The Board of Directors of County Sanitation District Noo
, of Orange County, California, does ordain as follows:
ARTICLE 1 -PURPOSE
The purpose of this ordinan?e is to provide for the maximum
public benefit from ~he use of the District's facilities by regulating
the quality and quantity of sewage and industrial waste discharged
thereto and to provide for charges for the use thereof when such use
is disproportionate t6 District costs imposed on other property within
the District.
The revenues to be derived from the application of this ordinance
shall be used to defray the costs of, including the repayment of
principal and interest on bonds issued for the acquisiticn, construction
or reconstruction and the maintenance of an adequate sewerage system
to serve the territory of the District excepting that no revenues
derived from this ordinance shall be used for the acquisition or con-
struction of new local street sewers or laterals as distinguished
from main trunk interceptor and outfall sewers.
ARTICLE 2 -DEFINITIONR
(a) Assessed Valuation -Shall mean that portion of the total
assessed valuation of the property producing and discharging sewage
or industrial waste upon which District taxes are levied in the fiscal
year beginning in the calendar year in which the discharge takes.

District used, owned, leaoed, occupied or maintained by·or for the
user whether or not sewage or industrial waste is generated by a

particular improvement and shall include, but not be limited to,
offices, landscaped areas, parking lots, warehouses and incidental
improvements. It shall also .include unimproved land located in
the District when such land is used, owned, leased, occupied or
maintained by the user. For property upon which no District tax is
levied, the assessed valuation will be considered to be zero.

(b) District -Shall mean County Sanitation District Noo
, of Orange Countyo
(c) General Manager -Shall mean the individual duly
designated by the Board of. Directors of the District to administer
this ordinance.
(d) Industrial Waste -Shall mean the waterborne waste and
wastewater from any producing, m~nufacturing, or processing operation
of whatever nature, including institutional and commercial operations
where water is used fo~ laundering, vehicle cleaning, or the removal
of significant quantities of wastes of non-human origin.
(e) Local Sewering Agency -Shall mean any public corporation
duly authorized under the laws of the State of California to construct
and/or maintain public sewerso
(f) Excess Capacity -Shall mean the hydraulic use of a
District facility for peak flow rate greater than reasonable useo
(g) Peak Flow Rate -Shall mean the annually determined
highest flow rate of sewage or industrial waste discha!1ged to a public
sewer over a period of at least 15 minutes at any time during the
preceding 12-month period. In the absence of actual peak flow rate
data, peak flow rate may be considered at 1.6 times the greatest .
metered eight-hour water use during the preceding 12-month period,
provided that where peak flow rate is established for permittees on
the effective date of this ordinance, the permittee certifies that
said eight-hour water use was for DOrmal operations and not the result
of extraordinary circumstancesg

(h) Pre-Treatment Facility -Shall mean any works or device
~or the treatment or flow limitation of sewage or industrial waste,
prior to discharge into a public sewer.
(i) Public Corporation - . Shall mean any City, District, or
other public agency duly organized under the laws of the State of
California.
(j) Reasonable Use -Shall mean the rate of discharge of
sewage or industrial waste and the suspended solids contained therein
to which a user connected to a public sewer shall be entitled to
discharge to said sewer without payment of excess capacity connection
charges or use charges by virtue of the assessed valuation of said
property and other criteriao For the purpose of computing excess
capacity connection charges, reasonable use is hereby established at
25,000 gallons per day peak flow rate_per $100,000 of assessed valuationo
For purposes of computing use charges, reasonable use is hereby
established at 10 million gallons per year and 15 dry tons of suspended
solids per year per $100,000 of assessed valuationo In the event a
person producing sewage or industrial waste maintains more than one
operation in the District, peak flow rate, annual flow, annual
suspended solids and assessed valuation shall be combined for all such
operations for the purpose of determining reasonable use and computing
excess capacity connection charges and use chargeso
(k) Sewage -Shall mean the wastewater derived from human
use of buildings for ordinary residential, institutional or commercial
purposes.
(1) Standard Methods -Shall mean procedures described in
the Twelfth edition of "Standard Methods for the Examination of Water
and Wastewater" as published by the American Public Health Association,
the American Water Works Association and the Water Pollution Control
Federation.
(m) Suspended Solids -Shall ~ean any insoluble solid matter
contained as a component of sewage or industrial waste and capable of
separation from the liquid portion of said waste by laboratory filtra-

tion, provided, however, no insoluble.solid matter shall be included
if permittee can demonstrate that it is non-putrescible and results
from planned water conservation or reuse within the premises of
permittee.
(n) User -Shall mean any person or public corporation
discharging sewage or industrial waste to a sewerage facility of the
District or to a sewerage facility of a local sewering agency, which
facility discharges to a District facilityo
ARTICLE 3 -PERMITS
(a) When Required -No person or public corporation shall be
permitted to connect to, use, or maintain a connection to the sewerage
facilities of the District without the permits required and issued
as hereinafter provided. No person or public corporation shall be
permitted to use or maintain a connection for the discharge of
industrial waste to a sewerage facility of a local sewering agency,
which facility discharges to a District sewerage facility, without
a valid permit issued as hereinafter providedo
(b) Condition Precedent -No permit shall be valid unless the
real property to be served by use of the permit is included within
the boundaries of the District and within the boundaries of a local
sewering agency authorized to maintain public sewerage works; provided,
however, a permit may be issued for property to be served outside the
boundaries of a local sewering agency if a local sewering agency makes
application for the issuance of such permit.
{c) Information to be Furnished -The District may requlre, in
connection with any application for a permit, that the applicant
furnish data regarding present and anticipated future flows, quality
of discharge and information concerning present and anticipated
assessed valuation.
(d) Permit for Connection To and Use of District Facility -
Application for such permit shall be made to the District and permits
shall be issued by the District ln two parts: First, a connection
permit for the purpose· of authorizing .connection to a District's
sewerage facility under conditions set forth in said permit; and
secondly, a use permit for discharging sewage and industrial waste
to the District's sewerage facility.
(1) A new connection permit is not required for existing
connections to District's sewerage facilitieso
(2) The connection permit may prescribe requirements as
to the type of connection and the use permit may require the provision
of pre-treatment facilities necessary to insure compliance with
Articles 4 and 5 hereof. Any such requirements shall be set forth in
the permit.
(e) Industrial Waste Discharge Permit -Application for a
permit to use District services and facilities for the treatment and
disposal of industrial waste shall be made to the Districto The
permit shall be issued by the District and shall be in accordance
with the provisions of Articles 4 and 5 hereof. The permit may require
the permittee to provide necessary pre-treatment facilities to insure
compliance with Articles 4 and 5 hereof. Any such requirement shall
be set forth in the industrial waste discharge permito
(f) Amendment of Permits Any permit issued under the
provisions of this Article 3 may be amended by the District after giving
to the permittee a thirty (30) day notice of intention to amend where
the permit given was based on incorrect information and the proposed
amendment is for the purpose of making the permit conform to the
actual factors involved as determined by the General Manager.
ARTICLE 4 -QUALITY REQUIREMENTS
(a) Substances Prohibited -No person or public corporation
shall discharge sewage or industrial waste into a District sewerage
facility or into a local sewering agency facility, which facility
.._,. discharges to a District facility, when the components of such effluent
cause the effluent to exceed the limits set forth herein or are in
violation of the rules and regulations of the District estabJished
as hereinafter provided.

(1) An eight-hour temperature average higher than 140°F

character or in such concentrations which result in
improper functioning of any public sewer through which
said solids are conveyed or in the improper operation
of the Districts' treatment facilities
(5) Any liquid or gas or other substance which, singly or
in combination with other substances, could cause an
explosive, dangerously radioactive, or toxic condition
in the sewerage system of the Districto
{b) Rain Water Prohibited -No person or public corporation
shall discharge or cause to be discharged to a District sewerage
facility or to a local sewering agency facility, which facility dis-
charges to a District facility, water from roof drains or other runoff
water from rain storms or uncontaminated water not classified as
sewage or industrial waste.
{c) Additional Rules and Regulations -The _General Manager of
the District shall, from time to time as pe deems necessary, prepare
additional regulations as to the quality of sewage or industrial
waste discharged to the sewerage facilities of the District or to the
sewerage facilities of a local sewering agency, which facility dis-
charges into a District facilityo Said regulations shall be for the·
purpose of insuring that sewage or industrial waste so discharged will
not cause undue maintenance in the DistrictYs facilities, interfere
w~th proper operation of the treatment_plants, produce a noxious or
malodorous gas, create a public nuisance, create hazards to structures,
equipment and personnel, or create a violation of the requirements

imposed upon the District by Federal, .state or local regulatory agencies.
Said regulations shall not be effective until after public hearing
and approval by resolution of the Board of Directors. The General
Manager shall, thirty days before formal consideration of such
resolution, mail a notice of such consideration to each person holding
a valid industrial waste discharge permito Such notice shall also
be mailed to any person who has filed with the District a request
for such notice.
ARTICLE 5 -QUANTITY REQUIREMENTS
In order to provide for reasonable use of the District's sewerage
facilities and in recognition of the fact that the transmission, treat-
ment and disposal ·or domestic sewage is the highest and best use of
the District's sewerage facilities, the General Manager may set forth,
in any industrial waste discharge permit issued, requirements to limit
the quantity of industrial waste discharged to a sewerage facility of
the District or a local sewering agency when, in the opinion of the
General Manager, the existing hydraulic capacity of the District's
sewerage facilities would be unreasonably used. Such requirements
may limit the quantity of industrial wastes to be discharged with
respect to any given unit of time and shall be subject to appeal as
provided in Article 12 hereof.
ARTICLE 6 -PERMIT FEES AND CHARGES
FOR CONNECTION AND USE
(a) Connection Permit Fees -No application for a permit
for a connection to a District sewerage facility shall be considered
until a permit fee is paid by the applicant, provided, however, that
such fee shall not be payable when a permit is issued for the reconnection
or alteration of an existing connection made by the District or at the
request of the District. Said permit fee shall ·be an amount set
forth in a resolution duly adopted by the Board of Directors.
(b) Industrial Waste Discharge Permit Fees and Excess Capacity
Connection Charges for Use Greater than Reasonable Use -Except as
hereinafter provided, no permit to use a connection to a facility of

the District or to a sewerage facility of a local sewering agency,
which facility discharges into a District facility, shall, after the
effective date of this ordinance, be issued until an industrial waste
discharge permit fee is paid by the applicanto An industrial waste
discharge permit fee shall be payable in an amount set forth in a
resolution duly adopted by the Board of Directors and shall be based
on the volume and characteristics of the industrial waste but in no
event shall exceed $250 per year. Industrial waste permit fees shall
be payable annually within thirty days after expiration date and upon
invoicing by the District.
Prior to commencement of use and upon invoicing by the District,
an excess capacit:y-connection charge shall be payable by a user when,
during the 12-month period after commencement of use, the peak flow
rate may be reasonably expected to exceed 25,000 gallons per day unless
such peak flow rate is a reasonable use as defined in Article 2 of
this ordinance. Notwithstanding the foregoing sentence, no excess
capacity connection charge shall be made for connections in use on
the effective date of this ordinance unless there is an increase in
peak flow rates of sewage and industrial waste which exceeds, by more
than 5,000 gallons per day, the highest peak flow rate previously
determined for such user.
Subject to the provisions hereinabove, excess capacity
connection charges payable shall be computed at the rate of $350 per
1,000 gallons per day of peak flow rate and, in the case of connections
in use on the effective date of this ordinance, shall be payable on
the lesser of the following amounts:
(1) The amount the latest determined peak flow rate
exceeds that determined for the 12-month period preceding the effective
date of this ordinance or
(2) The amount the latest determined peak flow rate exceeds
the reasonable peak flow rate determined at the time of the increaseo

(c) Use Charges Any person using a connection to a facility
of the District or a facility of a local sewering agency, which facility
discharges to a District facility, shall be subject to the payment of
an annual use charge for the preceding calendar yearo Such use
charge shall be payable only on the annual flow of sewage or industrial
waste discharged or suspended solids discharged greater than reasonable
use as hereinbefore defined. The use charge shall be the actual
treatment costs of the District for the fiscal year ending in said
calendar year expressed per 1,000 gallons in excess of reasonable
.use and $10 per ton of suspended solids in excess of reasonable use.
(d) Computation and Invoicing of Use Charges -After January 1
of each calendar year, the General Manager shall determine which users
are subject to the payment of use charges and shall invoice the user
in accordance with the mit charges established as hereinabove providedo
At the option of the General Manager, use charges may be invoiced more
frequently than annually when, in his judgment, the use charges are of
such a magnitude to warrant more frequent paymento Upon application
by any person to the Board of Directors, which application demonstrates
a financial hardship, the Board of Directors may allow the payment of
excess capacity connection charges to be made over a period of not
more than five years with interest at six percent per annum on the
unpaid balance.
ARTICLE 7 -REFUND OF EXCESS CAPACITY CONNECTION CHARGES
Upon application to the Board of D~rectors by any permittee who
has paid excess capacity connection charges to the District of more
than $5,000, which application certifies that the peak flow rate has
permanently decreased by 25 percent or more, and which application is
not disputed by the General Ma0ager, the Board of Directors will autho-
rize a refund to the applicant. The refund will be computed to maintain
the total remaining excess capacity connection charge paid to an amount
corresponding to the excess capacity connection charge payable at the
time of the decrease.

ARTICLE 8 -LOCAL AGENCY EXEMPTION FROM CHARGES
No excess capacity connection charges or use charges, as speci-
fied in Article 6 hereof, shall be payable for the discharge of sewage
or industrial waste from property in the District owned by elementary,
high school, and junior college sbhool districts, special districts,
the County of Orange, and cities.
ARTICLE 9 -MEASUREMENT OF QUANTITY AND
QUALITY OF FLOWS
(a) Annual Flow -The measurement of annual flow of sewage or
industrial waste shall be made by the District by means of a metering
device, approved by the General Manager, and installed and maintained
at the expense of the permittee, or by estimate arrived at from total
water used in the area occupied, or by other means acceptable to the
General Manager and to the permittee. The permittee shall have the
option of selecting whether the measurement shall be made by meter, or
by estimate, or other means, provided that the method of estimate or
other means is approved by the General Manager.
(b) Peak Flow Rate -The determination of peak flow rate
shall be made by means of an effluent meter approved by the General
Manager or by field measurements made by the ·District or by the method
provided in Article 2 hereof. The permittee shall have the option of
selecting the method of determination to be used, provided, however,
that in the event the field measurement is selected, an additional charge
of $600 per year will be made to defray the costs thereof and will be
invoiced each February 1 for the preceding calendar year.
{c) Determination of Components -The determination or
estimation of suspended solids or other components contained in sewage
or industrial waste discharges shall be by one of the following methods:
(1) Sampling and analysis by District's personnela
(2) Samplir:ig and analysis by personnel of permittee or
laboratory acceptable to the District and employed
by the permitteee
(3) Estimates arrived at by study of operations leading
·to the dlscharge.

The permittee shall have the option of selecting which of
the foregoing methods will be used, provided, however, that such
method must be proposed by permittee and approved by the General
Manager before January 1 of any calendar year and continued through-
out the year. In the event no method is so selected and approved,
Method (1) will be used. Also in the event that either Method (2)
or (3) is so selected and approved, the District may, by appropriate
sampling and analysis, determine the accuracy of the results obtained.
If Method (2) is so selected and approved, the permittee shall pre-
pare and submit on, or before, January 15 of any year, a certified
statement of the results obtained for the preceding year. All
laboratory procedures shall strictly conform to Standard Methodso
ARTICLE 10 -INSPECTION
The General Manager shall institute a regular industrial
waste inspection program in order to determine the quality and quantity
of industrial waste discharged to the District's facilities and the
effect thereof on the maintenance and operation of said facilitieso
Said inspection program shall be carried out by employees of the
District and, insofar as possible, shall be funded from industrial
waste permit feeso
ARTICLE 11 -AGREEMENTS WITH PERMITTEES
(a) New Installations -At the option of the General Manager
or the permittee, the District will enter into an agreement with any
permittee whose assessed valuation and peak flow rate cannot be deter-
mined at the time of the issuance of the permit. Such an agreement
will provide for an estimate of the assessed valuation for the ensuing
fiscal year and the peak flow rate for the ensuing 12-month period,
and require payment of excess capacity connection charges on the basis
of such estimates and will provide for a method of additional payment
or refund, as the case may be, of such cha.rges when actual data as to
assessed valuation and peak flow rate can be obtainedu

(b) Special Situations -If any permittee feels that the circum-
stances involved in his discharge are of a nature which requires
special consideration, he may apply to the Board of Directors for a
special agreement. Such applica t.ion shall state the facts to warrant
such special agreement which may, upon resolution of the Board of
Directors, provide terms other than contained in this ordinanceo
(c) Existing Agreements -It is recognized that the District
may have special agreements for the discharge of sewage or industrial
waste to its facilities in effect on the effective date of this ordinance.
In such cases, the user shall have the option of maintaining the
existing agreement or to terminate it~ In the event of termination,
the provisions of .this ordinance will apply to permittee's dischargeo
ARTICLE 12 -INTERPRETATION AND APPEAL
(a) Request for Ruling -If any permittee or applicant for a
permit disputes the interpretation or application of this ordinance,
he shall set forth his contentions in writing to the General Managero
The General Manager shall, within thirty days, respond in writing to
the contentions so made and set forth his determinations thereof.
(b) Appeal -If the permittee or applicant for a permit is
dissatisfied with the determinations so made by the General Manager,
he may within thirty days after mailing of said ruling by the General
Manager to said permittee or applicant for a permit, appeal said
ruling by giving written notice of the basis of his appeal to the
Board of Directors of the Districto Said.written notice shall be
accompanied by a non-refundable fee of ONE HUNDRED DOLLARS ($100).
The Board of Directors of the District shall, within forty-five days
after receipt of said written notice of appeal, make a final determination
of the issues presented.
ARTICLE 13 -PAYIV'illNT OP CHARGES AND DELINQUENCIES
All charges made pursuant to the provisions of this ordinance
are due and payable upon receipt of notice thereof. All such charges
shall be and become delinquent forty-five days after mailing or

delivering notice thereof to the mailing address of the property
subject to such charges.
All delinquent charges shall be deemed a violation of this
ordinance and each day any such charge remains delinquent shall be
deemed a separate violation.
ARTICLE 14 -PENALTIES
Any charge that becomes delinquent shall have added to it a
penalty charge equal to ten percent of the charge that became delinquent
and thereafter an additional penalty shall accrue on the total charge
due, including the ten percent basic penalty at the rate of one-half
of one percent per month until paid.
ARTICLE 15 -COLLECTION
Upon motion by the Board of Directors of the District, any
charge and all penalties thereon shall be collected by lawsuit in the
name of the District. Any such action for collection may include an
application for an injunction to prevent repeated and reoccurring
violations of this ordinance.
ARTICLE 16 -VIOLATIONS
No person or public corporation shall violate any provisions or
fail to comply with any of the requirements of this ordinance. Any
person or public corporation violating any of the provisions or failing
to comply with any of the requirements of this ordinance shall be
guilty of a misdemeanor. Any person or corporation convicted of a
misdemeanor under the provisions of this ordinance shall be punished
by a fine of not more than $100,00 or by imprisonment in the County Jail
for a period not exceeding thirty days, or by both such fine and
imprisonment. Each person or public corporation shall be guilty of a
separate offense for each and every day during any portion of which
any violation of any provision _of this ordinance is committed, continued
or permitted by such person or public corporati9n and shall be
punishable accordingly.

ARTICLE 17 -SEVERABILITY
If any provision of this ordinance or the application thereof to
any person or circumstance is held unconstitutional, the remainder of
the ordinance and the application of such provision to other persons
and circumstances shall not be affected thereby. If a provision of
this ordinance is held invalid, all valid provisions that are
severable from the invalid provision shall remain in effecto
ARTICLE 18 -PROCEDURES FOR AMENDMENT
Thirty days before any formal consideration of an amendment to
this ordinance by the Board of Directors, the General Manager will so
notify in writing each city and local sewering agency in the District
and each person holding a valid industrial waste discharge permit or
who has paid an excess capacity connection chargeo Such notice shall
also be mailed to any person who has filed with the District a request
for such noticec Such notice shall contain a brief description of
the nature of the amendment to be considered.
ARTICLE 19 -REPEAL
Ordinances Nos., are hereby repealed and all
ordinances or parts of ordinances inconsistent with this ordinance
are hereby repealed to the extent that they are inconsistent with the
provisions of this ordinance.
ARTICLE 20 -EFFECTIVE DATE
The effective date of this ordinance is January 1, 19710

Angeles County adopt a uniform ordinance establj_shing charges for
connection to and use of said Districts' sewera~e facilities, the
Boards of Directors of these Districts will review the said Los Angeles

Section 2. Cou.Dty Sanitation District No. 1, of Orange County,
is a separate and distinct agency organized under Chapter 3, Part 3,
Division 5 of the Health and Safety Code, State of California, for the
...,,,,, purpose of constructing, operating and maintaining a major trunk sevrer
system for the collection of sewage from the cities and other local
collection sewering agencies, and has joined with other County Sani-
tation Districts, namely County Sanitation Districts Nos. 2, 3, 5, 6, 7,

and 11 in constructing, operating and maintaining joint sewage treatment
plants and disposal facilities under an agreement dated October 8, 1959,
knoi·m as the Joint Ovmership ~ Operation and Construction Agreement.
Section 3. In accordance with the terms of said Joint 01·mership,
Operation and Construction Agreement, County Sanitation District No. 1,
of Orange County, acts for itself and as agent for County Sanitation
Districts Nos. 2, 3, 5, 6, 7, and 11, of Orange County, California, each
organized for similar purposes and serving different territories, all
in Orange .County, Calj_fornia, for the purpose of constructinr; and
operating said joint sewaee treatment plants and disposal facilities.

Gentlemen:
I, Andre Babineau, and my representative John E. O'Malley,
of the Orange County Employees Association, request a
meeting with your committee as provided in paragraph 6
of the new Grievance Procedure.
The reason for my request is that I have been unjustly denied
my merit increase and my rights to a hearing. It has been
stated by some that the time limits for filing a grievance
have expired.· Unfortunately, that statement is unacceptable
because the nature of the present injustice is such that for
each working day injustice remains unresolved, the grievance
renews itself.
For example, if a man works overtime and is not compensated
in some way, his failure to file a grievance within the speci-
fied time limits dissolves the issue, until the next time the
incident occurs. In my case, the unjust denial is not an iso-
lated incident in time, but a continuing injustice renewed
each working day.
Therefore, I request a hearing before your honorable board as
provided in the Grievance Procedure.

APPLICATION FOR OCEAN OUTFALL NO . 2 : The Directors will recci.11 tha t
at the March 11 me eting a l etter was received from Peter Kiewit Sons'
Company requesting that the Districts app ly in their behalf for
greatly increased Federal financial ass istanc e to compensate for
d amages to them resulting from the excess ive amounts of river mud
d eposited in the outfall construction area as a result of th e 1969
floods. Th e matter was referred by the Boards to the Gen eral Counsel
fo r study and report.

Nos . 20 and 21 -CHA NGE ORDER FOR CONTRACT NO . 3 -15 AND AUTHORITY TO
PURCHASE PIPE: This contract with Cook & Barletta, Inc., is for
r epair of manholes in the Miller-Holder Trunk Sewe r . which have incurred
serious damage in the past ten years from sulfide attacl~. When this
job was planned, it was intended to include in it a badly ne eded sewer
gas vent across a siphon under the Wintersburg Flood Contro l Channel
in order to prevent the upstream .escape of malodorous sewer gases
which have been the cause of a number of comp l aints . How ever, since
it ·was determined tha t the most economica l method of constructing this
vent would be to place it on the Southern Pacific bridge ad jac ent to
our sew er , an agreement had to be reached with the railroad company .
Since thi s agreement took considerab le time to c onsummate, the contrac~
as bid, did not include installation of the gas vent .
In order to proceed with this construction, we h ave asked the
contractor to install the pipe and fittings, to be purchased by the
Districts (Item No . 21), under the fo rce account provisions of his
contract. This matter is of constderable urgency s i nce the con-
tractor is now working in the area of the gas vent and his charges for
the extra work will hence be consid e r ab ly l ess than if the change
order is d e l ayed .

contract for the r emode ling of the existing Na vy Way Pumping Station
wet well h as now been completed and it is recormnend ed that the work

of the work, the Distr1ct 1 s Mainternrnce Departme nt requested an
additiona l manho l e access to the wet we ll. Th e contractor h as sub-

SUMMARY OF PROPOSED SEWER CONNECTION AND USE ORDINANCE
(Refer to 3-10-70 draft of Ordinance)
Article l -Purpose. To establish effective control by District over
quality and quantity of sewage and industrial wastes reaching District
facilities and to establish charges wh e re a user contributes more flow
than his asse s sed valua tion justifies (more than "Re asonab le Use" -see
below). Ordinance is applicab le to all users of District's facilities,
whether or not directly connected there to (except for connection permi ts -
see Article 3).
Article 2 -Definitions . The only definitions p e rha~s not entirely self-
explanatory are 11 Peak Flow Rate" and "R easonab l e Use'.
Peak Flow Rate is theoretically the highest flow rate sustaine d
for 15 minutes during any year . In the absence of a r ecording e ffluent
flow meter, it is recogniz ed that it i s difficult or impractica l to
d etermine this value. In such c ases, a_n estimating procedure is provided.
As an example , if it wer e de termined that ·a user h a d a highest eight-
hour water u se of 80,000 gallons, his p eak flow r ate would be estimated
at 10,000 x 1.6 gallons per hour or 10,000 x 1.6 x 24 gallons per day
(384,000 gpd). Peak flow r a te is the governing f a ctor in the amount of
the Di strict 's capital outlay . He nce this term is r e l ated in the ordi-
nanc e to a one -time c apacity cha r g e ("Exc ess Capacity Conn e cti on Charge ").
Re asonab l e Use -The i ntent o f this c on cept is to e x emp t all tax
paying us ers from excess capacity and u se charges except those whose
taxes paid to t h e District a r e conside r ab l y le ss than the c apital and
opera ting c osts t h e Di s trict incurs to handl e their wastewater . Reason-
able us e fi gures a re established for peak flow r ate , annual flow and
annua l suspended solids .
~rticle 3 -Permits . Two types of permits a r e estab lished . A Connection
Permit i s r e quired for connecting to and u sing of n ew conne ctions to
Di strict facilities (not t o those of. local agencies ). This typ e o f
permit i s already i ssu ed by the Districts. An Industrial Waste Dischar ge
Permit will be r equired for all discha r ges o f industrial wa ste in the
Distri.ct, r egardless o f wh e re located . ·
Article 4 -Qua l i t y Requirements. Se l f -exp l anatory . Hoi:.rever, t he adoption
o f additional rules and regulations by r esolution i s provided fo r wh e n

Article 5 -Qu ant ity R e~~r ements . The Dis trict i s empowered to limi t
the quantity of' industrial waste d ischarges . It is intended that this
pow e r wi ll be invoked on l y in c ases of n ew discharges , or increases in
existing discharges , when t h ere i s a possibj_l i t;:r of ove rloading District
facilities to the extent .t hat disposal of domestic se1mge wou l d b e
endangered .
Article 6 -Fees and Charges.
(a) Connection Fee -To defray costs of inspection, etc., of
connections to District 1 s facilities only.
(b) Industrial Waste Permit Fee -To be charged annually to all
industrial waste dischargers in the District, depending on quantity and
quality of flow. Maximum is $250 per year.
(c) Excess Capacity (Capital) Charges -To be paid by all new
users (and existing users whose peak flows increase in the future) if
their peak flow rates exceed 25,000 gallons per day per $100,000 of
assessed valuation (Reasonable Use). No user discharging less than
25,000 gallons per day · will pay this charge, regardless of assessed
valuation. The charge is $350 per 1,000 gallons per day of peak flow
rate which exceeds Reasonable Use.
(d) Use {O & M) Charges -To be paid by all users, new and existing,
whose annual flows exce ed 10,000,000 gallons per $100,000 assessed valu-
ation or whose total suspended solids exceed 15 dry tons per year per
$100,000 assessed valuation (Reasonable Use). Th e use charge for flow
above Reasonable Use will be the exact cost the District is currently
incurring for operating and maintaining its treatment facilities (at
present, $0.03 per l,ooo· gallons). The use charge for solids above
Reasonable Use is $10 p e r dry ton.
Article 7 -Refund of Excess Cap a c i ty Charges. Under certain circum-
stances the District will refund such charges when a user substantially
decreases his peak flow or ceases operations entirely.
Article 8 -Local Agency Exemption. All local public agencies, Cities
and the County of Orange are exempt from payment of excess capacity of use
charges . However, Federal and State installations are not exempt from
these charges , except when their peak flow rate is less than 25,000
gallons per day.
Article ·9 -Measurements of Quantity and Quality. Reasonable options _a_r_e~p-r_o_v~i~d~e-d-::--f=o-r--t~h,__e_s_e~m-e_a_s_u_r~e-m_e_n~t~s~.'--~T=h~e-=--o-r~d~i~nance emphasizes cooperation
between the user and the District in arriving at measurements and esti-
mates. See also definition of 11 Peak Flow Rate" under Article 2 for a
method of estimating this value.
Article 10 -Inspections . Provides for the nece ssary field and lab oratory
work to determine complianc e with the ordinance.
Article 11 -SEecial Agreements. Provides for agreements for special
cases which do not entirely fit the framework and intent of the ordinance
and for new users expected to pay excess capacity charges but whose peak
flow rate and assessed valuation are of course not known at commenc eme n t
of use. An example of a special situation would be a user who c an , and ·
agrees to, discha r ge his waste at off-peak hours. In such a case, the
Board of Directors could authorize an agreement calling for a lower excess
capacity charge. ·

self-explanatory and as are recommended by the District's Legal Counsel.

1. Background. The original ordinance (brought before the Boards last
summer) proved , after a series of meetings with industrial representa-
tives and a special committee of the Orange County Chamber of
Commerce , to be unacceptable to industry . A new approach to the
question of charges , similar to that contemplated by the Los Ange l es
_county Sani ta ti on Districts, wa s then proposed to the Chamber
Committee on which ·were represented two of the major indust ria l
waste dischargers in the Covnty, Kimber ly-Clarke Corp ., and Hunt -
Wesson Foods , Inc.
Th e staff feels that industry in general now agrees with the purpose
of the ordinance, that is, that the Districts must hav e control of
the quality and quantity of d i scharge s to the sewer and that users
who discharge more than their share of wastevmter (as judg ed b y
taxes paid to the District) should pay charges for such excess use .
The Chamber has also generally approved i n writing the ordinance in
its present form ..
A public h earing on the new ordinance is scheduled for the Apri l 8
meeting and it is hoped that a vote on adoption of the ordinance
will t ake place after the hearing .
2 . Basic Di f ference Between Orig inal and New Ordina n ce
(a) Credit Ag ainst Ch a r ge s . The orig inal a p proach wa.s to a llow

the ass e ss e d valua tion of the property of the discha r ge r using the
sewer . (See I tem 3 below)
(b) Excess Capacity Connection Charg es . The orig ina l ordina nce
did not provide a conne c.tion cha r g e for excess capa city (cap ita l
charge). Recovery of c a pital cost was orig ina lly b a sed on a hig her
u se charge for volume and suspended sol ids . The n e w ordina nce provide s
such a capital cha r g e (see below for method of computa tion) which is
applicable only to new di s cha r g e rs or when a n exi s tin g discha r g er
incre as e s the vol ume o f wa t e r d i scha r g e d o ve r t hat of 19 7 0 .
(c ) Us e Ch a r ge s . Th e norma l us e charge has b een r e duc e d from
$0 .0 5 per 1,000 ga llons to the actual tre a tmen t co s t (at pre s ent
approxima t e ly $Oo0 3 p e r 1,000 gallons ) since the c ap ita l cos t will
b e recovere d s e p a r ate ly, as e xp l a ine d ab ove .
(d) Ap plicab ility . The Ch ambe r Committee was opposed to the
emphasi s on indus trial was t e in the orig inal ordina nc e . The sta f f
a g r ee s with this vi e w and h e n ce the n e w ordinanc e makes cha r g e s
applic a b l e to all discha r ges , wh e the r of sewage or i n du s trial wa ste .
Tax exempt dischargers are now· liable for charges since their assessed
valuation credit (see 2(a)) will be zero. However 2 Cities, special
districts and the County of Orange will be exempt from all.charges.
It should be pointed out that most small businesses and
·industries, residential buildings, etc., will not pay excess capacity
charges since the ordinance exempts all discharges under 25,000
gallons per day. In addition, it is expected that the assessed
valuation of most apartment houses, larger businesses and industries
will be suff:icient to preclude any capital or use charges.
It should also be noted that both the above charges are
applicable to all users of the District's system, whether connected
directly to a District trunk or served by a sewer m·med by a City or
local agency, which sewer drains to a District facility.
3. Theory of Amount of Charges and Credi ts. 'I'hese charges were computed
from actual District's data.
(a) The excess capacity char~ is derived from the recent John
Carollo Engineers' study to establish similar charges for areas out-
side the Districts (Riverside County and the Irvine Ranch Water
District). It is comprised of tvw components: $232 per 1, 000 gallons
per day peak flow for plant capacity, plus $118 for trunk sewer
capacity, for a total of $350 per 1,000.gallons per day of peak flo}!
rate.
(b) The excess us~ char~ is the actual cost of treating the
wastewater at the plants as determined annually and charged to the
individual Districts. This is now approximately $0.03 per 1,000
gallons. An additional charge of $10 per ton of excess solids is
also established, which is the cost of handling solids at the plants.
(c) The credit ~gainst tpese charges for assessed valuation of
25,000 gallons per day of peal\. flow rate per $100,000 assessed valua-
tion was computed from the actual peak flow rate reaching the plants
and the current total assessed valuation of' the Districts. The
credit for use of 10,000,000 gallons per year of total flow and 15
tons per year of solids per $100, 000 assessed valuation were simj_larly
derived. These all011J"able flows and solids per ~~100, 000 assessed
valuation are called "Reasonable Us.e" in the ordinance. Only
dischargers exceeding reasonable use will j_ncur charges. --
4. Fees. In addition to the above charges,. the ordinance also esta-
blishes two types of fees designed to recover the District's inspection
costs.
(a) An annual industrial waste permit fee will provide funds for
field inspections and labo~atory analysis of industrial wastes. The
amount will be established by resolut:ion of the Board but cannot
exceed $250 per year.
