Nos. 25 and 26 -REPORT ON NEW LABORATORY BUILDING: At its December 30 mee ting, the Building Committee adjourned to 7:00 p .m. on the night of this Joint Board meeting t o consider e l evations and schemati cs subri1itted by the architect for the new l aborato ry building, now under de s ign. It is anticipated that the Conuni ttee will p r esent verbal recoL~n endations to the Joint Boards conc erning this matte r for action at this meeting. Also, the architect and staf f will be prepared to describe to the Joint Boards progress to dat e in the building des i gn . No . 29 -ACCEPTANCE OF PROPOSAL OF CDM, INC. (DR. J. E. McKEE OF CALIFORNIA I NST ITUT E OF TECHNOLOGY): The Directors will recall that Dr . McKee has been a consultant, acting in an i n dividual capacity, to the Dist r:;,.cts for the past eight years for advice and consultation with res pect to technica~ and opera~io nal matters, relations with regulatory a~encies , e t c . His services have been on the basis of a retainer of $1800 p e r year which provided one day's consultati on each month. Dr. McKee has suggested that his consultation service on an 11as needed " basis wou ld now be mo r e appropriate and the staff concurs. We therefore asked h im to submit a new proposal which is included in the agenda a ttachments . Also , Dr. McKee is requesting t h at payment for his services be made to the above firm with which he is now affiliat ed . ~he staff recomm ends approval and acceptance of t hi s new proposal. Nos . 28 and 29 -CO MPLETION OF PLANT JO B NO . P2 -8 -4 (PAVING AT PLANT NO . 2): This small contract was for addi tional paving at Plant No . 2 following completion of the n ew Plant office there . The job has been satisfactorily completed and it is r ecomme nded t hat it be accepted and a Notice of Comp letion filed. Item No . 28 is a change order ($92) for additiona l aspha lt paving over existing r ock b as e which was inadve rtently omitted from the original p l ans . No . 30 -REQUE ST FOR EXTENSION OF TIME, OCEAN OUTF ALL NO . 2: As exp lained in p revious a genda r ep orts, a procedure has been establi shed to receive a n d file a nd act upon r equests for extensions of time rec eived during the preceding mo nth. It is recommended that the reques t for one day's extension of time, as shown on the agenda, be granted. No. 31 -EMERGENCY SO IL STABILIZATION WORK: It was recent ly discovered tha t the s l udge draw-off line of a sedimentation basin at Plant No. 2 had ruptured due to unknown causes, causing the basin to become inoperative . The Districts ' forces remo ved a section of the reinforced concrete bottom of the basin and d e termined that the cast iron draw -off line had be e n broken in several p laces. Because of the hig h ground water conditions at the site, it became apparent that dewatering to unde rta ke rep ai r work coul d not be done without en - dangering the founda tion to the structure due to l oss of soil under the central part of the structure because of the runnin g soil conditi ons. The staff, because of this danger and the fact tha t the Plant efficiency is s eve rely impaired by the loss of the use of t he basin, decided that emergency ac tion should be taken to emp l oy a soil stabilization (mud jacking) firm to provide cutoff wal l s (Phase I) -2- necessary for dewatering the area of the break. Accordingly the James E. Lenihan firm of Torrance was asked for a proposal, which will be found in the agenda attachments, to perform the necessary mud jacking work for Phase I and was subsequently authorized to proceed on the basis of their proposal. After Phase I is completed, Phase II of the operation, which involves an indeterminate amount of concrete soil stabilization of the entire area affected, will be necessary prior to putting the basin back into service. As the Lenihan company will be on Phase I of the job, the staff recommends that this firm be also authorized to conduct Phase II on the basis of their proposal. Since the total cost of the work exceeds the existing staff authorization without Board approval , Board ratification is requested. No . 32 -ACQUISITION OF REPLACEMENT ~UMP PARTS: Our Maintenance Superintendent has prepared a memorandum on this subject, a copy of which will be found in the agenda attachments, and which we believe is self-explanatory. It is obvious that by far the most economical method of obtaining the needed parts is the method recommended by Mr. Clarke and, accordingly, the formal action appearing on the agenda is reconrrnended. Nos. 33 and 34 -CLEARING OF FARM HOUSE SITE ON PLANT NO. 1 PROPERTY~ When additional land was acquired several years ago for Plant No . 1 expansion, an old farm house and storage shed were also acquired in the transaction . This property has been rented to our farm tenants, Marshburn Brothers, who have been l easin g our suz-plus land for a number of years for agricultural purposes. Since Marshburn Brothers no longer wish to rent the house and shed and since the structures are not fit for h abitation, and are located in an area needed next y ear for our new vehicle storage bui lding, we are recommending authori -. za ti on for their renova l by r.:.eans of the actions appearing under these agenda items. To expedite the demolition and removal of the structures, we suggest e d to the Fountain Vall ey Fire Department that the buildings might be burned for fire training purposes. The Department was very happy to accept this suggestion and the Fire Chief 1s letter on this subject will be found in the agenda under this item. No. 35 -ATTENDANCE AT OCEANOLOGY BRIEFING SESSION, FEBRUARY 2-4 , SAN DIEGO: The American Management Association is sponsoring this briefing session at which many eminent leaders in the field of oceanology and marine water qua l ity will be speakers . We recommend that one staff member be authorized to attend . District No . 2 Nos. 42 and 43 -LEGAL DOCUMENTS REGARDING ACCIDENT ON CONSTRUCTION JOB: The legal documents referred to in this agenda item are the result of an accident occurring during the 1969 construction of the new Euclid Street Trunk. Sewer between Chapman Avenue and Ball Road. The action appearing on-' the agenda is recommended by the General Co u nsel. -3 - No. 44 -AWARD OF CONTRACT NO. 2-13: Bids for this job, the Trask Avenu e Interceptor Sewer between Newhope and Euclid Streets, were not originally scheduled to be taken until February of this year but because of concurrent construction work by the City of Garden Grove , the bid date was put forward to January 9 to minimize con- flicts. Since it will not be possible to analyze the bids before the agenda is mailed, the staff and engineers will present a recommenda- tion for award at the time of the Board meeting. The engineer's estimate for the job is $99,500. No. 45 -ADJOURNJ::iENT TO 6 :00 P.M., JANUARY 27: It will be recom- mended that the Board adjourn to the above hour and date to meet jointly with the Executive Conunittee. A light supper will be served. The principal purpose of the adjourned meeting is to review with the Executive Committee the proposed agreements with the Riverside County Flood Control and Water Conservation District for joint use of Plant facilities and construction of a joint use trunk sewer along the Santa Ana River. The Directors will recall that this matter was discussed at a special meeting last July and in the interim we have had repeated conferences between our counsel and staff and the Riverside District attorney and staff to draft these agreements. It is anticipated that copies of these agreements will be in the hands of the Directors and members of the Executive Com:r.iittee well in advance of the January 27 meeting. District No. 3 No. 48 -REQUEST OF CITY OF FULLERTON FOR MODIFICATION OF MASTER PLAN: Included with the agenda material is a letter, dated December 8 , 1969 , from the City of Fullerton requesting that the District include in its Master Plan of new sewer facilities an extension of the proposed Orangethorpe Relief Trunk easterly from Magnolia Street to Brook- hurst Street, a distance of one mile. Since this request has a number of ramifications involving policy matters and precedents, I have discussed the matter with Chairman Culver who has suggested that a special committee of Directors be appointed to study the matter and recommend a decision on the request to the Board at the February meeting. District No. 8 No. 54 -RECEIVE AND FILE INTERIM AUDIT REPORT: At the No vember meeting of the other Districts the Interim Audit Report, submitted by Hanson, Peterson, Cowles and Sylvester) Certified Public Accountants, for the period ending September 30 , 1969, was received and filed. A similar action is recommended for District No. 8 at this meeting. -4- ... ' ~ ... " .. , -- Di s tricts Nos. 6 and 7 No. 60 -$500 CLAIM BY APOLLO DEVELOPMENT CORPORATION: The Directors may recall that on November 12, the Boards ratified the action of the General Manager in awarding a contract for the emergency re- construction of a manhole on the Air Base Line in the total amount of $3,600. This unexpected project was necessitated by a new tract development immediately easterly of Treatment Plant No. 1, on land through which the Districts hav e an easement. Included in the agenda material is a memorandum from the Districts' Deputy Chief Engineer explaining the circurnstances surrounding this. It is the staff's opinion that the reconstruction of the manhole was expedited in a spirit of cooperation with the developer , and his claim is not justified. District No. 7 No. 62 -RANGEVIEW DRIVE EXTENSION SEWER REIMBURSEMENT AGREEMENT: This is a standard agreement to reimburse those parties who financed the construction of the Rangeview Drive Extension Sewer, when and if adjacent property owners connect to said sewer. No. 63 -BOND ELECTION ACTIONS: Mr. Nisson has asked that an item be placed on the agenda regarding possible actions which may be required concerning the upcoming bond election. Fre d A. WHEREAS, all of the County Sanitation Districts if Orange County, California, employ the same legal counsel in accordance with the provisions of the Joint Administrative Agreement dated December 8, 1948; and, WHEREAS, it is deemed to be in the best interests of the County Sanitation Districts of Orange County, California, to modify the provisions concerning the duties and compensation of the General Counsel of the Districts in order to bring them up to date and in line with current operations of the Districts; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: Section 1. That C. Arthur Nissan, be and he is hereby appointed legal counsel for the Joint Administrative Organization and for each of the eight County San1tation Districts of Orange County, California, and of their works and operations, and that his title shall be General Counsel. Section 2. That the compensation of the General Counsel shall be Seven Hundred ($700.00) Dollars per month, said compensa- tion to be a retainer fee and ~hall be payment for the general legal services required by the Joint Administrative Organization and the County Sanitation Districts of Orange County lndividually and collectively. Section 3. That the General Counsel shall, by monthly written report, account for the time spent and his activities on behalf of the Districts and the Joint Aclrni.nistrati.ve Ore;an:lzat:Lon. That at the conclusion of each quarter of the c~_endar year, the ~enda Item #2h H-1 All Dtstrlets General Counsel shall be compensated at the rafe of $45.90 per hour for that time worked in excess of 46~ hours during the quarter. Section 4. Appearances by the General Counsel in any court of law or before any administrative or legislative committee or agency or at any public hearing 9n behalf of the County Sanitation Districts of Orange County or the Joint Administrative Organization shall be at the rate of Two Hundred and Fifty Dollars ($250.00) per day or any part of a day; and all such time so compensated shall not be credited to the 46~ hours of time per quarter or be considered compensated in any other or additional way. Section 5. That, in addition to the compensation herein- above provided, the actual expenses of travel, food and lodging outside the County of Orange on the business of the Districts and all other necessary expenditures on the business of the Districts shall be reimbursed in the actual amounts so expended. Section 6. The firm installed a diversion pumping system which places their peak flow into a trunk sewer line which will be over capacity in the immediate future. As a permanent solution to this problem, the City of Fullerton proposes to construct a 27 inch sewer line in Brookhurst Road from Common- wealth Avenue to a connection with the Sanitation District trunk in Orangethorpe Avenue. Funds have bee11 budgeted for this project, and it is contesnplated that the work will be done in April of 1970. A meetin~ with the Sanitation District staff has disclosed that sufficient total capacity is not available in the Sanitation District's trunk lin~ in Orangethorpe. Since the new line being constructed by Fullerton is the most economical and direct route to the Sanitation District facilities, it is apparent that a parallel trunk facility is needod in Orangethorpe Avenue from Magnolia to the point of connection of the new City of Fullerton trunk. The CoDntv Sanitation District master olan does not contemplate the constiuction of this needed facili~y. We understand that this facility was not included in the master plan because: 1. At the time of the formulation of the master plan, preliminary studies indicated that the flows from the subject industrial area would reach the Sanitation District facilities at Orangethorpe and Magnolia and not at Orangethorpe and Brook- hurst. 2. Flow quantities obtained during the master plan study wer~ not of the magnitude now contemplated, because increases have resulted from processing me~hod changes and plant expansions. Lo Zimmerman's letter dated December 10, 1969, his claims for the additional work having been caused by acts of the Districts are not entirely accurateo The Districts were delayed in beginning the project for two reasons, both beyond the control of the Districts and the developero (1) The Operating Engineers strike in the summer of 1969 began shortly after the problem was discovered. (2) A lack of contractors available to remodel the manhole caused the Staff to spend more than normal time in trying to find qualified contractors who were willing to submit quotations to perform the worko In fact, the contractor who installed the tract sewers was too busy to perform the work. Two bids were received, one for $3600.00 and the other for approximately $13,000.00. Additionally, the Districts made every effort to assist the de- veloper to have the tract sewerage system approved. Near the comple.:. tion of the project, the developer insisted that the connection should be inspected even though, as the developer was aware, that we could not accept this system without acceptance by the Costa Mesa Sanitary District. The Districts had to pay an inspector overtime so the developer could be satisfiedo · As for the cost to lower the manhole without having to reconstruct it, the Districts received a verbal quotation from the contractor who remodeled the manhole, for $900.00 to lower the manhole onlyo This manhole was a brick manhole and would have required reconstruction within three to four years. In conclusion, the developer's claim of $500.00 to offset the charge for the pavers moving onto the site twice should not be borne by the Districts, and the $200.00 paid by the developer as his share for remodeling the manhole is more than equitable.
