCRIPTION OF ASSESSMENT DISTRICT
SECTION 3: That the said contemplated work and improvement, as
aforesaid, is of more than local or ordinary public benefit and the said Board
of Directors hereby makes the expenses of said work and improvement charge-
able upon a district, which said district the Board of Directors hereby declare

costs and expenses thereof, including incidental expenses and costs, and which

All that certain territory situated in the unincorporated territory of
the County of Orange included within the exterior boundary lines shown on the
plat exhibiting the property affected or benefited by or to be assessed to pay
the costs and expenses of said work and improvement in said "ASSESSMENT .
DISTRICT N0 0 9, '.' which said plat consists of one sheet and is entitled, "Pro-
posed Boundaries of Assessment District No. 9, County Sanitation District
No. 7 of Orange County, Calif.," dated August, 1971, and which was finally
approved by the Board of Directors of said County Sanitation District No. 7
of Orange County, California, on September 30, 1971, indicating by said
boundary lines the extent of the territory included within the proposed assess-
ment district, and which map or plat is on file in the office of the Secretary
of County Sanitation District No. 7 of Orange County, California, and a copy
of which is on file in the office of the Engineer of Work, EXCEPTING from
th.e area shown within and delineated upon said map or plat he reinabove
referred to, the area of all public streets, public avenues, public lanes, public
roads, public drives, public courts, public alleys and all easements and
rights-of-way therein contained belonging to the public, and any lot or parcel
of land belonging to the United States, and also excepting therefrom any lot
or parcel of land belonging to the State of California or to the County of Orange
or to the Orange County Flood Control District, which lot or parcel of land is
in use for the performance of any public function, and all such property above

DESCRIPTION OF BONDS
SECTION 4: That serial bonds, bearing interest at the rate of seven
'1 per cent (7%) per annum, shall be issued to represent each assessment of
8 Fifty Dollars ($50. 00) or more remaining unpaid at the expiration of the last
9 date fixed for payment of assessment in the notice to property owners mailed
10 pursuant to the provisions of Section 5390 of the Streets and Highways Code
11 of the State of California. Said serial bonds shall extend over a period ending
12 nine (9) years from the second day of January next succeeding the next Septem-
13 ber 1st following their date. Payments on the principal of unpaid assessments
14 and interest thereon shall be made by property owners to the County Treasure
15 and the same shall be disbursed by said County Treasurer, all as provided in
