Harpe~, Oran~e County Sanitation District No. 7, concerning the pr~posed Assess- ment District No. 9. I must contend that I feel that your sa.tement " • • • the City will not participate or contribute funds." to this assessment district is somewhat misleading i]asmuch as this statement is not qualified or explained in any manner in your letter. As your attorney, Mr. Rodger Howell, do-.:ibtlessly informed you, Mr. Howell, the City Manager, and the City Attorney met with me on Friday, May 21, to discuss th~s entire subject of · providing sewer service to the area encompassed by this Assessment District No. 9. As you know, the City of Orange offered to contribute $35,000 to $40,000 tm·nrd this project to provide a portion of the sewer main extenzion in Chapman Avenue to serve an area which was to encompa.ss the land to be developed for a specialty restaurant as wfll as certain parcels of land on the south side of Chapman owned by certain .other parties, including yourself. As you recall, originally, the City pro}osed an agree- ment with you and certain other property own~rs located within an approximately 90 acres by which agreement the City of Orange would contribute some $35, 000 to $l~O ,©00 toward the extension of the sewer main in an easterly direction along Chapman from which extension the specialty r~staurant property and other properties on the south side of Clnpman could be served by sewer. Mead June 8, 1971 Page 2 these properti7s to receive sewer service through this city- owned sewer main extension without the necessity of agreeing to annexation to the City of Orange unless the parties (the City and landowners) could agree on appropriate zoning if and when annexation to the city was legally possible. The only penalty which the City of Orange exacted for a failure by the property owners to annex to the city when legally possible to do ·so was a requirement that the property owners reimburse the City of Orange on a prorated bas·is for the approximate $35,000 cost of the extension of the main which the City proposed to assume. In fact, the property .owner of the property to be developed for the Specialty Restaurant appeared to offer to annex said property to the City of Orange without any qualifications or reservations. However, after we had held the first discussions, a revised agreement was presented ~o us by your attorney which proposed to add to the area of some 90 acres originally pro- posed to receive sewer service, an area of soJte 270 acres lying east and north of the area in question. This 270-acre area had not previously been considered by th= City of Orange as an area to receive sewer service under the agreement cover- ing approximately 90 acres which was initially discussed and agreed upon by the parties. As we explained to your legal counsel in our meeting of May 21, the City of Orange could not ma.ke~a similar commitment at this time a·s to the 270 acres lying north and east of the land initially proposed to receive sewer service through the City of Orange sewer main extension. As Mayor, I expressed my continuing of fer to enter an agreement with you covering the original 90 acres. ·. Of course, it was your right ·to reject this proposal of the City and choose to assume all of the cost associated with the extension of sewer service to this 90-acre area without financial assistance from the City. I only review this back- ground and history of our negotiations in view of the fact that I felt your letter did not fully explain these matters. California With reference to your increase in connection charges from $100 per unit to $150 per unit effective July 1, 1971, the undersigned wishes to obtain your District's permission to pay the connection charg~s in advance of issuance of building.permits and on the basis of $100 per unit. This would amount to $11 ,200.00 for our 112 unit development. · As you may know, I own most of the property bounded by Laguna Rd., Redhill and San Juan St., in the Tustin area. I have been developing this property under a master plan since July of 1968. During this time your connection · charges have increased from $25.00 to $150.00 per unit and this increase together with other fee increases have created a severe hardship in the de- velopment of the balance of my property. Inasmuch as my property has been zoned for its intended use for several years and we have installed sewer lines in the various rights of way to provide service in accordance with our master plan, it seems reasonable that I request the right to pay these connection charges on the basis of your old fee schedule even though we do not intend to secure building permits for the next several months. My architect, Gared Smith, has completed prelimi.nary studies and has been commissioned to proceed with the working drawings. I anticipate completion of the plans by September l, 1971, after which time application for building permits will be made.
