Box 5 175 10844 Ellis Avenue Fountain Valley, Calif., 9270 8 Phone 962-241 1 May 8, 1970 Agenda Item No . 2 5 -D -PROP OSED WASTEWATER I NTERCEP TOR AGREEMENT WITH RIVERSIDE COU NTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT: The Directors who served on the Board last year are thoroughly familiar with the purpose and general terms of this agreement which has been under discussion for several years and which was the main subject of a special meeting of the District Board with the Executive Conunittee on Janua ry 27. At that time it was believed that staff agreement on the terms of the proposed agreement had been reached. However, questions arose which caused a d e l a y in formal consideration of the agreement until this meeting. We now have a final version of the agreement, acceptable to the staffs and a ttorneys of b oth parties, a nd a copy is attached hereto . Bas ically, the Riverside interests desire to p urchase capacity rig hts in the Distr icts ' treatment and disposal facilities for 50 mil l ion ga l l ons per day (mgd ) in 5 mgd increments . In addition, they wish to construct, jointly with District No. 2, a major trunk sewer following the a lig nment of the Santa An a River from the Riverside County boundary to Plant No . 1 . This proposal requires two companion agreements, one with the Joint Districts and the attached with District No. 2 a lone , as discussed below. The agreement for purchase of Plant capacity ri g hts is described in the a ccompanying Executive Conunittee r eport and a ction by the Joint Boards on it (Item No . 25 -E) h as been placed on the agenda as directed by the Conunittee . As District No . 2 is the only District directly invol ved, the attached a g reement is with this District alone. However, it should be pointed out that the t erms of our Joint Ownership, Operation and Construction Ag reement provide that no Di str ict may accept waste- water from an a re a outside the District without the consent o f the other sioc Districts. Therefore, the agreement must be reviewed and approved by the Joint Boards . It is the Executive Conunittee 's and staff 's reconunendation that the agreement be approved by the Board of District No . 2 and the other Boards for three principal reasons : 1 . Joint participation in the financing of the p roposed sewer by the two agencies will g reat l y reduce the cost to District No . 2 . Commencement of construction of the project as soon as possible i s also vital to District No . 2 since its existing trunk sewer system will soon be overloaded, and the project is necessary to serve deve l oping areas in the northeast part of the District . (The proposed sewer basically conforms to the District 's existi ng Master Plan of Future Facili- ties, as approved in 1965 .) 2. The project will help to maintain or improve the present quality of the Santa Ana River water reaching Orang e County since the sewer will be used principally by the Riverside County interests to dispose of mineral ized industrial wastes which would otherwis e deteriorate the quality of the ground water basins if disposed of locally . 3 . If the proposed sewer is not jointly constructed, it is likely that the Riverside interests will construct their own facility to the ocean. This would be un- desirab l e for Orange County since we would lose all control over the treatment artd disposal of wastewater from areas upstream of the County l ine . There are many aspects to the proposed agreement which cannot be adequately covered in this brief report . K-2 City and District 11 A G R E E M E N T THIS AGREEMENT is made and entered into by and between the CI'TY OF HUN'J:'ING'TON BEACH, a municipal corporation, herein- after referred to as CITY, and COUNTY SANITATION DISTRICT NO. 11, hereinafte~ referred to as DISTRICT. WHEREAS, CITY intends to enter an agreement with the SUNSET BEACH SANI'rARY DISTRICT, hereinafter referred to as SUNSET, for the connection of the SUNSET sewer lines to CITY sewer lines, and for the acceptance of the SUNSET sewage through said CITY lines into the DISTRICT's sewer li~es; and, CI'rY and DIS'I'RICT desire to enter an agreement to permit CITY to enter the above-described agreement with SlIT~SET, and it is in the best interests of the residents of SUNSET, CITY and DISTRICT and in the best interests of the public health, safety and .general welfare of said residents that SUNSET be permitted to dispose of its s.ewage through CITY' s lines and into DISTRICT's lines for treatment and disposal; NOW, THEREFORE, CITY and DISTRICT do hereby mutually agree as follows: That at such time as CITY shall complete the connection of SUNSET's se:wa.ge lines to CITY sewage lines, approxj_rnately sixty (60) days from the date of this agreement, DISTRICT shall accept sewage from SUNSET subject to the conditions hereinafter set forth: 1. Said sewer line connection shall be completed in accordance with the plans and specifications approved by DISTRICT, at no cost to DISTRICT. 2. Said sewer line connection shall convey sewage and waste water originating within the territorial limits of SUNSET as they exist on April 1, 1970, and from no other area. 3. CITY shall cause to be installed and maintained at CITY's expense a flow regulator and a recording and totalizing meter capable of measuring the quantities of waste water K-3 discharged from SUNSET's collection system for disposal through the sewage facilities of DISTRIC1'. Said flow regulator shall be set so no flow in excess of SUNSE'l1 ' s cc::.paci ty rights can be discharged from SUNSET. Said meter shall be of a kind and type approved by DISTRICT and shall be installed in such location as DISTRICT may designate. Said meter shall be sub- ject to such inspection and testing by· DISTRICT as it may require and shall be read at such times as DISTRICT may from time to time designate. All costs for installing, reading, maintaining and testing said flow regulator and meter shall be borne by CITY. 4. CITY shall pay to DISTRICT annually, beginntng on December 31, 1970, and on December 31st of e~ch succeeding year thereafter until December 31, 1972, an amount equal to $lJ.o.oo per million gallons of measured waste water from SUNSET. After December 31, 1972, said cost may be proportionately ad- justed to reflect increases or decreases in the treatment and disposal costs of waste water to DISTRICT. 5. CITY shall pay to DISTRICT $95,288, of which $63,525· is payment to DISTRICT for acquisition of capacity rights in the joint treatment and disposal facilities of DISTRICT for an average treatment capacity of 150,000 gallons per day (with a permissible peak flow treatment capacity of 250,000 gallons per day) for SUNSET's sewage and waste wate~and $31,763 of which is payment for capacity rights in DISTRICT's conveyance.facili- ties for said flows. Peak flow is defined as the maximum rate of waste water flow which is sustained for 15-minute intervals expressed as gallons per 24-hour day. CITY shall pay $10,000 on execution of this contract, and the remaining amount, or $85,288, on or before April 1, 19'71. The balance due shall bear interest e.t the rt:ite of 6% per annum, which shall be due and payable on April l, 1971. In addition thereto, beginni:1g Ap:r-il 1, 1970: and anrnw,]ly thereafter, s.s an · K-4 annual capital cost replacement charge, CITY shall pay to DISTRICT 3% of $95,288, to wit: the sum of $2,860, of which $1,907 is payment to DISTRICT for capital cost replacement of joint treatment and disposal facilities, and $953 of which is for capital cost replacement of DISTRICT conveyance facilities. 6. If said territory is annexed to DISTRICT on or before March 31, 1975, a credit of $31,763 shall be allowed said territory on the DISTRICT's annexation fee. 7. It is recognized that pursuant to expressed public policy of.national, state and local governments, it may be appropriate and necessary for DISTRICT to provide facilities for the improvement of the degree of treatment in advance of the imposition of regulatory requirements. It is also recog- nized that any federal, state, regional or local regulatory body or agency having jurisdiction may hereafter require addi- tional facilities not now provided at DISTRICT's treatment and disposal facilities. CITY, on behalf of SUNSET, shall partici- pate in the proportion which CITY' s total capital in-..restment hereunder bears to DISTRICT's total investment for treatment and disposal facilities in the audited cost of any capital investment reasonably required for the provision of such addi- tional facilities. 8. CITY shall have the duty to collect fees and costs hereinabove provided for to be paid by SUNSET. However; not- withstanding CITY's duty, DISTRICT shall have the power to enforce the payment of such costs and fees by SUNSET and to enforce the agreement to be executed concurrently herewith between CITY and SUNSET, copy of which is attached hereto and marked Exhibit "l". Harper's request, we are pf eased to submit our proposal for furnishing engineering services for the preparation of plans and specifi- caf"ions for the Sunflower Interceptor Sewer, Reaches 1 and 2, as presented _ in the Engineer's Report for County Sanitation District No. 1, dated November 1969 and Engineer's Report for County Sanitation District No. 7, dated November 1969. The Sunflower Interceptor is a major facility in the masi'er plans of Districts Nos. 1 ancl 7. When placed in servic.e it will relieve the existing systems of both districts and serve as the main transportation arf·ery for woste water flows which are expected to be generated within the next thirty years. The interceptor will begin at Treatment Plant No. l, cross the Santa Ana River and the San Diego Freeway 1 extend easterly along Sunflower Avenue through the cities of Costa Mesa and Santa Ana and terminate cit Main Street just west of the Newport Freeway. The interceptor will consist of approximately 12,500 feet of 81--inch pipe and approximately 9 ,000 feet of 78-·inch pipe. Total estimated cost of the project including construction, engineering inspection and incidental costs, is $4,822,000. Under the joint participa- tion agreement as out I ined in the engineering reporf-s, the share for District No. l will be $1,358,000 and for District No. 7, $3,464,000. It is ·currently proposed thaf· the construction of the interceptor be accomplished by two contracfs corresponding to the limits of each reach. The fiist contract (Reach 1) would ex1·end from Treatment Pi ant No. 1 to Raitt Street. The second controct (Reach 2) would begin at Raitt Street and extend to Main Street. Dividing the project into these two specific contracts also corresponds with the submittal to the Sf·ate Water Resources Control Board for eligibility under the Fcderof Water Pollution Control Administrc1tion Public Law 660 grant program. Review laboratory reports on materials tests and inspection and correlate such reports with the intentions of the plans. and specifications. 14. Furnish consultation and advice to the district or its agent during construction. 15. Furnish periodic observations of construction work and progress ·and provide appropriate reports to the district.. . 16. Observe initial operation of the projeci·, witnessing perfor- mance tests as required by the specifications and reporting same to the district. 17. Make a final inspection and report of the completed proiect with a representative of the district or its agent. 18. · Prepare record drawings {"as-constructed") when construction work has been comp I eted and accepted by the district. Th is shafl mean the original tracings of the pf ans will be modified, if necessary, because of deviations from the original work. When inspection is carried out by personnel not direct I y employed by the engineer / modifications to the original tracings will be based upon information supplied to the engi- neer by the district. The original tracings after being modified wil I become district property. We propose to provide the services in Items 1 through 18 for each of the construction contracts on an individuol lump sum basis. The total fee for the first conirncf' will be $104,485, with $73, 140 payable by District No. 7 and $31,345 payable by District No. 1. For the second contract f-he fee will be $65,315, with $48,986 poyable by District No. 7 and $16,329 payabf e by District No. 1. The fees have been prorated between the two districts based on capacity ownership in each contract by each district. We suggest that payment be monthly on a percentage complete basis up to 90 percent at time of delivery of pf ans and specifications, with 100 percent payment when the work on each individual contract is comp.I eted and accepted by the district. There wilf be field surveys required in order to prepare tf1e plans and specifi- cations. These surveys will include taking topography and culture within the proiect limits. Payment to be monthly as invoiced e Mr. Harper has requested that we consider the possibility that oth~r agencies may wish to join with Districts Nos. l and 7 in construction of the Sunflower Interceptor. More specifically, he asked that we estimate the final date which changes could be made in the overall system without drastically affecting any of the preliminary work which might have been accomplished. At this time we estimate that July 15, 1970 would be the latest date a final decision musf· be made. The proposed relocation is feasible, and would result in an improvement of the District's facilities. However prior to ~he relocation, ~greement should be reached on the size of the line. The existi~g line is a 21 inch, and it has been proposed that the relocated line be a 24 inch. In the Plan "B" Alternate of the Master Plan, the line should be a 39 inch if the ultimate service area set forth in the Master Plan is to be served. If the area easterly of the present District. boundary is not to be served via this facility, then the 24 inch line would be adequate. The section to.be relocated is approximately 2750 feet in length. The estimated constructiori cost, exclusive of e~gineeri~g, for a 24 inch line is $71,000 and for a 39 inch line is $136,000. If a final determination cannot be made on the size of the line prior to the time relocation is required, perhaps it would be wise to install the 39 inch line. An ,. Overall market conditions have never been worse. There is a very large backlog of bonds waiting for interest rates to break. If Proposition 7 passes, an additional $1. 3 billion in state bonds will be saiable. Because of the overdemand for tax-exempt money, we cannot foresee any rapid im- provement in interest rates for a long time to come. We have reviewed your funding requirements with your engineer. a~d staff. Two general alternatives appear possible at this time: a) sell all or part of the bonds as soon as practicable in order to assure that priority pro- jects can proceed, or b) delay any plru1s for bond sales until after January when the first construction project plans will be ready for bids. Discussions with your manager have indicated the desirability of preparing for an early initial sale of pa:rt of the bonds in order to assure that some of the projects can proceed. We will prepare basic material necessary for a sale of bonds on July 28, 1970. You should fix the actual amount of bonds to be sold on that date by about the first week in June. (213) 636-4923 April 24, 1970 Reference: Orange County Sanitation District Job No. P2-l 6 Sedimentation Basin J and Digester J at Plant 4f2 Gentlemen: In our proposal for construction of Sedimentation J and D{gester J at Plant No. 2, Job No. P2-l 6, we listed G. H. Dahlberg, 14 052 Mooncrest Street, Westminster, California, as a subcontractor for the painting and protective coating work on the project. After the contract vva s awarded to our company, we mailed Mr. Dahlberg a purchase order, subcontract, and subcontractor's bond form, and requested that he complete all documents and return them to our office. These documents were mailed on March 2 6, 19 70. On April 20, 1970, Mr. Dahlberg came into our office and retyrned all docu- ments unsigned. He advised our company that his price for the work would have to be increased 33% if he was requfred to furnish a bond, even though our company would pay all premium costs. We refused to accept this increase in price, and have negotiated a subcontract for the work with Superior Coating and Painting Co. , of Long Beach. We request your approval of the substitution of Superior Coating and Painting in place of G. H.
