As shown on the plans prepared by Boyle Engineering, the sewer pipe will consist of a 96-inch concrete pipe placed at an approximate depth of 20 feet below existing grade. It is proposed to drill 18 to 20 exploratory borings to a depth of about 25 feet {five feet below invert elevation) for a total footage of 450 to 5.00 feet. Unforeseen subsurface conditions may dictate minor changes in the fotal number and depth of the borings. A continuous log of the ·soils encountered in the borings· will be recorded by our field personnel. Undisturbed san1ples will be obtained for laborat~:Hy testing, and the engineering properties of the subsoil materials will be detern1ined. An engineering analysis of the results will be made and reco1nmenda- tions will be developed for excavation and installation of the planned 96-inch interceptor pipe. A complete report presenting our findings and recom1nendations will include: 1. A description of the field investigation, boring logs and classifications of the subsoils encountered. We were f in~I ly advised that although the City was in the process of developing PUD ordinance permitting the type of development we proposed, there was no poss- ible way at that time that the City could al low a Plonnod Unit Development. ·(It is our understanding the City of Orange has not yet adopted a PUO ordinance.) for this reason, we instructed our planning team, Evans & Associates, Inc., and Anthony & L~ngford, to prepare plans for submission to the County of Orange under Its PUD ordinance. Maps and plans were prepared and an appl rcation for a Conditional Use Permit and Tentative Tract No, 7389 were filed with the Planning Commission on Apri I 26, 1971. The area covered in the. application and in the tenta1ive tract was tho first pha~e of the Master Plan of Development consisting of the approximate south- easterly 10 acres of the estate, This area was selected because it was adjacent to the principal access of Crawford Canyon Road, The proposed development was reviewed anj recommended by County staff and Conditional Use Permit No, C-1425 together with Tent- ative Tract ~o. 7389 were approved by the Planning Commission on June 8, 1971. The Co~ditional Use Permit was approved by the Board of Supervisors on July 14, 1971. Concurrently with our filing of the tentati~e map with the Planning Commission on Apri I 26, 1971, Evans & Associates, tnc,, sent prints of the map to the County Sanitation District .office, copy ·at trans- . mit.ta·t enclosed, with a r:-equest for· review and comments, A reply ·was received from your off ice dated Apr·i I 29, 1971, tentatively approving the ·1ayout and-enclosfng instructions for annexation, A:renda Item #60 GG-1 District 7 -3- (Copy enclosed.) It was necessarily our assumption upon receipt of District's tentative approva·I that there would be no delays or questions regarding annexation and provisions for sewage_ di sposa I. This assumption was conf irmod on July 20, 1971, shortly after approval of the tentative map and Conditiorial Use Permit, when Mr. Gary •iincs. of Evans & Associates, contacted Mr. Paul Hogan to request a copy of spectf ica1ions which he needed to prepare· final pfans and design of the sewer system. On August 3, fol lowing the normal order. of _events in a develop- ment of this type, Mrs. Maridayle Peay, Executrix of·the Estate, filed a petition for annexation fo·r Tract l·~o. 7389, consisting of 10 acres, which is Unit No, I of this projec+, Fol lowing the f i I Ing of this petition on Au~ust 3, Evans & Associates were advised, on August 10, that the petition and method of sewerage trwre not accept ab I e because (I ) the connecting sewer that we proposeJ to bui Id between Uni1 No. I and the existing sewers in Ryals Lane and Avenida Palmar would not be in the Disttict and could not be accepted or maintained by the District unless the who! c property v:ere annexed and ( 2) there ·was a poss i bi I i ty that the existing 10" main in Santiago Boulevard might become overloaded at some future datq because the 10 acres of our development in the southerly corner was not originally planned to be served in that direction. On August 13, 1/1r·. Evans met \vith Mr. Paul Hogan and Dr. John Sig-ler to resolve these problems. It is our understanding that it was agreed at th~t ~eating to annex the entire property and pro~ide sew8r ease~ients for the se\'>'ers 1o be constructed outside the first unit. A copy of Mr, Evans letter dated August 16, setting forth this understanding is attached. Further it was agreed that the effluent from the southeasterly 10 acres although not planned to be served by the Santiago sewer. was such a smal I amount that as a practical matter it could be carried by that se~er I ine. On August 20, Mr. Evans was informed that the apparent solution reached at his meeting of August 13, was not now acceptable and that the southeasterly 10 acres must be drained to a sewer I ine in Chapman Avenue to be constructed by the City of Orange, and that the \'/ho I e rnatter was to be referred to your adjourned meet- ing held August 24th. As no action was taken at that meeting, Mr~ Evans addressed a letter to the Board dated August 26, 1971, copy attached, On September 8, the Board again considered this matter and did not render a decision, but suggested that Unit No. I be served by connecting to the proposed City of Orange sewer line in Chapm~n·Avenuo. Not knowing the schedule of construction of th1s pr·oposed smver, and further that annexation to the City of Orange Agenda Item #60 GG-2 District 7 -4- might be required in order to connect, we, in our letter of September 16th, offered to construct a portion of· this sub- trunk in Chapman Avenue under a rei~burse~ent agreement. This offer, although an agenda iteM, was completely ignored at your last meeting of September 30th., when the annexation was refused. The above su~mary of events, contrary to certain remarks made at the last meeting, clearly indicates that we were and have been advised on tl1is matter by our representatives, but it is also apparent that our representatives may not have been fully advised as to the real probler'l concerning annexation. At the meeting there was nothing mcntio~ed regarding the increased connection charges and tho increased tax b~se which this type of develop~ent wi I I create over and above a stahdard R-1 subdivision, We feel this should be considered by the Board in ·making a decision.
