The Chair recognized Mr . Milo Keith, of Lowry and Associates,
District 's Engineers, who presented to the Directors the Special
Engineers Report for increasing the capacity of the Golden West Street
Pumping Station .

Suggested Revision of Article 4, Ordinance No. 502.
ARTICLE 4 -INSPECTION AND CONNECTION CHARGES
Before any connection permit shall be issued, the applicant
shall pay to the District or its agent the charges specified herein.
{a)-Inspection Charge for Direct Connection. An inspection
addition thereto.
This charge is
for new building
Connection Charge for New Construction, Single Dwelling
For each new single dwelling building constructed, the
connection charge shall be $120.00.
{~) Ci51" Connection Charge for New Construction, MultiEle
Dwelling Building§_. For each new multiple dwelling building con-
structed, the connection charge shall be $120.00 for each dwelling
unit or $6.00 for each plumbing fixture unit contained within such
construction, whichever sum is less.
(c) (~ Connection Charges for New Construction, Other than
Dwelling Units. For all other new construction including but not
limited to commercial, industrial and public building construction,
the connection charge shall be $6.oo for each plumbing fixture unit
contained within such construction, provided that the minimum
connection charge for such new construction shall be $60.00.
( ol) ~ Connection Charges for Replacement Buildings. For new
construction replacing former buildings, the connection charge shall

be calculated on the same basis as provided in paragraphs (.e-), (-EP)

and (~) hereinabove. If such replacement construction is commenced
within two years after demolition or destruction of the former
building, and such demolition or destruction occurs after July 1,
1965, a credit against such charges shall be allowed calculated at
$120.00 per dwelling unit replaced or $6.oo per plumbing fixture
unit replaced, whichever sum is more.

Existing Building~. For additions to or alterations of existing

When Charge is to be Paid. Payment of inspection and
connection charges shall be required at the time of the issuance of
the building permit for all construction within the District,
excepting in the case of a building legally exempt from the require-
ment of obtaining a building permit in the City of Newport Beach.
The payment of the sewer connection charge for such buildings will
be required at the time of and prior to the issuing of a plumbing
connection permit for any construction within the territorial limits
of the District.
Schedule of Charges. A schedule of charges specified herein
· will be on file in the office of the Secretary of the District and
in the office of the Building Department of the City of Newport
Beach and will be based on plumbing fixture units as defined and
specified in Sections 402 and 403 of the Western Plumbing Officials
Uniform Plumbing Code, 1964 Edition, as adopted by the City of
Newport Beach on March 24, 1965.

ARTICLE 4 -PERMIT CHARGES
The Dist r ict connect 4 on cha~ge >hall be determined as
follows:
(a) A charge of $ 2 0.r) p er unit for all new single
family dwellings within t he District.
(b) All other construction including but not limited
to multiple family dwellings, commercial, industrial and public
building construction shall be charged a connection fee in accord-
ance with the number of plumbing fixture units contained within
such construction. The connection f ee shall be calculated to
be a sum totalling $6.00 per plumbing fix ture unit, provided
that the minimum sewer connection fee shall be $120.00 for all
new construction as differ i ng from the remodeling of or additions
to a structure already connected to an existing sewer. A schedule
of such charges will be on file in the office of the Secretary of
the District and in the office of the Building Department of the
City of Newport Beach and will be based on plumbing fixture units
as defined and specified in the Western Plumbing Officials Uniform
Plumbing Code, 1964 Edition, as adopted by the City of Newport
Beach on March 24, 1965.
(c) Payment of a sewer connection fee shall be required
at the time of the issuance of the building permit for all con-
struction within the District, excepting in the case of a building
legally exempt from the requirement of obtaining a building permit
in the City of Newport Beach. The payment of the sewer connection

AN ORDINANCE AMENDING ORDINANCE NO. 502
PROVIDING RULES AND REGULATIONS RELATING TO
CONNECTIONS TO DISTRICT SEWERAGE FACILITIES,
ESTABLISHING CHARGES THEREFOR AND PROVIDING
PENALTIES FOR VIOLATIONS, AND REPEALING
ORDINANCE NO. 501.
The Board of Directors of County Sanitation District
No. 5, of Orange County, California, does ordain as follows:
ARTICLE 1
ARTICLE 4 -INSPECTION AND CONNECTION CHARGES, under
Ordinance No. 502 is hereby amended to read as follows:
"ARTICLE 4 -CONNECTION CHARGES
"Before any connection permit shall be issued, the
applicant shall pay to the District or its agent the charges
specified herein.
"(a) Connection Charge for New Construction,
Single Dwelling Buildings. For each new single dwelling
building constructed~ the connection charge shall be $120.00.

at $120.00 per dwelling unit replaced or $6.oo per plumbing
fixture unit replaced, whichever sum is more.

building permit for all construction within the District, ex-
cepting in the case of a building legally exempt from the
requirement of obtaining a building permit in the City of

to the issuing of a plumbing connection permit for any con-
struction within the territorial limits of the District.

ARTICLE 2 -VALIDITY
If any article, section, subsection, sentence, clause
or phrase of this ordinance, or the application of any thereof to
any person, entity, public corporation or circumstance be held to
be invalid for any reason, such invalidity shall not affect the
....,J validity of any other provision or application of any of the
remaining provisions or portions of this ordinance; and to this
end the Board of Directors of County Sanitation District No. 5, of
Orange County, California, hereby declares that it would have
adopted this ordinance and each and every article, section, sub-
section, sentence, clause or phrase thereof irrespective of the
fact that any one or more other articles, sections, subsections,
sentences, clauses or phrases, or the application of any thereof to
any person, entity, public corporation or circumstance be declared
invalid.
ARTICLE 3 -EFFECTIVE DATE
The Chairman of the Board of Directors shall sign this
ordinance and the Secretary of the District shall attest thereto
and certify to the passage of this ordinance, and shall cause the
same to be published once in the ___ D_~_I_L_~ __ P_I_LO __ T _______ , a daily
newspaper of general circulation, printed, published and circulated
in County Sanitation District No. 5, of Orange County, California,
within fifteen (15) days after the date of the passage of this
ordinance by said Board of Directors, and said ordinance shall take
effect March 1, 1966.
PASSED AND ADOPTED by the Board of Directors of County
Sanitation District No. 5, of Orange County, California, at a

for all direct connections to District's facilities. This charge is
separate and distinct from connection charges for new building
construction, remodeling or alteration of buildings as provided
hereinafter, and is in addition thereto.
(b) Connection Charge for New Construction, Single Dwelling
Buildings. For each new single dwelling building constructed, the
connection charge shall be $120.00.
(c) Connection Charge for New Construction, Multiple
Dwelling Buildings. For each new multiple dwelling building con-
structed, the connection charge shall be $120.00 for each dwelling
unit or $6.oo for each plumbing fixture unit contained within such
construction, whichever sum is less.
(d) Connection Charges for New Construction, Other than

COUNTY SANITATION DISTRICTS NOS. 1, 2, 3,
5, 6, 7, AND 11, OF ORANGE COUNTY, CALIFORNIA,
ACCEPTING JOB NO. I-6-1 AS COMPLETE
The Boards of Directors of County Sanitation Districts
Nos. 1, 2, 3, 5, 6, 7, and 11, of Orange County, California,
DO HEREBY RESOLVE, DETERMINE AND ORDER:
Section 1. That the contractor, VINNELL CORPORATION, a
California corporation, has completed the construction in accordance
with the terms of the contract for ADDITION TO PIANT NO. 1 EFFLUENT
DISCHARGE FACILITIES PIPELINE, JOB NO. I-6-1, on the 7th day of
January, 1966; and,
Section 2. That by letter the engineers for the Districts
have recommended acceptance of said work as having been completed
in accordance with the terms of the contract; and,
Section 3. That the General Manager of the Districts has

Section 4. That the construction of the ADDITION TO PIANT
NO. 1 EFFLUENT DISCHARGE FACILITIES PIPELINE, JOB NO. I-6-1, is
hereby accepted as completed in accordance with the terms of the
contract therefor dated the 27th day of February, 1965; and,
Section 5. That the Chairman of County Sanitation District
No. 1 is hereby authorized and directed to execute a Notice of
Completion of Work therefor.

routine items which appear on the enclosed agenda and which are not
otherwise self-explanatory. Warrant registers are not attached to
the agenda since they are made up immediat ely preceding the
meeting but will appear in the complete agenda available at the
meeting .
Joint Boards
Nos . 4 and 5 -SEA TING OF NEW DIREC TORS : We have been notified by
the City of Newport Beach that Councilman Lindsley Parsons has
been appointed by the City Council t o replace retiring Councilman
Stoddard as a member of the Board of Dir ectors of District No . 5 .
By the time of the meeting, we expect also to receive formal
notification from the Board of Supervisors that Supervisor Allen
has been e l ected as Chairman of the Board of Supervisors and hence
ex officio member of the Boards of Directors of all Districts with
Supervisor Hirste i n as his alternate on our Boards .
No. 6 -ELECTION OF CHAIRMAN, DISTRICT NO . 5 : Since Director
Stoddard has r etired from the Board of Directo rs, it will be
necessary to elect a new Chairma n to f i ll his u nexpired term as
Chairman of District No . 5 .
No . 7 -ELECT I ON OF J OI NT VI CE CHA I RMAN : Mr . Stoddard 's retirement
has also created a vacancy in the office of Joint Vice Chairman
of the Joint Boards of Directors. Consequently, it will be
necessary to elect a new Director to this office for the ba l ance
of Mr . Stoddard 's term .
Nos. 19, 20 and 21 -CLOSEOUT AND ACCEPI'ANCE OF PLANT JOB NO . I -6 -1:
This contract with the Vinne l l Co r poration of Alhambra has been
satisfactorily completed and well within the contract time speci -
fied. We consider ourselves fortunate in several respects on this
job, which involved the installation of a new 84-inch diameter
reinforced concrete pipe between the Plants designed to carry, to -
g ether with existing pipelines, the u l timate f l ow of effluent from
,
Plant No. 1 to the ocean outfall pumping stations.
The total contract price, including extra work payments
rec omm ended under Items Nos. 19 and 20, amounts to sli~htly over
$1 .5 million as against our original budget figure of $1 .8 million.
A portion of this savings of $300,000 was due to the cooperation
of the Orange County Flood Control District in permitting instal-
lation of the pipeline in the Santa Ana River levee, thus
eliminating purcnase of additional expensive right of way. The
balance of the saving is due to the unexpectedly low bid received
from Vinnell Corporation. Also, the contractor did an excellent
job with a minimum of controversy and demands which can normally
be expected in a job of this magnitude. In spite of formidable
difficulties the c~ntractor also met the desired objective of
completion of levee work during the dry weather months of 1965,
thus avoiding holding over fina l completion of the job until the
summer of 1966, which delay, if it had occurred, would have caused
us a great deal of inconvenience and overloading of existing pipe-
lines.
Item No. 19 is approval of recommended Change Order No . 2
(revised) and is basically a bookkeeping document to adjust the
final contract price to allow for placing extra gravel fill ordered
by the Engineer where unstable soil conditions were encountered,
at the unit price bid of $8 .oo per cubic yard.
Item No . 20 is approval of recommended Change Order No . 5
adding the sum of $43,232.88 to the contract price for the encounter-
ing of an unknown abandoned 24-inch vit rified clay pipe line in a
large stretch of the trench area, which, because of its location,
seriously interfered with the progress of the work where encountered.
The existence of thi s abandoned pipeline during the preparation of
plans and specifications for this job was completely unknown to the
Flood Control District or us. By coincidence, about the time it
was f irst encountered, in an entirely unrelated investigation we
turned up an old map showing this pipeline to be a joint venture
of the City of Santa Ana and the Southern California Sugar Company
constructed in 1912 (and abandoned in 1923) to carry domestic
sewage and sugar plant effluent to the ocean. By this time the work
was under way and the discovery of the old map mere ly confirmed our
suspicions that the abandoned pipe would be encountered throughout
most of the work area. Unfortunately , its alignment could not have
been worse with respect to this job since for long stretches it lay
at the bottom edge of the trench where the contractor's shield
rested thus requiring hand renoval, replacement of the soil it
occupied and also presented a water problem in certain areas where
it was carrying a considerable flow of seepage. The new 84-inch
line could not be moved except in one 700 foot stretch because of
the proximity of our 66-inch pipeline now carrying most of the
Plant No. 1 effluent .
The existence of this old pipeline and the seepage water it
carried also caused considerable difficuity and extra expense in the

tunneling operation at Ad ams Avenue, as stated in the formal change
order attached to the agenda. Our sta ff h as been negotiating with
the contractor re garding the additional c ost imposed on him by this
old pipe line and we be lieve the final settlement reached to be fa ir
and reasonable to both parties. We are also r easonably sure that
had the existence of this old pipe line been known at the time of
bidding and s hovm on the plans, the low bid could have been higher
by an amount considerably greater than the amount called for under
this r ecommended change order .
Item No . 21 is the customary r esolution accepting the contract
as complete and authorizing filing of Notice of Completion.
Districts Nos . 5 and 6
No . 31 -REPA IR OF VOID UNDER HIGHWAY AT ROCKY POINT PUMP STATION :
During the course of construction of Contract No . 5-12, a. serious
hazard to the Pa c ific Coast Hi g hway has been discovered. I n 1 952
a new fo rc e main from the Rocky Point Pump Station wa s installed
and either duri ng its construction, or later, a void in the soil
under the highway, of unknown extent, was created. The State
Divi sion of' Hlghways is quite conce r ned over the possib ility of a
future cave-in and it is obvious that it is an obligation of the
two Di s tricts to repair this void as soon as possib le. District
No . 5 's engineer, Mr ·. Simpson, has dis cussed thi s matter with the
staff and we feel that this r epair can be most economically and
expeditiously ac complished by i ssuing a. purchase order to a suitable
contractor (presumably the sub-contractor installing the neN force
ma.in under Contract No . 5 -12 ). We are, according ly, rec omm ending
that the Boards authorize this work and the issuance of a purchase
order therefor . By this procedur e our accounting records will be
simplifie d in t hat th e repe.ir job is a maintenance and opcre.tion
expense and should not be confused with the capital outlay work
being done unde r Contra.ct No. 5 -12.
District No. 5
No . 32 -REFUNDS OF CONNECTION CHARGES: The Bo ard , at its Novembe r
meeting, authori zed an interpretation of Ordinance No . 502 to
provide for a credit on sewer connection charges when a new build-
ing replaces an existing structure . We h ave asked the Newport
Beach Building Departmen t to submit a list of those persons who
pa.i d the f ull connection charge prior to this interpretation and
the refunds to which they are entitled under the interpretation .
The motion, under this item, is to authori z e these refunds, the
amounts and payees of which will appea r under the approval of
warrant demands secti on of the final agenda distributed at the
mee ting .
District No. 6
No . 36 -REPAIR OF SUBSIDENCE ON DOVER DRIVE : Following the recent
heavy rains, a serious street subsidence over the Dov e r Dr ive Trunk

between 16th and 17th Streets in Newport Beach has been reported
to us by the City of Newport Beach. Preliminary investigation shows
that a stretch of at least 100 yards of sewer is involved. We feel
that the most expeditious method of repairing this defect, which is
obviously a District obligation, is to authorize the City of Newport
Beach to undertake the necessary repairs and later bill the District
on completion. We are in the process of proposing this procedure
to the City Public Works Department and we hope it will be agreeable
with them. It is possible that the job will be of considerable
magnitude if further investigation shows it is ne cessary to remove
unstable fill and replace it with adequately compacted soil.
No. 37 -ENGINEERING SERVICES FOR RECONSTRUCTION OF ROCKY POINT PUMP
STATION: We have asked the District's engineers, Southworth &
Stevens, to submit a proposal for providing engineering services
for this job which has been discussed at several previous meetings.
Action was also taken some time ago by Districts Nos. 5 and 6 to
authorize District No . 6 to act as the contracting agent for the
work. The engineering firm is in the process of preparing this
proposal at the present time and we anticipate that it will be
available for consideration at the Board meeting.
District No. 8
No. 42 -RECEIVE AND FILE QUARTERLY FINANCIAL REPORT: This is a
routine item already acted upon by the other Boards at the December
meeting . Since District No. 8 Board meets only quarterly, it is
usual;l-y necessary for it to act on this type of matter after the
other Boards . At this particular meeting, this is the only action
of this type required.
District No. 2
No. 45 -REPORT OF SPECIAL FINANCE COMMITTEE: As authorized at the
December meeting, the Committee has met to consider the recent
letter of the City of Anaheim concerning trunk sewer construction
in the Santa Ana Canyon area and a.lso the other financial problems
facing the District . The meeting was held on January 5 at the
Orange City Hall and was attended by the full Committee, Mayor
K:rein of Anaheim, and several members of the City's staff . After a
lengthy discussion it was the concensus of the Committee, with
Anaheim's representa.tives concurring, that the City should submit
for further consideration a more concrete proposal for ultimate
financing of the facility under consideration. It was believed
that the new proposal should spell out a definite deferred payment
program whereby the District would ultimately reimburse the City
for a portion or all of the construction cost. If this new proposal
is received before the Board meeting, it would appear appropriate
to refer it back to the Committee for further study. However, in
the event it is not received in time, the Committee felt that the
Board should authorize it to consider the proposal prior t o formal
receipt by the full Board at the following Joint Board meeting.
This matter will be elaborated on in greater detail by the Committee
and/or staff and engineers, if desired .

District No. 3
No. 49 -SETTLEMENT OF LAWSUIT WITH VALLEY ENG I NEERS, INC.: This
firm, which was the contractor in 1960 for the construction of the
Hoover-Western Subtrunk, filed suit some time ago against District
No. 3 alleging that the District wrongful ly withheld $4800 from
the contract amount for liquidated damages . Trial was scheduled to
commence on January 5, immediately prior to which the General
Counsel was successful in negotiating with the firm's attorneys
a settlement representing one -half of t h e above sum plus accrued
interest. This matter will be reported on further by the General
Counsel at the meeting, if desired, prior to the recommended formal
action shovm on the agenda under this item.
No . 50 -TEMPORARY DENIAL OF CLAIMS FOR EXTRA COMPENSATION, CONTRACT
NO. 3-10: At the December Board meeting this matter was discussed
by the Engineers and staff and the Board subsequently authorized
further -negotiations with the contractor over his claim for extra
compensation due him because of restricted working hours imposed
by the State Division of Highways. Such negotiations were under-
taken but the contractor's opinion of his damages is so far apart
from ours that we believe the formal action appearing on the agenda,
recommended by the General Counsel and concurred in by me, should
be taken to deny these claims for the time being without precluding
re -opening the matter at the time of closeout of the contract .
No. 51 -PURCHASE OF REPLACEMENT PUMP I NG EQUIPMENT AND APPURTENANCES
FOR WESTSIDE PUMP STATION : This pump station, which was constructed
by the Los Alamitos County Water District and subsequently sold to
District No . 3, was designed structurally to handle all future
flows tributary to it as determined at the time of the eng ineer's
report for the 1958 bond issue . It was recognized, at that time,
that when flows reached a certain point the original pum p s and
motors would have to be replaced to cope with the increased volume
of water and pumping head. This point is rapidly approaching and
in view of slow de l ivery of equipment in recent months, we are
recommending that immediate steps be taken to initiate the purch ase
of the required larger pumps and motors and related electrical g ear .
Accordingly, we have requested the District's engine ers, Boyle &
Lowry, to submit a brief letter report and proposal for engineering
services in connection with purchase of this equipment . This
report and proposal will be available at the time of the meeting .
The preliminary estimate for this equipment is $36,000 . Our present
planning calls for the major portion of installation to be done b y
District's crews as the most economical and expeditious route for
g etting the job completed. The formal action as shown on the
agenda is to receive and file the engineer's report and to accept
their proposal for eng ineering services in connection with this
project.

No. 55 -RATIFYING ACTION OF THE GENERAL MANAGER IN ACCEPrING
CONNECTION CHARGES: Ordinance No . 709 adopted July, 1965, and

effective January 1, 1966 , provides for an increase in the District's
direct connection permit charges on any permit issued after Decembe r
31, 196 5. Because the offices of the participating cities observed
a legal holiday on December 31st, thus denying applicants an
opportunity to obtaih connection permits at the old connection
charge fee on that date, your General Manager authorized acceptance
of permit application fees on January 3rd. The motion appearing on
the agenda for this item ratifies the action of the General Manager
in accepting these fees and issuing connection permits at the old
rate.
No. 56 -PETITIONS BY PROPERTY OWNERS FOR SEWER SERVICE: At the
December 8th meeting of the Board, the engineers presented a
petition from property owners outside of the District for inclusion
of their properties in an assessment district to provide sewer
service . The matter was referred to the staff for a report and
rec ommendation . A recommendation will be made to the Board at this
meeting .
No. 57 -REPORT ON AC QUISITION OF THE TUSTIN AVE:N1JE SEWER: As
directed at the December 15th adjourned meeting of the Board,
the staff, engineers and the General Counsel have been in contact
with the City of Santa Ana administrative staff in an attempt to
negotiate further for the purchase of the City's facility in
Tustin Avenue north of 17th Street. A report on these negotiations
will be made to the Di rectors at the meeting.

ARTICLE 4 -IMSPECTION AND CONNECTION CHARGES

Before any connection permit shall be issued, the applicant
shall pay to the District or its agent the charges specified herein.
{a) Inspection Charge for Direct Connection. An inspection
fee of $25.00 per connection shall be paid by a public corporation
for all direct connections to District's facilities. This charge is
separate and distinct from connection charges for new building
construction, remodeling or alteration of buildings as provided
hereinafter, and is in addition thereto.
(b) Connection Charge for New Construction 2 Single Dwelling
Buildings. For each new single dwelling building constructed, the
connection charge shall be $120.00.
(c) Connection Charge for New Construction, Multiple Dwelling
Buildings. For each new multiple dwelling building constructed, the
connection charge shall be $120.00 for each dwelling unit or $6.oo
for each plumbing fixture unit contained within such construction,
whichever sum is less.
(d) Connection Charges for New Construction, Other than
Dwelling Units. For all other new construction including but not
limited to commercial, industrial and public building construction,
the connection charge shall be $6.oo for each plumbing fixture unit
contained within such construction, provided that the minimum
connection charge for such new construction shall be $60.00.
(e) Connection Charges for Replacement Buildings. For new
construction replacing former buildings, the connection charge shall
be calculated on the same basis as provided in paragraphs (b), (c)
and (d) hereinabove. If such replacement construction is commenced
within two years after demolition or destruction of the former
building, and such demolition or destruction occurs after July 1,
1965, a credit against such charges shall be allowed calculated at

replaced, whichever sum is more.
(f) Connection Charges for Additions to or Alterations of
Existing Buildings. For additions to or alterations of existing
buildings, the connection charge shall be $6.00 for each plumbing
fixture unit added, provided that no charge shall be made for the
first ten fixture units added. In the event that such alterations
or additions include the elimination of existing fixture units, a
credit, calculated on the same basis, shall be allowed against the
connection charge for such alterations or additions.
When Charge is to be Paid. Payment of inspection and
connection charges shall be required at the time of the issuance of
the building permit for all construction within the District,
excepting in the case of a building legally exempt from the require-
ment of obtaining a building permit in the City of Newport Beach.
The·payment of the sewer connection charge for such buildings will
be required at the time of and prior to the issuing of a plumbing
connection permit for any construction within the territorial limits
of the District.
Schedule of Charges. A schedule of charges specified herein
will be on file in the office of the Secretary of the District and
in the office of the Building Department of the City of Newport
Beach and will be based on plumbing fixture units as defined and
specified in Sections 402 and 403 of the Western Plumbing Officials
Uniform Plumbing Code, 1964 Edition, as adopted by the City of
Newport Beach on March 24, 1965.
Waiver of Charges. Upon petition by an applicant showing
sufficient cause therefor, the Board of Directors of the District
may, by recorded action, waive any or all connection charges as
hereinabove provided when the facts presented by applicant are
sufficient for a determination that serious inequity will result
from the payment of such charges.

The District connection charge shall be determined as
follows:
(a) A charge of $120.00 per unit for all new single
family dwellings within the District.
(b) All other construction including but not limited
to multiple family dwellings, commercial, industrial and public
building construction shall be charged a connection fee in accord-
ance with the number of plumbing fixture units contained within
such construction. The connection fee shall be calculated to
be a sum totalling $6.00 per plumbing fixture unit, provided
that the minimum sewer connection fee shall be $120.00 for all
new construction as differing from the remodeling of or additions
to a structure already connected to an existing sewer. A schedule
of such charges will be on file in the office of the Secretal"y of
the District and in the office of the Building Department of the ·
City of Newport Beach and will be based on plumbing fixture units
as defined and specified in the Western Plumbing Officials Uniform
Plumbing Code, 1964 Edition, as adopted by the City of Newport
Beach on March 24, 1965.
(c) Payment of a sewer connection fee shall be required
at the time of the issuance of the building permit for all con-
struction within the District, excepting in the case of a building
legally exempt from the requirement of obtaining a building permit
